MINUTES OF THE BOARD OF COUNTY commissioners in called session

 tuesday, january 17, 1956

 

The Board of County Commissioners met in called session in the County Commissioners’ Room in the Courthouse at two p.m. Tuesday, January 17, for the purpose of adopting a resolution correcting the Voting Precinct lines for Precincts No. 27 and No. 29 and such other matters as may be brought before the Board, with the following present:  Chairman Singeltary; Commissioners Cowart, Lightfoot, Simpson, and Stokes; Attorney Duncan; and Clerk Owens.

Mr. Duncan explained that the Resolution adopted on October 3, 1955 designating Precinct Lines should be corrected and amended, with the concurrence of the Supervisor of Registration; WHEREUPON, on a motion by Commr. Stokes, seconded by Commr. Lightfoot, the following resolution was adopted:  Mrs. Baker being present concurred orally in this change by the Board.

WHEREAS, on the 3rd day of October, 1955, the Board of County Commissioners of Lake County, Florida, with the concurrence of the Supervisor of Registration of Lake County, realigned the Precincts in Lake County, Florida, including Voting Precincts numbers 27 and 29, and

WHEREAS, the City of Leesburg has elected to exercise its right to use the County Registration Lists for City elections and has requested the Board of County Commissioners to align the County Voting Precincts with City boundaries, and

WHEREAS, it has been brought to the attention of the Board of County Commissioners that an error was made in the delineation of the City Limits of Leesburg as they pertain to voting precincts 27 and 29, and in order that the City of Leesburg may properly exercise its right to use the Registration Lists of Lake County for City elections, said Precinct lines should be corrected to coincide with the City boundaries of Leesburg;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, with the concurrence of the Supervisor of Registration of Lake County, that the Voting Precinct lines for Precincts Numbered 27 (located within the City of Leesburg) and 29 (located without the City of Leesburg) be corrected and amended to read as follows:

PRECINCT NO. 27, LEESBURG

Begin at the Northwest corner of Sec. 22, Tp. 19 S. R. 24 E., run thence East to the Northeast corner of 22, Tp. 19 S. R. 24 E., in the center of State Highway No. 25, thence South along the center line of State Highway No. 25 to intersect the center line of Main Street, City of Leesburg, being the intersection of Highway No. 25 and Highway No. 44, thence East along the center line of Main Street, Leesburg, to point intersecting the center line of Euclid Avenue, Leesburg, thence South along center line of Euclid Avenue, Leesburg, to point intersecting the center line of Dixie Avenue, Leesburg, thence Southwesterly on center line of Dixie Avenue to point intersecting center line of State Highway No. 25, thence South along center line of Highway No. 25 to the Southeast corner of Sec. 34, Tp. 19 S. R. 24 E., thence West to the Southwest corner of SE ¼ of SE ¼ of Sec. 34, Tp. 19 S. R. 24 E., thence North to the Southwest corner of NW ¼ of said Sec. 34, thence North to the Northwest corner of Sec. 22, Tp. 19 S. R. 24 E., the point of beginning.

PRECINCT NO. 29, OUTSIDE OF LEESBURG

Begin at the intersection of the center line of State Highway No. 44 with the West boundary of the Corporate limits of the City of Leesburg, thence in a Westerly direction along the center line of State Highway No. 44 to a point intersecting the West boundary of Tp. 19 S. R. 24 E., thence South along the West boundary of said Tp. 19 and West boundary of Tp. 20, to the Southwest corner of Sec. 6, Tp. 20 S. R. 24 E., thence East along the South boundary of Section 6, 4, and 4 of Tp. 20 S. R. 24 E. to the waters of Lake Dunham, thence in an Easterly direction through lake Dunham to the mouth of Oklawaha River, thence in an Easterly direction along the center of the Oklawaha River to the East boundary of Sec. 10, Tp. 20 S. R. 24 E., thence North along the East boundary of Sections 10 and 3 of Tp. 20 S.R. 24 E., to the Southeast corner of Section 34, Tp. 19 S. R. 24 E. thence West along the South boundary of Sec. 34, Tp. 19 S., R. 24 E., to the Southwest corner of SE ¼ of SE ¼ of said Section 34, thence North to the Southwest corner of SE ¼ of NE ¼ of said Section 34, thence West to the Southwest corner of NW ¼ of said Section 34, thence North to point intersecting the center line of State Highway No. 44, the point of beginning.

Clerk Owens read a letter from the Atlantic Coast Line Railroad Company regarding the Application of the Board for permission to construct a public road crossing over the railroad tract and right of way at point 1,056 feet east of Milepost TA-795, near Mount Dora, stating the cost of providing proper overhead wire clearance, including relocation of the pole, is estimated at $241.  Therefore, one check payable to Western Union Telegraph Company in the amount of $141 and one check payable to the Atlantic Coast Line Railroad Company in the amount of $101 signed by Eleanor Mielke for Harry Mielke, the 441 project setting pole and pole relocation clearance, were filed with the Board to be mailed to the Atlantic Coast Line RR Company.

On a motion by Commr. Simpson, seconded by Commr. Lightfoot, the following was adopted:

At a called meeting of the Board of County Commissioners of Lake County, Florida, held on the 17th day of January, 1956, the following was ordered and spread upon the minutes:

“It is hereby ordered by the Board of County Commissioners of Lake County, Florida, that the form of agreement between the said County and the Atlantic Coast Line Railroad Company dated January 4, 1956 by the provisions of which the said Railroad Company grants to the said County the right of license of constructing and maintaining a public road or street crossing at grade across the right of way and track or tracks of the Atlantic Coast Line Railroad Company near Mount Dora, Florida, at a point 1,056 feet eastwardly, measured along the center line of the Railroad Company’s Sanford-Tavares main track, from mile post TA-795, as particularly described in said agreement and as more fully shown on the blueprint attached to and made a part of said agreement, be and the same is hereby approved.”

“Further that the Chairman and Clerk of said Board of County Commissioners are hereby authorized and directed to execute said agreement in the name and on behalf of said County.”

Clerk Owens read a letter from Attorney Duncan enclosing a State of Florida warrant in the amount of $600 to Nandor Schantz and endorsed by him to Lake County to be applied upon the cost of installing connections for irrigation culverts in Section 1157 SR No. S-452 (Grand Island) (Credit D-5).

Clerk Owens read a letter from Attorney Duncan enclosing a State Warrant in the amount of $1,250 issued to Tavadora Shores, Inc. and endorsed to Lake County to cover a portion of cost of installing a culvert from Ditch 39 plus 58.21 on Sec. 1159, SR S-452, Lake Shore Drive, Tavares to Mount Dora.  The drainage easement and subordination of encumbrance to property rights to the State of Florida on said road was filed. (Check to be credited to D-3)

On a motion by Commr. Lightfoot, seconded by Commr. Simpson, the warrant in the amount of $88.75 on the Road and Bridge Fund and the warrant in the amount of $56 on the General Fund was issued to the Motor Vehicle Commission in payment of the 1956 X-tags for Lake County.
