MINUTES OF THE REGULAR MEETING OF BOARD OF COUNTY COMMISSIONERS

 on MONDay – OCTOBER 2, 1961

The Board of County Commissioners met in special session in the County Commissioners’ room in the Courthouse at Tavares on Monday, October 2nd, at ten  o’clock a.m., with the following present:  Chairman Theus, Commissioners Cowart, Dykes, Simpson and Babb; Attorney Duncan and Clerk Owens. 

The meeting was called to order with prayer by Chairman Theus.

Mr. Lahmann appeared before the Board re this matter and stated that the Chairman of the Commissioners is automatically the Chairman of Civil Defense, but we would also like to have a Vice-Chairman of Civil Defense as this would simplify the work.  Discussion on this request followed:  WHEREUPON, motion was made by Commr. Cowart seconded by Commr. Babb and carried, that O. M. Simpson be appointed Vice-Chairman of Civil Defense.

George Vance appeared before the Board re:  Bill in amount of $200.95 from Western Union for raising wires for railroad crossing near Mile Post 781 West of Tavares on Seaboard Air Line Railroad.  Letter was read from Seaboard requesting that the Board take care of this bill.  Mr. Owens announced he called Mr. Vane and he stated he thought when the people benefitting from the crossing come down probably in January he could collect for the bill, or at least within a reasonable time can pay, but not now, WHEREUPON, on motion of Commr. Babb seconded by Commr. Dykes and carried, the Clerk was authorized to pay this bill for raising the Western Union wires, and that the Board be reimbursed later by George Vance.  Mr. Duncan was instructed to contact the Western Union as to the amount of the bill as the Board thinks perhaps the bill may be for two crossings.  Therefore, Mr. Owens is to hold the bill until hear from Western Union.

Motion by Commr. Babb seconded by Commr. Cowart and carried, that the Chairman and Clerk be authorized to execute the Agreement with the changes as made by the Company on three pages.

sinclair avenue in tavares – agreement with seaboard air lines

This Agreement was referred to C. E. Duncan, County Attorney, re deleting certain paragraph.

John McQueen appeared before the Board re:  getting permission for bulldozing dirt out of a borrow pit East of his property.  The County owns land adjoining the pit.  Mr. McQueen wants to push up a dam to close off the borrow pit from the balance of the marsh for a fishery.  The Board advised him that the property belongs to Minute Maid, but the County is negotiating for same.  The County does not have authority at this time to grant this request.

Joe Graves, Lake Shore Drive, Bonnie Breeze, appeared before the Board again about the assessment on his property.  He stated he understands that the Board made no adjustment on his property assessment.  Was previously assessed at $5,500.00 and now at $16,500.00 – about 3 acres – 280 feet on the lake.  He read a Notice of Farm Bureau re:  Property Owners’ meeting in Leesburg in November.  Mr. Duncan advised Mr. Graves he could take the matter to Court.  Said he had no money to take it to Court.

Chas. Petteys appeared before the Board re: Assessment on his property.  Said he fully agreed with what Mr. Graves has said.  He has sold all his property but his home.  Lives on Lake Harris at Dead River Bridge.

Appraisal on “Market Value” on above by Edwin R. Waite, Emery Dillard and A. E. Mundy in amount of $115,432.00 was presented with bill for $800.00 each to Waite and Dillard and bill for $900.00 to Mundy.  WHEREUPON, on motion of Commr. Dykes seconded by Commr. Babb and carried, the appraisal was accepted and C. E. Duncan, County Attorney, authorized to forward the bills in triplicate to State Road Department for payment.

SECTION 11010 SR 500 – FROM SR 19 TO WEST CITY LIMITS OF TAVARES

Appraisal on “Market Value” on above by Edwin R. Waite, Emery Dillard and A. E. Mundy in amount of $74,215.00 was presented with bill for $600.00 each to Waite and Dillard, and bill for $800 to Mundy.  WHEREUPON, on motion of Commr. Dykes seconded by Commr. Babb and carried, the appraisal was accepted and C. E. Duncan, County Attorney authorized to forward the bills in triplicate to State Road Department for payment.

RIGHT OF WAY AGENT APPOINTED

Motion by Commr. Dykes seconded by Commr. Babb and carried, that Emery Dillard be appointed as right-of-way agent to purchase rights of way on Section 11090-502 SR 19 and Section 11010-2501 SR 500.

Section 11010-2501 SR 500 (Leesburg North By-Pass) filed with Board with bill in amount of $35.00, WHEREUPON, on motion of Commr. Simpson seconded by Commr. Babb and carried, C. E. Duncan, County Attorney, was instructed to mail the bill in triplicate to State Road Department for payment.  (Original and one copy of the report already mailed to SRD by Clerk.)

R. G. Breeden, Eustis, appeared before the Board re:  a subdivision he is trying to develop in Eustis.  He is having trouble with the right of way.  He presented a letter from City Manager of Eustis stating Mary Street is a 30-foot street and the City of Eustis maintains it as such.  Mr. Duncan stated Mary Street as far as he knows was there before the Plat Law was adopted and based on hardship case the plat could be accepted.  Mr. Breeden stated South Street in his section is 60-feet wide.  Mr. Breeden was advised that he should get a letter signed by all of the City officials of Eustis.  He should also write a letter to the Board that he will later build a road; the Plat should also be changed.  Need a letter from the Lake County Health Department and release of mortgage as to the streets.

Recommendations of the Zoning Department as follows were presented by Bob Webb:

1.     That henceforth a “quorum” of the Zoning & Planning Commission shall consist of one or more members of said commission from not less than 3 County Commissioners’ Districts.

2.     That a $15.00 fee be established to defray the expenses of applications for rezoning of properties in Lake County.  Such fee to be payable at time of application.

The above recommendations effective as of November 1, 1961.

WHEREUPON, on motion of Commr. Babb seconded by Commr. Simpson and carried, the following Resolution was adopted:

WHEREAS, it has been made to appear to the Board of County Commissioners that the business of the Zoning and Planning Commission is, from time to time, hampered by the failure of a majority of the duly appointed Members of the Commission to attend regularly called meetings; and

WHEREAS, the business of the Zoning Commission is increasing rather than decreasing and the necessity of holding legal meetings is becoming more and more important;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the number of Members of the Zoning Commission necessary for attendance to constitute a legal meeting, shall not be less than one Member from each of three of the County Commissioner Districts in Lake County; that the attendance of such quorum at any meeting shall henceforth be a legal meeting.

Motion by Commr. Babb seconded by Commr. Simpson and carried, the following Resolution was adopted:

BE IT RESOLVED by the Board of County Commissioners of Lake County, that from and after the adoption of this Resolution, a fee of Fifteen ($15.00) shall be paid by each Applicant for the rezoning of any properties in Lake County under the jurisdiction of the County Commissioners and that such application shall not be considered until the said fee is paid.

Motion by Commr. Babb seconded by Commr. Dykes and carried, the following Resolution was adopted:

WHEREAS, the attendance of Zoning and Planning Commission Meetings by various Members of said Commission, has been irregular and such irregularity has extended to the point that it is sometimes impossible to hold a legal meeting and thereby the business of the Zoning and Planning Commission is delayed;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the following policy and rule is hereby established:

In the event a Member of the Zoning and Planning Commissions shall be absent from three regular consecutive meetings of the Commission, such Member shall be requested to resign, and he shall be replaced.

Motion by Commr. Dykes seconded by Commr. Babb and carried, the following Resolution was adopted:

WHEREAS, the Members of the Zoning and Planning Commission of Lake County have heretofore served in such capacity without compensation; and it has been made to appear to the Board of County Commissioners that the business of said Commission is requiring more and more time of the Members of the Commission; and that such Members should be compensated for their expenses and mileage;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that from and after the adoption of this Resolution, each Member of the Zoning and Planning Commission of Lake County, shall be paid a per diem of $10.00 for each day in which the Members attend Meetings of the Commission, and shall be paid a mileage rate of 10¢ per mile each way for their expenses in transportation.

Bob Webb, Secretary of the Zoning Department, stated he asked Mr. Owens about using the County Engineer’s car and was advised to go ahead and use it.  Now would like to know what the Board suggests to do with the car.  Mr. Theus suggested that Bob use the car a few more weeks and that he be granted authority to have the car serviced.

Bob Webb stated that the Zoning Commission has been issuing permits for this kind of advertising, and asked what the Board wants him to do now.  Discussion was held on this matter.  Motion by Commr. Babb seconded by Commr. Simpson and carried, that until the Board employs a County Engineer that Bob Webb be authorized to issue permits for outdoor advertising.

Meeting adjourned at 12:00 o’clock noon for lunch.  Reconvened at 1:40 p.m.

Board called to order by Chairman Theus.

Mr. Theus announced that Mr. Charles N. Givens has applied for the job of County Engineer and the Board has interviewed him.  WHEREUPON, on motion of Commr. Dykes seconded by Commr. Babb and carried, Charles N. Givens of 3 Alabama Avenue, Merritt Island, Florida, was employed as County Engineer for Lake County beginning November 1, 1962, at an annual salary of $8,500.00; and that he be allowed to use the automobile previously used by County Engineer Goodson, at County expense.  Mr. Givens filed with the Board a letter stating his qualifications.

Application for the job as County Engineer and Zoning Director from C. W. McCauslin, Eustis, was read and filed.

Mr. Theus filed letter from Dura-Stress, Inc., Leesburg recommending Matt P. Cross for job as County Engineer.

Mr. French, Chairman of the Zoning Commission and Miss Reba Harris, Secretary, appeared before the Board and Miss Harris gave a report on attendance of the Members by Districts.  Mr. French inquired as to whether or not it comes within Zoning and Planning Commission to require the developer to maintain dedicated streets.  He was advised this is not within the jurisdiction of the Zoning and Planning Commission.

Motion by Commr. Simpson seconded by Commr. Dykes and carried, that all Plat owners be required to have a place for the signature of the Zoning Director.

Mr. French stated the Zoning Commission will have a meeting on October 16th at ten o’clock a.m. in the County Commissioners’ room in the Courthouse – re:  request for some variances re zoning in Silver Lake Estates.  Would like to have Mr. Duncan and any of the Commissioners who can come to be present.

advertise for purchasing trucks for districts 1, 2, 4 & 5

Motion by Commr. Simpson seconded by Commr. Dykes and carried, that Clerk Owens be authorized to advertise bids to be taken on November 13, 1961, for the purchase of the following:  Two trucks for District No. 1, with two trade-in trucks; Two trucks for District No. 1, with two trade-in trucks; District No. 4 one truck with one trade-in; and District No. 5 two trucks with 2 trade-in trucks.  Each Commissioner advised to furnish the specifications and Mr. Owens to check with the dealers.

Mr. Owens advised the Board he had to readvertise for the pump.  Now bids will be taken on Friday, October 13th, at a special meeting.

Mr. Theus was instructed to contact Robert Ford, Architect, re:  Preparing Notice to Bidders on furniture for the Ag. Center.  Should have alternate bids.

Mr. Duncan reported that he had contacted Mr. Greene, attorney in Ocala, re the Sand Pit Suit, and he reported that he had filed Notice of Appeal in the suit, but it is about to be thrown out of Court because he failed to  pay the assessment cost.

Commr. Dykes reported that the Fire Department of the City of Clermont had put out a fire on Bickle Bridge Labor Day morning, and he made a motion which was seconded by Commr. Simpson and carried, that Attorney Duncan write a letter of appreciation to the Fire Department.

Mr. Duncan was instructed to see Mr. Mims of SRD in Leesburg re this (as to the road involved).

Mr. Duncan reported on his talk with Walter Hunter re:  this Suit.  Said that Mr. Hunter said the Judge at first ruled with us, but later decided to give the other people two or three days to present additional information, but had received nothing on the 2nd day.

Mr. Dykes reported that no water is flowing through this ditch at the present time and the level of the ditch should be lowered.  He also stated if the County does not own a 30’ right of way through there should condemn and get the right-of-way.  WHEREUPON, on motion of Commr. Dykes seconded by Commr. Babb and carried, County Attorney Duncan was instructed to secure the right-of-way along the ditch.

Harry Padgett, Surveyor, appeared before the Board and presented Plat of this Subdivision, with letter from Mid-State Engineers Corp, and Lake County Health Department re septic tanks; also title policy #X-27-597 issued by Lawyers Title & Insurance corp. showing the title vested in Estates Land Company Inc.  Also letter from Lake County Zoning & Planning stating “Plat has been examined and approved in accordance with the Lake County Zoning & Planning Regulations as to lot size as stated on the plat that it takes two lots for a building site.  Further the Lake County Zoning & Planning Board recommends to the Board of County Commissioners that when the streets are improved or developer is bonded for their improvement that the Plat be finally approved.”  WHEREUPON on motion of Commr. Babb seconded by Commr. Dykes and carried, the Plat of Haines Lake Estate was approved.

minimum areas for construction of dwellings or other improvements

 

Motion by Commr. Dykes seconded by Commr. Simpson and carried, the following Resolution was adopted:

WHEREAS, the Zoning Regulations of Lake County heretofore established, require certain minimum areas for the construction of dwellings or other improvements thereon; and

WHEREAS, Plats have heretofore been submitted delineating lots having less than the required area for the above purposes and the platting of lots of such size is misleading to the public;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that a policy be, and it is hereby established; that from and after the adoption of this Resolution, no plats which shall define lots having less area than that permitted for the construction or improvement of buildings or other permanent improvements, as required by the Zoning Regulations of Lake County, will be accepted and approved for filing in the public records of Lake County, Florida.

Motion by Commr. Babb seconded by Commr. Simpson and carried, that C. E. Duncan, Attorney for the Board, be instructed to write a form letter to be sent to Plat owners re – maintenance of streets.

discussion re; niggertown street

Commr. Babb reported there is about one half mile of this road and thinks the cost would be approximately $900.00.  Marion County would reimburse Lake County for the work.  Mr. Duncan, County Attorney, was instructed to write Mr. Clark W. Jennings, Attorney in Orlando, re: this work.

Commr. Simpson filed Lake County General Revenue warrant #1597 in amount of $2.00 made to Rev. N. R. McNair for inquisition re:  Earl Dudley and said that Rev. McNair stated he knows nothing about the inquest and did not serve.  Motion by Commr. Babb seconded by Commr. Cowart and carried, that said warrant be cancelled.

Clerk Owens read a letter from H. L. Pringle re:  The Board rescinding the Resolution closing a certain road near Lady Lake on April 13, 1959.  Mr. Theus suggested that Mr. Duncan, Attorney for the Board, answer this letter to Mr. Floyd and send Mr. Pringle a copy of same.

Clerk Owens reported there were 3,836 1/3 linear feet of lumber, which was sold to J. W. Parrish, he being the highest bidder, at $77.50 per thousand.  Check for $299.87 has been forwarded to Mr. Owens.  Mr. Owens reported said check has been received and deposited.

hunnicutt & associates’ final statement

To services rendered on Lake County reappraisal job.  Contract completed – balance due and payable to City Bank & Trust Company, St. Petersburg, in accordance with assignment - $15,650.00.

Motion by Commr. Dykes seconded by Commr. Babb and carried that the Clerk be authorized to issue warrant in the amount of $15,650.00 to Hunnicutt & Associates and City Bank and Trust Company, for work as outlined above, and mail said warrant to City Bank and Trust Co. , St. Petersburg, Florida.

Motion by Commr. Dykes seconded by Commr. Babb and carried, that the request of Sheriff McCall for $18,650.00 be approved and Clerk Owens be authorized to issue warrant to Sheriff McCall for said amount.

Motion by Commr. Dykes seconded by Commr. Babb and carried, that the request of Sheriff McCall that A. C. Lee’s accumulated good time of 35 days as of September 28, 196, be disallowed, be granted and the Sheriff so notified.

Bill for this service was ordered held up until money for taxes is received.  This bill is in amount of $12,033.60.

ASSESSMENT FOR SECRETARIAL ASSISTANT FOR CIVIL DEFENSE

C. E. Duncan, Attorney, was authorized to write the Attorney General and find out if this Board has authority to pay this assessment.

Motion by Commr. Simpson, seconded by Commr. Dykes and carried, that the action of the Clerk and Chairman in approving the applications of the following to the T. B. Hospital be approved:  Reuben Gordon; Aaron Bell and Walter Carr.

Clerk Owens read a letter from Dr. Hall re:  Walter B. Foxworth as follows:  “We have been able to get this party admitted to the V. A. Hospital Oteen, N.C.”

sunshine state parkway toll road

Motion by Commr. Cowart seconded by Commr. Simpson and carried, that the following Resolution be adopted:

WHEREAS, it has been brought to the attention of the Board of County Commissioners of Lake County, Florida, that the proposed location of the Toll Road Northerly from Fort Pierce and passing through a portion of Lake County, has been changed so that it will run Northwesterly to Wildwood and would be some distance away from the original proposed location; and

WHEREAS, the Board of County Commissioners feel that the proposed relocation of said road will be very detrimental to the people and the economy of Lake County;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the State of Florida, by and through its proper Officials, be requested to stop the construction of the extension of the Sunshine State Parkway Toll Road at State Road 50 West of Orlando; and that no further planning and construction of said road be done under the present proposed plans.

Clerk Owens read Docket of Public Utilities stating that the express office and railroad station agency at Okahumpka will be discontinued on hearings at 9:30 a.m. Thursday, October 5, 1961, in the County Commissioners’ room in the Courthouse at Tavares, Florida.

Clerk Owens read a letter from Hon. Ray E. Green, Comptroller, acknowledging receipt of a letter of September 19, 1961, to which was attached original and one copy of the Budget of the Board of County Commissioners of Lake County for the year ending September 30, 1962.  “I have today approved this Budget as to form and return the original herewith.”

Commr. Simpson reported that some signs on the old Mt. Dora-Eustis Road have been smeared with paint.  But no action has been taken on this as do not know who did it.

Commr. Dykes reported that hot rodders are using Woodlea Road and speed signs should be erected, WHEREUPON, on motion by Commr. Dykes seconded by Commr. Simpson and carried, the following Resolution was adopted:

WHEREAS, it has been brought to the attention of the Board of County Commissioners of Lake County, Florida, that excessive speeds along the roads hereinafter described have become increasingly dangerous to the lives of those using the highway and to the lives of property of those living along the boundaries of said highway; and, in order to protect them, a speed limit should be determined and posted along said roads;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that a maximum speed limit of 35 miles per hour is determined and set for “Woodlea Road,” commencing at State Road 19, and extending Westerly on the Northerly side of the new Agricultural Building, and in a general circular manner through Lane Park, rejoining State Road 19 approximately 1-1/2 miles South of the beginning of said road.

Anyone violating the provisions of this Resolution shall be guilty of a misdemeanor and shall be prosecuted under the laws pertaining to misdemeanors.

Mr. Theus thinks this limit should be 25 miles, WHEREUPON, on motion of Commr. Simpson seconded by Commr. Babb and carried, the following Resolution was made:

Bob Webb presented two applications for changes in zoning, which have been passed on by the Zoning Commission, with recommendation that the County Commissioners adopt a Resolution granting the changes, WHEREUPON, on motion of Commr. Dykes seconded by Commr. Babb and carried, the following Resolution was adopted:

WHEREAS, the Lake County Zoning Commission did, on the 28th day of September A.D. 1961, after due Notice of the hearing, review applications for changes and revisions of the zoning of certain areas in Lake County and did approve certain changes as requested in the particular applications hereinafter set forth, subject to approval of the Board of County Commissioners of Lake County; and the Board of County Commissioners of Lake County, having reviewed said applications and the recommendations of the Lake County Zoning Commission;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the Zoning Rules and Regulations of Lake County be altered and amended as they pertain to the following tracts of land, to the classification designated after each description:

1.         The East 300 feet abutting and running parallel with the right of way of U. S. 27, commencing with the North line of Section 2, and continuing Southerly to State Road 48, and lying within Sections 2, 11 and 14, Township 20 South, Range 24 East, now classified and zoned as R-1 (Residential), be, and the same is hereby amended, changed and rezoned to Classification C-1 (Commercial).

2.         The South Half of Government Lot 12, in Section 22, Township 21 South, Range 26 East, lying East of the Tavares & Gulf Railroad right of way, now classified and zoned as A (Agriculture), be, and the same is hereby amended, changed and rezoned to Classification R-2 (Residential).
