MINUTES OF the SPECIAL MEETING OF THE BOARD OF COUNTY commissioners ON FRIDAY– SEPTEMBER 18, 1959

 

The Board of County Commissioners met in special session in the County Commissioners’ room in the Courthouse at Tavares on Friday, September 18, 1959, for the purpose of hearing a Report of the Citizens Advisory Committee of the Juvenile Court and such other matters as may be brought before the Board, with the following present:  Chairman Simpson; Commissioners Theus, Cowart, Bishop, and Cross; Attorney Duncan; and Clerk Owens.

The Board was called to order by Chairman Simpson.

THE FOLLOWING APPLICATIONS for admittance to the School for the Deaf and the Blind in St. Augustine were approved by the Board:

Harry Richard Finley and Bobby Wayne Finley, parents Mr. and Mrs. J. L. Finley, R-1, Box 103, Leesburg:  Robin Gray, parents Mr. and Mrs. R. F. Gray, R-1, Box 563, Leesburg.

DISCUSSION ON NOTIFYING THE PRESS of called meetings:

Motion by Commr. Cross seconded by Commr. Cowart and carried, that if a special meeting is called at a regular meeting, it is not necessary to have the Clerk notify the Press later of this meeting.

Motion by Commr. Cowart seconded by Commr. Cross and carried, that the application of Frank W. Stebbins, as Administrator of the Estate of Bessie K. Fischer, deceased, for duplicate tax certificate #4058 of 1942 covering N. 195 feet of S. 440 feet of Lot 26; S ½ of E ½ of S ½ of Lot 25, Section 29 Manhattan be approved.

Commr. Bishop filed Petition of James Allison Adkinson and Myra Adkinson Pickard, as Trustees to Vacate Subdivision Plat of a Replat of Clermont Palisades, and reported he has checked this Plat and there are no homes there, but all grove land, WHEREUPON, on motion of Commr. Bishop seconded by Commr. Cowart and carried, the PETITION was ORDERED copied in the minutes as follows – and the following Resolution adopted:

TO THE BOARD OF COUNTY COMMISSIONERS OF LAKE COUNTY, FLORIDA:

The Petition of James Allison Adkinson and Myra Adkinson Pickard, as Trustees under the Trusts created in the Will of W. Hal Adkinson. Deceased, respectfully shows:

1.         That they are owners in fee simple of title to the following land embraced by a REPLAT OF CLERMONT PALISADES, a Subdivision in Lake County, Florida, recorded in Plat Book 9, Page 38, Public Records of Lake County, Florida.  Said Plat is a Subdivision of the following described land:

South One-Half of Government Lot 1; South One-Half of Government Lot 2; and all of Government Lots 6 and 7, LESS LAND DESCRIBED AS FOLLOWS:  Commencing N.E. Corner of SW ¼ of Section 11, Township 22 South, Range 25 East and run South 660 feet, thence West 1320 feet, thence North 660 feet East 1320 feet to beginning or Northeast Corner of Government Lot 6, Also a certain tract of land described as follows:  Begin 660 feet South of Northeast Corner of Government Lot 5, and run West 165 feet thence South to Northeast Corner of Government Lot 5, and run West 165 feet thence South to South Boundary of Government Lot 5, thence East 165 feet thence North to Point of Beginning, all land being in Section 11, Township 22 South, Range 25 East, of Lake County, Florida.

 

2.         That Petitioners desire the plat hereinabove described to be vacated and the land it embraces to be returned or converted into acreage.

3.         That Petitioners are the owners in fee simple of all the land embraced by said Plat.

4.         That Petitioners have published according to law, Notice of Intention to Apply to the Board of County Commissioners of Lake County, Florida, to Vacate said Plat by publishing said Notice in the Clermont Press in two weekly issues of said paper, it being the newspaper published in Lake County, Florida, nearest to the lands above described.  Proof of Publication being hereto attached and marked Exhibit “A.”

5.         That all State and County taxes through the year 1958 have been paid, proof of which is shown by certificate of the Lake County Tax Collector hereto attached and marked Exhibit “B.”

6.         That the Plat herein described of a REPLAT OF CLERMONT PALISADES is not within the corporate limits of any incorporated city or town.

WHEREFORE, Petitioners pray that the Board of County Commissioners of Lake County, Florida, adopt an appropriate Resolution vacating a REPLAT OF CLERMONT PALISADES described herein.

SAID RESOLUTION BEING AS FOLLOWS:

RESOLUTION OF BOARD OF COUNTY COMMISSIONERS OF LAKE COUNTY, FLORIDA, VACATING “A REPLAT OF CLERMONT PALISADES,” A SUBDIVISION LOCATED IN LAKE COUNTY, FLORIDA, AND RECORDED IN PLAT BOOK 9, PAGE 38, PUBLIC RECORDS OF LAKE COUNTY, FLORIDA.

 

   WHEREAS, on the 7th day of September 1959 James Allison Adkinson and Myra Adkinson Pickard, as Trustees under the Trusts created by the Will of W. Hal Adkinson, filed with this Board their Petition praying that a REPLAT OF CLERMONT PALISADES, hereinafter described, be vacated in order to return or convert the property embraced by said Plat into acreage; and

WHEREAS,

1.         The Petitioners are owners of fee simple title to the lands embraced in REPLAT OF CLERMONT PALISADES, a Subdivision of Lake County, Florida, recorded in Plat Book 9, Page 38, Public Records of Lake County, Florida.  That the lands embraced by said Plat are described as follows:

South One-Half of Government Lot 1; South One-Half of Government Lot 2; and all of Government Lots 6 and 7, LESS LAND DESCRIBED AS FOLLOWS:  Commencing Northeast Corner of Southwest Quarter of Section 11, Township 22 South, Range 25 East, and run South 550 feet, thence West 1320 feet, thence North 660 feet thence East 1320 feet to beginning or Northeast Corner of Government Lot 6, Also a certain tract of land described as follows:  Begin 660 feet South of Northeast Corner of Government Lot 5, and run West 165 feet thence South to South Boundary of Government Lot 5, thence East 165, thence North to Point of Beginning, all land being in Section 11, Township 22 South, Range 25 East, in Lake County, Florida.

3.         That State and County taxes through the year 1958 have been paid, proof of which has been furnished this Board by certificate of the Lake County Tax Collector filed with the Petition.

4.         The Plat herein described is not within the corporate limits of any incorporated city or town.

WHEREAS, upon said public hearing being held September 10, 1959, and no interested person appearing to object to the granting of the prayer contained in said Petition, and it appearing that Petitioners have complied with all requirements set forth in Chapter 192.29-.30, Florida Statutes.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the Plat hereinbefore described, to-wit:  A REPLAT OF CLERMONT PALISADES, A Subdivision of Lake County, Florida, recorded in Plat Book 9, Page 38 Public Records of Lake County, Florida, be, and the same is hereby vacated and the property embraced by said plat be returned or converted into acreage as provided in Chapter 192.29-.39

At this time Chairman Simpson announced that this meeting was called for the purpose of hearing report of the Citizens Advisory Committee Re:  Detention Home for Juveniles.  Mr. W. F. Williams, Chairman of the Committee, stated the reason we have come here this morning is to offer our cooperation and assistance.  We asked the other day if you would look at the present building inside as you would have a better idea of what we are trying to talk about.  Mr. Simpson stated he has looked inside of the building.

Mrs. Barbara Hinebaugh, Secretary of the Committee, gave a report of the results of the Committee’s findings.  She stated they have been to Bartow and Ocala and studied the homes there.  She estimated a permanent detention home for Juveniles in Lake County would cost $90,000.00 and the furnishings $5,000.00, and should have a 10-acre plot for the home.  Judge Hall stated he thinks the home should be located so as to have city lights and water, also police protection, and be close to Court, convenient to doctors and medical sources.  He also stated we need a place right now to do the job you gentlemen expect me to do for the Juvenile Court.  It is up to you gentlemen to provide a place to detain the children until we can get this model detention home.  Commr. Theus asked what do we need for the building North of the Chamber of Commerce Building to be placed in use now.  Judge Hall stated the only thing needed to be done right now is to complete the work on the showers.  The Board of Visitors will inspect the building just as soon as you gentlemen notify us that it is completed.  I have been authorized to engage a man and his wife as superintendents, and have had several applications, but when they looked at the space they would occupy, they lost interest, but since the improvements have been made by Mr. Goodson, I think I can get someone.  Would have to have a substitute as the superintendents could not be expected to stay there all the time.  Committee requested that the Board appoint 2 members to work with it.

Mrs. Seiler of the Juvenile Court was asked by Mrs. Hienbaugh to explain her work with delinquent children.  She gave a report on some of the children that have been brought to her attention.  She said the caseload each month would average 30 to 40 children.

Miss Geraldine Fell, Child Welfare Unit Worker, gave a report on her work with dependent children, and the Foster Homes.

Mrs. Emma Krankey, President Lake County Women’s Clubs, being present, stated the Detention Home should have recreation facilities, and she has a friend who will donate a thousand dollars for this purpose.

After the above discussion, Mr. Simpson stated the Board will appoint two of its members to work with this Committee.  Will confer with the members and see who wants to work with you and Mr. Owens will submit the names to Mr. Williams.  Mr. Simpson thanked the Committee for coming before the Board, after which they left the meeting.

Mr. Simpson stated we were requested by this Committee to appoint a committee from the Board of County Commissioners to confer with them.  Will any of the members of the Board volunteer to work on that Committee?  Mr. Theus volunteered to serve on the Committee and Mr. Bishop stated he will serve.  Motion by Commr. Cowart seconded by Commr. Cross and carried, that Mr. Theus and Mr. Bishop be appointed to serve with the Advisory Committee.

Mr. Cross stated that he and Mr. Goodson went over the plans for the Home for the Aged and they should be amended to suit the new location, WHEREUPON, Mr. Simpson instructed Mr. Cross, Mr. Theus and Mr. Goodson to go over the plans with the architect and make the necessary changes.

Motion by Commr. Cross seconded by Commr. Cowart and carried, that the Board proceed to acquire the deed on the 4-acre tract of land in Leesburg which has been offered to Lake County for a Home for the Aged that they might perfect their plans for the construction of the Home.

CLERK OWENS READ THE FOLLOWING ORDER:

CIRCUIT OF THE STATE OF FLORIDA, IN AND FOR

LAKE COUNTY

 

WHEREAS, it appears that there are not sufficient number of names remaining in the jury box for the Circuit Court of Lake County, Florida, from which jurors may be drawn for the fall term of said Court, and for such other occasions as trial before a jury may be necessary; it is therefore

ORDERED that the Board of County Commissioners of Lake County, Florida, forthwith select and place in said box, 200 additional names of persons qualified to act as jurors within said county, in accordance with the qualifications set forth in and the procedure provided for by Sections 40.01, 40.02, and other provisions of law relating to the selection and compiling of lists of names to serve as juror in said Court.
