MINUTES OF regular MEETING OF BOARD OF COUNTY COMMISSIONERS

 monday – october 9, 1961

The Board of County Commissioners met in regular session in the County Commissioners room in the Courthouse at Tavares on Monday, October 9, 1961 at ten o’clock a.m., with the following present:  Chairman Theus; Commissioners Cowart, Babb, Dykes, and Simpson; Attorney Duncan; and Clerk Owens.

The meeting was called to order with prayer by Chairman Theus.

bond for carrying firearm approved

The bond of H. E. L. Brainard with D. R. Igou and H. M. Igou as bondsmen for carrying a pistol made by Colt Patent Firearms Co. of 32-20 calibre and numbered 348066 was approved by the Board.

On a motion by Commr. Cowart, seconded by Commr. Babb and carried:

DISTRICT 1 – No changes were made

DISTRICT 2 – Genevieve Bansberg, Lake Highland Nursing Home, Clermont, was canceled.

DISTRICT 3 – The address of Maybell Burton was changed to Route 1, Box 1271, Tavares.

DISTRICT 4 – No changes were made.

DISTRICT 5 – Mrs. Shirley Deal, Box 841, Umatilla, was approved for $25 per month.

lake saunders ditch

A delegation of 15 citizens living in the Lake Saunders vicinity appeared before the Board re high water in Lake Saunders.  Mr. James Pollock was the spokesman for the group and asked that some relief be given.  He stated the lake is 24 inches higher than it should be at normal times.  If we have another wet spell in the spring, we will be in serious danger.  The group was advised that at the last meeting, Mr. Duncan, attorney for the Board, was authorized to get the rights of way, and this will then be taken care of.

The bill of appraisers L. W. Huey and H. B. Harrell, Jr. in the amount of $200 each and the secretary’s expense in the amount of $25 was presented to the Board.  On a motion by Commr. Babb, seconded by Commr. Cowart and carried, the bill in the total amount of $425 for appraisal work on the above-numbered Section was approved, and Mr. Duncan was authorized to forward same to the State Road Department in triplicate for payment.

The bill of Inland Abstract & Title Company in the amount of $17.50 for an additional Title Search on the above-numbered Section was presented with a copy of the title report.  On a motion by Commr. Simpson, seconded by Commr. Babb and carried, the bill was approved and Mr. Duncan was authorized to forward same to the State Road Department in triplicate for payment.

The Contractor’s Request No. 5 on the above was presented.  On a motion by Commr. Babb, seconded by Commr. Dykes and carried, the Architect’s request No. 5 for Fred S. Conrad Construction Company in the amount of $64,326.72 for work to date on the Jail and Sheriff’s Department was approved for payment.

state civil defense bill for secretarial services

The bill in the amount of $34.92 was again presented to the Board for 1.5 % assessment of the Federal disaster relief payment to date.  On a motion by Commr. Dykes, seconded by Commr. Babb and carried, the bill in the amount of $34.92 was approved and the Clerk authorized to make a warrant payable to the Treasurer of the State of Florida, due to the fact that the Attorney General and Budget Commission concur in this expenditure.  (See letter attached to bill.)

A memorandum from Post Office Department of U. S. – K. B. Sears, Postmaster, for postage October 1, 2961 through January 31, 1962 in the amount of $1,400 in compliance with Section 98.081, Election Code of Florida as Amended was presented to the Board.  On a motion by Commr. Babb, seconded by Commr. Cowart and carried, the bill in the amount of $1,400 was approved for payment.

request from home demonstration agent

The request of Marian Valentine, Home Demo. Agent, for $50 to help defray the expense of the recognition banquet on November 7, 1961 for County winners in the 4-H program - 45 4-H girls will receive recognition – was presented.  On a motion by Commr. Dykes, seconded by Commr. Babb and carried, Clerk Owens was authorized to issue a warrant for $50 to Mrs. Marian B. Valentine, Home Demo. Agent, to help defray the expense of the recognition banquet to be held November 7, 1961.

rental or lease of drainage pumps

Irving Richardson appeared before the Board and asked if the Board would lease or rent the drainage pumps and pipe that was used at Lady Lake last year for use by an individual.  The attorney for the Board advised him that the Board could not rent or lease public property, as if they did it for one, they would have to do it for all.

The Board adjourned for lunch and reconvened at 1:30 p.m.

Chairman Theus called the Board to order.

plat of winona bay subdivision in clermont

This Plat was presented by Roy W. Caldwell, attorney, with a letter from the Lake County Health Department.  Mr. Duncan stated the letter states the subdivision consists of 9 lots owned by Mr. Cody Johnson and is approved for septic tank type sewage disposal.  Mr. Duncan also stated Title Policy #8104 issued by Title & Trust Company of Florida shows the title in the name of 4 subdividers subject to recording of two quit-claim deeds, both of which are before me; also subject to a mortgage held by the Bank of Tavares.  I have before me a subordination of the mortgage to the streets.  So it now appears to be satisfactory so far as the County is concerned to be accepted.  WHEREUPON, on a motion by Commr. Babb, seconded by Commr. Dykes and carried, the Plat of Winona Bay Shores Subdivision was approved.

Clerk Owens read a letter from Mrs. Margaret Lafroos re purchasing this property.  On a motion by Commr. Simpson, seconded by Commr. Babb and carried, Clerk Owens was authorized to advertise in the Mount Dora Topic Notice of Sale of this property, pending Mrs. Lafross depositing with him a firm bid of $2,240 with a deposit of 5 % of the bid.

Attorney Duncan was requested by the Board to forward this appraisement to the State Road Department for approval and final acceptance.

advertise for supplies

On a motion by Commr. Dykes, seconded by Commr. Babb and carried, Clerk Owens was authorized in the Tavares Lake County Citizen for the following:  Concrete Pipe, Diesel Fuel, Corrugated Metal Pipe, Regular Gasoline, Crushed Stone, 5 Dump Trucks, and Asphalt Materials.

bills from charles butler for servicing air conditioners

The bills from Charles Butler for servicing air conditioners and also for new air conditioners purchased by the County were presented.  These bills were approved, and Clerk Owens requested to write Mr. Butler that in the future he present the bills monthly for servicing air conditioners and also for any purchases made from him by the County.

furniture for agricultural center

Robert V. For, architect, appeared before the Board re advertising for furniture for the Agriculture Center.  He said he understands the Board wants alternate bid proposals. He suggested that the successful bidder on alternate and base bids be asked to display pieces of equipment showing prices.  Bids should be taken on November 13, 1961 and Notice published this week.  The Board suggested publishing in the Daily Commercial, Leesburg, and the Eustis Lake Region News, Eustis.

A motion was made on June 12, 1961 authorizing the Clerk to advertise for bids for furniture and equipment for the Agricultural Center, which bids were all rejected.  Therefore, the Clerk is now authorized to again advertise for bids for furniture and equipment for the Agricultural Center on a motion by Commr. Simpson, seconded by Commr. Dykes and carried.  Mr. Ford is to furnish the advertisement for the papers.

Mr. Ford gave a report on the well at the Ag. Center.  Said he does not have certification from the State Board of Health.  There has been no log kept on the well.

Mr. Rosier was called in on the discussion on the well, and Commr. Theus explained to him the status of the well.  Said Mr. Ford thought we had a pump of sufficient size to supply the building with water, but finds it is not adequate, and there is some question as to whether or not we have the right size well.  Mr. Rosier stated the well is 466 feet deep, and the pump advertised for will do the job.  Commr. Theus asked if Mr. Rosier would pump out the well this week.  Mr. Duncan stated it would be alright for Rosier to use the County pump if he will guarantee he will get the water off without damage to our pump.  Commr. Theus suggested that this be left up to Mr. Rosier and Mr. Duncan, and whatever is the fair thing to do, they will do. It was suggested that when the well is being pumped that Mr. Dykes notify Mr. Norris and Mr. Lunsford, and he will go with them to see how the well worked.

school board millages

Clerk Owens read to the Board a certified copy of a resolution adopted by the Lake County Board of Public Instruction at a special meeting of the Lake County School Board on September 21, 1961 fixing millages to be assessed for school purposes for the Fiscal Year beginning July 1, 1961 and ending June 30, 1962; WHEREUPON, on a motion by Commr. Babb, seconded by Commr. Dykes and carried, the millages as submitted by the Lake County Board of Public Instruction for the fiscal year beginning July 1, 1961 and ending June 30, 1962 were approved and filed, and Clerk Owens was instructed to order the Hon. R. G. Cassady, Tax Assessor, to assess the millages as contained in said resolution and Hon. Paul H. Reed, Tax Collector, to collect taxes according to the millages contained therein.

SAID RESOLUTION BEING AS FOLLOWS:

FORM FOR CERTIFYING TAX LEVIES UNDER SECTION 237.18

Resolution of the Board of Public Instruction of Lake County, Florida, determining the amount of revenues to be produced and the millage to be levied for the County Current School Fund, for the County B&B Reserve Fund, for the County General (BPI) Interest and Sinking Fund, for the Special Tax School District Current Fund, for the District B&B Reserve Fund, and for the District Bond Interest and Sinking Funds for each of the Districts in the County for the Fiscal Year beginning July 1, 1961 and ending June 30, 1962.

Adopted at the special meeting of the Lake County School Board, September 21, 1961.

I

WHEREAS, Section 237.18 of the Florida School Code required that “upon the final adoption of the budget and upon receipt of the certificate of the Assessor of Taxes giving the assessed valuation of the County and of each of the Bonded School Districts, the County Board shall determine by resolution the amounts necessary to be raised for the County Current School Fund, for the County B&B Reserve Fund, for the County General (BPI) Interest and Sinking Fund, and for each District Bond Interest and Sinking Fund and the millage necessary to be levied for each such fund and shall also show in said resolution the millage voted by the Special School District for the District Current School Fund,” and for the District B&B Reserve Fund, as

WHEREAS, the school budget for the current fiscal year has been finally approved by the State Superintendent and is now official except for the certification of millages as required by Section 237.18; and

WHEREAS, the certificate of the County Assessor of Lake County, giving the assessed valuation of the County and of each school district has been received;

THEREFORE, BE IT RESOLVED by the County Board of Public Instruction of Lake County, Florida, assembled in regular (special) meeting, that the amounts necessary to be raised as shown by the officially adopted budget and the millages necessary to be levied for each school fund of the County for the fiscal year beginning July 1, 1961 and ending June 30, 1962 are as follows:

(1)  COUNTY CURRENT SCHOOL FUND:  Non-exempt Assessed Valuation as certified by Tax Assessor $268,673,076; Amount to be Raised from Tax Levies $1,735,628; and Millage Levy Required 6.8 mills.

(2)  COUNTY B & B RESERVE FUND:  Non-exempt Assessed Valuation as certified by Tax Assessor (left blank); Amount to be Raised from Tax Levies (left blank); and Millage Levy Required (left blank)

(3)  COUNTY GENERAL (BPI) INTEREST & SINKING FUND: Non-exempt Assessed Valuation as certified by Tax Assessor (left blank); Valuation including Homesteads Assessable for Bonds (left blank); Amount to be Raised from Tax Levies (left blank); Levy Required from Bonds, excluding Homesteads (left blank); and Levy Required for Bonds Including HS (left blank)

(4)  SPECIAL TAX SCHOOL DISTRICT CURRENT FUND:  Non-exempt Assessed Valuation as certified by Tax Assessor $268,673,076; Amount to be Raised from Tax Levies $25,523; and Levy Approved by Voters .1 mills.

(5)  DISTRICT B & B RESERVE FUND:  Non-exempt Assessed Valuation as certified by Tax Assessor (left blank); Amount to be Raised from Tax Levies (left blank); and Levy Approved by Voters (left blank).

(6)  DISTRICT BOND INTEREST AND SINKING FUNDS OF THE RESPECTIVE DISTRICTS: Non-exempt Assessed Valuation as certified by Tax Assessor $268,673,076; Valuation including Homesteads Assessable for Bonds (left blank); Amount to be Raised from Tax Levies $433,907; Levy Required from Bonds, excluding Homesteads (1.7 mills); and Levy Required for Bonds Including HS (left blank).

*NOTE:  If bonds were issued prior to the date the homestead amendment became effective, the assessed valuation and tax levies should include homestead property; if bonds were issued after that date, only the non-exempt property should be included.  If in any district some bonds were issued before the amendment became effective and some afterward, two lines should be used for each such district, one to give values and levies for the issue including homesteads and the other to include only non-exempt property and the levies thereon for bonds issued since the amendment became effective.

WHEREAS, Section 237.18 of the Florida School Laws provides that “A certified copy of said resolution shall thereupon be filed with the Board of County Commissioner shall thereupon order the Assessor to assess the several millages certified by the County Board against the taxable property of the several Bonded School Districts.  The Assessor shall then assess the taxes as ordered by the Board of County Commissioners, and the Collector shall collect said taxes and pay over the same promptly as collected to the county school depository or depositories to be used as provided by law, provided that all taxes authorized herein shall be assessed and collected on railroad, street railroad, sleeping car, parlor car, and telegraph company property in the manner now provided by law;”

AND WHEREAS, the County Board of Public Instruction of this county has determined the millage to be levied for the County General School Fund for the County B & B Reserve Fund, for the County General (BPI) Interest and Sinking Fund, and for the District Bond Interest and Sinking Funds by dividing the applicable assessed valuation as finally certified by the Assessor after equalization as hereinbefore specified into the amount budgeted to be received from taxes before five per cent (5%) is deducted using the nearest one-fourth (1/4) mill or other fraction or decimal ordinarily used in the county as prescribed by Section 237.18 and has found the millage levies required to be set forth in Part I above;

NOW, THEREFORE, BE IT RESOLVED that the Board of Public Instruction of Lake County, Florida, does hereby determine that the aforesaid millages on said assessed valuation of the taxable property for the year 1961 will be required and does hereby request the Board of County Commissioners of Lake County, Florida, in conformity to law to direct the Tax Assessor to assess and the Tax Collector to collect taxes according to the millages certified herein.

BE IT FURTHER RESOLVED that a certified copy of this resolution be forthwith transmitted to and filed with the Board of County Commissioners of Lake County, Florida.

BE IT FURTHER RESOLVED that a second certified copy of this resolution be forthwith transmitted to and filed with the State Superintendent of Public Instruction, Tallahassee, Florida, to become a part of the official budget which is in his file and that another copy be filed with and become a part of the official budget in the files of the said County Board of Public Instruction.
