MINUTES OF special MEETING OF BOARD OF COUNTY COMMISSIONERS

 friday – august 13, 1965

The Board of County Commissioners met in special session in the Commissioners’ Room in the Courthouse at Tavares on Friday, August 13, 1965, at 9:00 o’clock A.M. for the purpose of considering a letter from the State Road Department dated August 10, 1965 pertaining to State Road 19 through Eustis, Law Case No. 7735.

The meeting was called to order by the Chairman with the following members present:  Chairman Livingston; Commrs. Cowart, Dykes and Babb; Clerk Owens; and Attorney Duncan.  Commr. Theus was absent.

condemnation proceedings

Chairman Livingston requested the Attorney to review the actions of the Board with reference to the Blakeley property.  Attorney Duncan advised that prior to the road suit, the Board adopted a resolution requesting the State Road Department to pay the Blakeleys a reasonable amount for the destruction of the building, which request was denied by the State Road Department.  On August 9, the Board adopted another resolution requesting payment to the Blakeleys, which resolution has not been drawn, but the State Road Department was advised of same.  The Board is now in receipt of a letter from the Legal Division of the State Road Department in which they advise the resolution adopted on August 9 is in direct contravention of the Right of Way contract between Lake County and the State Road Department

On a motion by Commr. Dykes, seconded by Commr. Babb and unanimously carried, a resolution was adopted rescinding the action of the Board on August 9 and voiding the resolution of that date pertaining to the Blakeley property.

Attorney Duncan was directed to write a letter to the State Road Department stating this Board was not aware it was in violation of the Right of Way Contract.

 Clerk Owens stated Commr. Theus called and said he could not be present at this meeting, but he has received a copy of the State Road Department’s letter and is in favor of the Board rescinding the resolution of August 9.

Attorney Duncan said he will call the State Road Department and advise them of the action of the Board today.

road & bridge department – county property

Chairman Livingston stated due to the great distance his trucks have to travel to haul overburden, he would like to acquire two to four acres to be used as a clay pit at a price not to exceed $500 per acre.  On a motion by Commr. Babb, seconded by Commr. Dykes and carried, Don Driggers was appointed appraiser on Bill Herrington’s property east of Eustis, and the Engineer was instructed to supply the description of the property.

Clerk Owens submitted a letter from Lane Blanton, owner of Hilltop Nursery, inquiring if the County has ever determined that County clay pits may contain the Burrowing Nematode, and if not, would the County be willing to have the clay pits certified, and if the pests are found, to confine the use of clay used in citrus areas to the certified pits.

Clerk Owens was instructed to write Mr. Blanton that the Board is willing to ask for certification of its clay pits from the Division of Plan Industry and is willing to cooperate 100 percent in helping to control the spread of the Burrowing Nematode.

audits

The Clerk presented a letter from the State Auditor with a list of adverse findings which will be included in the audit report for the period October 1, 1963 to September 30, 1964.  The list of adverse findings was read and filed.  Commr. Dykes stated he is in favor of a central road and bridge department.

roads – state

Designs of typical sections on the following roads were approved on a motion by Commr. Cowart, seconded by Commr. Dykes and carried, and the Clerk was authorized to execute same and return them to the State Road Department:

Job 11520-8601 – Bay Lake to State Road 50

Job 11510-8602 – Orange County Line to State Road 46

Job 11550-8602 – Silver Lake Road and Connection to State Road 44

Job 11506-8602 – Woodward Avenue, SR S-452 to Grove Street in Eustis

There being no further business to bring before the Board, the meeting adjourned at 11:00 o’clock A.M.
