MINUTES OF special MEETING OF BOARD OF COUNTY COMMISSIONERS

 tuesday – october 25, 1966

A special meeting of the Board of County Commissioners of Lake County, Florida, was held in the Commissioners’ Room in the Courthouse in Tavares, Florida, at 4:00 o’clock P.M. for the purpose of considering the purchase of ten acres of land to be used as a county clay pit.

The Chairman called the meeting to order with the following members present:  Chairman Theus, Commrs. Cowart, Dykes, Livingston and Babb.  Also present were Attorney Duncan, Engineer Hays, Clerk Owens and Deputy Clerk Norma Coven.

appraisals

Clerk Owens submitted for the Board’s approval appraisal made by Edwin R. Waite on the following described property:

The East 1/4 of the NE 1/4 of the NW 1/4 of Section 13, Tp. 21 South, Range 25 East, lying South of the right of way of SR 455,

and giving the market value as follows:

                        5 acres mature trees, including crop @ $2500.           $21,500.00

                        3 1/2 acres young trees                      @   1400.              4,900.00

                        1 1/2 acres skips                                @     500.                 750.00

                                                                                                            $18,150.00

On motion made by Commr. Babb, seconded by Commr. Dykes and unanimously carried, the appraisal of Edwin R. Waite dated October 24, 1966 on the above described property was accepted and approved.

The right of way agent was present and advised the location of the property is advantageous to the county as a clay pit in that hauling distance will be shortened.  Mr. Dillard further advised there is approximately 4 1/2 to 5 acres of clay n the tract and he believes the fruit on the trees can be sold.  The Engineer stated there is fill dirt on the property that is badly needed by the county.  The Clerk advised the assessed value of the property is $4,300.00.

On motion of Commr. Dykes, seconded by Commr. Babb and carried, a resolution was adopted authorizing the purchase of the property in the amount of $13,300.00 when title binder and deed are furnished by Lake Italy Groves, Inc.

Motion was made by Commr. Dykes, seconded by Commr. Livingston and carried, authorizing the Chairman and Clerk to execute contract between Lake Italy Groves, Inc. and Lake County, and also authorizing the payment of Federal and State stamps on the deed when recorded.

Road closings

Attorney Duncan presented petition to close certain streets in Lowell’s Addition to Lane Park, whereupon, on motion of Commr. Dykes, seconded by Commr. Cowart and carried, a resolution was adopted authorizing advertising for a public hearing to be held November 14, 1966 of the intention to close the following described streets:

First, Second, Third, Fourth and Fifth Avenues, and First and Second Streets, according to said Plat entitles Lowell’s Addition to Lake Park:

LESS:  That part of Second Street lying between Lot 7, Block 1, and Lot 1, of Block 2, of said Lowell’s Addition to Lane Park.

Condemnation proceedings

Attorney Duncan presented bills for services rendered in condemnation suits and on motion of Commr. Dykes, seconded by Commr. Babb and carried, the Attorney was authorized to forward bills on Case No. 7150, SR 25, Shadley, in the sum of $12,000 and Case No. 7114, SR 470, Tyndall in the sum of $1,500 to the State Road Department for payment from Secondary funds.

Mosquito control

Clerk Owens advised the Mosquito Control Directors reports the bulldozer used at the Tri City Dump is broken down and in dire need of repairs amounting to approximately $1500 to $1800, whereupon, on motion of Commr. Dykes, seconded by Commr. Cowart and carried, the Board adopted a resolution declaring the repairs to the bulldozer an emergency and authorizing that the repairs be made without bids.

Suits affecting county

On recommendation of the Attorney and on motion of Commr. Livingston, seconded by Commr. Babb and carried, the Board authorized payment of filing fee on Petition to Designate Successor Trustees regarding Seminole Springs Cemetery near Cassia, Chancery Case No. 25,325.

Maps & Plats

On recommendation of the Attorney and on motion of Commr. Babb, seconded by Commr. Livingston and carried, the Board adopted a resolution vacating the following described property located in Silver Lake Estates:

Blocks 9 and 10 of Silver Lake Estates, according to plats thereof recorded in Plat Book 5, pages 1 and 2, and Plat Book 10, pages 66 to 69 inclusive, of the Public Records of Lake County, Florida, together with roads surrounding each of said blocks, the same being and constituting the South 1/2 of the Northeast 1/4 of Section 11, Township 19 South, Range 25 East, in Lake County, Florida.

Subject to right of Lake County, Florida, to road right of way as described in Law Case No. 7434 presently pending in the Circuit Court of Lake County, Florida.

Roads – county

On motion of Commr. Dykes, seconded by Commr. Babb and carried, the Engineer was instructed to notify Mr. H. L. Pringle the county will accept deeds and establish two connecting roads between Haines Creek Road and the new SR 473 at the following locations:

            Right of Station 138 + 09.34

            Right of Station 157 + 12.70

Roads – county – road maintenance

The Chairman initiated a discussion with reference to the procedure of establishing prescriptive roads.  The Attorney advised the Statute states that new established roads must be 60’ wide, except farm to market roads.  This requirement does not apply to the present county maintained roads.  If a road has been in use and evidence submitted substantiating this fact, the county may declare the road a prescriptive road.

The Engineer presented a list of the presently maintained county roads together with Lake County Road Map showing the location of the roads.  On motion of Commr. Babb, seconded by Commr. Cowart and carried, the Board accepted the Road Map together with list of roads for filing and adopted a resolution declaring the roads designated by number and delineated on the maps, to be dedicated to the public and the title vested in Lake County, in accordance with the provisions of Chapter 337.31, Laws of Florida 1965.

The Engineer was instructed to add to the list of roads to be improved County Road #1-7807 near Conant, approximately 3/4 mile.

Roads maintenance

The Engineer was instructed to determine the price per mile for improving the following roads located in Marion County:

            Marion County Road #8161 County line to SR 42                            1.384 miles

            Marion County Road #8165 N. Boundary Section 1 & 2,

T 18 S., R. 26 E.                                                                                 1.292 miles

Marion County Road #8872 County line to West                                .519 miles

Marion County Road #7939 County line to SR 450                            .973 miles

Marion County Road # 8147 N. Boundary Sec. 5-18-26 and North   .914 miles &  .961 miles

Road #8165 and #8147 will be improved jointly by Marion and Lake Counties.  The other roads will be maintained by Lake County with cost of same being paid by Marion County.

Road maintenance – subdivision

On recommendation of the Engineer, the Board agreed to discontinue maintaining any streets within the incorporated towns or cities.

There being no further business to bring before the Board, the meeting adjourned at 5:50 o’clock P.M.
