MINUTES OF THE CALLED MEETING OF THE BOARD OF COUNTY commissioners

TUESday – JULY 28, 1959

 

The Board of County Commissioners met in called session in the County Commissioners’ room in the Courthouse at Tavares on Tuesday, July 28th at 9:00 o’clock A.M. for the purpose of hearing the report of C. E. Duncan, Attorney for the Board, on information received from Mr. Harry A. Johnston, Attorney of West Palm Beach, and such other matters as may be brought before the Board, with the following present:  Attorney C. E. Duncan, Chairman O. M. Simpson; Commissioners Cecil Theus, J. C. Cowart, R. G. Bishop, and Fred Cross; and Deputy Clerk Mrs. Robertson.  (Clerk Owens absent attending Court)

The Board was called to order by Chairman Simpson.

Mr. Duncan presented Chairman Simpson a gavel for keeping order.

Mr. Duncan stated on authority you gave me, I went to West Palm Beach and discussed with Mr. Harry A. Johnston, Attorney, the matter of issuance of revenue certificates on the proposed courthouse center.  He gave me a schedule which has been followed in the past.  When the certificates go into market, they are referred to as bonds rather than revenue certificates.  We should employ an attorney who is recognized throughout the United States as an expert on the validity of bonds and certificates of indebtedness.  Mr. Duncan recommended Mr. John T. Trimble, Attorney of the Firm of Caldwell, Marshall, Trimble and Mitchell in New York and requested that he be authorized to promptly contact Mr. Trimble and see if he will cooperate with us and to employ him if possible.  Mr. Duncan stated that the monies which we seek to raise are for the purpose of the construction of a jail, and the acquiring of property on which to place it and other county buildings.  This improvement is required upon the recommendation of the Grand Jury, the Courts and others.  The project will call for one and a quarter million dollars and should have a callable feature in the bonds.  Mr. Duncan asked whether or not we shall proceed along these lines.

Motion by Commr. Theus seconded by Commr. Bishop and carried unanimously, that the Board authorize Attorney C. E. Duncan to contact John T. Trimble, Attorney of the New York firm of Caldwell, Marshall, Trimble and Mitchell, in regard to employing him to cooperate with the Board in working out the bond issue on the proposed courthouse center and that Mr. Duncan be authorized to go to New York for a conference with Mr. Trimble if necessary.

Mr. Duncan reported he has talked with one of the owners of the property North and East of Tavares, and told him the Board has had an appraisal of the property made.  Mr. Duncan recommended that the owners get an appraisal also.  Put the two appraisals together then could come up with a deal.  Then have the property surveyed.

Motion by Commr. Cowart seconded by Commr. Theus and carried, that Board proceed with getting the land surveyed.  Mr. Bishop, Mr. Cross, Mr. Duncan and Mr. Goodson to work this out.

Mr. Duncan read four letters from the State Road Department in regard to Resurfacing Old SR 50 in Groveland; SR 561; survey 19 from Groveland South; and Survey from Groveland South to Lake County Line.

Motion by Commr. Bishop seconded by Commr. Cross and carried, that Attorney Duncan be authorized to write Mr. Richey Green of the State Road Department, to mark a center line on the – old Eustis-Mount Dora Road.

Mr. Goodson reported that the Zoning Commission will have a meeting Thursday, July 30, on the zoning of the area from the Dream Boat Corner to the Orange County Line.  Mr. Duncan stated he has written a letter to Mr. French re the Zoning.
