MINUTES OF THE SPECIAL MEETING OF

THE BOARD OF COUNTY commissioners

 monday – OCTOBER 24, 1960

 

The Board of County Commissioners met in called session in the County Commissioners’ room in the Courthouse at Tavares on Monday October 24, at ten a.m., for the purpose of receiving bids on various items and such other matters as may be brought before the Board, with the following present:  Chairman Cross; Commissioners Cowart, Bishop, Simpson and Commissioner-Elect Babb, Clerk Owens, County Engineer Goodson.

Board called to order by Chairman Cross.

Ross Swartzel of Minute Maid Corporation appeared before the Board and requested assistance from the County on a clay road going into Minute Maid groves between Altoona and Weirsdale.  This road is under water and it is impossible to get to the groves.  Other people also own groves in there and cannot get in and out.  Other grove owners refuse to let us through and we would like to ask help from the Board.  Mr. Cross said he has talked with Mr. Brakefield, County Engineer of Marion County, and he said they have other jobs of general interest under water and they could not attend to this job.  Mr. Cross also stated the place under water is in Marion County and not in Lake County.  Mr. Swartzel said he thinks Marion County will help if this Board would contact them again.  Mr. Theus suggested that Mr. Swartzel attend the Board meeting in Ocala tomorrow and see what they will do.  Mr. Goodson said he would call Mr. Brakefield about the matter.

Katherine Baker, Supervisor of Registration, appeared before the Board and requested additional help in her office as there are so many new registrations.  Motion by Commr. Theus seconded by Commr. Bishop and carried, that Mrs. Baker be allowed to employ additional help in her office up to a maximum of $250.00 on an hourly basis.

Representative C. Welborn Daniel appeared before the Board and reminded the Commissioners of the motorcade for Democratic nominee for Governor – Hon. Farris Bryant – this afternoon and hoped all members can attend.

LAKE SHEPHERD AND LITTLE EVERGLADES DRAINAGE

Mr. Daniels reported that the committee appointed to look over the Lake Shepherd situation met last Monday afternoon and arrived at what we thought was a solution, but found out later it was not.  So we met again in my office on Wednesday of last week and this meeting was attended by Commissioners Bishop and Cowart, also Mr. Haynie, Mr. Jones, Mr. Lacey, Mr. McClure, Mr. Arthur Roberts, Mr. Joe Roberts, Mrs. Campbell and Mr. Daniel.  Mr. Daniel reported at this time we arrived at a very inexpensive solution and I now present the recommendations.  We do not think the expense will be more than $2500.00 to $3,000.00, and would like the approval of the Board of the recommendations.

Motion by Commr. Cowart seconded by Commr. Bishop and carried, that the Board accept the recommendations of the committee as an official document and proceed with the work.  SAID RECOMMENDATIONS BEING AS FOLLOWS:

Re:  Committee Report – Sheppard Lake, Little Everglades Drainage Project

 

Dear Mr. Cross:

Pursuant to your instructions appointing a committee consisting of R. G. Bishop, County Commissioner, and J. C. Cowart, County Commissioner, as well as any other interested citizens, for the purpose of arriving at a compromise solution which would permit water to be flowed from Sheppard Lake and School House Lake through the Little Everglades and thence to Lake Harris, such committee has met and arrived at the following conclusions and recommendations:

1.  A spillway type dam across the natural drainage ditch should be constructed at or about the point where the ditch enters the Western property line of W. R. Lacy’s property with the elevation of top of such spillway established at 82 feet above sea level according to the field notes taken by Orange State engineers at approximately 1:00 o’clock P.M., October 19, 1960, plus or minus any error in said field notes.

2.  Mr. Lacy should deed to the County the necessary property to construct such spillway, together with an easement for the purpose of maintaining such spillway and the ditch Easterly from the spillway to the next ensuing County clay road, commonly known as the Power Station Road.  Mr. Lacy has agreed to execute such easement and deed.  It should be understood that the easement and deed will be for the purposes mentioned above and shall not be open to the public for any other purposes.

3.  It is further recommended that the ditchway, or flowway, from the Little Everglades, including any lakes and ponds, shall be kept clear and cleaned out to the present flow line by the respective property owners abutting such ditch or flowway.  This applies to the area of ditch or flow-way from the spillway upstream to and through the area known as the Little Everglades.

4.  It is further recommended that the County proceed according to the terms of the agreement executed by George McClure in behalf of Libby, McNeil & Libby for the creation of a ditch connecting School House Lake and the Little Everglades.  Mr. McClure has reaffirmed this agreement.

5.  It is further recommended that the County establish control structures in the Libby, McNeil & Libby ditch to control the flow of water from School House into the Little Everglades.  This control structure should be established at the County clay road crossing such ditch.  This control structure should be in the form of three 18 inch culverts with flach board attachments.

6.  It is pointed out that the undersigned persons were in attendance at the meeting at which the foregoing was agreed to and they endorse the principles herein above stated by their signatures attached hereto.

It should be pointed out that Raymer Maguire, Sr., of Orlando and Roy Sutzman of Toledo, Ohio and E. A. Nimnicht of Mt. Dora, Florida are in a small way affected by the above recommendations and that their approval should be secured.  However, this should not necessarily delay the beginning of the execution of the above recommendation.

It should further be pointed out that as long as the ditchway or drainageway, including the ponds and lakes, are kept clean to the present flow line to the site of the spillway, it is permissible with all parties that the ditch across the property of Libby, McNeil & Libby may be immediately constructed and water from School House Lake may be immediately diverted down such ditch.

Mr. Daniel called the State Road Department requesting the use of its dragline for the work and he later reported that Mr. Richey Green said they have a dragline in that area and would use it.  Mr. Daniel suggested at all times we should indicate the good faith of the County before moving any equipment, and notify the owners of what steps are being taken.  Fred Tanner of the Mosquito Control is to use the County dragline and help with this work.

Mr. Bishop filed two checks, each in the amount of $76.98 from U. S. Fidelity & Guaranty Company to Henry Harrell Eley and endorsed by him paying for compensation for injury for 9-22-60 to 10-5-60 and 10-6-60 to 10-19-60.

Mr. Simpson filed a check from Superior Asphalt Company – D. C. Stubble – in the amount of $77.55 for culvert. 

Motion by Commr. Bishop seconded by Commr. Theus and carried, that these checks be accepted and deposited to the Road and Bridge Fund.

Motion by Commr. Theus seconded by Commr. Cowart and carried, that the apparent low bid on concrete pipe of Lakeland Cement Company be accepted.

            Mr. Cowart suggested taking the bids under advisement in order that he and Mr. Goodson could look over them.  Mr. Goodson asked to be allowed until Monday on the truck bids, but Mr. Clark was present and stated he would like to know now, WHEREUPON, on motion of Commr. Cowart, seconded by Commr. Theus and carried, that the Board accept the apparent low bid of Creamons Chevrolet Company to furnish Lake County one Chevrolet 8-cylinder dump truck for the price of $3,737.28 pending further study.

Euclid Parker of Paisley appeared before the Board and presented a sketch of some lots in Pittman and stated he wants to make a trailer lot of these lots.  Mr. Goodson is to check the lots.  Mr. Parker owns the property on the West and part on the East side of the street.

Robert Ford, Architect, Brown Gregg and Mr. Newman appeared before the Board in regard to the bids for the construction of the Agricultural Center.  Mr. Ford gave a report on the two low bids.  Greg, Gibson and Gregg construction time is 100 days and Thompson construction time is 150 days.  Gregg, Gibson and Gregg’s bid is $98,886.00 without panel add $2,850 for panel making $101,736.00 total and this would still make Gregg, Gibson and Gregg the low bidder.  Thompson’s bid with the panel is $102,476.00.

Mr. Owens reported the Board has on hand $99,693.64, and will not have any more until December 1960, when taxes will bring in $65 to $75 thousand dollars.

Discussion on 13 items that could be eliminated from the contract, which would amount to between 4 and 5 thousand dollars.  Mr. Owens suggested to hold this matter in abeyance until Mr. Duncan gets back and can contact the Attorney General and see if the Board can obligate on this.

WHEREUPON, on motion by Commr. Theus seconded by Commr. Bishop and carried, the Contract to Construct the Agricultural Center was awarded to Gregg, Gibson and Gregg in the amount of $98,886.00 plus $2,850.00 for paneling, subject to C. E. Duncan, County Attorney, contacting the Attorney General as to whether or not can obligate the County on this.  (By pledging of the additional money from next year’s expected revenue in order to get the project started immediately.)

Clerk Owens read a letter from Acousti Engineering Company of Florida, Box 3242, Orlando re:  Acoustical title quotation to the General Contractors bidding on the Agricultural Center.  Letter filed.

James B. Hurt, representing J. M. Smedley Publisher, Inc., of DeLand, appeared before the Board and presented copies of land atlas and explained same.  He said city limits and subdivisions not included in the atlas.  The price quoted is one book - $350.00; two books $325.00 each; 4 or more books $300.00 each.  No action taken at this time on purchase of books.

Clerk Owens advised the Board that the Small Claims Court needs a docket book and presented quotations as follows:

In the absence of Chr. Cross for a few minutes, Vice-Chairman Theus presided.

Motion by Commr. Cowart, seconded by Commr. Bishop and carried, that the Small Claims Court be authorized to purchase the docket book with index and inside from Bowen Supply Company, the low quotation for the sum of $68.75.

Clerk Owens read a copy of the Proclamation of the Mayor of Groveland proclaiming October 23 thru 28, 1960, as Bald Eagle week for the City of Groveland and urging the cooperation of the Board.  Copy filed.

Commr. Theus said the man is pumping at Lady Lake today and we should know where the gasoline is coming from and what it will cost.

Clerk Owens gave each Board member a budget statement on Road and Bridge Fund.

On August 8, 1960 Clerk Owens was authorized to advertise for bids for furnishing the Home for the Aged when the Committee presents the list of furnishings needed.  Now the list is complete and Clerk Owens was instructed to advertise for bids to be taken on 12-5-60.

Motion by Commr. Bishop seconded by Commr. Cowart and carried, that the following Resolution be adopted:

WHEREAS, because of the high water resulting from excessive rainfall at and around Lake Shepherd and Schoolhouse Lake, both of which border State Road No. 25 (U.S. 27), a health hazard is developing and flood waters are damaging the properties in that area extensively, the Board of County Commissioners of Lake County, Florida, has determined to excavate a ditch from Schoolhouse Lake northerly and passing under said State Road 25, and eventually discharging the excess water into “Little Everglades,” and

WHEREAS, the State Road Department has agreed to the location of a culvert under the pavement of said State Road 25, providing Lake County will assume all liability which may arise from the installation of culverts under the road, and the Board of County Commissioners has determined that the placing of a culvert and the assumption of such liability is essential;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that upon the location of a culvert under State Road 25 (U.S. 27), at the most natural location northerly from Schoolhouse Lake for the flow of water from said Lake into “Little Everglades,” Lake County will assume all liability which may arise from the installation of such culvert and will hold the State Road Department harmless from any damage or injury which may result from such installation.

Motion by Commr. Theus seconded by Commr. Simpson and carried, the following Resolution was adopted:

WHEREAS, excessive high waters throughout Lake County and the State of Florida, caused by excessive rainfall during the past two years, has created health hazards, and has resulted in considerable damage to properties along the public highways of the County and will continue to create further damage and loss of property to many citizens of Lake County, and unless emergency steps are taken, there will be more seriously damaged areas in the County; and

WHEREAS, the Board of County Commissioners has determined that the most expeditious and effective manner of alleviating this condition is the purchase of one or more pumps and discharge pipelines of not in excess of ten inches in diameter; and

WHEREAS, upon request of the Attorney General’s office of the State of Florida, for advice on such emergency purchase, the following telegram was received:

“In response to the request of the Honorable Senator J. A. Boyd as to authority of Lake County to expend County funds for equipment to be used in connection with emergency drainage please be advised that such expenditures in the absence of a drainage district in the affected area would be authorized only in connection with the Board power of the County Commissioners to provide and maintain the County Road System.  In connection with such emergency drainage action it would appear that the County could acquire necessary mechanical equipment, viz., pumps, etc., without advertising for bids.  Bids, however, should be taken from a number of suppliers of said equipment as quickly as possible and later confirmed in letters to the Board.  Sincerely – Richard W. Ervin – Attorney General.”

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that this Board enter into a Contract for the purchase of two (2) Trailer mounted pumping Units and 18,540 feet of pipe, at a total cost of $75,273.80, without delay, and without advertising for bids;

BE IT FURTHER RESOLVED that said Purchase is made because of an emergency situation existing in Lake County and in accordance with authority and recommendation as hereinbefore set forth.
