MINUTES OF REGULAR MEETING OF BOARD OF COUNTY COMMISSIONERS

 monday – November 5, 1962

The Board of County Commissioners met in regular session in the County Commissioners’ Room in the Courthouse at Tavares at 10:00 a.m. on Monday, November 5, 1962, with the following present:  Chairman Simpson; Commissioners Theus, Cowart, Dykes, and Babb, also Commissioner-elect Livingston. Mr. Owens, Clerk, was absent due to illness and Mr. Duncan was attending Court, but came in for a few minutes during the session.

The Board was called to order by Chairman Simpson.

Mr. Theus gave the invocation.

THE FOLLOWING NOTARY PUBLIC BONDS WERE APPROVED BY CLERK OWENS since the First Regular Meeting in October:

BOND in amount of $10,000.00 with Fidelity and Deposit Company of Maryland of EMMETT B. PETER JR., as Member of the Florida Board of Forestry, who was appointed on October 22, 1962 to serve until his successor is appointed, was approved by the Board.

 

R. E. NORRIS, County Agent, appeared before the Board and requested an increase in the salary of Miss Patty Gravlee to the same amount of the salary of Mrs. Anne Clore - $2,925 – which is an increase of $150.00 per year, WHEREUPON, ON MOTION of Commr. Babb, seconded by Commr. Dykes, and carried, the request of R. E. Norris for an increase in his secretary’s salary was approved.

Motion by Commr. Cowart, seconded by Commr. Theus, and carried, Clerk Owens was authorized to transfer from the contingency item in the general revenue fund from $150.00 to Item #681-7-A.

Clerk Owens was advised that the increase allowed for Dr. Hall, County Health Director, is to be paid on a monthly basis.

NOTICE HAVING BEEN ADVERTISED FOR PURCHASE OF FURNITURE FOR THE SMALL CLAIMS COURT OFFICE, the following bids were received:

Motion by Commr. Cowart, second by Commr. Babb, and carried, that the bids be taken under advisement and referred to Howell Hopson, Architect, for study and report  to the Board before noon.

Before noon, Mr. Hopson reported to the Board that the low bid on the furniture for the Small Claims Court was Hilltop Book Nook of Clermont, but they did not bid on Item B and did not bid on the desk for the Clerk’s office. Therefore, Mr. Hopson recommended that the low complete bid be accepted, which is Leesburg Typewriter Service at the price of $2,906.69, as definite low bid, WHEREUPON, on motion of Commr. Dykes, seconded by Commr. Theus, and carried, the low complete bid of Leesburg Typewriter Service was accepted.

Mr. Hopson advised the Board that Simons Office Equipment was just 31¢ over the low bid of Leesburg Typewriter service.

JUVENILE SHELTER:

Mr. Hopson presented Request No. 2 of David D. Morris, Contractor, on the Juvenile Shelter in amount of $5,872.50, and recommended approval for payment. WHEREUPON, on motion of Commr. Dykes, seconded by Commr. Babb, and carried, Request No. 2 of David D. Morris, Contractor, in amount $5,872.50 on work for the Juvenile Shelter was approved for payment.

CHANGE ORDER NO. 2 on Juvenile Shelter in amount of $375.65 - providing additions to the existing sound system in accordance with specifications, was presented by Mr. Hopson, WHEREUPON, on motion of Commr. Dykes, seconded by Commr. Babb, and carried, CHANGE ORDER NO. 2 was approved.

Mr. Hopson advised the Board that he met with the Board of Visitors of the Juvenile Shelter and they have provided a list of necessary equipment for the Shelter. Mr. Hopson suggested that he be authorized to advertise for bids for the equipment for the Shelter, WHEREUPON, on the motion of Commr. Babb, seconded by Commr. Dykes, and carried, Howell Hopson, architect, was authorized to advertise for bids on equipment for the Juvenile Shelter, as recommended by the Board of Visitors and Mr. Hopson.

Mr. Hopson advised the Board he will get quotations on the drapes for the December meeting.

CHAMBER OF COMMERCE BUILDING:

REQUEST of J. P. Hutchinson, contractor, for the 10% which was held up at the final request June 28, 1962 - in amount of $455.00, plus extras in the amount of $188.50; $40.00 and $26.88 - total amount being $710.38, was approved for payment on motion of Commr. Dykes, seconded by Commr. Babb, and carried.

NOTICE HAVING BEEN ADVERTISED FOR BIDS FOR QUARTERLY MAINTENANCE ON COUNTY OWNED TYPEWRITERS (exclusive of IBM)

 and also on County owned adding machines, the following bids were received.

Motion by Commr. Cowart, seconded by Commr. Babb, and carried, that the bids be taken under advisement and find out what the contract was last year.

COUNTY ENGINEER - Mr. Gordon Hays - was introduced to the Board Members at this time by Commr. Theus.

GAS FOR AGRICULTURAL CENTER:

It was brought to the attention of the Board that two companies have put gas tanks at the Center, and someone should find out about this. It was suggested that later the Board advertise for bids on furnishing gas for the Center.

RE: PURCHASING A PIECE OF PROPERTY LOCATED EAST OF DEAD RIVER:

Mr. Duncan advised the Board that the State Road Department has acquired a piece of property East of Dead River and Lake County can purchase it for the sum of $500.00. a building is located on the property. This would make an excellent Park for Lake County, which would be a joint deal with the County and the Road Dept. the land has been appraised by C. B. Treadway at $2,600.00.

Motion by Commr. Dykes, seconded by Commr. Babb, and carried, that the County Attorney - C. E. Duncan - be authorized to purchase the property East of Dead River for a Park for the sum of $500.00. (GOVT. LOT 5, Section 24-19-25)

FLORIDA STATE TURNPIKE AUTHORITY BRIDGE DATA DRAWING #12.4-1 -

COUNTY ROAD OVER PARKWAY CONTRACT 12.4.

This data was presented to the Board with a letter from the Authority requesting that the drawing be reviewed, commented on and/or approved. Said bridge being over a clay road South of SR 561-A (Sheppard Lake to Montverde) in Section 32-19-26, WHEREUPON, on motion of Commr. Dykes, seconded by Commr. Babb, and carried, the Chairman of the Board - Hon. O. M. Simpson - was authorized to sign the Drawing. Return the original (slick copy) and retain two copies.

            INVITATION from Southwest Florida Water Management District to attend a meeting of the Board of Governors to be held in Ocala at the Ocala Boat Club, on Friday, November 16, 1962, with a letter from Mr. Virgil L. Milbrath, County Attorney of Marion County, urging the Commissioners to attend the meeting was read. The Board will decide on next Monday how many can go.

            RIVERWOOD UNIT NO. 2 in Section 25-19-25 was presented by E. T. Hall, Engineer, who stated this ties into a county road. Lawyers Title and Insurance policy No. 269-334 showing no restrictions on the property was presented. Letter from Lake County Health Unit with Orange State Engineers’ report was filed. WHEREUPON, on motion of Commr. Babb, seconded by Commr. Cowart, and carried, the Plat of Riverwood Unit No. 2 was approved.

Zoning Director Webb appeared before the Board and read a clipping from the Tampa Tribune re: Levy organizing a technical action panel to co-ordinate and make available technical services, advice, and council of all the USDA agencies to all county and area development and planning groups. Mr. Hanson suggested that the Board of County Commissioners obtain a new soil survey for Lake County. This County was one of the first to have a survey, which was made in 1923. Attorney Duncan was instructed to request USDA to furnish Lake County a revised Soil Survey, on motion of Commr. Dykes, seconded by Commr. Cowart, and carried.

SR S-433 (From SR 46 near Cassia Station to Orange County Line)

Clerk read a telegram from State Road Department stating the low bidder for construction of this road is J. D. Manly Construction Company of Leesburg at $149,583.72.

FOLLOWING INSTRUMENTS WERE FILED RE THIS ROAD:

RIGHT OF WAY CONTRACT in quadruplicate

COUNTY COMMISSIONERS’ RESOLUTION in triplicate

STATE ROAD DEPARTMENT RESOLUTION and LOCATION MAP SURVEY

WHEREUPON, on motion of Commr. Babb, seconded by Commr. Dykes, and carried, the following resolution was adopted:

WHEREAS, the State Road Department of Florida has authorized and requested Lake County to furnish the necessary rights of way, borrow pits and easements for that portion of Section 11580, State Road S-433, extending from Orange County Line Northwesterly to State Road 46, which has been surveyed and located by the State Road Department as shown by a map on file in the office of the Clerk of the Circuit Court of said County, and in the office of said Department at Tallahassee, and

WHEREAS, the said Department will not begin construction of said portion of said Section in said County until title to all land necessary for said portion of said Section had been conveyed to or vested in said State by said County, and said lands are physically cleared of all occupants, tenants, fences, buildings, and/or other structures and improvements upon or encroaching within the limits of the land required for said portion of said Section; and

WHEREAS, the said County is financially unable at this time to provide the necessary funds to acquire said rights of way, borrow pits and easements; now therefore, be it

RESOLVED, that the State Road Department of Florida be and it is hereby requested to pay for the rights of way, borrow pits and easements for said road, including the removal of buildings, fences, and other structures and improvements thereon, and for other expenses of acquiring title to said rights of way, borrow pits and easements by purchase or condemnation, from such funds and under such conditions as are set out in the contract hereto attached; and be it further

RESOLVED, that said County, through its Board of County Commissioners, comply with the request of said Department and procure, convey, or vest in said State the free, clear, and unencumbered title to all lands necessary for said portion of said Section, and deliver to the State Road Department said lands physically clear of all occupants, tenants, fences, buildings, and/or other structures and improvements situate upon or encroaching within the limits of the lands required for said portion of said Section, and that the Chairman and the Clerk of this Board be and they are hereby authorized and directed to execute and deliver on behalf of said County to said Department the Contract in the form hereto attached; and be it further

RESOLVED, that the Attorney for this Board be, and he is hereby authorized and directed to proceed to take the necessary steps for the County to acquire in the name of said County by donation, purchase, or condemnation papers, affidavits, and pleadings, and prosecute all condemnation proceedings in judgement; and furnish to the Department the abstract search provided for in said Contract.

REQUEST OF R. G. CASSADY, TAX ASSESSOR FOR COMMISSIONS:

Commissions on 1962 Tax Roll for South Lake Memorial Hospital District                     $542.81

Commissions on 1962 Tax Roll for general county levy in amount of                          $21,521.78

The bill was approved on motion of Commr. Cowart, seconded by Commr. Dykes, and carried.

REQUEST from HISTORICAL SOCIETY OF LAKE COUNTY to enter into a contract with Clements’ Pest Control and Garden Supply for yearly treatment for termites in the building. The cost will be $145.00.  This treatment will also cover the first year of a 5-year contract, the annual service charge for the other four years being $15.00 per year, WHEREUPON, on motion of Commr. Theus, seconded by Commr. Dykes, and carried, the Lake County Historical Society was authorized to enter into a 5-year contract with Clements’ for treatment for termites in the Building on the above stated basis.

MARSHALL’S REPLAT IN SECTION 12-19-26.

Tom Sawyer, representing Mrs. Dillard, appeared before the Board and presented the Replat, which is a replat of a replat of Irvin’s Subdivision. The reason for this Replat is to clear up title in order to vacate two streets. Mr. Sawyer stated he has checked with Mr. Duncan and he states Zoning does not come into this, as it is just turning back into acreage. The two streets - Marsh Street and Satsuma Avenue - have never been opened and are not now being used for streets. He presented title binder by lawyer’s Title Inc. #B-538194, dated October 29, 1962, at 8 o’clock a.m. showing that the title is vested in Audry Dillard Jackson.  Commr. Dykes suggested that the Zoning Director sign the Plat. Commr. Babb moved that the Plat be accepted. Motion seconded by Commr. Dykes, and carried.

CANCEL WARRANT:

Motion by Commr. Babb, seconded by Commr. Theus, and carried, that the Fine and Forfeiture warrant #874 in amount of $6.40 made payable to George Arnold for witness fee County Judge’s Court be canceled, at the request of Mr. Arnold.

REQUEST OF COUNTY JUDGE TO PURCHASE ITEMS AS FOLLOWS was read:

Electric typewriter for Juvenile Court Office - Smith Corona at                                        $400.50

Mailing scale for County Judge’s office                                                                              $180.25

Motion by Commr. Babb, seconded by Commr. Dykes, and carried, that the County Judge be authorized to purchase the items as listed above.

MEETING ADJOURNED FOR LUNCH

MEETING RECONVENED AT 1:15p.m.

Gordon Hays, County Engineer, advised the Board that he will need some book cases in his office.  Commr. Dykes stated he will request Babe Coven to build the book cases.

CIVIL DEFENSE PREPAREDNESS MEETING AT WESTCOTT AUDITORIUM, FSU, TALLAHASSEE from ten a.m. to three thirty p.m. Thursday, November 8, 1962. Telegram from Farris Bryant, Governor, requesting the Commissioners, Sheriff, Director of Civil Defense, and Mayors of municipalities to be present at this meeting was read and some of the Board members stated they will go.

PETITION to vacate part of Plat of Lake Ella and Part of Plat of Dundee Subdivision was presented by Mr. Booth of Cherry and Booth, law firm, Leesburg. The petition was referred to

Mr. Duncan to study and report to the Board.

RESOLUTION OF FLORIDA STATE TURNPIKE AUTHORITY confirming and ratifying request to have SR 19 designated as U. S. ROUTE #23 was read and filed.

SR S-470 Section 11670-2601 South of Okahumpka to Sumter County line. Copy of Title Report on this road was filed. Original and one copy having been sent to State Road Department by C. E. Duncan on October 29, 1962. 

PROGRAM FOR INDIGENTS:

The Board Members, Mr. Duncan, Dr. Hall, and Mrs. Sudderth, attended a breakfast this morning at the Waterman Memorial Hospital in Eustis, at the request of Mr. Budge Mead and others. Mr. Simpson gave a report on the meeting, stating that a Committee of three - Mr. Huffstettler, Dr. Tyre, and Mr. Gaylord - was appointed to meet with the Board of County Commissioners, at some future date. Dr. Hall, Mrs. Sudderth, Mr. Duncan, Mr. Dykes, and Mr. Livingston will meet with the Committee.

After discussion on what to do about the list of cases previously presented to the Board by the Hospitals, Commr. Babb moved that the Board pay $15.00 per day on all eligible bills that have been presented to this Board and meeting County requirements. The motion was seconded by Commr. Dykes, and on roll call by Districts, the vote was as follows: District One - yes: District Two - yes: District Three - yes: District Four - yes: District Five - yes. Therefore the motion was carried unanimously. (The payments to be paid out of this year’s budget) The Hospitals being as follows: Waterman Memorial Hospital; South Lake Memorial Hospital; Durham-Young Hospital; Theresa Holland Clinic and Hospital.

ASSISTANCE TO HANDICAPPED PERSONS, OR BLIND:

Mr. Irving Morse appeared before the Board, representing District No.11 Welfare Board in the interest of handicapped persons. He inquired as to whether or not the Board is making any provisions in remodeling the Courthouse to have a stand downstairs to be operated by some handicapped person. Is there an opportunity here for a handicapped person? The District Board has asked me to ask you to consider this in your plans. Commr. Dykes stated this has been investigated by the Lions Club and they turned in a negative report as not being warranted. However, Mr. Moore did not agree with this as the public needs such a service. Mr. Morse suggested that a central switchboard be installed in the Courthouse. He also suggested that the old elevator be kept in operation even if a new one is installed.  Judge Milton was present and did not approve keeping the old elevator.

HEAD COUNSELOR FOR JUVENILES:

County Judge Milton appeared before the Board and advised that W. T. Mills was confirmed the first of November as Head Counselor. The Merit Board recommended this, therefore, he now requests that W. T. Mills’ salary be increased to $6,000.00 per year as Head Counselor as of November first, WHEREUPON, on motion of Commr. Dykes, seconded by Commr. Babb, and carried, W. T. Mills’ salary was increased to $6,000.00 per year - the salary set up for the Head Counselor - beginning as of November 1, 1962.

Judge Milton advised the Board that the position under counselor is open. Judge Milton requested that Mrs. Seiler, Special Counselor, be authorized to attend a conference in West Palm Beach in December, which is to be attended by the Deans and Counselors from all over the State. $42.50 was left over from the $200.00 allowed on her last trip, and he asked for permission for her to spend this to attend the Conference, which would keep her in good standing with her profession. No action now.

Mr. and Mrs. Elling Peterson, Mr. Chas. Anderson, and several other citizens of Clermont appeared before the Board re: trying to get a railroad crossing in Clermont declared a public crossing. After a lengthy discussion on this matter, Commr. Dykes stated he would talk to Mr. Duncan and see what can be done.

Doug Igou appeared before the Board re: permanent markers or survey on some of his property between SR 42 and SR 44 - Road No. S-439.  He has had three different surveyors survey the land, but they do not agree.  It was suggested that the State Road Department be asked to bring the field notes to Mr. Igou and go over them with him and Mr. Moorhead.  Mr. Hays, county engineer, will contact the Road Department.

TRUCKS TO BE PURCHASED:

District Three needs a big truck with 5-yard capacity with no body, no trade-in. Also needs two 4-yard dump trucks with no body. Trade in on this 2-1958 GMC trucks with 3-yard bodies. Also needs one new ¾ ton 6-cylinder pick-up truck, trade-in1959 ½ ton Chevy truck.

District Five needs two dump trucks and one pick-up truck.

The County Engineer was instructed to contact Steve Pemberton and they are to work out the specifications on these trucks and bids will be taken on 12-10-62.

Bids will also be taken on December 10th on Crushed slag, concrete pipe, corrugated metal pipe, asphalt, diesel fuel, and regular gasoline.
