MINUTES OF REGULAR MEETING OF BOARD OF COUNTY COMMISSIONERS

 monday – august 13, 1962

The Board of County Commissioners met in regular session in the County Commissioners’ Room in the Courthouse at Tavares on Monday, August 13, 1962, at ten o’clock a.m. with the following present:  Chairman Simpson; Commissioners Theus, Cowart, Dykes, and Babb; Attorney Duncan; and Clerk Owens, also present was County Engineer Givens.

The Board was called to order by Chairman Simpson.

Commr. Theus gave the invocation.

PAUPER LIST

Motion by Commr. Theus seconded by Commr. Cowart and carried:

DISTRICT 5 – That Mrs. Mabel Bedgood, c/o A. R. Matteson, RFD Hwy 19, Lake Dorr Trailer Park, Umatilla, be granted $20 per month.

JAIL EQUIPMENT

Howell Hopson, Architect, appeared before the Board and presented invoices as follows:

            Howell Hopson basic fee 6% of $1,035,397.87         $62,123.87

                        Less amount previously paid                           50,859.09

                                                                                                $11,254.78 final payment

Motion by Commr. Babb seconded by Commr. Dykes and carried, that the bill of Howell Hopson, Architect, as set out above be approved for payment.

Bill of Ametex, Inc., for Laundry Equipment balance in amount of $50.20 was approved for payment on motion of Commr. Theus seconded by Commr. Cowart and carried.

Bill of Skipper’s on furniture in amount of $1,140.00 and $5,590.00 on equipment was approved for payment on motion of Commr. Babb seconded by Commr. Dykes and carried.  $500.00 being held back on invoice from Skipper pending replacement of two sections of counter tops.  (The additional items on this invoice – one extra desk and 4 modesty panels are being referred to Sheriff McCall.)

Bill of Motorola – original bid and contract in amount of $15,481.00 less $500 – making total of $14,981.00 was approved for payment on motion of Commr. Dykes seconded by Commr. Babb and carried.  (There is a discrepancy of $500 on Motorola bill and Mr. Hopson was instructed to take this up with the Company to see if this was an error or an additional allowance for trade-in.  (Allowance listed as $3,375.50.  Total charge $18,356.50.)

Mr. Hopson stated that Mr. Conrad of Conrad Construction Company had hoped to have all his releases of liens from the sub-contractors in today, but did not get them.  However, he would appreciate it if the Board would authorize Mr. Owens to issue him a warrant in payment of the 10% being retained upon receipt of the releases, WHEREUPON, on motion of Commr. Babb seconded by Commr. Dykes and carried, Clerk Owens was authorized to issue warrant to Fred S. Conrad Construction Company for the 10% being retained upon receipt of all releases of liens from the sub-contractors.

PUMPS RENTED TO POLK COUNTY:

Clerk Owens advised the Board that he has received a check in the amount of $2,942.00 from Board of County Commissioners of Polk County in payment of 294.2 hours @ $10 per hour for two pumps.

COUNTY WATERWAYS

T. C. Hanson advised the Board that there will be a meeting of the Sumter and Lake County Waterways on the third Wednesday in September to discuss the proposed water conservation project being considered in the SW section of the County.  The project will be a joint venture in Lake and Sumter counties to improve water conservation with funds from the Federal Government and individual property owners.  Government funds to be furnished under Public Law 556.

LIST OF ERRORS

List of Errors, insolvencies, double assessments as submitted by Paul H. Reed, Tax Collector, was approved by the Board on motion of Commr. Theus seconded by Commr. Cowart and carried.

TELEGRAM FROM STATE ROAD DEPARTMENT

Clerk Owens read a telegram from State Road Department stating the low bidder on the following roads is PAV-A-WAY CORP OF LAKELAND, FLORIDA:

Marion and Lake Co. State Project Job No. 3616-8501, SR 42 between SR 450 E. of Weirsdale and Lake County line W. of Altoona;

Job No. 11010-8506 SR 500 in Tavares between ACL RR and SR 19A; & Job no. 11120-8501;

SR 448, between SR 561 S. of Tavares and Orange County lines;

Job No. 11150-8502, SR 450, between a point approximately 0.8 miles W. of SR 19 in Umatilla and Marion County line E. of Weirsdale;

Clerk Owens read a letter from City of Clermont stating “At a regular meeting of the City Council of the City of Clermont August 7th, motion was made and duly carried that the City of Clermont join with the Board of Lake County Commissioners in accepting the low bid of $0.45 per square yard submitted by Orlando Paving Company for the resurfacing of Hook Street.”

Motion by Commr. Cowart seconded by Commr. Dykes and carried, that the action of Clerk Owens in submitting R/W map on this road to Lake Abstract and Guaranty Company to prepare title search be approved.

holding court during courthouse remodeling

Sheriff McCall appeared before the Board re:  a place to hold Court during the time the Courthouse is being remodeled.  Suggested the Lions Club and the Legion Hut, WHEREUPON, on motion of Commr. Dykes seconded by Commr. Babb and carried, the County Commissioners were authorized to furnish a place for holding Court during the remodeling of the Courthouse; and that the Lions Club at Summerall Park and the Legion Hut be designated as official places for holding Court.

Clerk Owens presented list of County Warrants which are on hand, delivery having been attempted and requested that same be canceled.  Said Warrants being as follows:

VS. LAKE COUNTY, FLORIDA, ET AL

Mrs. Elvena B. Ogden and Mrs. Margaret Rosendahl appeared before the Board and asked that the County protest the elimination of dedicated roads near Fruitland Park which have never been used as public thoroughfares.  Mrs. Ogden stated several parties have been served notice re the above entitled suit, WHEREUPON, on motion by Commr. Dykes seconded by Commr. Theus and carried, Mr. C. E. Duncan, Attorney for the Board, was instructed to file an answer for the Board of County Commissioners and cooperate with the attorneys for the other defendants in the suit.

Mr. Irving Morse, Attorney, appeared before the Board re an error in the description of Lot 235, Clermont Heights, Clermont, in the foreclosure of delinquent taxes.  Lot described as 235 in the Petition; in the notice as Lot 335, and in the Final Decree as Lot 235.  Mr. Morse asked that the Board be authorized to execute a Quit Claim Deed to clear the cloud from the title.  Mr. Duncan recommended that the County execute a Quit Claim Deed for the removal of the cloud; WHEREUPON, on motion of Commr. Dykes seconded by Commr. Cowart and carried, the Chairman and Clerk were authorized to execute a Quit Claim Deed re Lot 235 Clermont Heights for the purpose of clearing title only.

This Plat was presented with Opinion of Title by Cherry & Booth, Attorneys, stating title is vested in C. V. Firsch and J. H. Frisch by deed dated August 19, 1940, subject to easement to Florida Power Corporation.  Letter from Lake County Health Department, stating based on survey of Orange State Engineers, Inc. report, we are accepting their recommendations on this property for septic tank installation.  Mr. Duncan stated the Plat is acceptable, WHEREUPON, on motion of Commr. Dykes seconded by Commr. Theus and carried, the Plat of Frisch’s subdivision First Addition was approved.

EXCHANGE OF PROPERTY with shoreline dredging & construction co. – e. e. leitner

 

Letter from Shoreline Dredging & Construction Company dated August 10, 1962 was read as follows:

“This will confirm our conversation that we will remove the old bridge and piling at Dead River at the price of $1,400.00.  After completion of the work, the above amount shall be credited toward the exchange of property for the County lot at the West end of Dead River Bridge.”

Mr. Duncan was instructed to proceed with whatever is necessary now for the Exchange of the property.

Commr. Theus stated he has an old Cat. Grader No. 12 and Commr. Simpson has an old Warco Huber grader they want to trade in on a new motor grader, WHEREUPON, on motion of Commr. Cowart seconded by Commr. Babb and carried, Clerk Owens was authorized to advertise in the Daily Commercial for the purchase of a new motor grader, with two pieces of equipment to be traded in.  Motion carried.

Commr. Dykes stated that we need an easement for some property from Downer’s property and he would like to have this surveyed.  Commr. Dykes was authorized to have the survey made.

SR S-44-A

Two Turnout Permits were submitted for execution on this.  One on Section 11580 located at Mile Post 0.68 and 2 miles East of Eustis for the construction of one commercial paved driveway.  County road in existence to be paved.  No pipe necessary.  The other one was on Section 11580 located at Mile Post 2.8 and 3 miles East of Eustis for the construction of one commercial paved driveway – clay road to be paved.  Motion by Commr. Babb seconded by Commr. Dykes and carried, that the two permits be executed and mailed to M. H. Mimms, Engineer SRD, Leesburg.

Mid-Florida Oil Company, P. O. Box 1751, Miami 30 – Cutback asphalt RC-4 meeting Fla SRD specifications at a delivered price of $0.1257 per gallon to any point in Lake County, with a discount of $0.0022 per gallon

 

Motion by Commr. Theus seconded by Commr. Dykes and carried, that the two bids as listed on page 145 for Asphalt RC-4 be accepted, they being the low bidders.

Letter from Mrs. Valentine, Home Demo Agent, stated “The 4-H girls who attended Short Course would like to have you as their guests for lunch today in the Agricultural Center.”  Therefore, the Board adjourned to attend the luncheon at 12 noon.

Board adjourned at 12 noon and reconvened at 2 p.m.

Mrs. McDonald appeared before the Board re closing of a street in McDonald Terrace.  Mr. Duncan instructed her as to what the necessary requirements are for closings streets.

insurance on county property and equipment

A group of insurance agents appeared before the Board re insurance requirements for Lake County.  Mr. Ted Ostrander was the spokesman for the group and he presented a list of recommendations and discussed same.  Mr. Simpson recommended that some decision be made; stating he thinks the County would save a considerable amount of money on machinery insurance if it was all under one policy.  Motion by Commr. Dykes seconded by Commr. Babb and carried that the Board accept the recommendations as presented by the Insurance Board and that the necessary information be obtained and that Clerk Owens be instructed to advertise for bids on all County buildings, vehicles and automotive equipment, with $100.00 deductible on collision automotive equipment; also under comprehensive coverage.  Bids to be taken on October 8, 1962.  Liability insurance on vehicles $100,000 to $300,000.

Motion by Commr. Cowart seconded by Commr. Babb and carried, that Workmen’s Compensation for the Mosquito Control be placed in the General Policy for Lake County.

Mr. Ostrander stated he will assist the Board in getting the information ready for the Notice to Bidders.

Tom Sawyer appeared before the Board and presented this Plat, which is a partial replat of Eustis Heights Subdivision in Section 15-19-26, with letter from Lake County Health Department and soil analyses and percolation tests made by Orange State Engineers, Inc.  Health Department letter states “Based on these reports, we find these lots are apparently suitable for septic tank installation.”  Mr. Duncan stated the Binder for title insurance policy states two mortgages are on the property.  Have the release for one of the mortgages on the streets.  Also a letter from Robert M. Avent stating – “We have prepared Partial Release of Mortgage covering the streets in Eustis Heights Partial Replat.  The President of the Company – St. Joe Paper Company – is out of the city, also the Vice-Presidents, so am not able to get this release in your hands before the Plat is approved.  However, will forward to you as soon as possible.”  Mr. Duncan stated the Replat is bordered on the South by Clay Avenue.  Title Binder #86-828 issued by Title & Trust Company of Fla., shows title in Dewey Livingston and wife, subject to two mortgages, none of which is released as to the streets executed by the First Federal Savings & Loan Association.  The other from St. Joe Paper Company per letter quoted above.  Therefore, Mr. Duncan suggested that the Plat be approved subject to the receipt of the Partial Release of Mortgage from St. Joe Paper Company.  The Plat has been approved by the Zoning Board.  WHEREUPON, motion was made by Commr. Dykes seconded by Commr. Babb and carried, that the PLAT OF EUSTIS HEIGHTS PARTIAL REPLAT be approved, subject to receipt of the release of the streets by St. Joe Paper Company.

Beginning at SR-46 and continue Southerly to the Orange County Line – passing through Sections 30 & 31, Township 19 S. Range 29 East.

Tom Burschell, representing Orlando Daily Sentinel, appeared before the Board and called to the attention of the Board that Orange and Seminole Counties failed to budget funds for their Section of road S-433 – of which Lake County is responsible for 1.863 miles; Orange County 5 miles and Seminole 3 miles.  The rights-of-way were to be donated by property owners.  According to the State Road Department’s secondary road budget for Lake County, S-433 was to cost an estimated $80,000, however, an estimated cost of $190,000 showed up on the Typical Section Map prepared by the Road Department.  After Mr. Burschell gave the above report, discussion was had on the matter.  Mr. Theus then made a motion that since the Board has been informed that neither Orange nor Seminole Counties has this project set up in the budgets, and if this be true, that the Board request the State Road Department to withdraw this request from the Lake County Secondary Road Budget.  The motion was seconded by Commr. Dykes and carried.  Mr. Duncan was instructed to notify the State Road Department.

resignation of chas. n. givens as county engineer

Clerk Owens read a letter from Mr. Givens requesting that the Board accept his resignation as County Engineer as of August 31, 1962.  Mr. Givens stated he is joining the firm of Givens, Hurdle and Quick, Inc. of Cocoa Beach, of which he has one third interest, as of September 1, 1962, as this firm has been assured of approximately two million dollars’ worth of engineering work on Cape Canaveral and the immediate vicinity and he feels this is an opportunity he cannot turn down.

Motion by Commr. Theus seconded by Commr. Dykes and carried, that the Board accept the resignation of Chas. N. Givens as County Engineer and Zoning Director, with regrets, and that he be given one-fourth of a month vacation after September 1, 1962.

Petition signed by Elizabeth P. Marshall and 10 others requesting the Board to give consideration to some type of permanent topping on the clay road on the East side of Lake Eldorado was presented to the Board.  The Engineer was instructed to check this for right of way.  Petition was filed.

Chairman Simpson instructed County Engineer Gives to get the description on the Britt Grove Road so Mr. Duncan can draw the deed.

The Engineer was also instructed to check the right of way on the road at the colored school in Eustis.  The County has right of way over to SR 44, which the people had given.  This road is in District 4 and 5.  The people will pay for the asphalt.

Mr. Simpson read a letter from Mr. Elliott re a cave-in in Mount Plymouth.

Mr. Owens advised the Board that Bob Norris, County Agent, needs a mower at the Center.  He has found a second-hand one that will cost $200.00.  Motion by Commr. Babb seconded by Commr. Dykes and carried, that R. E. Norris, County Agent, be authorized to purchase the snappin’ turtle mower for $200.00.

Dewey Livingston, Commissioner Elect, appeared before the Board and stated it has been brought to his attention that pilings were left in Lake Dorr by the Bombing Squadron during World War II.  These pilings are rotted and are causing a hazard and the cabin owners around the lake have asked that the Board request the Navy to remove same.  Motion by Commr. Babb seconded by Commr. Dykes and carried, that C. E. Duncan, Attorney for the Board, be instructed to contact the Commandant of the Sixth District, U.S.N. Jacksonville, to find out the proper procedure for requesting the removal of the pilings located in Lake Dorr in Lake County.

Clerk Owens advised the Board that Mrs. Robertson needs a new desk as the new IBM typewriter will not fit in the desk she is using.  Mr. Owens was instructed to get quotations on the kind of desk she wants.

Bob Webb, Assistant Zoning Director, appeared before the Board and stated a Resolution adopted on December 4, 1961, in regard to zoning, was in error.  WHEREUPON, on motion of Commr. Dkyes, seconded by Commr. Babb and carried, the following Resolution was adopted to correct the error:

WHEREAS, heretofore, on the 4th day of December 1961 the Board of County Commissioners did consider certain recommendations of the Lake County Zoning Commission for changes in zoning and did adopt a Resolution making the changes recommended by the said Zoning Commission; and

WHEREAS, it appears that in the Resolution, paragraph number 3, the property thereafter particularly described, was, through error, changed and rezoned to Classification C-1 (Commercial); whereas the application was for change of Classification C-1 (Commercial) and the designation “C-1” was, by clerical error;

NOW, THEREFORE, BE IT RESOLVED BY the Board of County Commissioners of Lake County, Florida, that Section 3 of the Resolution adopted on the 4th day of December 1961, pertaining to the following tract of land in Lake County, Florida:

The West 374 feet of the Northwest Quarter of the Southwest Quarter of Sec. 24, Tp. 19 S., .R. 25 E, lying North of U.S. 441 right of way, less the West 48.27 feet thereof;   ALSO:  a part of the NW 1/4 of the SW 1/4 of Sec. 24, Tp. 19 S., R. 25 E. described as follows:

 

From the NW corner of the SW 1/4 of the NW 1/4 of said Sec. 24, run thence East 440 feet to the East boundary of Haines Creek Road, thence south along the East boundary of said Haines Creek Road 2263 feet to the point of beginning.  From said point of beginning continue south along the East boundary of Haines Creek Road, 367.06 feet, more or less, to the North right of way line of U.S. 441.  Back to the point of beginning run East from point of beginning 150 feet, thence South 200 feet, thence West 50 feet, thence South 196.05 feet, more or less, to the North right of way line of U.S. 441, thence Northwesterly along the North right of way line of U. S. 441, a distance of 104.12 feet, more or less, to intersect the first line described above, which property is located at the corner of Haines Creek Road and U.S. 441, West of Tavares about 3 miles;

 

be amended by striking the last line of said paragraph 3, which reads:  “re-zoned to Classification C-1 (Commercial),” and inserting in lieu thereof the following:  “re-zoned to Classification C-2 (Commercial).”

ZONING RESOLUTION

Bob Webb also presented three applications for changes in present zoning:  W. H. Thompson; Sherman Fletcher; and William Rhodes.

WHEREUPON, on motion of Commr. Babb seconded by Commr. Cowart and carried, the following Resolution was adopted:

WHEREAS, Lake County Zoning Commission did, on the 26th day of July 1962, after due notice of the hearing, review applications for changes and revisions in the zoning of certain areas in Lake County and did approve said changes as requested in the particular applications hereinafter set forth, subject to the approval of the Board of County Commissioners of Lake County, having reviewed said applications, and the recommendations of the Lake County Zoning Commission;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the Zoning Rules and Regulations of Lake County be altered and amended as they pertain to the following tracts of land, to the classification designated after each description:

1.         Lots 26 through 33, according to the Plat of Thompson Estates First addition, recorded in Plat Book 16, page 50, public records of Lake County, Florida, now classified and zoned as A (Agriculture) be, and the same is hereby amended and changed and rezoned to Classification R-1 (Residential).

2.         That part of Government Lot 5 in Section 28, Township 19 South, Range 26 East, in Lake County, Florida, according to page 7 of the Supplemental survey of said Section 28, which lies South of the southerly right of way line of U. S. Highway 441, now zoned R-1-A (Residential) be, and the same is hereby amended, changed and rezoned to Classification C-3 (Commercial).

3.         Lots 45 to 48 inclusive; Lots 51 to 54 inclusive; the South 1/2 of Lots 55 and 56; Lots 57 to 66 inclusive; Lots 75 to 84 inclusive; Lots 95 to 100 inclusive; and Lots 33 to 36 inclusive, all of the above described lots lying and being in Eustis Meadows, a subdivision in Lake County, Florida, according to the plat thereof recorded in Plat Book 1, page 2, public records of Lake County, Florida, LESS AND EXCEPT that part of said Lots 33 to 36 inclusive lying southerly of a line drawn parallel with and 200 feet Northerly from the Southerly meandering line of the low water mark of Lake Serpentine; ALSO:  The South 1/2 of the Northeast 1/4 of the Northeast 1/4 of Sec. 30, Tp. 18 S. R. 27 E. in Lake County, Florida; ALSO:  The North 1/2 of the Northeast 1/4 of Sec. 36, Tp. 18 S., R. 26 E.; ALSO:  Tracts 27 and 28 in Eustis Meadows, a subdivision in Lake County, Florida, according to the plat thereof recorded in Plat Book 1 page 2, public records  of Lake County, Florida; said property also described as the Southeast 1/4 of the Northeast 1/4 of Sec. 356, Tp. 18 S., R. 26 E., now zoned R-1 (Residential) and R-1-A (Residential), be, and the same is hereby amended, changed and rezoned to Classification A (Agriculture).
