MINUTES OF called MEETING OF BOARD OF COUNTY COMMISSIONERS

 thursday – november 16, 1961

The Board of County Commissioners met in called session in the County Commissioners room in the Courthouse at Tavares at 9:00 a.m. on Thursday, November 16, 1961, for the purpose of hearing recommendations from the County Engineer on bids received November 13 and the acceptance or rejection of same and such other matters as may be brought before the Board, with the following present:  Chairman Theus; Commissioners Cowart, Babb, Dykes, and Simpson; Attorney Duncan; and Clerk Owens.

The meeting was called to order by Chairman Theus.

Letter from Ray E. Green, Comptroller, regarding Confederate Pensioners of Lake County - Mrs. Lenorah Haire, Umatilla; Mrs. Nonnie Gray, Mascotte; and Mrs. Betty Smith, Leesburg – asking for approval by the Board of same.  After checking on the Pensioners, the Board approved same, as they are all still living in Lake County.

Mr. Duncan stated he has just received a map from the State Road Department on this section, and they are ready for appointment of appraisers.  WHEREUPON, on a motion by Commr. Babb, seconded by Commr. Dykes and carried, the following named persons were appointed appraisers on this road:  Emery Dillard, Edwin R. Waite, and H. B. Harrell, Jr.

Mr. Ford announced that the bids are broken down in six groups.  We have 7 low bidders as follows:

On a motion by Commr. Dykes, seconded by Commr. Babb and carried, the Bid of Boyd’s Furniture Company to furnish Lake County, Group A for $4,987.85; Group B for $1,519.40 and Group D for $168.00; and the bid of George Stuart, Inc. to furnish Lake County – Group C for $4,950; the bid of Leesburg Typewriter to furnish Lake County – Group E for $1,796; and Skipper’s bid on Group F for $212.66 be accepted and that Clerk Owens be instructed to return the bonds or cashier’s checks of the other bidders.

Mr. Ford was instructed to select the color and fabrics.

County Engineer Givens announced the low bidders on trucks as follows:

On a motion by Commr. Cowart, seconded by Commr. Babb and carried, the low bids of Joe Creamons Chevrolet Inc., Eustis to furnish Lake County six (6) Chevrolet dump trucks for the prices as listed above was accepted, and the low bid of Lake Motors Company, Eustis, to furnish Lake County one (1) Dodge dump truck for the price as listed above, $2,824.00, was accepted; and Clerk Owens was instructed to notify all bidders.

On a motion by Commr. Dykes, seconded by Commr. Babb and carried, the bids of Florida Crushed Stone Company and Shands & Baker, Inc. on crushed stone and slag as listed above was accepted.

County Engineer Givens did not recommend acceptance of any of these bids, but held the bids for further study.

Discussion on the Commissioners selling various amounts of pipe to individuals.  Mr. Owens advised the Commissioners they should not sell pipe to individuals.  Therefore, the Board agreed not to sell pipe to individuals.

County Engineer Givens stated the low bidder is:

LAKELAND CEMENT COMPANY, Lakeland        Price $2.60

On a motion by Commr. Babb, seconded by Commr. Cowart and carried, the bid of Lakeland Cement Company to furnish Lake County pipe in sizes as requested by the Board for the price of $2.50 was accepted.

County Engineer Givens presented a tabulation on the bids and recommended that the bid of Texaco, Inc. be accepted; WHEREUPON, on a motion by Commr. Dykes, seconded by Commr. Cowart and carried, the bid of Texaco, Inc. to furnish Lake County the following at the prices as listed was accepted:

Fire Chief Gasoline in T/W deliveries – current T/W price .175 per gallon, less .045 cents per gallon

Diesel Fuel #2 T/W deliveries – current T/W price .1660 cents per gallon, less .0524 p/g

Diesel Fuel #2 Transport delivered price per gallon .0991 cents

These prices are exclusive of taxes and firm for 1 year – 1% discount – 10 days.

County Engineer Givens presented a tabulation on these bids and recommended that the following bids be accepted:

Bannerman Co. Inc. RC-1S and RC-2

Central Oil Company Inc. and Supreme Oil Company, Inc. Cationic and AC-15 and RS-2

WHEREUPON, on a motion by Commr. Dykes, seconded by Commr. Babb and carried, Bannerman Company, Inc. was awarded the contract on RC-1S and RC-2 at $0.1203 per gallon, less discount; and Central Oil Company, Inc. and Supreme Oil Company, Inc. were awarded the contract on SM-K cationic asphalt @ 12.84 cents per gallon; RS-2 and AC-15 @11.47 cents per gallon.

Commr. Dykes stated he will talk to Mr. T. C. Boyd, Sr. about his property on US 441 in answer to his letter.

Letter from Atlantic Coast Line Railroad Company regarding crossing at this subdivision north of Leesburg which belongs to Mr. Temple.  Mr. Duncan was instructed to answer the letter and request such agreements as are necessary in order to locate the crossing.

Mr. Dykes stated that Mr. Richey Green told him that since the walkway has been approved, the Board should select a site for same; WHEREUPON, on a motion by Commr. Dykes, seconded by Commr. Cowart and carried, the following resolution was adopted:

WHEREAS, Lake County, by and through the Board of County Commissioners, has requested the construction of a walkover over State Road 19 in the City of Tavares coincident with the construction of a four-lane highway through the City of Tavares, to be located in the vicinity of Kentucky Avenue in said City, and

WHEREAS, the State Road Department has requested the Board of County Commissioners to designate the specific location of said overpass which will best serve the subdivision and result in the least amount of damage to adjoining properties;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the State Road Department be requested to include in its plans for the construction of State Road 19, Section 11090-2502, a walkover overpass to be located as follows:

Commencing on the easterly side of Park Avenue in Lakewood Park Addition to Tavares North of the right of way for the above-described road and extending southerly and over said right of way, to descent in the easterly part of Park Avenue and west of Lots 1 and 2, in Block F of Lakewood Park Addition.

BE IT FURTHER RESOLVED by said Board that the State Road Department be requested to construct a sidewalk along the northerly boundary of the right of way for State Road 19, Section 11090-2502, commencing at Orange Avenue and extending northeasterly to Park Avenue as an access from Orange Avenue to said walkover overpass.

SECTION 11010-2501 AND 1109-2502

 Mr. Duncan presented a map of a portion of Tavares and Lakewood Park Addition, which was discussed.  Mr. Duncan stated that the State Road Department agreed to make a municipal section in the City of Tavares.  A right of way agent should be appointed; WHEREUPON, on a motion by Commr. Dykes, seconded by Commr. Cowart and carried, Emery Dillard of Eustis was appointed right of way agent on Section 11010-2501 and 1109-2502.

On a motion by Commr. Dykes, seconded by Commr. Babb and carried, the following resolution was adopted:

WHEREAS, the Board of County Commissioners is advised of the plans for the construction of State Road 19-500, passing through the City of Tavares, and

WHEREAS, heretofore, the State Road Department has agreed that the said roads as they pass within the City Limits of Tavares shall be of municipal section type, and

WHEREAS, it appears from the proposed right of way maps that a portion of said road will require more than the 100 feet accepted for a municipal section in the remaining portion of the City;

NOW, THEREOFRE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the State Road Department be requested to limit the right of way for State Roads 19 and 500 as they pass through the City of Tavares to a 100-foot right of way and that the road constructed thereon be of the municipal section type as heretofore agreed.

On a motion by Commr. Dykes, seconded by Commr. Simpson and carried, the following resolution was adopted:

WHEREAS, Lake County has heretofore requested the construction of a wayside park in the margin of Lake Eustis connecting with State Road 500 at such time as said road is four-laned, the establishment of which park has heretofore been approved by the State Road Department, and

WHEREAS, plans are now underway for the construction of a four-lane road extending westerly from the City of Tavares to the Silver Lake fork intersection, and the location and construction of such a wayside park in the margin of Lake Eustis should now be accomplished;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the State Road Department be requested to include in the construction plans for State Road 500, Section 11010-2501, a wayside park connected with said roadway to be located in a margin of Lake Eustis west of the mouth of the Dora Canal and that said wayside park include a ramp for loading and unloading boats.

The public hearing for the proposed improvement on Section 11010-3502, SR 500, from State Road 25 to State Road 44 through Leesburg in the City Commission Room in City Hall at Leesburg on the 29th day of November, 1961, at 2:00 p.m. announced by letter from Richey Green, District Engineer, State Road Department.

Mr. Hopson, architect, presented a Notice to Bidders for the above.  On a motion by Commr. Simpson, seconded by Commr. Dykes and carried, Clerk Owens was authorized to advertise in the Lake Eustis Lake Region News to Notice to Bidders on kitchen and laundry equipment for the new Jail and Sheriff’s Department and take bids on December 11, 1961.

Commr. Theus advised the Board that he and Mrs. Sudderth met with Dr. Hall and others yesterday afternoon and had a discussion on the Nursing Home management.  He presented an application from Mrs. Mary Hamner, a registered nurse, for the position as manager of the Lake Memorial Nursing Home in Leesburg.  He stated Mrs. Hamner has good recommendations and we know her.  We have gone through this in detail with Dr. Hall, Mrs. Haley, Mrs. Sudderth, and Mrs. Hamner and now recommend that the Board employ Mrs. Mary Hamner, R. N., as manager of the Lake Memorial Nursing Home in Leesburg; WHEREUPON, a motion was made by Commr. Dykes that the Board hire Mrs. Mary Hamner, R. N, as Manager of the Lake Memorial Nursing Home in Leesburg at the salary as set out in the proposed budget, $375 per month beginning today, and that she be placed under bond in the amount of Five Thousand ($5,000) dollars.  The motion was seconded by Commr. Babb and unanimously carried.

On a motion by Commr. Simpson, seconded by Commr. Dykes and carried, the following named persons were authorized to go to the Lake Memorial Nursing Home in Leesburg tomorrow and take inventory:  Commr. Theus; Mrs. Sudderth; Mr. Givens, County Engineer; and Donna Jean Hayes from the Clerk’s office.

On a motion by Commr. Simpson, seconded by Commr. Cowart and carried, Attorney Duncan and Clerk Owens were instructed to notify Mrs. Martha Schaller (Root) that her lease on the Lake Memorial Nursing Home expired on November 15th and also notify Mrs. Mary Hamner, Leesburg, that she is employed as manager of the Lake Memorial Nursing Home in Leesburg.

amend budget general revenue of receipts

On a motion by Commr. Dykes, seconded by Commr. Simpson and carried, the General Revenue Budget of Receipts were amended to include Item No. 167, Hospital Receipts (unanticipated receipts), $51,334.50, thereby increasing the total estimated receipts and balances to $999,199.73 and that the estimated expenses were amended as follows:  Item #531 – Maintenance of County Homes - $51,334.50 (the correct amount of this item is less 5% or $48,767.77) and that the total estimated expense budget be increased to $999,199.73.
