MINUTES OF REGULAR MEETING OF BOARD OF COUNTY COMMISSIONERS
MONDAY – SEPTEMBER 9, 1963
The Board of County Commissioners met in regular session in the Small Claims Office in the Courthouse at Tavares on Monday, September 9, at ten o’clock A.M. with the following present:
Chairman Dykes, Commrs. Theus, Cowart, Livingston and Babb; Clerk Owens, Attorney Duncan, Engineer Hays, and Zoning Director Webb.
The meeting was called to order by Chairman Dykes.
indigent list
On motion of Commr. Babb seconded by Commr. Cowart, the following changes were made to the present indigent list:

plats
Mr. W. M. Johnson of Clermont appeared with reference to a correction to the plat of Crescent Cove Development. Attorney Duncan stated this will take some study and Mr. Johnson filed a blueprint of the plat with him. Mr. Duncan is to review same and advise Mr. Johnson.
plats
Mr. Brock Steel and T. O. Moorhead appeared and presented plat of Deer Island Estates, owners G. P. S. Corp. located in Section 2, Township 20 South, Range 26 East. Attorney Duncan said the property has access to a County road of sufficient width. Title opinion from Daniel M. Hunter, attorney of Winter Park, states the title is subject to a mortgage executed by Harry Byrd Kline to C. D. Blount and wife Vivian Baxter Blount which has been assigned to Barbara Borling Amstutz and no release of mortgage is on file at this time, however, Mr. Steel advises that one has been requested and promised but not received as yet. Also, there is an easement granted to Edwin Mead for road way and suggest that a report be secured from a surveyor. Mr. Moorhead stated the easement referred to in Mr. Hunter’s letter does not conflict with the easement granted to Edwin Mead and the property included in the plat. The plat has been approved by the Zoning Commission, therefore upon receipt of release of mortgage above referred to, the plat is acceptable.
Mr. Hays, County Engineer, filed letter recommending the property for septic tank installation provided the drain fields be located along the ridge running parallel to the shore line.
On motion of Commr. Babb seconded by Commr. Livingston, the plat of Deer Island Estates was approved subject to release of mortgage as stated above.
roads – county
Mr. J. F. Huff appeared and filed petition which has been signed by eight property owners requesting that this road be kept open; WHEREUPON, on motion of Commr. Livingston seconded by Commr. Babb and carried, the following Resolution was adopted:
WHEREAS, it appears to the Board of County Commissioners of Lake County, Florida, and particularly described as follows:
Begin on the East line of the SE 1/4, where the same intersects the right of way of State Road 44 in Sec. 35, Tp. 18 S. R. 28 E., run thence North to the center of said Sec. 35, thence in a northwesterly direction through the NW 1/4 of said Sec. 35, to a point approximately 700 feet West of the Northwest corner of said Sec. 35, thence continuing in a Northwesterly direction through Sec. 26, Tp. 18 S. R. 28 E., to the Southeast corner of Sec. 22, Tp. 18 S. R. 28 E.;
has been closed by adjoining property owners by fencing the same and putting a gate across said road and by locking said gate with a padlock, so that other property owners using said road, are unable to traverse the same, and
WHEREAS, THERE HAS BEEN FILED BEFORE THE BOARD OF COUNTY COMMISSIONERS, an Affidavit signed by eight persons who own property along said road, or have frequent occasion to use the same, which Affidavit states in effect, that the said road has been used by the various property owners owning property contiguous thereto for more than twenty (20) years; and that said road, by continual use, has become a public road by prescription and should remain open for the use of the public, and particularly parties owning properties contiguous to said road;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the parties who have placed the barrier across said road in the form of a padlocked gate, be required to remove the same with permission to install a cattle guard within their discretion, in order to permit free passage along said road by the public and the parties above particularly mentioned.
BE IT FURTHER RESOLVED that in the event said road is not opened for use as above set forth, the Honorable Willis V. McCall, as Sheriff of Lake County, be, and he is hereby empowered and instructed to remove the obstruction above mentioned and to open the road so that the same may be used and traversed by the public and the parties particularly above mentioned.
county agent – weather circuit
Mr. R. E. Norris, County Agent, appeared with reference to the U. S. Weather Bureau installing teletypewriter circuit to the Agricultural Center office, at a cost of $37.75 per month from November 1, 1963 through March 31, 1964 with an installation charge of $20.00. Mr. Norris gave a brief outline of the advantages this service will be to the County and stated there will be no additional salary cost as his employees have stated their willingness to take on this additional service.
game & fresh water fish commission
Mr. T. L. Garrison of the Game and Fresh Water Fish Commission appeared with reference to the County giving an easement for a public boat ramp on the Palatlakaha River North of Lake Louisa; WHEREUPON, on motion of Commr. Livingston seconded by Commr. Babb and carried, the following Resolution was adopted:
BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that a permanent easement be and is hereby granted to the State of Florida for the use and benefit of the State Game and Fresh Water Fish Commission of Florida, for the purpose of locating and constructing a boat ramp for launching and loading boats from boat trailers upon the following described tract; said boat ramp to be located within a one acre tract, to be more definitely selected by the State Game and Fresh Water Fish Commission of Florida at the time of installation, located, however, within that portion of Government Lot 3 in Sec. 7, Tp. 23 S, R. 26 E. lying westerly of the Palatlakaha River.
BE IT FURTHER RESOLVED that upon the selection and determination of the description thereof, the Chairman and Clerk of the Board of County Commissioners be, and they are hereby authorized to execute and deliver a Permanent Easement, including a definite description therefor.
Mr. Garrison advised that money has been appropriated by the State for boat ramp installation and asked that he be notified of any available property for this type installation.

On recommendation of the County Attorney and on motion of Commr. Babb seconded by Commr. Livingston, deed was accepted conveying the following described property to Lake County and ordered same recorded upon the public records:
GRANTORS - J. F. Sparks and wife, Dorothy C. Sparks of Tavares, Lake County Florida and J. J. O’Connell and wife, Miriam O’Connell of the County of Bristol and State of Massachusetts
Lot 23 in Sparks’ Village, according to Plat thereof, filed and recorded in the public records of Lake County, Florida, in Plat Book 13, Page 58, together with a permanent easement for the use of a Canal extending from Lake Harris to the Westerly boundary of Lot 23 above described. PROVIDING, however, that said Lot 23 shall be used by the public solely for the purpose of launching and landing boats, and the parking of boat trailers on said area temporarily while boats are in use.
WHEREUPON, on motion of Commr. Babb seconded by Commr. Livingston, the following Resolution was adopted:
WHEREAS, the following described tract of land, being the property of Lake County, located in Lake County, has been declared non-essential for County purposes:
That portion of the lake bottom of Lake Harris located in, or adjacent to, fractional Sec. 25, Tp. 19 S. R. 25 E., described as follows:
All that part of the lake bottom of Lake Harris lying Southwesterly of the mean high water mark, and included within the following described tract: Begin at a point of 482.17 feet East and 545.14 feet South of the Northwest corner of Sec. 25, Tp. 19 S. R. 25 E., and run thence South 53°42’30” East 45.17 feet, thence run South 58°28’40” East 236.21 feet, thence South 44°99’40” East 128.36 feet thence South 34°08’20” East 13.68 feet to the point of beginning of this tract, thence continue at the same angle 341.5 feet, thence South 41°14’40” East 243 feet more or less to the water’s edge of Lake Harris, at the mouth of Dead River; begin again at the point of beginning, run thence South 47°09’10” West 169.90 feet to a bulkhead, thence run Southeasterly through the waters of Lake Harris a distance of 548 feet more or less, to a point 100 feet Southwesterly, and at right angles to the last call of the Northeasterly boundary of this tract, thence Northeasterly to the mean high water mark of Lake Harris at the mouth of Dead River, the Southerly point of the Northeasterly boundary of this tract; the title to which property is vested in Lake County, under and by virtue of Chapter 10811 of the Special Acts of the Legislature of Florida, 1925 Session;
and
WHEREAS, a Notice of Exchange of said tract of land for a tract of land located in Lake County, Florida, described as follows:
Lot 23 in Sparks’ Village, according to Plat thereof, recorded in the public records of Lake County, Florida, in Plat Book 13, Page 58, together with the right to use the Canal extending from said Lot into Lake Harris, and restricted to loading and launching of boats, and parking of boat trailers temporarily;
has been published, due proof of which has been filed with the Board of County Commissioners of Lake County and which provided that the Board of County Commissioners would, on the 9th day of September 1963 at 10:00 o’clock in the forenoon, consider such exchange of properties and consider the adoption of a Resolution authorizing such exchange, and
WHEREAS, no one appeared to object to said exchange, and the County Commissioners having received appraisal of said properties above described, showing that the value of the land offered in exchange for land of Lake County, is in excess of the value of the tract owned by Lake County; and that the exchange will be for the benefit of Lake County;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the Chairman and Clerk of this Board be, and they are hereby authorized and empowered to execute a Deed conveying the tract of land owned by Lake County and above particularly described to J. F. Sparks and wife, Dorothy C. Sparks, and J. J. O’Connell and wife, Miriam O’Connell and to exchange the same with said Grantees for a deed executed by them, conveying to Lake County, the tract of land last above described, together with the rights and privileges therein mentioned.
Bill from C. B. Treadway in the amount of $25.00 appraisal fee on this property was approved for payment by the Board.
right of way
Representatives of the Apopka Natural Gas District, Mr. Charles Roe and Mr. Bentley, Engineer, appeared with reference to 3-1/2” pipeline their company is installing on County rights of way in the towns of Montverde, Mascotte, Groveland, Minneola and Clermont. Chairman Dykes said this is in his district and his main concern is that the rights of way will be restored according to the requirements of his road foreman. Attorney Duncan suggested that the County enter into the same type agreement as the State Road Department does for restoration of County roads. Engineer Hays was authorized to meet with Mr. Bentley and Mr. Roe in the near future and execute the proper use permit for this work.
complaints
Chairman Dykes said he has had several complaints from the Lakewood Park area that boats are being parked in the canals in Lakewood Park and are obstructing traffic in the canals. Attorney Duncan was instructed to check into this matter with Mr. George Daugherty.
At the request of the Chairman, Mrs. Evelyn Thompson again appeared regarding an encroachment on her property. Attorney Duncan stated he had talked to the County Prosecutor about this and on his recommendation, the County Prosecutor was called to the meeting to give his opinion that civil action should be instituted rather than criminal action. Attorney Duncan was instructed to advise Mrs. Thompson in this matter.
courthouse remodeling
Mr. Howell Hopson, Architect, appeared regarding stainless steel door on floors 2, 3, 4, and 5 for the new elevator to be installed. The contract only calls for stainless steel doors on the first floor. On motion of Commr. Cowart seconded by Commr. Babb, the Board approved the installation of stainless steel elevator doors for floors 2, 3, 4, and 6 at an additional cost of $1,583.40.
Mr. Hopson showed a picture of the Courthouse when completed. He is returning the picture to the artist for final work and when it is completed will present same to the Board.
relief
Attorney Duncan said he has a letter from Mrs. Myrtle Sudderth, County Welfare Worker, with reference to Mr. & Mrs. Harry G. Weitzel of Sorrento. It has been brought to Mrs. Sudderth’s attention that the Weitzels have a considerable bank account in an Orlando bank. According to Mrs. Sudderth, the County has expended $1,421.82 to aid the Weitzels. Mr. Duncan was instructed to advise Mrs. Sudderth to proceed with negotiations to recover this money.
juvenile home
Engineer Hays reported on his investigation of the electric bills for the Juvenile Home. Said he has checked with the power company and we are getting commercial rates. He has asked that a representative from the power company go over the equipment and outlets installed in the home but as of this date no one from the power company has been there to make the inspection.
mosquito control building
On recommendation of Engineer Hays and on motion of Commr. Theus seconded by Commr. Babb, the Attorney was instructed to write Inland Steel Company requesting that a representative be sent to inspect the work of Orlando Building Service, Inc. Motion was unanimously carried.

Application of Waldron F. Schanz for the position of Civil Defense Director was read and filed.
Mr. Jack Jones of Leesburg appeared stating he is a qualified architect practicing in Leesburg and would like to be remembered when there is any County building going on.

PROPOSED UNIVERSITY SITE
Mr. W. H. (Bill) Reedy appeared with reference to the inspection of the proposed university site by the members of the Board of Control on September 17th. The Commissioners assured Mr. Reedy that the members will be present on this inspection tour. On motion of Commr. Babb seconded by Commr. Theus, the Clerk was instructed to extend an invitation to the following persons to be present on the tour:

highway patrol station
Mr. Reedy said the money for the construction of a highway patrol station in Lake County is available; WHEREUPON, on motion of Commr. Babb seconded by Commr. Cowart, the Attorney was instructed to write the Governor requesting release of funds for construction of highway patrol station.
recess and reassembly
The Board recessed for lunch at 12 o’clock noon and reassembled at 1:30 o’clock P.M. to take up the remaining items of business.
industrial & tourism commission
Mr. Everette Huskey appeared and reported on the advertising program under the direction of Mr. Al Rehbaum and his committee.
Mr. Huskey called attention to the future benefit to the County of four laning SR-46 and urged the Commissioners to take this into consideration when designating future road work.
Commr. Theus filed letter of resignation from R. Parks Williams as a member of the Industrial and Tourism Commission. Commr. Theus will appoint two new members to replace Mr. Williams and Mr. Butler.
oklawaha water authority
On motion of Commr. Livingston seconded by Commr. Babb and carried, the following vouchers for the Oklawaha Water Authority were approved for payment:

accounts allowed
Clerk Owens advised the Board that payment of the principal and interest on Certificates of Indebtedness is due October 1, 1963 – interest $16,675.00 and principal $60,000.00 making a total of $76,675.00 due; WHEREUPON, on motion of Commr. Babb seconded by Commr. Livingston and carried, Clerk Owens was authorized to issue warrant in the amount of $76,675.00 on Bond interest and Sinking Fund, County Buildings, to Bankers Trust Company of New York for interest and principal due on October 1, 1963 on Certificates of Indebtedness issued for the construction of the Jail and Sheriff’s Department and also the remodeling of the Courthouse.
On motion of Commr. Babb seconded by Commr. Cowart and carried, purchase of air conditioner for the Circuit Judge’s Chambers from Charles Butler in the amount of $278.45 was approved.
Requisition from Clerk of the Court for $500.00 advance for paying State Trial Witnesses at the Fall Term of Court was approved on motion of Commr. Theus seconded by Commr. Livingston.
On motion of Commr. Theus seconded by Commr. Babb and carried, the Clerk was authorized to purchase two (2) Globe-Wernicke Color Guard Series Filing Cabinets, 5 drawer legal size #1052, with vinyl clad snap-on fronts, at a price of $120.00 each, from Leesburg Typewriter Service.
On motion of Commr. Livingston seconded by Commr. Cowart, the Clerk was instructed to deposit check from Givens-Jackson Groves dated 8/14/63 in the amount of $76.12 in payment for culvert under County road to the Road & Bridge Fund.
Letter from the Town of Lady Lake returning Warrant #1143 in the amount of $234.76 was read and check was accepted on motion of Commr. Theus seconded by Commr. Livingston and the Clerk was instructed to deposit same to the Road & Bridge Fund.

On recommendation of Zoning Director Webb, the Board approved Rules of Procedure for the Board of Zoning Appeals and on motion of Commr. Theus, seconded by Commr. Babb, the following Resolution was adopted:
WHEREAS, the Board of Zoning Appeals has prepared and submitted to the Board of County Commissioners its Rules of Procedures under which all appeals shall be initiated, processed and handled, and
WHEREAS, the Board of County Commissioners has reviewed said Rules of Procedure and find them to be reasonable as to procedure and costs.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the Rules of Procedure, as established by the Board of Zoning Appeals for Lake County and submitted to the Board of County Commissioners for consideration and approval be, and the same are hereby approved and adopted, and that from and after the adoption of this Resolution, all appeals and procedures involving the Board of Zoning Appeals be initiated and processed in accordance with said Rules of Procedure.

Upon presentation by the Zoning Director of recommended amendment to the Southern Standard Building Code and on motion of Commr. Babb seconded by Commr. Theus, the following Resolution was adopted:
WHEREAS, the Lake County Planning and Zoning Commission has presented to the Board of County Commissioners the latest issue of the Southern Building Code in which it appears that amendments have been made to the Southern Building Code heretofore adopted by the Lake County Planning and Zoning Commission and the Board of County Commissioners, and
WHEREAS, it appears that it will be in the best interest of Lake County that the amendments adopted by, and included in the Southern Building Code, be adopted by the Lake County Planning and Zoning Commission and the County Commissioners;
NOW, THEREFORE, the Board of County Commissioners of Lake County, Florida, does hereby adopt and make an official part of the Building Code requirements for the Lake County Planning and Zoning Commission and the Board of County Commissioners, the Southern Building Code as presented to the Board of County Commissioners by the Lake County Planning and Zoning Commission and that from and after the adoption of this Resolution the Southern Building Code, as amended, shall be the Code under which all permits shall be issued and the Code under which all buildings shall be constructed.
