MINUTES OF REGULAR MEETING OF BOARD OF COUNTY COMMISSIONERS

 MONDAY – JUNE 2, 1969

A regular meeting of the Board of County Commissioners of Lake County, Florida, was held in the Commissioners’ Room in the Courthouse, Tavares, Florida, on Monday, June 2, 1969,  at 9:00 o’clock A.M. with the following members present:  Commissioner Thomas J. Windram, Chairman; Commissioners James R. Carson, Jr., Alex J. Macdonell, J. M. Hoskinson and Kenneth VanAuken.  Others present were County Attorney C. E. Duncan, County Engineer Gordon Hays, Jr., Clerk of Circuit Court Frank E. Owens, and Deputy Clerk Norma H. Coven.

The meeting was called to order by Chairman Windram and the invocation was given by Mr. Hays.

minutes

On motion of Commissioner Hoskinson seconded by Commissioner Carson and carried, the minutes of the regular meeting held April 14, 1969 were approved as submitted.

public health

Commissioner Macdonell explained the location of a landfill site in Mascotte was reported erroneously.  It was never the intention of the Board to locate the site inside the City of Mascotte.  The tentative location is now on SR 50.

county employees

In an effort to establish a uniform fee for medical examinations for County employees, Commissioner Hoskinson was instructed to contact Dr. Hall with reference to the Medical Association establishing the fee and appointing three physicians throughout the County to handle the examinations.

records

The County Attorney was instructed to review the law relative to the procedure and disposition for destroying old records.

road maintenance

On motion of Commissioner Hoskinson seconded by Commissioner Carson and carried, a Resolution was adopted to enter into a cooperative agreement with Orange County to maintain and keep in reasonable repair the following portions of road located adjoining Lake County, but extending into Orange County:

That portion of Scofield Road (formerly known as Shell Pond Road) (County Road #3-0558), commencing at the County line and extending to State Road No. 545 in Orange County;

 

Conditioned upon the maintenance by Orange County of the following described roads:

 

“Marsh Road” (formerly known as Southern Fruit Road) (County Road #3-1067), and the “Flat Lake Road,” (County Road #3-0769), extending from Orange County into Lake County.

 

ROAD NAMES

A Policy determining the names on County roads was discussed and on motion of Commissioner Hoskinson, seconded by Commissioner Carson and carried, the Board agreed that each Commissioner would submit his recommendations to the Board for approval before having name signs erected.

elections – precincts

Attorney Duncan advised the Board’s action of May 12 combining Precincts 8 and 33 was in error because the law provides the boundaries of the two precincts must adjoin.  On motion of Commissioner VanAuken seconded by Commissioner Carson and carried, the action of the Board on May 12 combining Precincts 8 and 33 was rescinded.  Commissioner VanAuken moved the adoption of the following Resolution.  The motion was seconded by Commissioner Carson and carried.

RESOLUTION

 

“WHEREAS, with the consent and advice of the Supervisor of Elections for Lake County, the Board of County Commissioners did consider the advisability of combining Precincts 33 and 37 and it was determined that it would be for the best interests of Lake County and the Electors in said Precincts to combine the same, and

 

“WHEREAS, the Supervisor of Elections, Katherine L. Baker, in open meeting announced her approval and consent to the combining of said two Precincts in the manner hereinafter set forth, and the Board did express its unanimous approval to such combination of voting Precincts.

 

“NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that with the approval and consent of the Supervisor of Elections, Precincts 33 and 37 be, and they are hereby altered, changed, amended and designated as follows:

Begin at the Southeast corner of the SW ¼ of NE ¼ of SW ¼ of Sec. 1, Tp. 19 S. Harry Mielke presents Plat of Golden Heights, Third Addition, owners Harry and Eleanor Mielke.  Attorney Duncan advised the Plat shows the proper access road and street widths.  The streets tie in with streets in the original Plat.  The subdivision has not been approved for percolation tests and no title report was presented.  Approval of the Plat was deferred pending percolation tests and title report.

Lester Kalmanson presented Plat of Hilltop-Sorrento Subdivision located on SR 437 in Section 19, Township 19 South, Range 28.  Attorney Duncan advised the streets are sufficient width and access road is provided.  Letter from the County Engineer stating that the percolation and soil analysis tests were made by Ardaman & Associates Testing Lab. Of Orlando and find them to be satisfactory.  The Engineer further recommends the Subdivision for septic tank type sewage disposal and that street markers have been erected.

On motion of Commissioner Carson seconded by Commissioner Hoskinson and carried, the Board approved the Plat of Hilltop-Sorrento and ordered same accepted and filed for record.

Mr. D. T. Larabee was present and discussed changes he proposes to make in Hilltop Subdivision and Haines Creek Mobile Homesites (unrecorded plats) before disposing of all the lots.

bids

It now being the time advertised to receive bids on a Conserva-File for the Clerk’s Office, the Chairman directed the Clerk to open and tabulate the bids.  Whereupon, the Clerk reported receiving bids from the following:

                        Bowen Supply Company                    $3,268.00

                        Fla. Forms and Systems, Inc.               3,414.48

                        Simons Office Equip., Inc.                   3,172.87

 

On motion of Commissioner Hoskinson seconded by Commissioner Carson and carried, the Board accepted the low bid from Simons Office Equipment, Inc. in the amount of $3,172.87 subject to the approval of the Clerk.

utilities

Mr. Earl Harris representing Sumter Electric Coop., Inc., appeared and objected to the request of Tampa Electric Corp. for a franchise to operate in Lake County.  Mr. Harris stated Sumter Electric or Fla. Power Corp. have never requested a franchise in the County.  Mr. Pierce Wood, Vice President, Tampa Electric, was present and informed the Board their request is simply a license to use the County’s right of way.

Commissioner Macdonell moved that the franchise be granted.  The motion died for lack of a second.

The fact that Tampa Electric had requested a general permit to install lines in Lake County, the Commissioners determined that the application should be made on specific projects instead of all over the County and no action was taken.

county property

Engineer Hays advised there is an old truck with wooden body stored on the Wells property and would like to move same.  Clerk Owens advised all personal property is involved in liens and mortgages and do not recommend that the truck be moved.  Mr. Hays was instructed to contact Robert Warfield with the First National Bank & Trust Co., Eustis.

road maintenance

Engineer Hays advised the owners of property adjoining the Lake Yale Clay Pit Road are willing to pay $1,000.00 to the County to resurface the road.  The County has 50 foot right of way.  On motion of Commissioner Carson seconded by Commissioner VanAuken the offer was accepted and the Road and Bridge Department was authorized to resurface the road.

The meeting recessed for lunch at 12:00 o’clock noon and reconvened at 1:30 o’clock P.M. to take up the remaining items of business.

roads – county

On motion of Commissioner Carson seconded by Commissioner Hoskinson, a Resolution was adopted determining a maximum speed limit of 25 miles per hour on County Road #4-6580 connecting State Road 44-A and County Road #4-6079.

On motion of Commissioner Hoskinson seconded by Commissioner VanAuken and carried, a Resolution was adopted determining a maximum speed limit of 35 miles per hour on County Road #3-4260, South Bay Road.

roads – state

Engineer Hays reported that all the towns and cities have agreed to pay the maintenance costs of Flashing School Crossing Signals at the following locations:

1.     Section 11010 at SLD MP 4.135 – SR 50 in Mascotte

2.     Section 11100 at SLD MP 4.790 – SR 19 in Umatilla

3.     Section 11100 at SLD MP 7.879 – SR 19 in Altoona

4.     Section 11200 at SLD MP 19.083 – SR 25 in Minneola

5.     Section 11110 at SLD MP 0.502 – SR 44 in Eustis

6.     Section 11010 at SLD MP 3.968 – SR 44 in Leesburg West of SR 25

7.     Section 11070 at SLD MP 7.025 – SR 50 in Groveland at 1st Avenue

 

On motion of Commissioner Carson seconded by Commissioner Hoskinson and carried, a Resolution was adopted authorizing the State Road Department to install the signals at the locations described above and that installation costs will be paid from State Primary Road funds.

water studies

H. E. Young and Darwin Knochenmus appeared with reference to the County participating in a continuing water studies program with the Oklawaha Water Authority.  Commissioner Carson moved that Lake County participate with the Water Authority in a year’s study to be conducted by the U.S. Geological Survey at a cost of $2500.00, or $1250.00 each.  The motion was seconded by Commissioner VanAuken and carried.

e. central florida regional planning council

Mr. Gordon Wagner, Executive Director of the Council, was present relative to Lake County participating in a three year comprehensive water study of the Oklawaha River Basin.  On motion of Commissioner Hoskinson seconded by Commissioner Carson and carried, the Board approved $13,000.00 per year for three years in support services only.

water pollution

Mr. Roy Snell and Mr. C. W. Sheffield were present and submitted the Air Pollution Rules and Regulations as adopted by the Pollution Control Board.  On motion of Commissioner Carson seconded by Commissioner Hoskinson and carried, a Resolution was adopted approving the Rules and Regulations as the Official Air Pollution Rules and Regulations for Lake County.

county property

Attorney Duncan filed petition for Exchange of Properties from Green Valley Real Estate, Inc., whereupon, on motion of Commissioner Macdonell seconded by Commissioner VanAuken and carried, a Resolution was adopted approving the exchange of the following described lands and authorizing a public hearing to hear any objections to the exchange for July 7, 1969:

Parcel No. 9, LESS the right of way for State Road 50, according to the Plat of Midway, Lake County, Florida, which Plat is recorded in Plat Book 11, Page 57, Public Records of Lake County, Florida;

 

for the following property owned by Lake County and located in Lake County, Florida:

 

That part of the SW ¼ of NE ¼ of Sec. 32, Tp. 21 S. R. 25 E., in Lake County, Florida, lying East of the Easterly line of the right of way of State Road 19.

 

On recommendation of the Engineer and on motion of Commissioner Carson seconded by Commissioner VanAuken and carried, a Resolution was adopted declaring the following described land to be surplus and authorizing the publication of notice to sell the surplus property at public sale:

The South 131 feet of the West 82 feet of the SE ¼ of SE ¼ of NE ¼ of Sec. 22, Tp. 18 S., R. 24 E.; LESS the South 25 feet thereof, reserved for road purposes.

 

On recommendation of the Engineer and on motion of Commissioner Carson seconded by Commission Hoskinson and carried, a Resolution was adopted authorizing a public hearing for July 14, 1969 to hear any objections to the exchange of the following described property:

TRACT A:

Commence at the North Quarter Corner of Sec. 8, Tp. 19 S. R. 24 E., and run thence South along the centerline of said Section 8, 1070 feet, thence run South 89°35’ West 250 feet to the point of beginning.  Thence continuing South 89°35’ West 600 feet; thence run North 220 feet; thence run North 89°35’ East 600 feet; thence run South 220 feet to the Point of Beginning; for

TRACT B:

Commence at the North Quarter Corner of Sec. 8, Tp. 19 S. R. 24 E., run thence South 1070 feet, thence run South 89°35’ West 108 feet for the point of beginning; thence continue running South 89°35’ West 542 feet; thence run North 4°39’53” West 338.56 feet; thence run North 85°20’ East 571.42 feet; thence run South 380 feet to the point of beginning; and

TRACT C:

Commence at the North Quarter corner of Sec. 8, Tp. 19 S. ROAD MAINTENANCE

Engineer Hays presented letter from Sumter County approving the improvements to Cherry Lake Road (County #1-6602).  The Attorney was directed to prepare agreement with Sumter County under the terms outlined in their letter.

The Engineer advised John Harder is willing to pay for improvements to a road adjacent to County Rd. #3-1038.  He was instructed to notify Mr. Harder of the cost and to send the money in before the work is done.

road maintenance – SUBDIVISIONs

Engineer Hays advised at the present time only $309.70 is outstanding against the proposed improvements to Oklawaha Drive.  The Board declined to take any action on this until after the Legislature adjourns.

roads – state

The Engineer reported he has discussed the school crossing at Altoona on SR 19 with the State Road Department and they have instructed the Leesburg Maintenance force to correct the sight distance North of the sign.

road closings

The Attorney was instructed to notify Mr. Gus Anderson the County cannot close the portions of Flossmoor St. and Westward Ho. Ave. in Mt. Plymouth, which adjoins his property, and have the title to the property revert to him.

Attorney Duncan advised he has received a letter from Mrs. John Erbele to proceed with the closing of a portion of Old State Road 561.  Commissioner Hoskinson stated this portion of the road was abandoned by the State Road Department and Jake Bishop claims to have a deed to the property.  Attorney Duncan said if the road is owned by Mr. Bishop, the County has no jurisdiction. This matter was referred to the Attorney for further processing.

Petition for Closing Platted Streets in Eldorado Heights signed by Margaret McM. Palmer, Joel F. Smith and wife Fran P. Smith, and Ruth Palmer was referred to the Chairman.

Clerk Owens advised request for title search on Section 11040-2507, SR 25, was submitted to Lake Abstract & Guaranty Co. on May 23, 1969.

roads – county

Attorney Duncan presented letter from Norbert P. Sullivan accepting the Board’s proposal that the road adjoining his property will be completed before the end of the year, if not sooner.

resolutions not classified elsewhere

Clerk Owens submitted Resolution from Lee County opposing any modification to the present Federal Tax Exemption on Bonds issued by state and local government.  Commissioner Hoskinson moved the adoption of a similar Resolution and urging the Congressional Delegation to do everything possible to maintain the present Federal Tax Exemption on Bonds issued by State and Local Government.

The motion was seconded by Commissioner Carson and carried.  Commissioner Macdonell voted against the Resolution.

tax assessments

Request from the Tax Assessor for approval of Certificates of Error and Corrections on the 1968 tax roll numbered 138-154 was approved on motion of Commissioner Macdonell seconded by Commissioner VanAuken and carried.

Letter from the Tax Assessor that property covered under Tax Certificate No. 226 dated June 1, 1967 is County owned was referred to the Engineer.

On motion of Commissioner Hoskinson seconded by Commissioner Carson and carried, the Clerk was authorized to advertise notice of completion of the tax assessment roll and presentation of same to the Board on July 7, 1969 at 9:00 o’clock A.M.

The Clerk submitted letter from Roy Christopher, Attorney for the City of Mt. Dora, relative to violations of the law requiring junk yards to be fenced was referred to the Planning & Zoning Director.

pensions

Letter from the Comptroller’s Office relative to Confederate Pensioner Mrs. Nonnie Gray, Mascotte, was referred to Commissioner Macdonell.

hospitals

On motion of Commissioner VanAuken seconded by Commissioner Carson and carried, applications for admission to the W. T. Edwards Tuberculosis Hospital were approved for the following:

Mrs. Mary Hamner, Director of Lake Memorial Nursing Home, appeared and presented to the Board twenty-five shares of Carpenter Technology Corp. stock.  Mrs. Hamner explained the stock was donated to the Nursing Home by Mrs. Lois H. Miller and is to be used for improving the air conditioning in the Home.  On motion of Commissioner Hoskinson seconded by Commissioner Carson and carried, the stock certificate was accepted and money derived from the sale of the certificate will be used for improvements to the air conditioning system.

Mrs. Hamner also reported the Home received seven offers of television sets and only two were accepted.

The Clerk was authorized to advertise notice of Equalization Board meeting for August 4, 1969 at 9:00 o’clock A.M. on motion of Commissioner Carson seconded by Commissioner Hoskinson and carried, to receive testimony as to the value and classification of any property as fixed by the County Assessor of Taxes.

budget

Amendment to the Capital Outlay Reserve (Health Clinic) Fund budget was approved as submitted on motion of Commissioner VanAuken seconded by Commissioner Carson and carried.

checks received

Checks in the sum of $125.00 and $30.00 were accepted from Olive Sumner and WLCO, reimbursement for road materials for improvements to N. Palm Circle.

county employees

On recommendation of Frank Woodson, the personnel at the Motor Vehicle Inspection Stations will be reduced to two (2) inspectors and one (1) clerk at each station effective June 23, 1969.  Mr. Woodson agreed that during the rush periods he will fill in as needed at the stations.  This reduction in personnel being necessitated by the annual auto inspections.

laws & legislature

On recommendation of the Engineer and on motion of Commissioner Carson seconded by Commissioner Hoskinson and carried, the Clerk was directed to request the Law Enforcement Agencies in the County to enforce the Motor Vehicle Safety Inspection Law.

Commissioner Carson stated it is his understanding there is an act before the Senate which would repeal all laws relating to air and water pollution.  Attorney Duncan was instructed to contact Tallahassee regarding this.

The Attorney was also instructed to contact the Legislative Delegation for a report on the status of local bills.

The Attorney was requested to investigate the possibility of securing race track funds to be used for a bond issue.

roads – state

Clerk Owens submitted letter from the Director of Department of Public Safety in answer to the Board’s Resolution relative to additional troopers in Lake County due to the high death and accident rate.  Letter states no affirmative answer can be given based on the “short money and no-new-tax pledges by many of the Legislators.”

Letter from Samuel Goldmeer requesting road signs on SR 42 to protect the children was referred to the County Engineer to advise Mr. Goldmeer to contact the State Road Department.

Statements of the status of Trust Fund and Secondary Funds as of April 30, 1969 were filed and copies distributed to each Board member.

complaints

Letter of complaint from Sylvan Shores Assn. relative to the clearing of vacant lots was referred to the Chairman.

Copy of letter addressed to the County Attorney from the Tavares Chamber of Commerce with reference to the status of the suit involving property adjacent to the Dora Canal was read and the Attorney advised the property on the North end of the canal has been sold and the owner has indicated he will donate the property for proposed park to the County. The other property is owned by Ralph Jones who is in the process of selling.

Commissioner VanAuken said he has received complaints in the Astor area relative to residents not complying with the zoning and building regulations. He will discuss this with the Planning and Zoning Director.

Public Health

Chairman Windram asked if the County Judge can sign death certificates in the event of an accident or violent death within the County.  Doctors are refusing to sign death certificates when the victim is not a patient and in the event of an accident the doctor is not always sure of the cause of death.  Attorney Duncan advised the County Health Director could sign the certificates but he is not always available.  The County Judge may authorize an autopsy if the cause of death is questionable.

accounts allowed

On motion of Commissioner Carson seconded by Commissioner VanAuken and carried, expenditure of $8,406.13 was approved to the City of Eustis for the County’s share of costs of the lift station and sewer line at the fairground.

Travel expenses for Gordon Hays were approved to attend National Association of Counties Convention in Portland, Oregon, July 26 – 31 – on motion of Commissioner Hoskinson seconded by Commissioner Carson and carried.

On motion of Commissioner Carson seconded by Commissioner Macdonell and carried, interest payment on the notes to finance the Motor Vehicle Inspection Stations in the sum of $562.50 each, or a total of $1,687.50, was approved.

On motion of Commissioner Macdonell seconded by Commissioner Carson and carried, the action of the Clerk was approved in paying 1968 taxes to the City of Tavares on the Wells property.

Request from A. W. Smith & Son for payment in the amount of $3,811.50 in accordance with contract for constructing the telephone and information booth in the Courthouse lobby was approved on motion of Commissioner Carson seconded by Commissioner Hoskinson and carried.

Agreement with the Florida Power Corporation was approved on motion of Commissioner Hoskinson seconded by Commissioner Carson and carried, to furnish power for the operation of overhead street lights at the Lake County Fairgrounds at a minimum charge of $48.00 per month.  Commissioner Macdonell voted against the motion.

The Clerk was instructed to secure competitive prices on a window air conditioner for the Veterans Service Office.

On motion of Commissioner Hoskinson seconded by Commissioner Macdonell and carried, payrolls for the month of May were approved.

Letter from Shoup Voting Machine Corp. asking for an increase in the price of voting machines was read and action deferred until the next budget is considered.

The following monthly reports were filed:

            Supervisor Surplus Commodity Warehouse;

            Fla. Division of Corrections pertaining to the Lake County Jail and

                        Stockade, together with a copy of letter to Sheriff McCall commending him on the excellent report; and

            Florida State Board of Health Statistical Report for the first quarter of 1969.

Attorney Duncan read a letter from the State Road Department approving the inclusion of the Eustis Wayside Park in the City limits of Tavares.
