MINUTES OF THE regular MEETING OF BOARD OF COUNTY COMMISSIONERS

The Board of County Commissioners met in regular session in the County Commissioners’ room in the Courthouse at Tavares on Monday January 13, 1961 at ten o’clock a.m. with the following present:   Chairman Theus, Commissioners Cowart, Dykes, Simpson, and Babb, Attorney Duncan; Clerk Owens; and County Engineer Goodson. 

The meeting was opened with prayer by Chairman Theus.

purchase of addressograph

Paul Reed, Tax Collector, appeared before the Board and advised the Commissioners that his addressograph is wearing out and he needs additional equipment as well have additional assessment this year because of assessment by Hunnicutt & Associates.  He asked for permission to purchase the addressograph equipment for the Tax Collector’s and Tax Assessor’s offices, they to pay for same from fees in their offices.  All the Board will have to do is advertise for bids and accept a bid if you see fit.  Cost will be around $7,900.00, WHEREUPON, on motion by Commr. Dykes seconded by Commr. Cowart and carried, the request of Paul Reed, Tax Collector, to purchase an addressograph machine to be used in the Tax Collector’s and Tax Assessor’s offices and paid for out of their offices was granted and Clerk Owens was authorized to advertise for bids for an addressograph machine, to be taken on March 6, 1961.

REQUEST TO OPEN ROAD IN LADY LAKE

A delegation from Lady Lake – namely Mrs. Louise Reaves, Mayor, W. T. Adams and Ernest Zabor of the Town Council – appeared before the Board, requesting that the Board open a public road that has been closed by Irving Richardson.  The road has been open and in use for more than 30 years.  Richardson has plowed up the road and placed barricades across it.  Mr. Theus stated the road is in the city limits of Lady Lake and the County has maintained it for years.  Irving has taken the attitude that because he owns property on both sides of the road that he has a right to close it.  Mr. Duncan suggested that the City Council request the Board to keep the road open.  Mrs. Reaves stated she has two members of the City Commission with her now.  She was advised to have a Resolution drawn up requesting the Board to have the road opened and keep it opened.

Several parties present testified re:  the road – West Extension of Griffin View Road, located in the Town of Lady Lake, Lake County as follows:

Mrs. Reaves stated the road has been opened for more than 20 years of her own personal knowledge.

W. T. Adams also stated he has known the road to be opened for more than 20 years.  Several colored people and two white people in that neighborhood use the road.

Clyde Hardrick stated this road that goes by Irving Richardson’s house; I have known the road all my life for more than 20 years and it has been opened for more than 20 years.

Mathew Golden stated he came to Lake County in 1922.  Came to Leesburg then and went to Lady Lake to work for Harvey Brothers and that road was opened then and has been opened continuously and in use until recently when it was closed.  This road is essential to my mother-in-law’s place and is essential to place where I am living.

Mr. Duncan stated the next move would be the adoption of a Resolution by the Town of Lady Lake that the County cooperate with the Town that the road be kept opened.

Before the Board recessed for lunch the Town of Lady Lake sent in a Resolution requesting that the County cooperate with the Town of Lady Lake in having the road opened and keeping it opened, WHEREUPON, on motion of Commr. Simpson seconded by Commr. Babb and carried, the following Resolution was adopted:

WHEREAS, it has been brought to the attention of the Board of County Commissioners that Griffin Road, extending westerly from the Town of Lady Lake, has been opened and used by the public for more than twenty (20) years; that from time to time the County Commissioners have repaired the road and performed certain services in the maintenance thereof; and

WHEREAS, it has further been brought to the attention of the Board of County Commissioners that an adjoining property owner has erected obstructions in the highway making it impossible for residents in that area and those usually using the road to travel the same and to have proper access to their properties; and

WHEREAS, the Town Council of the Town of Lady Lake has adopted a Resolution requesting the Board of County Commissioners to join and assist them in keeping said road open for the use of the traveling public.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the road known as Griffin Road west extending in a westerly direction from State Road 500 (U.S. 441) is recognized as a public road and that the public has acquired a prescriptive right to use the same.

BE IT FURTHER RESOLVED that the Sheriff of Lake County be, and he is hereby instructed to remove any obstructions in said road, and to keep the same open for the use of the traveling public; and to further enjoin any and all persons attempting to obstruct the same to refrain therefrom.

Motion by Commr. Babb seconded by Commr. Dykes and carried, that the bill of Walter G. White for furnishing Lake County (D-2) on January 6, 1961 galvanized pipe coated in amount of $107.12 be corrected to read in the amount of $89.44, being the contract price Lake County has with Tri-State for this size pipe – and that the bill for said amount of $89.44 be approved for payment.

Motion by Commr. Dykes seconded by Commr. Simpson and carried, the following Resolution was adopted:

WHEREAS, because of the excessive high waters in the lakes and ponds and rivers in Lake County, and the resulting damage to adjoining properties, emergency situations arose wherein it was impossible to advertise for bids for the purchase of culverts and other pipes necessary for the removal of excess waters; and

WHEREAS, an emergency arose in District 2 wherein it was necessary to acquire pipe immediately to carry off such excess waters and the nearest and most immediate source was Walter G. White of Leesburg, Florida.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners that the bill of Walter G. White, in the sum of $107.12 for culvert, as listed in the attached statement, be corrected to read in the sum of $89.44, the contract price with Armco Drainage Metal Products, Inc., and that the sum of $89.44 be approved for payment under an emergency basis.

Motion by Commr. Simpson seconded by Commr. Dykes and carried, that the Chairman and Clerk be authorized to execute the Contract with L. T. Brennand, Inc., for raising and completely removing from the Courthouse block the “Home Demonstration Building” originally “Old Jail for Lake County.”

Clerk Owens read a letter from State Road Department re Drainage on property of W. B. & E. P. Hayter.  Mr. Duncan stated there is nothing for the Board to do, but at such time as the property is to be developed, the Board might have to take action.  (Bucky Harrell was present when this letter was read.)

H. B. (Bucky) Harrell, Jr., appeared before the Board re:  Street in Lake Griffin Park Subdivision – continuation of Third Street extending east to a clay road which connects with SR 500.  He presented a Quit Claim Deed from David M. Newell and wife to Lake County conveying 40 feet for right of way purposes.  Mr. Duncan stated the Board could accept this as a hardship case.  Practically all the lots have been sold prior to April 1956.

Motion by Commr. Dykes seconded by Commr. Babb and carried that the Quit Claim Deed from David M. Newell and wife to Lake County for right of way purposes be accepted and recorded.

INVOICE OF C. E. DUNCAN

Bill of C. E. Duncan for steno assistance for January and a trip to Tallahassee on County business in amount of $385.00 was approved for payment on motion of Commr. Simpson seconded by Commr. Cowart and carried.

TO THE HONORABLE BOARD OF COUNTY COMMISSIONERS OF LAKE COUNTY, FLORIDA:

 

Your Petitioners, James L. Brown, Vern G. Van Selus and Vera M. Van Selus; Euclid Parker and Grace Parker; Ilas Weston and sons Ronald Parker and Dennis Parker, the owners of all the property adjoining the public road hereinafter described, hereby respectfully request and petition that the Board of County Commissioners of Lake County, Florida, renounce, quit-claim and disclaim any right, title or interest of the County of Lake and of the public in and to the following described road, located within the limits of Pitman, an unincorporated town, said road being more particularly described as follows:

That certain public road located on the Westerly half of the former right-of-way of the Atlantic Coast Line Railroad commencing at the North boundary of Block 25, according to the Plat of Pittman, extended across the former railroad right-of-way and extending Southerly along the Westerly portion of said railroad right-of-way to the Southerly boundary of Block 28 of said Plat of Pitman, extended Easterly, except that portion of said road included in “Thomas Avenue” according to the Plat of Pittman.

 

And, in support of said Petition, Petitioners respectfully show:

 

1.     That your Petitioners are the owners of all the lands adjoining, abutting, and affected by the road hereinafter described.

2.     That said road is not included within any incorporated municipality of Lake County, Florida.

3.     That said road is not a part of any County, State, or Federal Highway.

4.     That said road continues along the Westerly portion of the right-of-way of the Atlantic Coast Line Railroad, as the railroad formerly existed and is not platted as a street.

5.     That the closing of said road will not interfere with the road system, and will not deprive any person owning property near or adjacent to said road of any means of ingress or egress to any existing public highway.

6.     That your Petitioners have published a Notice of Intention to apply to the Board of County Commissioners to close said road in the Tavares Lake County Citizen, a newspaper of general circulation, published in Lake County, Florida, as required by law for the closing of streets, roads and avenue and presents with this Petition a Proof of Publication of said Notice.

WHEREUPON, on motion of Commr. Babb seconded by Commr. Dykes and carried, the following Resolution was adopted:

WHEREAS, Vera M. Van Selus, James L. Brown, Mrs. James L. Brown, Euclid Parker, Grace Parker, Vern G. Van Selus, Ilas Weston, Dennis S. Parker and Ronald Parker, the owners of the lands abutting the following described road have presented to the Board of County Commissioners of Lake County, Florida, a Petition to Close said road as particularly described in the Petition for Closing Platted Road filed with the Board of County Commissioners and the Notice of Intention to Close Platted Road, proof of publication of which has been filed with the Board of County Commissioner’s; said road being located in Lake County, Florida, and more particularly described as follows:

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the public road hereinbefore particularly described, located within the subdivision known as “Pittman,” be henceforth closed, abandoned, discontinued and vacated; and that the Board of County Commissioners  acting for Lake County and the public, does hereby renounce and disclaim any right, title or interest in and to said public road; and that the title to said public road be vested in the adjoining property owners in accordance with law.

E. B. Thompson, Eustis, having declined to furnish three dozen bedspreads at the price quoted unless all items quoted were accepted, motion was made by Commr. Dykes seconded by Commr. Babb and unanimously carried, that Engineer Goodson be authorized to purchase three dozen bedspreads from the next lowest bidder; and work with the Soroptimist Club of Leesburg re getting drapes to match the bedspreads.

Mr. Duncan stated he has heard no more from his party re moving this house.  The Board agreed that the County Engineer should be authorized to get everything out of the house they can for salvage before wrecking the house.  Motion by Commr. Dykes seconded by Commr. Babb and carried, that Engineer Goodson be instructed to go ahead and salvage whatever he can from the house and turn the house over to the man to demolish; and that Mr. Duncan and Mr. Goodson proceed with whatever is necessary to get the house off the right of way as the contractors are ready to start work on the road.

Representative Bill Reedy appeared before the Board re:  Meeting in Tampa tomorrow of the Steering Committee of the Southwest Florida Water Management District, WHEREUPON, on motion of Commr. Simpson seconded by Commr. Dykes and carried, Representative Reedy and County Engineer Goodson were authorized to attend the meeting in Tampa tomorrow and that the expenses be defrayed by the Board of County Commissioners.

Clerk Owens advised the Board that a date for designating road requests to be submitted to the State Road Department should be set, WHEREUPON, the Board agreed to meet Tuesday, February 28, at ten o’clock a.m. for this purpose.  Clerk Owens was instructed to notify the various cities of the meeting, also call the Board members the day before the meeting.

Clerk Owens advised the Board that the County Finance Officers Association of the State of Florida is having a meeting in Tampa at the Tampa Terrace Hotel on March 2 and 3, 1961, and if it meets with the Boards’ approval he would like to take the three girls working for the Board – Mrs. Robertson, Mrs. Babb and Dona Babb.  Motion by Commr. Cowart seconded by Commr. Babb and carried, that Clerk Owens be authorized to attend the meeting of the County Finance Officers’ Association in Tampa and take the three clerks with him.

Tom Sawyer, representing J. E. Fretwell and wife, appeared before the Board and presented a Partial Replat of Crescent Cove, together with letter from Lake County Health Department stating “Based on survey of the Orange State Engineers, Inc. report on Crescent Cove (first addition - copy of report attached) located north of Picciola Road and west of Lake Unity Road, we are accepting their recommendations on this property for septic tank installation under normal operating conditions.”  Also Opinion of Title of John F. Cherry, Attorney, was filed.  Mr. Duncan stated “Shown on the map is Fretwell Road, which is a part of the road which runs off of Picciola road to Lake Unity Road.”  Due to the fact that this is a dedication of the Fretwell Road, that particular deed should be withdrawn before filing.  File the other deeds.  The other deeds were filed after withdrawing the one referred to.  Motion by Commr. Dykes seconded by Commr. Simpson and carried, that the Plat of Crescent Cove First Addition be accepted and approved.

Tom Sawyer representing Howard Bozeman presented this Plat together with Opinion of Title by P. B. Howell, Jr. and letter from Lake County Health Department stating “Based on survey of Orange State Engineer Inc. report (copy attached) we are accepting their recommendation on this property for septic tank installation under normal operating conditions.”  Mr. Duncan stated this subdivision connects with a paved road and he sees no reason why cannot be accepted, WHEREUPON, on motion of Commr. Babb seconded by Commr. Simpson and carried, the Plat of Cypress Haven Unit No. 2 was accepted and approved.

Tom Sawyer, representing BySel Corp, presented Plat of Park Heights Subdivision First Addition composed of 13 lots lying adjacent to U.S. 441 in the Town of Fruitland Park just South of Palm Avenue.  This Plat has been presented to the Town of Fruitland Park and accepted by them.  No roads being dedicated as all previously dedicated in original Park Heights Plat.  Letter from Lake County Health Department stating “Based on survey of Orange State Engineers, Inc. report (copy attached) we are accepting their recommendations on this property for septic tank installation under normal operating conditions with the exception of Lot #62.  The septic tank and disposal field on Lot #62.  The septic tank and disposal field on Lot #62 is restricted to the north half of said lot.  Lawyers Title Insurance Corp as follows:  “No transactions recorded on this property since the date of the policy.”  Mr. Duncan stated in view of the fact that we have no jurisdiction in the cities, we will have to accept the Plat; WHEREUPON, on motion of Commr. Dykes seconded by Commr. Simpson and carried, the Plat of Park Heights First Addition was accepted and approved.

Howell Hopson, Architect, and Joe Jenkins, Superintendent of Public Instruction, appealed before the Board re this drainage.  After discussion of the problem it was agreed to go look the situation over at noon today.

sewage disposal plant

Howell Hopson, Architect, presented final request of L. T. Brennand, Inc., in the amount of $4,542.96.  The Board requested Mr. Hopson to get releases of liens before the County would accept this.  WHEREUPON, on motion of Commr. Dykes seconded by Commr. Babb and carried, the final request of L. T. Brennand, Inc., as presented by Mr. Hopson, was approved subject to acquiring release of all liens.

The meeting adjourned for lunch and reconvened at 2:30 p.m.

agricultural center

The Committee on the Agricultural Center – Don Kemp, Chairman; R. E. Norris, Dave Lunsford, Gilford Sims, Lacey Thomas, Douglas Igou, and Robert Ford, Architect appeared before the Board and made the following recommendations.

“We wish to recommend that the enabling act be extended for one year in amount as necessary to provide funds for completion of all planned structures and furnishings.  We further recommend that the Act provide for borrowing against anticipated revenue so the job may be completed at the earliest possible date.”

Don Kemp stated the Committee has had a meeting and has decided we will need the following:

            $70,000.00 to complete the building

            $18,000.00 for additional furniture

            $  5,000.00 for landscaping and paving around the building

            $  5,000.00 Architect’s fees

            $98,000.00 Total

We understand that we have over committed ourselves approximately $10,000.  Should collect approximately $65,000.00 from taxes in November, but will need additional money in amount of $43,000.00. 

Discussion on Millage – Mr. Duncan stated it is obvious that the bill will have to be amended.  Mr. Theus asked if Mr. Duncan would get with the Committee and work this out prior to meeting on the 20th.  The Board agreed that should go ahead with this and finish the building.  WHEREUPON, on motion of Commr. Dykes seconded by Commr. Babb and carried, Attorney Duncan was instructed to draw up a bill to submit to the Legislative Delegation that the Agricultural Center be finished in accordance with the original plans.

Copy of letter from Robert V. Ford, Architect, to Gregg, Contractor, re Ag. Center was read and filed.

Certificate of payment No. 2 Agricultural Center, Lake County, Architect’s Order Number L2-66, dated February 9, 195`, in amount of $9,482.85, approved by Robert V. Ford, Architect, was presented to the Board, WHEREUPON, on motion of Commr. Cowart seconded by Commr. Babb and carried, the 2nd Estimate of contractors Gregg, Gibson and Gregg, as approved by Robert V. Ford, Architect, on the Agricultural Center in the amount of $9,482.85 was approved for payment.

Three members of the Zoning Committee, namely Mr. French, Mr. Amory and Mr. Gardner, appeared before the Board and presented copies of a Bill to be presented to the Legislative Delegation on the 17th of February.  Mr. Goodson stated that Fred H. Bair of Auburndale prepared the bill and the cost of preparing same would be approximately $500.

Motion by Commr. Simpson seconded by Commr. Dykes and carried, that C. E. Duncan, Attorney for the Board, be instructed to check the Bill and get it in shape to be presented to the Legislative Delegation on or before the 17th of February and that the bill of Mr. Bair for preparing the bill be paid when presented.

A letter from Lake County Fair Association requesting $2,000.00 appropriation as set up in the budget this year for work by the Fair Assn. was read by Clerk Owens.  WHEREUPON, on motion of Commr. Dykes seconded by Commr. Babb and carried, Clerk Owens was instructed to pay to the Lake County Fair Association $2,000.00 as set up in the budget for work by the Fair Association.

Discussion on amending the law where the Commissioners would in the future prepare the budget for the Fair Association and Chamber of Commerce.

Motion by Commr. Simpson seconded by Commr. Dykes and carried, that C. E. Duncan, attorney for the Board, be instructed to prepare a bill so that it is possible for the Chamber of Commerce and the Fair Association to request money as needed to pay the bills, by Resolution to the Board of County Commissioners.

Clerk Owens was instructed to make reservations for six rooms at the Duval Hotel in Tallahassee for the Annual Mid-Year Conference of the State Association of the County Commissioners for March 12, 13, and 14, 1961.

Clerk Owens was instructed to send to Mr. Max Brewer, Road Board Member Fifth District, Titusville, a copy of the Resolution adopted last week re:  R/W on SR 44 East of Eustis, and Mr. Duncan was instructed to call Mr. Brewer and see if he will come over and meet with the members of the Board to look over this situation.

Mr. Duncan reported he has a deed from W. H. Sapp and wife Annie Sapp to Lake County for 66 foot right of way off of Griffin Road running north to the next County road north.  They want $600.00 for the right of way.  However, the Leesburg Development Company paid him the $600.00.  We paid him nothing.  Two more deeds to come in probably tomorrow.  Galion and Ray J. Newell.

Motion by Commr. Dykes seconded by Commr. Babb and carried, that the deed referred to above for the right of way be accepted if the title is clear and that Mr. Duncan be instructed to check the title.

eustis vocational school drainage

Mr. Duncan reported that the Board did visit the site northeast of Eustis and the ditch in question is partly located on the school property and partly on Roger Getford’s property.  Getford agreed to grant to the County an easement for drainage purposes going out from line located northwest of the school property and extending in a northwesterly direction to Trout Lake.  The drainage easement to be approximately 30 feet in width.  Mr. Getford said that both he and the individual who owns the adjoining property, he felt, would cooperate with us.  Whereupon, on motion of Commr. Simpson seconded by Commr. Babb and carried, Tom Sawyer, Surveyor, was requested to make a survey and prepare the center line as described on the site today, following the natural drainage line.

request for salary increase

Mr. Goodson, County Engineer, reported to the Board that he would like to raise the salary of his secretary – Robert Webb – to $400.00 per month.  Motion by Commr. Dykes seconded by Commr. Babb and carried, that the request of Mr. Goodson, County Engineer, to raise the salary of his secretary – Robert Webb – to $400.00 per month be granted; and Clerk Owens be authorized to transfer from the contingency item in the General Revenue Fund the sum of $200.00 to Item 411-2 – salary Clerk to County Engineer – to take care of the increase.

Cowart and carried, that Clerk Owens be instructed to transfer $4,975.00 from Contingency Item in the Road and Bridge Fund to Item 411  Supervisory Salaries – Road Foremen – to cover increase of $25.00 per month for five regular Foremen from November 1, 1960 through September 30, 1961.  Also, that Clerk Owens be instructed to transfer $500.00 from the Contingency Item in the Road and Bridge Fund to Item 411-1 – Traveling Expense, to cover the expense of the Countywide Foreman, for said period as designated above.

Clerk Owens read a request from South Lake Memorial Hospital for $18,000.00 – partial repayment of construction of loan on Hospital Plant.  WHEREUPON, on motion of Commr. Babb seconded by Commr. Simpson and carried, the request of South Lake Memorial Hospital was approved as above.

summerall park restrooms

Clerk Owens read a letter from the City of Tavares re toilet facilities in Summerall Park.  Motion by Commr. Babb seconded by Commr. Dykes and carried, that Clerk Owens be instructed to notify the City of Tavares that furnishing of necessary supplies for the operation of the restrooms in Summerall Park would be the responsibility of the City of Tavares, as well as keeping the restrooms clean and the overall supervision of same.

Clerk Owens read a request from Small Claims Court for a counter in its office, with estimate of Coven Construction Company in amount of $78.87 to make the counter, WHEREUPON, ON MOTION OF Commr. Dykes seconded by Commr. Babb and carried, the request of the Small Claims Court to have Coven Construction Company make a counter for its office at a cost of $78.87 was approved.

Motion by Commr. Dykes seconded by Commr. Babb and carried, that the action of the Chairman and Clerk in approving the application of Coy Leon Strickland for admittance to the T. B. Hospital be approved.

Letter from State Road Department enclosing statements showing the status of Lake County Secondary Funds was read and discussed.  Mr. Goodson suggested that an underpass be built on an emergency basis out of Primary money at the intersection of Roads 19 and 27.

WHEREAS, the Lake County Zoning Commission did, on the 12th day of January A.D. 1961, after due notice of hearing called for that purpose, review applications for changes and revisions in the zoning of certain areas in Lake County and did approve such changes as requested in the particular applications hereinafter set forth; and the Board of County Commissioners of Lake County having reviewed said applications and recommendations of Lake County Zoning Commission;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the Zoning Rules and Regulations and classifications of Lake County be altered and amended as they pertain to the following tracts of land to the classification following each description.
