MINUTES OF regular MEETING OF THE BOARD OF COUNTY commissioners

Monday, September 5, being a holiday, and a quorum not being present for the Regular Meeting of the Board of County Commissioners, Clerk Owens adjourned the Regular Meeting of the Board until Tuesday, September 6 at 10:00 a.m.

The Board of County Commissioners met in regular session in the County Commissioners’ room in the Courthouse at Tavares on Tuesday, September 6, 1960, at ten o’clock A.M., with the following present:  Chairman Cross; Commissioners Theus, Cowart, Bishop and Simpson; and Clerk Owens.  (Mr. Duncan, Attorney, was absent attending a hearing in Tallahassee, and his assistant, Mr. Ernest Aulls was present.)

The meeting was called to order by Chairman Cross.

On a motion by Commr. Theus, seconded by Commr. Bishop and carried, the reading of the Minutes was omitted at this time.

The Board approved the following Notary Public Bonds:

With Mass Bonding & Insurance Co.:  P. F. Reich, 515 S. Highland, Mount Dora; and Thomas W. Burcchino, Box 1199, Leesburg.

Clerk Owens reported he has approved since the first regular meeting in August the following Notary Public Bonds with American Surety Company of New York:

Lillian L. Smith 8-3-60; Earline B. Winston 8-9-60; Irma Karch 8-15-60; Rose White 8-16-60; Patricia T. Green 8-29-60; Hope Zeleski 9-1-60; and Lola Mae Thomas 9-6-60.

With American Fire and Casualty Company the following:  Ulay J. Thompson 8-1-60; Gerald A. Thorn 8-16-60.

And With Untied States Fidelity & Guaranty Company:  Mabel C. Cook 8-29-60.

Mr. Bishop filed a check in the amount of $125.46 from Boykin Construction Company dated August 1, 1960 for a culvert.

On a motion by Commr. Bishop, seconded by Commr. Cowart and carried, the contract for paving approximately 125,300 square yards of Lake County roads (7 roads as listed in the advertisement) for the price of $.124 per square yard was awarded to J. D. Manly Construction Company. (total price $15,537.20)

E. T. Hall presented the Plat of Rod ‘N Reel Club Subdivision with Title Policy #FE34499 by Title & Trust Company of Florida, showing the title in J. F. Sparks and wife; Mr. Hall said the Health Department has approved this Plat but gave him the wrong letter.  He will get the correct letter and bring to the Board.  WHEREUPON, on a motion by Commr. Bishop, seconded by Commr. Theus and carried, the Plat of Rod ‘N Reel Club Subdivision was approved.

This Plat was presented by Mr. Hall with Title Policy #Y-687-516 by Lawyer’s Title Insurance Corp.  This policy stated there are possible unfiled mechanics, labor, and material liens.  A letter from the Lake County Health Department was filed; WHEREUPON, on a motion by Commr. Theus, seconded by Commr. Bishop and carried, the Plat of Spring Lake Manor was approved.

This Plat was presented by Mr. Hall with Title Policy #FE-34419 by Title and Trust Company of Florida issued to John G. Kennedy and Paul D. Mitchell as trustees.  Mr. Hall stated there are four mortgages on the property, but he has partial release as to the streets that will be filed simultaneously with the Plat.  A letter of the Lake County Health Department and a letter of Orange State Engineers Inc. were filed.  Parts of the subdivision will not pass the percolation test, but lots are big enough that they can be sold by metes and bounds.  Three lots cannot be sold until filled.  WHEREUPON, on a motion by Commr. Cowart, seconded by Commr. Theus and carried, the Plat of Lost Lake Hills Subdivision was approved.

Mr. Owens informed the Board that the meeting in Umatilla for the Democratic nominee for Governor, Hon. Farris Bryant, has been cancelled, but he will try to come later.

Mr. Owens read the schedule regarding the ribbon cutting on SR 19 September 15 at 11:00 a.m.

bill of gregg, gibson & gregg

The bill of Gregg, Gibson & Gregg was presented.  On a motion by Commr. Theus, seconded by Commr. Bishop and carried, the bill of Gregg, Gibson & Gregg showing the balance of $17,642.63 which has been approved for the final acceptance of County Engineer Goodson was approved for payment.  (This bill is regarding the contract on the Home for the Aged.)

Mr. Owens reported that the air conditioner in the Juvenile Office is worn out.  We have one in the vault in the SE corner on the second floor in the Courthouse which is not being used, but it is a ¾ ton unit and is wired for 220.  Chas Butler will charge one hundred dollars to run a new wire in for the installation of this machine in the Juvenile office.  On a motion by Commr. Theus, seconded by Commr. Simpson and carried, the Board authorized Chas Butler to go ahead and extend the wire in the Juvenile office for the air conditioner to be connected.

Mr. Owens reported that J. D. Slone who owns the house at the corner of Irma and Barrow streets asked him if the Board is contemplating buying this house.  Mr. Owens said he informed Mr. Slone that as far as he knew, the Board is not interested.  This was satisfactory to the Board, as they are not interested in purchasing the property at the present.

Mr. Goodson reported that the resurfacing of this road was not included in the 1960-61 budget.  Mr. Simpson, Mr. Goodson, and Mr. Duncan stated they will contact the member of the Road Board in this District and see if they can get it included in this budget before adopting a resolution requesting that it be included in the budget.

STATE ROAD DEPARTMENT RESOLUTION

On a motion by Commr. Simpson, seconded by Commr. Cowart and carried, the following resolution was adopted:

WHEREAS, the State Road Department of Florida has authorized and requested Lake County to furnish the necessary rights of way, borrow pits, and easements for that portion of Section 11685, State Road S-439, extending from State Road 44 in Section 34, Township 18 South, Range 27 East, northerly to State Road 42, which has been surveyed and located by the State Road Department as shown by a map on file in the office of the Clerk of the Circuit Court of said County and in the office of the said Department at Tallahassee, and

WHEREAS, the said Department will not begin construction of said portion of said Section in said County until title to all land necessary for said portion of said Section has been conveyed to or vested in said State by said County and said lands are physically cleared of all occupants, tenants, fences, buildings and/or other structures and improvements upon encroaching within the limits of the land required for said portion of said Section; and

WHEREAS, the said County is financially unable at this time to provide the necessary funds to acquire said rights of way, borrow pits and easements; now therefore, be it

RESOLVED, that the State Road Department of Florida be and it is hereby requested to pay for the rights of way, borrow pits, and easements for said road, including the removal of buildings, fences, and other structures and improvements thereon and for other expenses of acquiring title to said rights of way, borrow pits, and easements by purchase or condemnation from such funds and under such conditions as are set out in the contract hereto attached; and be it further

RESOLVED, that said County, through its Board of County Commissioners, comply with the request of said Department and procure, convey, or vest in said State the free, clear, and unencumbered title to all lands necessary for said portion of said Section and deliver to the State Road Department said lands physically clear of all occupants, tenants, fences, buildings and/or other structures and improvements situate upon or encroaching within the limits of the lands required for said portion of said Section and that the Chairman and the Clerk of this Board be and they are hereby authorized and directed to execute and deliver on behalf of said County to said Department the Contract in the form hereto attached; and be it further

RESOLVED, that the attorney for this Board be and he is hereby authorized and directed to proceed to take the necessary steps for the County to acquire in the name of said County by donation, purchase, or condemnation said rights of way, borrow pits, and easements for said portion of said Section and to prepare in the name of said County by its County Commissioners all condemnation papers, affidavits, and pleadings and prosecute all condemnation proceedings to judgment and furnish to the Department the abstract search provided for in said Contract.

On a motion by Commr. Theus, seconded by Commr. Cowart and carried, the following Resolution was adopted:

WHEREAS, the State Road Department has located and proposes to construct and improve State Road S-439, Section 11685 in Lake County, Florida and

WHEREAS, in order for the State Road Department to further and complete said project, it is necessary that certain lands now owned by Lake County be acquired by the State of Florida for the use and benefit of the State Road Department of Florida; and

WHEREAS, the State Road Department having requested Lake County to execute and deliver to the State Road Department a deed or deeds in favor of the State of Florida, conveying all right, title, and interest that said County has in and to said lands required for right of way for said State Road, and said request having been duly considered.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of said County that the Chairman and Clerk of said Board be and they are hereby authorized and directed to make, execute and deliver to the State Road Department a deed or deeds in favor of the State of Florida conveying all right, title, and interest of said County in and to said lands owned by said County required for right of way for said State Road.

BE IT FURTHER RESOLVED that a certified copy of this Resolution be forwarded forthwith to the State Road Department at Tallahassee, Florida.

On a motion by Commr. Simpson, seconded by Commr. Cowart and carried, Clerk Owens was authorized to execute the Typical Section on SR 44B, budgeted amount $130,000, Length 1.62 miles.

A letter from Carl L. Ferran stated he is unable to serve as an appraiser on SR S-44B; WHEREUPON, on a motion by Commr. Simpson, seconded by Commr. Bishop and carried, Ransford A. Potter, Leesburg, was appointed appraiser in place of Mr. Ferran to serve with W. P. Wingler and John A. Murray on SR 44-B.

On a motion by Commr. Theus, seconded by Commr. Bishop and carried, Clerk Owens was authorized to execute the typical Section on 11020-8501 SR 33 ($125,000).

On a motion by Commr. Bishop, seconded by Commr. Simpson and carried, Clerk Owens was authorized to execute the typical Section on SR 455 (Budgeted amount $20,000).

On a motion by Commr. Theus, seconded by Commr. Bishop and carried, the typical Section on SR S-449 was executed by Clerk Owens. (Budgeted amount $3,000, length 1.236 M)

On a motion by Commr. Cowart, seconded by Commr. Bishop and carried, the appraisal on S-565A in the amount of $16,874.60 was accepted, and the bill of John S. Arnold, E. L. Puryear, and Ralph E. Nash, appraisers, in the amount of $150 each for a total of $450 was approved for payment by the State Road Department. (Section 11681-2601 as amended and Section 11681-2602)

On a motion by Commr. Bishop, seconded by Commr. Cowart and carried, Chairman Cross was authorized to execute the application for a railroad crossing near Dead River West of Tavares.

dedication of right of way easement

The dedication of the right of way easement to Lake County from the Florida Board of Parks and Historic Memorials over the west 33 feet of W ½ of SE ¼ of NW ¼ of Section 2, Tp. 19 S, Range 24 East was filed with the Board.  On a motion by Commr. Theus, seconded by Commr. Bishop and carried, the Dedication Right of Way Easement was accepted and the original filed for record.

A letter from Richey Green, District State Road Department, to C.E. Duncan, Attorney for the Board, regarding entrances to the property – Community Club building at Cassia was read and filed.  Said letter stated the State Road Department does not think there is a need of two entrances as requested by the Directors of the Cassia Community Club.  Clerk Owens was instructed to send a copy of said letter to the Community Club at Cassia.

Letters from the State Road Department and the City of Eustis regarding the Eustis Boat Basin and Park (proposed) was ordered held in abeyance until Mr. Duncan is present.

The meeting adjourned for lunch and reconvened at 2:00 p.m.

disposal plant

Howell Hopson appeared before the Board and discussed fencing the proposed Disposal Plant.  It was agreed that the Plant should be fenced.  Mr. Hopson asked if the County would do the excavation or the contractors.  The Board agreed for the contractors to do the excavation, but the County to do the hauling of the fill between the site and the existing paved street which is a low area.  The contractors are to do the bulldozing necessary.  The State Board of Health has to approve this.  Mr. Hopson will contact Mr. Duncan when he gets the approval of the State Board of Health.  Mr. Duncan will get the permit from the Railroad Company to go under the tracks and a railroad crossing. Mr. Hopson said he will be ready to advertise for bids in October.

Mr. William C. Hunt, 129 N. Rockingham, Tavares, presented a tax receipt of Robert Miller on Lots 7 to 12 inclusive, Block 53 East, Umatilla, stating the lots had been erroneously assessed showing a trailer located thereon.  Mr. Miller would like to be reimbursed for the overcharge of taxes, as there was no trailer on the lots.  This matter was referred to Mr. Duncan.

Letter from the Secretary of State, Hon. R. A. Gray, enclosing a copy of the Call by the Governor of the special nominating primary elections for the purpose of filling the vacancy in the Republican Nomination for the office of Representative in Congress for the Fifth Congressional District of Florida.  The Secretary of State has set the latest date for candidates to qualify for this office as noon September 13, 1960 and calls a first special nominating primary election in the Fifth Congressional District of Florida for the selection of a Republican nominee for the office on Tuesday, September 27, 1960, and should no candidate receive a majority of the votes cast at such election, a second special primary election on Tuesday, October 4, 1960.  In the event no more than one candidate qualifies in such nominating primary, he shall be deemed nominated, and the elections herein provided for shall not be held.

Statements showing the financial activity in Lake County Secondary Funds during the fiscal year 1956-1960 and Statements showing the status of the Lake County Secondary Funds as of July 1, 1960 and June 30, 1960 were filed with the Board.

Mr. Duncan filed state warrant #450732 in the amount of $500 made payable to G. G. Ware, et al and endorsed to Lake County to be used in the cost of laying a culvert instead of digging a ditch from the above road to Lake Harris.  The ditch is located at approximately Station 22 plus 00.  Commr. Theus has agreed that upon the repayment of this money, he would put in a culvert instead of leaving an open ditch.

On a motion by Commr. Theus, seconded by Commr. Simpson and carried, the action of the Chairman and Clerk in approving for admittance to the T. B. Hospital the following applications:  Maude L. Ashmore, Minneola and Lillian Cubbage, Leesburg, was approved.

On a motion by Commr. Cowart, seconded by Commr. Bishop and carried, the bill of J. E. Baker for services in procurement of right of way on SR S-439 in the amount of $221.90 was approved. (7 days at $25 per day plus mileage at 10 cents per mile.)

The request of Clerk Owens for an IBM Typewriter at a cost of $400 was approved on a motion by Commr. Theus, seconded by Commr. Simpson and carried.

A letter from Mrs. Shaw, President of the Historical Society, was read and filed.

A copy of a letter from Dr. Black to Ed S. Bell was referred to Commr. Cowart.

Clerk Owens presented a letter from Southeastern Telephone Company and a copy of his reply on August 19, 1960 regarding the telephone bill of Sen. J. A. Boyd in the amount of $70.41.  Clerk Owens stated he asked for an itemized statement of the old bill made in 1959, but has not received same.  Therefore, the bill was not authorized paid.

Clerk Owens read a letter from the Lake Region Packing Association requesting the Board to grant permission to them to use an area of land lying east of Highway 19 in Sec 31-19-26, south of the present access road to Mobile Homes Estates, adjoining the north boundary of property owned by Lake Region and running east and west within the limits of the present fence around its property for parking purposes.  On a motion by Commr. Bishop, seconded by Commr. Simpson, and carried, the Lake Region Packing Association was granted temporary permission to use the above-described property as a parking area.

The Notice of Exchange of Minute Maid properties having been advertised for consideration as of this date and the Board having discussed the exchange, on a motion by Commr. Theus, seconded by Commr. Simpson and carried, the following resolution was adopted:

WHEREAS, Lake County is vested with the fee title to the following described lots of land in Lake County, Florida:

Lots 1 through 6, inclusive, in Block C, according to the Plat of Avalon Park Subdivision, as recorded in Plat Book 9, page 14, public records of Lake County, Florida.  ALSO:  The West 50 feet of the East 160 feet of the North 50 feet of Lot 7, in Block 62 and the North 50 feet of the West 100 feet of the East 110 feet of Lot 7, in Block 62, according to the Official Map of the City of Leesburg, as recorded in the public records of Lake County, Florida.

for the use of which Lake County has no immediate or foreseeable need.

WHEREAS, the Board of County Commissioners of Lake County, Florida, deems it expedient to acquire a certain tract of land for which Lake County has a need, said property being owned by Carney Groves, Inc. and is located in Lake County, Florida, and described as follows:

 WHEREAS, a Notice of the proposed exchange of properties above described has been published in accordance with law, as will appear by reference to a Notice of Exchange of Properties published in the Daily Commercial, Leesburg, Florida, in its issues of August 16th and 23rd, 1960, proof of publication of which has been filed with this Board;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that upon receipt of a Deed from Carney Groves, Inc., a Florida Corporation, properly executed conveying to Lake County, a Political Subdivision of the State of Florida, the following described tract of land in Lake County, Florida:

Lots 1 through 6, inclusive, in Block C, according to the Plat of Avalon Park Subdivision, as recorded in Plat Book 9, page 14, public records of Lake County, Florida.  ALSO:  The West 50 feet of the East 160 feet of the North 50 feet of Lot 7, in Block 62 and the North 50 feet of the West 100 feet of the East 110 feet of Lot 7, in Block 62, according to the Official Map of the City of Leesburg, as recorded in the public records of Lake County, Florida.

Clerk Owens read a letter from the State Road Department regarding moving the Wawryzchi house on SR 19, stating it would cost $9,500 to move the house.  Commr. Theus said he knows a party in Haines City who would move it cheaper than that, and he would send the name to Mr. Duncan.

Clerk Owens read a letter from Richey Green, District Engineer, State Road Department, stating “the job is 3.5 miles in length and is in need of maintenance currently.  The shoulders are just about missing through a large part of the road.  The right of way is indefinite (except for a very short stretch of 40 feet), and the apparent maintained width is 40 feet (plus or minus).  The sight distance is quite limited, and it has other very apparent deficiencies.  Considering the overall condition, we do NOT RECOMMEND IT FOR STATE MAINTENANCE.”

Clerk Owens read to the Board a certified copy of a resolution adopted by the Lake County Board of Public Instruction at the special meeting of July 26, 1960 fixing millages to be assessed for school purposes for the year 1960; WHEREUPON, on a motion by Commr. Theus, seconded by Commr. Simpson and carried, the millages as submitted by the Lake County Board of Public Instruction for the fiscal year beginning July 1, 1960 and ending June 30, 1961 were approved and filed, and Clerk Owens was instructed to order the Hon. SAID RESOLUTION BEING AS FOLLOWS: RESOLUTIONS OF THE BOARD OF PUBLIC INSTRUCTION OF LAKE COUNTY, FLORIDA, DETERMINING THE AMOUNT OF REVENUE TO BE PRODUCED AND THE MILLAGE TO BE LEVIED FOR THE COUNTY CURRENT SCHOOL FUND, FOR THE COUNTY B&B RESERVE FUND, FOR THE COUNTY GENERAL (BPI) INTEREST AND SINKING FUND, FOR THE SPECIAL TAX SCHOOL DISTRICT CURRENT FUND, FOR THE DISTRICT B&B RESERVE FUND, AND FOR THE DISTRICT BOND INTEREST AND SINKING FUNDS FOR EACH OF THE DISTRICTS IN THE COUNTY FOR THE FISCAL YEAR BEGINNING JULY 1, 1960 AND ENDING JUNE 30, 1961.

(Adopted at the special meeting of the Lake County Board, July 26, 1960.

WHEREAS, Section 237.18 of the Florida School Code required that “upon the final adoption of the budget and upon receipt of the certificate of the Assessor of Taxes giving the assessed valuation of the county and of each of the Bonded School Districts, the County Board shall determine by resolution the amounts necessary to be raised for the County Current School Fund and for each district Bond Interest and Sinking fund and the millage necessary to be levied for each such fund and shall also show in said resolution the millage voted by Special School District for the District Current School Fund,” and for the District B & B Reserve Fund, and

WHEREAS, the school budget for the current fiscal year has been finally approved by the State Superintendent and is now official except for the certification of millages as required by Section 237.18; and

WHEREAS, the certificate of the County Assessor of Lake County, giving the assessed valuation of the county and of each school district has been received.

THEREFORE, BE IT RESOLVED by the County Board of Public Instruction of Lake County, Florida, assembled in regular (special) meeting that the amounts necessary to be raised as shown by the officially adopted budget and millages necessary to be levied for each school fund of the county for the fiscal year beginning July 1, 1960 and ending June 30, 1961 are as follows:

*NOTE:  If bonds were issued prior to the date the homestead amendment became effective, the assessed valuation and tax levies should include homestead property; if bonds were issued after that date, only the non-exempt property should be included.  If in any district some bonds were issued before the amendment became effective and some afterward, two lines should be used for each such district, one to give values and levies for the issue including homesteads and the other to include only non-exempt property and the levies thereon for bonds issued since the amendment became effective.

WHEREAS, Section 237.18 of the Florida School Laws provides that “a certified copy of said resolution shall thereupon be filed with the Board of County Commissioners shall thereupon order the Assessor to assess the several millages certified by the County Board against the taxable property of the several Bonded School Districts.  The Assessor shall then assess the taxes as ordered by the Board of County Commissioners, and the Collector shall collect said taxes and pay over the same promptly as collected to the county school depository or depositories to be used as provided by law, provided that all taxes authorized herein shall be assessed and collected on railroad, street railroad, sleeping car, parlor car, and telegraph company property in the manner now provided by law.”

AND WHEREAS, the County Board of Public Instruction of this county has determined the millage to be levied for the County General School Fund for the County B & B Reserve Fund, for the County General (BPI) Interest and Sinking Fund, and for the District Bond Interest and Sinking Funds by dividing the applicable assessed valuation as finally certified by the Assessor after equalization as hereinbefore specified into the amount budgeted to be received from taxes before five per cent (5%) is deducted, using the nearest one-fourth (1/4) mill or other fraction or decimal ordinarily used in the county as prescribed by Section 237.18 and has found the millage levies required to be as set forth in Part I above.

NOW, THEREFORE, BE IT RESOLVED that the Board of Public Instruction of Lake County, Florida, does hereby determine that the aforesaid millages on said assessed valuation of the taxable property for the year 1960 will be required and does hereby request the Board of County Commissioners of Lake County, Florida, in conformity to the law to direct the Tax Assessor to assess the Tax Collector to collect taxes according to the millages certified herein.

BE IT FURTHER RESOLVED that a certified copy of this resolution be forthwith transmitted to and filed with the Board of County Commissioners of Lake County, Florida.

BE IT FURTHER RESOLVED that a second certified copy of this resolution be forthwith transmitted to and filed with the State Superintendent of Public Instruction, Tallahassee, Florida, to become a part of the official budget which is in his file and that another copy be filed with and become a part of the official budget in the files of said County Board of Public Instruction.

resolution for repair of damages due to hurricane donna

On a motion by Commr. Theus, seconded by Commr. Cowart and carried, the following Resolution was adopted:

WHEREAS, because of the emergency resulting from the recent hurricane “Donna” in various communities in Lake County, immediate repairs were necessary and immediate equipment required for such repairs, and

WHEREAS, complying with the rules and regulations of the Florida Development Commission relative to the purchase of equipment for such purposes, Lake County has acquired for the City of Tavares and the City of Mount Dora certain materials and equipment necessary in such emergency, and

WHEREAS, the City of Tavares has required materials and supplies to the extent of $610.40 and has paid said sums to Lake County, and the City of Mount Dora has required materials of the value of $20.74 and has paid such amounts to Lake County;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the County issue to the Florida Development Commission in payment for said supplies and equipment its check in the sum of $631.14.

discussion on not allowing trucks on eustis-tavares lake shore drive

On a motion by Commr. Simpson, seconded by Commr. Bishop and carried, the following Resolution was adopted:

WHEREAS, the County Highway known as the Lakeshore Drive between Tavares and Eustis is not constructed to such standards as will support the weight and the resulting wear and tear of heavily loaded trucks, and the continued use thereof by such trucks are forbidden to drive upon, trespass, or use that certain road and right of way commencing at Bay Street in the City of Eustis and extending westerly and southwesterly along Lakeshore of Lake Eustis to intersect State Road 19, northeast of Tavares, providing however that trucks serving properties adjacent to said highway and person residing on the properties adjacent to said highway may be served by trucks transporting supplies to said properties and transporting fruit from said properties to connecting State Highways.

golden isle subdivision

Mr. Goodson presented the Plat of Golden Isle Subdivision for a numbering system.

On a motion by Commr. Simpson, seconded by Commr. Bishop and carried, the numbering system for Golden Isle Subdivision was accepted if the plans are approved by the proper postal authorities.

Mr. Duncan was instructed to contact the owners of Golden Isle Subdivision in regard to paying for the installation of the railroad crossing, the amount of which is $202.
