MINUTES OF SPECIAL MEETING OF BOARD OF COUNTY COMMISSIONERS

tuesday, november 15, 1966

The Board of County Commissioners of Lake County, Florida, met in special session on Tuesday, November 15, 1966, at 4:30 o’clock P.M. for the purpose of acting on petition requesting the reconstruction and repaving of streets in Sylvan Shores Subdivision and any other business which might be brought before the Board.

Chairman Theus called the meeting to order with the following being present:  Commissioners Theus, Livingston and Babb; Clerk Owens, Attorney Duncan, Engineer Hays, Zoning Director Webb and Deputy Clerk Norma Coven.

The Chairman called on Engineer Hays to report on the percentage of owners and front feet on the petition at this time.  Engineer Hays stated the petition had 225 signatures on it when originally presented to the Board out of a total of 290 owners.  There are now 208 owners’ names on the petition or 71.72%.  Out of a total of 32,306 front feet there is now 23,149’ or 71.65%.

J. G. Ray, Attorney for the Sylvan Shores Assn., requested the Board to defer action on the petition until Friday in order to give him time to contact the eighteen (18) owners who have withdrawn their names.  Attorney Duncan advised at the time of the hearing yesterday was the last time names could be withdrawn or added to the petition.  Whereupon, on motion of Commr. Babb seconded by Commr. Livingston and carried, the Board rejected the petition for the reason it does not comply with the provisions of the Act.

Clerk Owens advised the notice advertised regarding the extension of zoning within the County which the Board acted on yesterday was not advertised in sufficient time to hold the hearing, whereupon, on motion of Commr. Livingston the Resolution adopted on November 14, 1966 extending zoning within the County was rescinded and the Clerk was instructed to readvertise the hearing for December 5, 1966 at 2 o’clock P.M.  The motion was seconded by Commr. Babb and carried.

On recommendation of the Zoning Director and on direction from the Chairman, the Clerk was instructed to write Rep. Herlong concerning the Urban Planning Assistance Project P-40 Grant for the County and urge the expediting of this Grant.

ROADS – COUNTY

The Board entered into a discussion with reference to roads into groves that have been maintained by the County.  The Attorney advised if three signed affidavits can be obtained certifying a road has been used for commercial purposes for at least twenty years, same can be declared a County road by prescription.

ACCOUNTS ALLOWED

On recommendation of the Zoning Director and on motion of Commr. Babb seconded by Commr. Livingston and carried, the Board accepted proposal from Adley Associates, Inc. for professional services on an “as-needed” basis at $125.00 per day, including travel, food and other expenses.

There being no further business to bring before the Board, the meeting adjourned at 5:45 o’clock P.M.
