MINUTES OF adjourned MEETING OF BOARD OF COUNTY COMMISSIONERS

 thursday april 13, 1961

The Board of County Commissioners met in adjourned session in the County Commissioners room in the Courthouse at Tavares on Thursday, April 13, 1961 at 1:30 p.m.,  for the purpose of receiving bids for the construction of the Lake County Jail and Sheriff’s Department, Tavares, Florida, and also for receiving bids for the sale of $1,250,000 Lake County, Florida Certificates of Indebtedness and such other matters as may be brought before the Board, with the following present:  Vice Chairman J. C. Cowart; Commissioners Herman T. Dykes, O. M. Simpson, and Herbert A. Babb; also Attorney C. E. Duncan, Clerk Frank E. Owens, and County Engineer Charles P. Goodson.  (Chairman C. Theus was absent.)

In the absence of Chairman Theus, Vice Chairman Cowart presided and called the Board to order.

homestead exemption for minnie campbell

Harry Gaylord, Attorney, having been requested to appear before the Board re:  the homestead exemption for Minnie Campbell, an aged Negro woman in Eustis, did appear in her behalf and stated that when she deeded her property to her son, she had intended to retain a life interest in the property, but through error this was omitted.  The 1960 tax statement was sent to her son, Sam D. Brown.  Mr. Gaylord stated he has talked to Mr. Cassady, Tax Assessor, about this, and he said if the Board of County Commissioners will authorize him to do so, he will cancel the taxes for 1960.  Mr. Gaylord asked that the County Commissioners authorize the Tax Assessor to cancel the 1960 taxes.  Mr. Duncan suggested that Mr. Gaylord prepare the proper statement in order that the Board may have it on file before making the request for cancelation of 1960 taxes.

Sam Cook, representing Hunnicutt & Associates again appeared before the Board re:  the Board releasing one half of the 10% retainer fee on the contract with Hunnicutt & Associates.  Mr. Duncan said the Board could adopt a motion to the effect that the Clerk be authorized to issue a warrant for one half of the payment being held against the completion of Hunnicutt’s contract with Lake County upon receipt of a performance bond submitted by Hunnicutt; WHEREUPON, on a motion by Commr. Dykes, seconded by Commr. Simpson and carried, Clerk Owens was authorized to issue a warrant to Hunnicutt & Associates for one half of the 10% retainer fee on the contract, upon presentation of the proper performance bond and that the contract be amended.

Commr. Babb presented a letter from Margaret E. Wilson re: selling beer, etc. on Sunday.  Clerk Owens was instructed to send her a copy of the resolution disallowing sale on Sunday.

oklawaha basin authority resolution

Mr. Owens advised the Board that the Oklawaha Basin Authority adopted a resolution yesterday requesting that Lake County be amended out of the creation of the Southwest Florida Water Management District.  A copy of the resolution was read and also a statement that is to be published in the papers.

The hour of 2:00 p.m. having arrived and notice to bidders having been published that bids would be received at said hour for the construction of the Lake County Jail and Sheriff’s Department, Tavares, Florida, Mr. Hopson, Architect, announced bids are now closed.  Clerk Owens read the legal notice, and the following bids were opened and read by Mr. Hopson:

Mr. Hopson thanked the bidders present and stated it is not our intention to award the contract this afternoon.  The County Engineer will take the bids under advisement, with the assistance of Sheriff McCall and myself.  The Board should have a meeting sometime next week to receive our recommendations.

On a motion by Commr. Simpson, seconded by Commr. Babb and carried, the bids as above set forth were taken under advisement, and the Board would meet in adjourned session at ten o’clock a.m. Wednesday, April 19, to receive the recommendations of the Architect, the Sheriff, and the County Engineer on the bids for the construction of the Lake County Jail and Sheriff’s Department.

certificates of indebtedness

The hour of 3:00 p.m. having arrived, the Chairman requested the Clerk to read the Notice to Bidders to purchase certificates of indebtedness published in the Leesburg Daily Commercial in Leesburg, Lake County, Florida, and in the Bond Buyer in the City of New York and the various weekly papers published in Lake County.

THEREUPON, the Clerk read the Notice to Bidders for the purchase of $1,250,000 in Certificates of Indebtedness, the proceeds of which are to be used in the construction of a jail and the repair and alteration of the Courthouse in Tavares, Florida.

Before reading the Notice, the Clerk presented a proof of publication, showing that said Notice had been published in the Leesburg Daily Commercial on the 10th, 17th, 24th, and 31st of March 1961 and also presented for filing the proof of publication of said Notice in the Bond Buyer in New York and other papers in Lake County.  The Clerk then read the Notice appearing in said proofs of publication.

The Clerk announced that there were eight bids submitted and proceeded to open and read the bids.

After the bids had been read and tabulated, the following Resolution was made by Commr. Herman T. Dykes and seconded by Commr. Herbert A. Babb:

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF LAKE COUNTY, FLORIDA, AWARDING $1,250,000 CERTIFICATES OF INDEBTEDNESS OF THE COUNTY OF LAKE, FLORIDA

WHEREAS, pursuant to notice heretofore duly published for the sale of $1,250,000 Certificates of Indebtedness of the County of Lake, Florida, dated October 1, 1960, the following sealed proposals have been received:

The proposal of Solomon Bros. and Hutzler and Associates offering to pay the sum of One Million Two Hundred Fifty-two Thousand, Six Hundred Thirty-one Dollars ($1,250,631), together with accrued interest from April 1, 1961 to the date of delivery thereof for said Certificates bearing interest at the rate of Three and Ten One Hundredths per centum (3.10%) per annum on the Certificates maturing in the year 1961 to 1970, inclusive, being a net interest cost of $229,249.00.

The proposal of Merrill Lynch, Pierce, Fenner & Smith Incorporated and Associates offering to pay the sum of One Million Two Hundred Fifty Thousand Dollars ($1,250,000) together with accrued interest from April 1, 1961 to the date of delivery thereof for said Certificates bearing interest at the rate of Four per centum (4%) per annum on the Certificates maturing in the years 1961 to 1963, inclusive, at the rate of Three and Twenty-five One Hundredths per centum (3.25%) per annum on the Certificates maturing in the year 1964, and at the rate of Three per centum (3%) per annum on the Certificates maturing in the years 1964 to 1970, inclusive, being a net interest cost of $228,156.25.

The proposal of James F. Magurno & Company offering to pay the sum of One Million Two Hundred Fifty Thousand Two Hundred Fifty Dollars ($1,250,250), together with accrued interest from April 1, 1961 to the date of delivery thereof for said Certificates bearing interest at the rate of six per centum (6.00%) per annum on the Certificates maturing in the years 1961 and 1962 at the rate of three per centum (3.00%) per annum on the Certificates maturing in the years 1963 to 1970, inclusive, being a net interest cost of $227,375.

The proposal of Goodbody & Company and Associates offering to pay the sum of One Million Two Hundred Fifty Thousand Dollars ($1,250,000), together with accrued interest from April 1, 1961 to the date of delivery thereof for said Certificates bearing interest at the rate of Two and Seventy–five One Hundredths per centum (2.75%) per annum on the Certificates maturing in the years 1961 to 1965, inclusive, and at the rate of Two and Ninety One Hundredths per centum (2.90%) per annum on the Certificates maturing in the year 1966 and at the rate of three per centum (3.00%) per annum on the Certificates maturing in the years 1967 to 1970, inclusive, being a net interest cost of $220,118.75.

The proposal of B. J. Van Ingen & Company and Associates offering to pay the sum of One Million Two Hundred Fifty Thousand ($1,250,000) together with accrued interest from April 1, 1961 to the date of delivery thereof for said Certificates bearing interest at the rate of four per centum (4.00%) per annum on the Certificates maturing in the years 1961 and 1962 at the rate of Two and Ninety One Hundredths per centum (2.90%) per annum on the Certificates maturing in the years 1963 to 1968, inclusive, and at the rate of three per centum (3.00%) per annum on the Certificates maturing in the years 1961 and 1970, being a net interest cost of $221,167.50.

The proposal of White, Weld & Co., Manager, and Associates offering to pay the sum of One Million Two Hundred Fifty Thousand Five Hundred Dollars ($1,250,500) together with accrued interest from April 1, 1961 to the date of delivery thereof for said Certificates bearing interest at the rate of Three and Ten One Hundredths per centum (3.10%) per annum on the Certificates maturing in the years 1961 to 1966, inclusive, at the rate of Two and Ninety One Hundredths per centum (2.90%) per annum on the Certificates maturing in the year 1967 and at the rate of three and ten one hundredths per centum (3.10%) per annum on the certificates maturing in the years 1968 to 1970, inclusive, being a net interest cost of $229,365.

The proposal of John Nuveem & Co, Inc. and Associates offering to pay the sum of One Million Two Hundred Fifty Thousand One Hundred Ninety-seven Dollars ($1,250,197), together with accrued interest from April 1, 1961 to the date of delivery thereof for said Certificates bearing interest at the rate of two and seventy-five one hundredths per centum (2.75%) per annum on the Certificates in the years 1961 to 1964, inclusive, at the rate of three per centum (3.00%) per annum on the Certificates maturing in the years 1965 to 1970, inclusive, being a net interest cost of $222,378.

The proposal of IRA HAUP & Co. offering to pay the sum of One Million Two Hundred Fifty Thousand Six Hundred Forty-eight Dollars ($1,250,648), together with accrued interest from April 1, 1961 to the date of delivery thereof for said Certificates bearing interest at the rate of three per centum (3.00%) per annum on the Certificates maturing in the years 1961 to 1970, inclusive, being a net interest cost of $223,752.

WHEREAS, the proposal of Goodbody & Company and Associates referred to in the preambles hereof is the highest and most advantageous of said bids and in all other respects complies with said notice of sale; now, therefore,

BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF LAKE COUNTY, FLORIDA:

Section 1.  That the proposal of Goodbody & Company and Associates referred to in the preambles hereof, be, and the same is hereby accepted, and the following described Certificates of the County of Lake, Florida, be and they are hereby awarded and sold to the said purchaser referred to in the preambles hereof:

$1,250,000 – CERTIFICATES OF INDEBTEDNESS, dated October 1, 1960 numbered 1 to 1,250, inclusive, in the denomination of $1,000 each, bearing interest (payable semi-annually on April 1 and October 1 in each year) and maturing on October 1 in the years and amounts as follows:

Section 2.  That the proper officers of the County be, and they are hereby authorized and directed to execute said Certificates when prepared and to deliver the same to said purchaser upon payment of the purchase price pursuant to the conditions stated in the notice of sale without further authority from this Board.

Section 3.  That the Chairman of this Board be and he is hereby authorized and directed to return forthwith the good faith checks of all unsuccessful bidders.

Section 4.  This resolution shall take effect immediately.

The foregoing resolution was unanimously carried.

 

On a motion by Commr. Dykes, seconded by Commr. Babb and carried, the meeting adjourned to 10:00 o’clock a.m. Wednesday, April 19, 1961.
