MINUTES OF regular MEETING OF THE BOARD OF COUNTY commissioners

monday – NOVEMBER 14, 1960

 

The Board of County Commissioners met in regular session in the County Commissioners’ room in the Courthouse at Tavares on Monday November 14, 1960, at 9 a.m. with the following present:  Chairman Cross; Commissioners Theus, Cowart, Bishop and Simpson; Attorney Duncan and Clerk Owens.

The Board was called to order by Chairman Cross.

Motion by Commr. Simpson seconded by Commr. Theus and carried, that the Minutes of the meetings of August 24; September 6, 12 and 20; October 3, 10, 14, 17 and 24 be adopted as read.

Mr. Simpson reported that Mr. Lampert who lies in Sorrento called on him in regard to obtaining a license for carrying firearms.  Mr. Lampert works for Hubbard Construction Company as night watchman in charge of the machinery and needs the permit to carry a pistol.

Motion by Commr. Simpson seconded by Commr. Theus and carried, that the Bond of Alton R. Lampert, with Adolph Lauck and Earl Davis as bondsmen, for carrying firearms – a pistol made by Pistol Marcas Registrades – Smith & Wesson, Springfield, Mass., of 38 calibre and numbered 198743 – be approved and license issued.

Mr. Hugh Hanna appeared before the Board and requested certified copies, or Photostat certified copies, of all minutes pertaining to the purchasing of the pumps and pipe for the Lady Lake Drainage Project.  (These copies are to be sent to State Road Dept.)

Notice having been advertised for the purchase of two tractors, the following bids were received:

Motion by Commr. Cowart, seconded by Commr. Theus and carried, that the bids be taken under advisement for Mr. Goodson, County Engineer, to check.

clearing ditch in leesburg vicinity

Notice having been advertised for clearing a certain public ditch in Leesburg Vicinity, no bids were received.

Atty. Duncan stated the Board has complied with the law in running the advertisement, but no bids were received, therefore, can notify the various dragline companies to contact Chas. Goodson and give him quotations for cleaning the ditch.

Eugene A. Moss of Swift & Company General Adhesive Products Department appeared before the Board and displayed coating for masonry surfaces.  This coating can be sprayed on or put on with brush – can be used on inside or outside walls - 12¢ per square foot for two coats.  Mr. Simpson stated that since we have an offer to put on a sample, think should accept the offer, WHEREUPON, on motion of Commr. Simpson seconded by Commr. Theus and carried, the offer of Mrs. Moss to demonstrate this coating for masonry surfaces by applying on the East Wall of the Photostat room be accepted.

Letter from Atlantic Coast Line Railroad re:  Installation of public road crossing over Coast Line’s right of way and track at a point 2,375 feet East of Mile Post TA-795 near Mount Dora was read.

Motion by Commr. Bishop seconded by Commr. Simpson and carried, that the following Order be entered in the Minutes:

“It is hereby ordered by the Board of County Commissioners of Lake County, Florida, that the form of agreement between the said County and the Atlantic Coast Line Railroad Company, dated October 25, 1960, by the provisions of which the said Railroad Company grants to the said County the right or license of constructing and maintaining a public road or street crossing at grade across the right of way and track or tracks of the Atlantic Coast Line Railroad Company near Mount Dora, Florida, at a point 2375 feet northeastwardly, measured along the center line of the Railroad Company’s Sanford-Tavares main track, from  Mile Post TA 795; as particularly described in said agreement and as more fully shown on the white print attached to and made a part of said agreement, be and the same is hereby approved.

“Further that the Chairman and Clerk of said Board of County Commissioners are hereby authorized and directed to execute said agreement in the name and on behalf of said County.”

Mr. Earl Harris presented request for Railroad Crossing 4,262 feet southeastwardly from Railroad mile post 786 on Road 448 between Road 561 and U. S. 441 near where the T & G spur leaves the Seaboard Airline Track.

Motion by Commr. Bishop seconded by Commr. Simpson and carried, that the application for the railroad crossing be made when Milton Welder, the owner, desiring the crossing, deposits check for $400.00 in escrow for payment of costs.  (Letter and sketch referred to C. E. Duncan, Attorney for the Board.)

Mr. Duncan reported that he has contacted Hugh Hanna of the State Road Department re:  Change in right of way on Eustis Orange Avenue Extension – taking all of the right of way on one side of the road.  Mr. Hanna is to report back to Mr. Duncan after investigation of the matter.    Letter from State Road Department, Chairman William B. Killian, enclosing statements showing the status of Lake County Secondary Funds as of September 30, 1960 was read.  Mr. Cross said he will give each member of the Board a statement of the Secondary Funds.

It was brought to the attention of the Board of County Commissioners that the Plat of “Hilldale” which was approved on November 7th, should have been Villdale as there is already a Hilldale in Lake County; WHEREUPON, on motion of Commr. Simpson seconded by Commr. Bishop and carried, Clerk Owens was authorized to change the minutes of November 7th to read “Villdale Plat approved.”

At this time Mr. Goodson announced that Hodges Equipment Company is the low bidder on the tractors, therefore, he recommended acceptance of this bid.

Motion by Commr. Theus seconded by Commr. Cowart and carried that the Alternate Bid No. 1 in the amount of $6,645.50 each or a total of $13,291.00 of Hodges Equipment Company be accepted.

Mr. Bishop reported that Mrs. Cassady who lives on the far side of Lake Tavares talked to him about improving the road on that side of the Lake.  No action taken.

Mr. Duncan filed the following instruments for record:

Quit Claim Deed – between State of Florida, by and through its component Agency State Road Department of Florida and Lake County, a political subdivision.

Mr. Duncan stated he has a survey prepared by Tom Sawyer showing Lot 15 Avalon Subdivision title will have to be cleared.   Therefore, the deed from Lake County to Minute Maid was not filed for record.

Motion by Commr. Theus seconded by Commr. Bishop and carried, that the Attorney for the Board be instructed to bring suit to quiet the title on Lot 15 Avalon Subdivision.

Copy of Resolution from Volusia County requesting that the 1961 Annual Meeting of the State Association of County Commissioners be held in Daytona was read by Chairman Cross.  (Resolution not filed) No action was taken on this as it will be taken up at the meeting this week in Lakeland.

The Certificate of County Canvassers for the General Election was filed.

Section 1109-106 SR 19

Map on Section 1109-106 SR 19 from Dream Boat Corner to U. S. 441 in Tavares was presented to the Board with letter from State Road Department rest of center line maps.

Motion by Commr. Bishop seconded by Commr. Theus and carried, that the Lake Abstract and Guaranty Company be requested to make title search on Section 1109-106 SR 19 from Dream Boat Corner to U. S. 441, subject to obtaining from State Road Department rest of center line maps.

Mr. Bishop read a letter from State Road Depatment in part as follows – “Upon receipt of funds to pay, the work will start.”  This was in reply to a Resolution adopted on October 3, 1960 requesting installation of a culvert under SR 50.  Mr. Hanna stated the State Road Department found the old culvert and cleaned it out and it is OK now.  Mr. Goodson also said it is OK.  Therefore, at present no funds will be collected by Mr. Oswalt.

BOARD ADJOURNED FOR LUNCH AND RECONVENED AT 1:30 P.M.

Mr. Goodson reported to the Board that St. Lucie Paper Company called him and requested that he serve as engineer for drainage district as required by law since unretired bond holders had forced reactivation of the district which had been inactivated for some time. He said he will not have any particular duties to perform, but since the law requires the appointment of an engineer, he is willing to accept the appointment provided the County Commissioners approve this appointment.  Mr. Cross said as long as it does not interfere with County duties, think it is all right and suggest that the Board give Mr. Goodson this authority.   No vote was taken on this suggestion.

Roy Christopher and Mr. Broadcheck appeared before the Board re a road in Section 26-19-27.  Mr. Christopher stated they have checked the records and find the County has no deed to the property in question.   Mr. Broadcheck is willing to give the County a right of way for road going through his property if the County will give him some clay for a road going into his muck farm – would like to swap right of way for clay.  Mr. Simpson thinks this is a prescriptive road.  Would have to have some kind of instrument from Lykes Brothers to get in there.  Mr. Cross said he will help out with this road if can get some kind of release from Lykes Brothers.  Mr. Christopher said they would discuss this with Lykes Brothers.

Mr. Rhodes and Mr. Broadcheck presented another problem to the Board re their muck operation on Eustis Meadows.  The water is too high.  Impossible to farm.  Mr. Broadcheck said if you gentlemen can give us some cooperation on this, we will be glad to do what we can.  Mr. Cross said he thinks will have to put in another pipe, or another bridge.  Have had it cleaned out once, but it fills up again.

Kenny Pearce appeared before the Board and stated that the relief man for the Superintendent of the Juvenile Detention Home has been unable to come over on weekends for quite some time, therefore the Superintendent has had to work overtime on weekends.  Mr. Pearce asked if it is agreeable with the Board to allow the Superintendent overtime for the time the relief man was not here.  Motion by Commr. Theus seconded by Commr. Simpson and carried, that the Clerk be authorized to pay the Superintendent of the Juvenile Detention Home overtime for the time the relief man was absent.

Mr. Duncan was instructed to look up the law on appointments.

Mr. Simpson stated he wants to purchase a long wheel base truck on which to put his asphalt distributor as cannot turn the trailer around as well as can a truck.  Have looked around and found a Ford truck at the Eustis Motor Company that will do.  The price is $465.00.  Mr. Simpson was authorized to purchase the Ford truck from Eustis Motor Company the price of $465.00.

Mr. Simpson stated he needs a pickup truck for use by the Road Foreman.  Has a 19565 Ford truck to trade in.  Motion by Commr. Simpson seconded by Commr. Cowart and carried, that Clerk Owens be authorized to advertise for a pickup truck for District #4, with trade-in 1955 Ford truck.

Motion by Commr. Bishop seconded by Commr. Simpson and carried, that Clerk Owens be authorized to advertise for bids for a dump truck for District #3, with a 1954 Chevy dump truck trade in.

Mr. Goodson, Zoning Director, stated the Zoning Commission held a public hearing on November 10, 1960.  Mr. Goodson filed recommendations for changes in certain applications, WHEREUPON, on motion of Commr. Theus seconded by Comr. Cowart and carried, the following Resolution was adopted:

WHEREAS, the Lake County Zoning Commission did on the 10th day of November 1960, after due notice of hearing called for that purpose, review applications for changes and revisions of the zoning of certain areas in Lake County and did approve such changes as requested in the particular applications hereinafter set forth and the Board of County Commissioners of Lake County having reviewed said applications and recommendations of the Lake County Zoning Commission;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County Florida, that the Zoning Rules and Regulations of Lake County be altered and amended as they pertain to the following tracts of land to the classification following each description:

1.         Begin 1388 feet South and 219 feet west of the Northeast corner of the Northwest Quarter of the Northwest Quarter of Section 13, Township 19 South, Range 25 East, at a point on the South boundary of Haines Creek Road for a point of beginning.  From this point run South 190 feet more or less to Bell Lake.  Begin again at the point of beginning and run East along Haines Creek Road 252 feet, thence South 10 feet, thence East along Northern Avenue 198 feet to Vista Avenue, thence run South 300 feet, thence run West 235 feet more or less to Bell Lake, thence Westerly along the Lake 400 feet more or less to the first line of this description (said property being located approximately 1-1/2 miles North of US 441) now zoned and classified as R-1 (Residential), be reclassified, amended, changed and rezoned to Classification C-1 (Commercial).

2.         Blocks E, F, G, H and I, according to the Plat of Minnehaha Beach Subdivision, as recorded in Plat Book 8, page 48, public records of Lake County, Florida, now zoned and classified as R-1-A (Residential), be reclassified, amended, changed and rezoned to Classification R-1 (Residential).

3.         Begin at a point located 1156.5 feet West of the Northeast corner of the Southeast Quarter of the Southwest Quarter of Section 32, Township 18 South, Range 26 East, in Lake County, Florida, run thence South 1825 feet, more or less, to the shore of Lake Eustis, thence back to said point of beginning and run West 163.5 feet, more or less, to the Northwest corner of the Southeast Quarter of the Southwest Quarter of said section, thence South 1825 feet, more or less to the waters of Lake Eustis, thence in an Easterly direction along water of Lake Eustis 163.5 feet, more or less, to point intersecting the Eastern boundary of this described tract of land, AND ALSO BEGIN 163.5 feet East of the Northwest corner of the Southeast Quarter of the Southwest Quarter of Section 32, Township 18 South, Range 26 East, for a point of beginning, run thence East 182.6 feet, run thence South across the North line of Section 5, Township 19 South of Range 26 East, to the low water mark of Lake Eustis, run thence Easterly along the shore of Lake Eustis to intersect the first described North and South line, now zoned and classified as R-1 (Residential), be reclassified, amended, changed and rezoned by granting a variance to permit the use of said property as a trailer park or trailer village.

4.         Lots 2, 3, 19 and 20, LESS the South 185 feet of Lots 3, 19 and 20, in Fairview Subdivision, as appears upon Plat thereof recorded in Plat Book 5, page 14, public records of Lake County, Florida; ALSO the West 891.8 feet of Government Lot 7, South of the Atlantic Coast Line Railroad right of way in Section 26, Township 19 South, Range 26 East (located on  U. S. 441 between Tavares and Mount Dora) now zoned and classified as R-1-A (Residential), be reclassified, amended, changed and rezoned to Classification C-3 (Commercial).

5.         That part of the Northwest Quarter of the Southwest Quarter of Section 24, Township 19 South, Range 25 East, in Lake County, Florida, bounded and described as follows:  From the Northwest corner of the Southwest Quarter of the Northwest Quarter of said Section 24, run South 1733 feet, thence run East 440 feet to a point on the East line of the right of way of Haines Creek Road for the point of beginning for this description.  From said point of beginning run South along the East line of the right of way of Haines Creek Road 250 feet, thence run East 135 feet, thence run South 115 feet, thence run West 135 feet, thence run South 20 feet, thence run East 330 feet, thence run South 115 feet, thence run East and parallel with the South line of the Northwest Quarter of the Southwest Quarter, thence run North along the East line of said Northwest Quarter of Southwest Quarter 5600 feet, thence run West and parallel with the North line of the Southwest Quarter of the Northwest Quarter of said Section 24 to the point of beginning, now zoned an classified as R-1 (Residential), be reclassified, amended, changed and rezoned to Classification C-3 (Commercial).

Mr. Cross reported that the County Engineer’s car is about used up and he needs a new one.  WHEREUPON, on motion of Commr. Simpson seconded by Commr. Cowart and carried, Clerk Owens was authorized to advertise for bids for the purchase of a new car for the County Engineer.  Bids to be taken on December 12, 1960.

Clerk Owens was instructed to charge the bill for the Roller recently purchased to Districts No. 2 and No. 3.

Letter from Margaret Lafross, Member Mount Dora City Council, re:  The Board of County Commissioners taking whatever action is necessary to acquire access from new U.S. 441 to extension of 11th Avenue in Mount Dora.  Letter also stated that all necessary 80’ rights of way extending East on 11th Avenue from Unser Street to new highway 441, have been acquired by the City of Mount Dora.  WHEREUPON, on motion of Commr. Simpson seconded by Commr. Theus and carried, the following Resolution was adopted:

WHEREAS, the City of Mount Dora has requested that an additional entrance to State Road 500, Section 11010-2111, be provided, so that direct access can be made available to Eleventh Avenue in the City of Mount Dora extended to intersect the right of way of State Road 500;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the construction plans for State Road 500, Section 11010-2111, be amended, if necessary, to provide for an entrance and access to said Road, at, or in the vicinity of Station 1315 and 92, on the left side, for connection with Eleventh Avenue in the City of Mount Dora extended Easterly to the right of way of said State Road 500.

Mr. Cowart said that Road No. 33 from Okahumpka to Mascotte is making a “Y” and not coming into Mascotte.  He has talked to Mr. Green of the State Road Department and asked if there is any way they can work out .7 of a mile of road bringing No. 33 into Mascotte.  Mr. Green said they would work this out if any way possible.

Motion by Commr. Cowart seconded by Commr. Bishop and carried, that the following Resolution be adopted:

WHEREAS, the State Road Department of the State of Florida has entered into a Contract for the resurfacing of State Road 33 from Helena Run South through the vicinity of Mascotte, Florida; and

WHEREAS, the plans for resurfacing of said road failed to include approximately seven-tenths (.7) of a mile of said road extending from the center of the Town of Mascotte north to the by-pass of State Road 33, running to the East of the Town of Mascotte; and

WHEREAS, the said stretch of approximately .7 of a mile is in need of repair and is used more by the traveling public passing from the North and to the West than the other portion of said road;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the State Road Department be requested to extend the Contract for resurfacing State Road 33 to include the approximate .7 of a mile, extending from the center of Mascotte north to intersect the by-pass of State Road 33.

Report of Hunnicutt & Associates, Inc., dated November 9, 1960 reporting on progress of the Lake County Revaluation Project up to and including October 29, 1960, was filed with the Board.  Each Commissioner received a copy of this report.

Motion by Commr. Simpson seconded by Commr. Theus and carried, that the bill of Hunnicutt & Associates, Inc., for services rendered on Lake County Revaluation Project for work completed October 1 through October 29 in the amount of $47,298.82, less 20%  - $9,459.76 – making a total of $37,839.06 be approved for payment.
