MINUTES OF special MEETING OF THE BOARD OF COUNTY commissioners

The Board of County Commissioners met in special session in the County Commissioners’ room in the Courthouse at Tavares on Wednesday, August 24, 1960, at ten o’clock A.M. for the purpose of considering and adopting a resolution regarding the call of the official Second Special Democratic Primary Election for the County Judge and such other matters as may be brought before the Board, with the following present:  Chairman Cross; Commissioners Theus, Cowart, and Bishop; Attorney Duncan; and Clerk Owens.  (Commr. Simpson was on vacation.)

This event will be participated in by Putnam, Marion, Lake, and Polk Counties, and US 23 Association people.  Mr. Lehmann said each county would be asked for $200 and in addition would be furnished 100 tickets to be sold at $1.00 each.  The formal program begins at 10:30 a.m. Thursday, September 15, 1960 with ribbon cutting on the bridge over the Oklawaha River in South Putnam County.  A motorcade then forms and proceeds to Salt Springs, where the speaking program begins at 11:30 and chicken barbeque dinner at 12:30.  The Board members and other County Officials will be guests.  There was discussion on where the $200 is to be made available. On a motion by Commr. Bishop, seconded by Commr. Cowart and carried, Clerk Owens was instructed to transfer $200 from the Contingency Item in the General Revenue Fund to Item #685-1 – Publicity.

Commr. Bishop reported to the Board that SR 25 (US 27) is about inundated at Shepherd Lake.  He understands that the State Board of Health will dig a canal to relieve this situation if this Board will pass a resolution declaring this area an emergency condition.  The Health Department will use its draglines and dig the ditch, which will be across McNeal-Libby property.  Commr. Bishop stated that McNeal-Libby will give an easement to go across their property.  The State Road Department has agreed to cut US 27 and put two 24-inch culverts in and drain the water into Little Everglades.  Mr. Bishop stated that Mr. Jones will give us permission to cut the ditch.

On a motion by Commr. Bishop, seconded by Commr. Cowart and carried, the following Resolution was adopted:

WHEREAS, the high water condition existing along State Road 25 (US Highway 27) approximately three miles north of Minneola where the same passes between Lake Shepherd and Schoolhouse Lake has created an emergency, not only for damage to the road and adjoining properties but from a health point of view that it is rapidly becoming a health hazard, and

WHEREAS, the Lake County Health Department and the State Health Department, because of the health hazard, have offered to cooperate with the Board of County Commissioners of Lake County in the construction of excavation of facilities which may be required to reduce the water levels in that area on an emergency basis,

NOW, THEREFORE, BE IT RESOLVED BY the Board of County Commissioners of Lake County, Florida, that the State Health Department and the Lake County Health Department be requested to cooperate with the Board of County Commissioners of Lake County in the digging of ditches, installation of culverts, and such other operations as may be necessary to carry off surplus waters from Shepherd Lake and Schoolhouse Lake to reduce the health hazard now existing and rapidly increasing.

Mr. Duncan stated he talked to Mr. Durden in the Governor’s office in Tallahassee yesterday and told him we have received no official notice of the Second Special Democratic Primary Election for Lake County Judge and that Mr. Durden stated it is the practice of the Secretary of State to do this.  However, Mr. Durden stated he would mail us a copy of the Governor’s order at once.  WHEREUPON, on a motion by Commr. Theus, seconded by Commr. Cowart and unanimously carried, the following resolution was adopted:

WHEREAS, the Honorable LeRoy Collins, Governor of the State of Florida, has pursuant to a decision rendered by the Court of Appeals of Florida, Second District, requiring a Special Primary for the nomination of a County judge for Lake County issued an Order calling for such Special Second Primary, and designating the 13th day of September 1960 as the day for holding such election, and

WHEREAS, the certain Special Second Primary applies to Lake County only and the Board of County Commissioners of Lake County acknowledges the Order entered by the Governor, calling said Special Second Primary;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that in accordance with the Order of the Honorable LeRoy Collins, Governor of the State of Florida, a Special Second Primary for the nomination of a County Judge to fill the vacancy in nomination created by the resignation of the Honorable W. Troy Hall, Jr., as County Judge, does hereby proclaim and call a Special Second Primary for the Office of County Judge to declare the Nominee for said Office; than in accordance with the Order entered by the Governor, such Special Second Primary shall be held on the 13th day of September, 1960, in accordance with the procedure and in the manner in which General Primary Elections are held.

BE IT FURTHER RESOLVED that the form of ballot presented by the Clerk of the Board for said Special Second Primary upon which appears the names of the two candidates receiving the highest number of votes, be approved and declared the Official Ballot for said Special Second Primary.

On a motion by Commr. Cowart, seconded by Commr. Theus and carried, the action of the Clerk and Attorney in going ahead in the preparation of the absentee ballot and instructing the Supervisor of Registration to close the books on Friday morning, August 19th, although we had no official notice from Tallahassee (as the law requires that the books be closed 30 days before an election, but in this instance the 30-day period could not be observed) was approved.

Mr. Duncan stated the Governor may call a special Republican election for the Republican party to fill the office of the nominee for Congressman, as the nominee was killed in an automobile accident several weeks ago.

Mr. Owens reported that Bill Reedy said the Hon. Farris Bryan, Democratic Nominee for Governor, is holding a workshop at the Umatilla Community Building on Thursday, September 13, 1960 and that the names be published one time in the Lake Eustis Region News at least 11 days before the Election, September 13, 1960.
