MINUTES OF REGULAR MEETING OF BOARD OF COUNTY COMMISSIONERS
MONDAY – september 8, 1969
A regular meeting of the Board of County Commissioners of Lake County, Florida, was held in the County Commissioners’ Room in the Courthouse, Tavares, Florida, on Monday, September 8, 1969, at 9:00 o’clock A.M. with the following members present: Commissioner Thomas J. Windram, Chairman; Commissioners James R. Carson, Jr., Alex J. Macdonell, J. M. Hoskinson, and Kenneth VanAuken. Others present were County Engineer Gordon Hays, Jr., Clerk of Circuit Court Frank E. Owens and Attorney C. C. Ford, and Deputy Clerk Norma H. Coven.
The meeting was called to order by the Chairman and the invocation was given by Mr. Hays.
minutes
On motion of Commissioner Macdonnell, seconded by Commissioner Hoskinson and carried, the Clerk was requested to furnish copy of the Board minutes to the members within one week.
Minutes of the regular meeting of July 14 and special meeting of July 17 were approved as submitted on motion of Commissioner Hoskinson, seconded by Commissioner Carson and carried.
Indigents
On motion of Commissioner Cason, seconded by Commissioner VanAuken and carried, the following changes were approved to the present indigent list:

road closings
It now being the time advertised to hold a public hearing to consider petition to close a portion of the “park” in Edgewater Beach, and no one appearing to object to the closing, a motion was made by Commissioner Hoskinson, seconded by Commissioner Macdonell and carried, that the Board adopt a resolution closing the following described park:
All that portion of the “park” and the area designated as “playground” abutting lake Boulevard and lying immediately East of the following described properties; Lots 21 and 22 in block A, and Lot 5 in Block B, all according to the Plat of EDGEWATER BEACH, as filed and recorded in the public records of Lake County, Florida, in Plat Book 8, Page 84.
elections – special
Members of the Board concurring, the Chairman informed the Clerk the members will investigate locations for voting places and clerks and inspectors for the special election on November 4, and will have their lists into the Clerk’s office by September 15.
ordinance
On motion of Commissioner Macdonell, seconded by Commissioner VanAuken and carried, the Board authorized a public hearing to consider Ordinance empowering the Board to establish and operate a garbage collection and disposal service.
state agencies
Messrs. Lain, Grubbs and Morris of the Florida Forest Service were present and explained the reorganization within the Service, which accordingly will be a more efficient operation. Lake County is in District 11 with headquarters in Bushnell.
roads – state
Paul Bryan, Done Berry and Richard Langley, members of the Board of Public Instruction were present relative to the installation of a flashing signal at the Leesburg Junior High School on SR S-44-B. Mr. Hays stated the City of Leesburg has agreed to maintain the signal, whereupon, on motion of Commissioner Macdonell, seconded by Commissioner Hoskinson and carried a resolution was adopted requesting the Department of Transportation to install a Flashing School crossing Light on SR S-44-B, Griffin Road, at the entrance to Leesburg Junior High School, and that the cost of the installation be paid from Secondary Road funds.
Clerk Owens filed notice from the Department of Transportation that interested parties may request in writing a public hearing concerning the location, economic and environmental effects of the proposed improvements to SR 25 between Dixie Avenue and Sunshine Avenue in Leesburg, not later than October 6, 1969. The Chairman instructed the Clerk to post the notice on the bulletin board in the Courthouse lobby.
complaints
Paul Milton, Mosquito Control Director, appeared with Gunard Brautcheck and M. A. Blocker with reference to drainage problem Northeast of Eustis from Trout Lake. Mr. Milton said this problem was recognized in 1965 and a ditching project proposed but same was deferred by the State board of Health due to a drought spell. He was instructed to contact the Lake County Water Authority for relief.
insurance
Mr. Hardin Powell appeared and advised he has secured prices on premise liability coverage with $100,000/500,000 limits, no medical payments, for $837.00 annually. With medical payments the cost will be $463 additional. The Board approved Mr. Powell’s recommendation for minimum liability coverage at a cost of $837.00 annually, on motion of Commissioner Carson, seconded by Commissioner Hoskinson and carried. The Attorney was directed to obtain an opinion from the Attorney General relative to the law exempting the County from tort actions.
right of way – roads
Richard Langley asked if Pearl Street from SR 25 to Minneola Elementary School is a county road. Engineer hays advised the existing right of way is within the city limits. Mr. Langley stated the street stays in bad repair. No action by the Board was taken.
Earl Freeman of Astor Park Campsite Subdivision was present and submitted dedication to the public for road right of way in the Subdivision. The dedication was accepted on motion of Commissioner Hoskinson, seconded by Commissioner VanAuken and carried, with no obligation for maintenance by Lake County unless the streets are constructed to specifications.

Mr. Langley stated there is an undetermined amount of land between the lot lines and the lake shore around Lake Minneola, and requested that title to the land be deeded to the property owners. Attorney Ford recommended that the mean high water line be established and statement obtained that no on eels has title to the land. Chairman Windram said the Board members will look at this on the next road trip.
Engineer Hays reported the Department of Transportation has agreed to construct a seawall in Lake Eustis at the Wayside Park West of Tavares but are holding up construction until a bulkhead line is established by the county or city in accordance with Chapter 67-393. The Board members concurring, the Chairman referred this matter to the Attorney.
roads – county
J. N. Clark and Mrs. J. F. Busby were present relative to Road No. 2-3021. Mr. Clark contends the road is private property and he has consented for the property owners to use same, but does not want the county to maintain the road because of damage to his citrus trees adjacent to the road.
Attorney Rantson Davis was present and spoke on behalf of Mrs. Busby. Robert Stowe and Dr. Harrold were present and stated they also must use the road to get to their properties, as well as L. B. Bryant. Attorney Irving Morse representing James M. Mead Citrus Corp. said his client must use the road for access and they are willing to donate the necessary right of way for a county road. Eugene Henderson representing Lake Butler Estates Groves said they need to use the road for access. Mr. Clark said he has no intention to close the road – his objection is to the county maintaining the road and damaging his trees.
Attorney Ford said from the events and facts recited, it is his opinion the road is a county maintained road, inasmuch as it has been maintained by the county for more than four years with the consent of the owners and the Board receiving no objection from Mr. Clark until recently. Engineer Hays stated he has received objections from Mr. Clark through the operator.
On motion of Commissioner Hoskinson, seconded by Commissioner VanAuken and carried, the Engineer was instructed to re-erect the county road signs and reinstate the maintenance of the road. Mr. Hays and Mr. Clark will determine the width of the road.
recess and reassembly
The meeting recessed for lunch at 12:30 P.M. and reconvened at 1:45 o’clock P.M. to take up the remaining items of business.
Courthouse
Mr. Carlton Johnston of the Florida telephone Corporation appeared and recommended changes and adjustments in the telephone system as follows:
Two additional lines in the County Judges’ Office at monthly rate of $2.50 each Key phone for the Secretary’s desk in the Juvenile Office at $3.00 per month Eliminate toll restricter device.
On motion of Commissioner Hoskinson, seconded by Commissioner Carson and carried, the above changes were approved.
Late in the day on motion of Commissioner Carson, seconded by Commissioner VanAuken and carried, Mr. Hoskinson was directed to determine from the phone company if there will be an additional installation charge to reinstate the toll restricter in December when the toll free dialing is complete throughout the county. If so, not to have the restricter removed.
On motion of Commissioner VanAuken, seconded by Commissioner Hoskinson and carried, request form Judge Hall to use the Commissioners’ Room for the Grand Jury on October 7 and 8 was approved.
Civil defense
Mr. Watkins distributed copies of the Community Shelter Plan, Step I, and Report of Basic Emergency Operation Plan for Lake County for study and review by the Board members.
Planning and zoning
On recommendation of the Planning and Zoning Commission and on motion of Commissioner Carson, seconded by Commission Macdonell and carried, Conditional use Permits were approved as follows: Conditional Use Permit 138-2, 147-1, 148-2, and 150-5; also Rezoning application No. 48-69-2 was denied; the Zoning Rules and Regulations were altered and amended as they pertain to the following tracts of land, to the classification designated after each description.

WHEREAS, the Lake County Planning and Zoning Commission, after giving Notice of a Hearing upon applications for change of zoning classifications, including a Notice as to the time such applications, if approved, would be presented to the Board of County Commissioners of Lake County, Florida, did, on the 28th day of August, 1969, review applications for changes and revisions of the zoning of certain areas in Lake County, and did approve certain changes as requested in the particular applications hereinafter set forth, subject to approval of the Board of County Commissioners, having reviewed said applications and the recommendations of the Lake County Planning and Zoning Commission;
NO THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the Zoning Rules and Regulations of Lake County, be altered and amended as they pertain to the following tracts of land, to the Classification designated after each description:
1. On East side of U.S. Highway 27 and 441 and South side of District Road 1-8104 ¼ mile South of Marion County line, and more particularly described as follows: NW¼ of S½ of Gov. Lot 2, LESS: the North 160 feet of East 140 feet; That part of N½ of S½ of Gov. Lot 3 lying East of SR 500; ALL in Sec. 5, Tp. 18 S.R. 24 E.,
now classified and zoned as C-2 (Commercial District) and R-1A (Rural Residential), be, and the same is hereby amended, changed and rezoned to Classification A (Agriculture and Rural Enterprises).
2. 1 7/8 mile South of Marion County line, approximately 1900 ft. South of Conant Road (1-7807) and 200 feet east of SR 25 of U.S. Highway Alt. 27-441, and more particularly described as follows: S½ of Lot 1, block 25, Town of Conant,
now classified and zoned as R-1A (Rural Residential), be, and the same is hereby amended, changed and rezoned to Classification A (Agriculture and Rural Enterprises).
3. Lying Southerly and 200 feet Westerly of Old Haines Creek Road, approximately 225 feet east of Junction with SR 473, 2½ miles North of U.S. Hwy 441 in Bassville Park section, and more particularly describes as follows: Blocks A, B and C, Unit No. 2, Hilltop Subdivision, according to the Plat thereof, as recorded in Plat Book 13, Page 37, public records of Lake County,
now classified and zoned as R-1 (Rural Residential), be, and the same is hereby amended, changed and rezoned to Classification R-3 (Mobile Home Park-Subdivision).
4. On South side of U.S. Hwy 441 app. 4 miles West of Tavares, opposite Lisbon Road (5-5433) at Altman’s Iron works location, and more particularly describes as follows: That part of the West 150 feet of E½ of NW¼ lying South of Hwy; that part of the West 150 feet of the East Half of Gov. Lot 3 North of Railroad; ALL in Sec. 23, Tp. 19 S.R. 25 E.,
now classified and zoned as R-1A (Rural Residential), be, and the same is hereby amended, changed and rezoned to Classification C-3 (Urban Commercial – Small Industry).
5. East of Lady lake South City Limits and East of SR 500, U.S. 441, approximately ¾ mile, ¼ mile North of County Rd. 1-7009, and more particularly described as follows: Begin at the SE corner of SW¼ of Sec. 22, Tp. 18 S.R. 24 E., run North 0°15’40” East 1321.22 feet, thence North 89°31’50” West 1332.68 feet for Point of beginning of this description, thence North 89°31’50” West 999.41 feet to a concrete marker, thence North 0°22’00” East 331.49 feet to a concrete marker, thence South 89°30’00” East 333.08 feet to a concrete marker, thence North 64°02’40” east 742.94 feet, thence South 0°19’20” West 661.97 feet to Point of Beginning;

6. 3-4 mile West of Okahumpka, fronting on and lying on the North side of SR 470 and touching the West side of Lake Markham, and more particularly described as follows: The SW¼ of the NW¼; W½ of SE¼ of NW¼; N½ of the SW¼; W½ of the SW¼ of the SW¼; SE¼ of the SW¼ of the SW¼; N½ of the NW¼; ALL in Sec. 9, Tp. 20 S.R. 24 E., AND: The E½ of NW¼; The S¼ of the SW¼ of the NE¼, LESS: Road; the north 3/4 of the W½ of the NE¼; That part of the SW¼ of the NW¼ lying Northerly and Easterly of SR 470; ALL in Sec. 16, Tp. 20 S.R. 24 E.;
now classified and zoned as R-1 (Rural Residential), be, and the same is hereby amended, changed and rezoned to Classification A (Agriculture and Rural Enterprises).
7. South of Leesburg and Northeasterly of Okahumpka on West side of U.S. Hwy. 27 and ACL Railroad (Now SCL Railroad) and north of Helena Run, adjacent to Hubbard subdivision and Hubbard Trailer Park, and more particularly described as follows:
All that part of Lots 2, 13 and 14 lying West of S.C.L. Railroad; that part of South 266 feet of Lot 5 lying West of said railroad; the South 237.43 feet of Lot 10, LESS: The North 50 feet of the E½ thereof; All of Lots 11 and 12, said lots being in De Louest’s Subdivision; the N½ of NW¼ of Sec. 11, Tp. 20 S.R. 24 East, according to the plat thereof as recorded in the public records of Sumter County, Florida. At this time the Chairman called for interested persons to be heard concerning Conditional use Permit 151-5, said permit would authorize the applicant to construct, maintain and operate agricultural housing facilities in an A Zone.
Mrs. Grace Strosberg appeared opposing the permit.
On motion of Commissioner Macdonell, seconded by commissioner VanAuken and carried, the permit was granted.
At this time, the Chairman called for interested persons to be heard concerning rezoning application No. 52-69-3, to rezone certain lands from R-1 (Rural residential) to R-3 (Mobile Home Park-Subdivision).
Mrs. Frank Bayer appeared opposing the rezoning.
On motion of Commissioner Hoskinson, seconded by Commissioner VanAuken and carried, the Board denied the request without prejudice.
Rezoning application no. 54-69-2 was considered at this time and no one appearing in support or opposition to the application, the recommendation of the Planning and Zoning commission to deny same was upheld on motion of Commissioner Carson, seconded by Commissioner VanAuken and carried.
Conditional Use Permit no. 146-1 was considered at this time and no one appearing in support or opposition to the permit, the recommendation of the planning and Zoning Commission to grant the permit was approved on motion of Commissioner Macdonell, seconded by Commissioner VanAuken and carried.
At this time the Chairman called for interested persons to be heard concerning Conditional Use Permit 149-4, said permit would authorize the applicant to operate a pullet brooder farm facility on real property in an A Zone.

On motion of Commissioner Macdonell, seconded by Commissioner VanAuken and carried, the permit was denied without prejudice.
On motion of Commissioner Hoskinson, seconded by Commissioner Carson and carried, the Attorney was instructed to proceed with legal action against zoning violator W. L. Beach of Okahumpka.
The Planning Director informed the Board the Orange Blossom Trail Garage has requested additional time to clear the junked cars from outside the fenced area. The request was denied on motion of Commissioner Macdonell, seconded by Commissioner Carson and carried.
Mr. E. T. Hall appeared and recommended certain changes to the new subdivision regulations. He was requested to work with the County Engineer and County Planner on any required amendments or changes.

Clerk Owens presented letter from the Department of Transportation requesting proposals and applications for Federal grants on local county roads. Engineer Hays advised he has received a letter from the Director of Road Operations stating there are no Federal funds available for local county roads.

Safety
Notice from the Florida Industrial Commission recommending certain safety measure at the Minneola Motor Vehicle Inspection Station was referred to the Engineer. Mr. Hays advised that the Items 3, 4, and 5 have been taken care of; Item 1 would necessitate employing more help; Item 2 is too costly to consider.
suits affecting county
Attorney Ford advised the temporary injunction is in force on the Dora Canal. On motion of Commissioner Carson, seconded by Commissioner Hoskinson and carried, the attorney was authorized to employ Don Driggers as appraiser in the suit.
Clerk Owens submitted letter from Reba Harris endorsing the Board’s action to preserve the natural beauty of the Dora Canal, and if funds are not available to purchase the property, that the general public raise the necessary funds.
Also, resolution from the Welcome Wagon Club of Leesburg urging the Board to preserve the canal was filed.
tax assessment
Commissioner Carson raised the question of steps a citrus grower may take to get tax relief. Attorney Ford advised Chapter 193.271, Florida Statutes, provides he may go to the Assessor and state that he will sell the property for the assessed value, the Assessor will then hold a public sale and if the assessed value is offered, the owner must accept it. The Attorney was directed to determine if this Statute is still in effect.
The Clerk presented letter from Wilfred B. Klein objecting to assessed values on parcels of land located in 7/18/25, 8/18/25 and 17/18/25, and requests relief from the Board of Equalization. Clerk Owens was instructed to notify him complaints were received by the Board of Equalization on August 4, 1969.
Contracts and agreements
Clerk Owens advised the contract with Leesburg Transfer and Storage Co. to store and haul the voting machines is for a maximum term of five years, with notice of annual renewal on the first of December. The cost of hauling the machines is $18.00 each.
Public health
Paul Milton reported he is still having problems locating landfill sites in Sorrento, Mount Plymouth, Bassville Park and Cassia area.

On motion of Commissioner VanAuken, seconded by Commissioner Carson and carried, the Clerk was instructed to notify all departments that in the future any request for transfer of funds or other finance matters must be cleared with the Finance Department in the Clerk’s office before same is presented to the Board for approval.
Accounts allowed
On motion of Commissioner Carson, seconded by Commissioner Macdonell and carried, the low proposal of Smitty’s Glass Works to replace plate glass window in the Lake Memorial Nursing Home for $120.25 was approved.
On recommendation of the Engineer and on motion of Commissioner Hoskinson and seconded by Commissioner Carson and carried, expenditure of $3,800.00 from the Road and Bridge Fund was approved to extend drain line on South Bay Road.
The Clerk was authorized to issue warrant on the Fine and Forfeiture Fund payable to the Police Academy for fees in the amount of $194.00 collected by the Sheriff on each conviction in County and Circuit Courts, on motion of Commissioner Macdonell, seconded by Commissioner Carson and carried.
On motion of Commissioner Carson, seconded by Commissioner Hoskinson and carried, payment on Certificates of Indebtedness was approved as follows:

Travel expense for a member of the Pollution Control Board to attend Florida Air and Water Pollution Control meeting in Tallahassee, September 17, was approved on motion of Commissioner Carson, seconded by Commissioner Macdonell and carried.
Travel expenses of J. W. Bryant were approved on motion of Commissioner Macdonell, seconded by Commissioner Hoskinson and carried, as follows:

Reimbursement to the Lake County Chamber of Commerce in the amount of $2,083.33 was approved on motion of Commissioner VanAuken, seconded by Commissioner Hoskinson and carried.
Payment No. 6 to Harvey Spears general Contractor in the sum of $11,099.70 for work performed on the Tavares Health Department Building was approved on motion of Commissioner Macdonell, seconded by Commissioner Hoskinson and carried.
On motion of Commissioner Hoskinson, seconded by Commissioner VanAuken and carried, the Clerk was authorized to purchase two microfilm readers from Eastman Kodak Co. in the amount of $455.50.
