MINUTES OF REGULAR MEETING OF THE BOARD OF COUNTY COMMISSIONERS

 MONDAY – OCTObER 12, 1970

The Board of County Commissioners of Lake County, Florida, convened in regular session in the Commissioners’ Room in the Courthouse, Tavares, Florida, at 9:00 o’clock A.M. on Monday, October 12, 1970, with the following members present:  James R. Carson, Jr., Chairman; Alex J. Macdonell, J. M. Hoskinson, Thomas J. Windram, and Kenneth VanAuken.  Also present were:  County Attorney Christopher C. Ford, County Engineer Robert H. Norton, Clerk of Circuit Court Frank E. Owens and Deputy Clerk Norma H. Coven.

The Chairman called the meeting to order and delivered the invocation, after which the Pledge of Allegiance was recited.

Mr. Ken Hart of the Lake County Chamber of Commerce was present and submitted report of the rental rates charged in the surrounding area for municipal facilities.  Mr. Hart recommended that the County charge $20.00 per hundred chairs and 75¢ per table.

COUNTY EMPLOYEES

On recommendation of the Attorney and on motion of Commr. Windram seconded by Commr. Hoskinson and carried, the Board approved the employment of Pat Rabun Kicklighter, Assistant Juvenile Counselor, effective October 1, 1970, at an annual salary of $6,500.00.

On motion of Commr. Macdonell seconded by Commr. Windram and carried, the resignation of H. D. Underwood was accepted effective September 30, 1970.

funds transfer

County Judge W. A. Milton, Jr. appeared concerning his request for transfer of funds from the Contingency Item to Salaries of Assistants and Clerks in the amount of $3,500.00.  The discussion was interrupted and when Judge Milton re-appeared on advice of the County Attorney, a motion was made by Commr. Windram that the transfer as requested be approved.  The motion was seconded by Commr. Macdonell and carried.

On motion of Commr. Windram seconded by Commr. Hoskinson and carried, the Clerk was authorized to transfer $158.75 in the Fish Conservation Fund from Acct. #34400 to Acct. #34414 “Supplies Not Otherwise Specified.”

On recommendation of the Architect and on motion of Commr. Windram seconded by Commr. Hoskinson and carried, the Board accepted bid from Lenhart Electric Company to install a fire alarm system in the Lake Memorial Nursing Home for $3,125.00 as the best and lowest bid.

It now being the time advertised to receive bids on sedans and pickup trucks, the Chairman directed the Clerk to open and tabulate the bids; whereupon Clerk Owens reported receiving the following bids:

            Eustis Dodge, Inc.

            Hodges Equipment Company

            D. C. Waters Ford, Inc.

 

On motion of Commr. VanAuken seconded by Commr. Hoskinson and carried, the bids were referred to the County Engineer for study and recommendation to the Board.

Later in the day, Mr. Norton reported the sedan bid from Eustis Dodge, Inc. does not meet the specifications.   D. C. Waters Ford, Inc. meets or exceeds the specifications.  Hodges Equipment Company is low on the pickups but the bid does not meet the specifications.  Commr. Macdonell moved that all the bids be rejected and the Board re-advertise for the equipment.  The motion was seconded by Commr. VanAuken and carried.  Commr. Hoskinson voted against the motion.

On motion of Commr. Hoskinson seconded by Commr. Macdonell and carried, the following changes were approved to the present indigent list:

public health

Representatives of the Cities of Eustis, Mount Dora and Tavares were present concerning the Tri City Landfill.  Commr. Windram informed the delegation Lake County is only interested in operating the landfill at a minimum of expense.  He asked that the cities stop burning and reduce the number of dumping areas.  Mr. Young of Tavares said if we do not allow burning, the site will be filled within five (5) years.  Mr. Everett of Eustis asked if the County has given any consideration to an incinerator.  Chairman Carson told him “no,” and requested Commrs. Windram and Macdonell investigate this and make recommendations to the cities.

ROADS – PRESCRIPTIVE

Mr. Frank Wagner appeared and presented three (3) affidavits that access road into a clay pit has been in use by the public for more than twenty years.  Mr. Wagner advised an adjoining property owner has barricaded the road.  He was instructed to contact an attorney to prepare a suit to declare the road a prescriptive road.

elections – general

On motion of Commr. Hoskinson seconded by Commr. VanAuken and carried, the Board appointed Clerks and Inspectors to serve on the election boards for the General Election, November 3, 1970.  Said list being on file in the Clerk’s Office and he was authorized to advertise the list.

road and bridge department

Commr. Hoskinson reported there is a shortage of rock and asphalt.  The Engineer said we have had orders for asphalt cancelled. Making a survey on amount of rock needed to complete construction work already started.  The Engineer was instructed to check on other sources of supply for rock.

recess and reassembly

The meeting recessed for lunch at twelve o’clock noon and reconvened at 1:30 o’clock P.M. to take up the remaining items of business.

public health

Paul Milton, Mosquito Control Director and Gene Smith were present at the request of the Board relative to progress made in picking up junk automobiles.  Mr. Smith reported to date he has picked up approximately 600 automobiles and about 112,000 lbs. of junk appliances.  Mr. Smith said he has not failed to pick up any cars when he was called and the people are willing to pay the $6.00 fee.

Mr. Milton announced as of October 1, 1970, a full time inspector has been working the program tagging cars and sending out notices of violations.  Mr. Milton was authorized to have appropriate stickers printed to place on the junk cars notifying the owners they are in violation and have the cars moved.

On inquiry from the Board, Mr. Milton advised the dozier operator is on duty at the Tri City Landfill 8 hours a day, 5 days a week.

roads – county

On motion of Commr. Hoskinson seconded by Commr. Windram and carried, a Resolution was adopted accepting Oak Shade Drive, County Road #3-0459, into the County maintained road system for the reason the road has been constructed to County specifications and has dedicated right of way of 50 feet.

On motion of Commr. Windram seconded by Commr. VanAuken and carried, the Attorney was instructed to notify the Sheriff to remove the barricade from the Sawgrass Road and to keep the road open to the public.

Mr. Norton advised County Roads #5-7878, 5-7776 and 5-7973 have no dedicated rights of way and Commr. VanAuken was requested to obtain the necessary rights of way.

Upon presentation of Court Order, the Clerk was authorized to pay Malcolm McCall the statutory amount allowed for his travel from New York City to Lake County and return, and witness fee, in the criminal cases State of Florida vs. Rex Adrian Ferriell.

Request from the Veterans Service Officer to employ Thelma Kilgore as part time help for the months of November, December and January at $300.00 per month, was approved on motion of Commr. VanAuken seconded by Commr. Hoskinson and carried.

Request from the Clerk to purchase RCA tape recorder for $79.00 was approved on motion of Commr. VanAuken seconded by Commr. Windram and carried.

On motion of Commr. VanAuken seconded by Commr. Hoskinson and carried, out-of-county travel was approved for J. W. Bryant as follows:

Veterans Administration, Jacksonville – September 30, 1970

Mid-Winter Conference, St. Petersburg – October 14 – 17

Veterans Administration, Jacksonville – October 21, 1970

Veterans Hospital – Gainesville – October 28, 1970

 

On motion of Commr. VanAuken seconded by Commr. Windram and carried, travel was approved for W. T. Mills to attend Juvenile Court Administrators Convention in West Palm Beach October 21-23.

On motion of Commr. Hoskinson seconded by Commr. Windram and carried, out-of-county travel was approved as follows for the County Extension Agents:

J. A. Haddox and Royce Williams – Annual State Horticultural Society meeting, Miami Beach – October 27 – 30

 

Marian B. Valentine – National Convention of Extension Home Economists, Milwaukee, Wisconsin – October 23 – 30

 

Request from the East Central Florida Regional Planning Council was approved in the sum of $2,139.59 on motion of Commr. Hoskinson seconded by Commr. VanAuken and carried.

Request from the Lake County Chamber of Commerce for $2,083.33 was approved on motion of Commr. VanAuken seconded by Commr. Windram and carried.

Request from the Clerk of Circuit Court for $1,000.00 advance for paying State Trial Witnesses was approved on motion of Commr. Windram seconded by Commr. VanAuken and carried.

On motion of Commr. Hoskinson seconded by Commr. Windram and carried, the Board approved payment of $1,445.91 to the Waterman Memorial Hospital as the balance of the sum raised in the District.

On motion of Commr. Hoskinson seconded by Commr. VanAuken and carried, the Board approved payment of $1,424.09 to the Leesburg General Hospital as the balance of sum raised in the District.

Request from the County Extension Director to purchase Mimeograph Machine for the sum of $643.50 and IBM typewriter for $461.00 was approved on motion of Commr. Windram seconded by Commr. VanAuken and carried.

Statement from Duncan & Ford, Attorneys for miscellaneous services was approved on motion of Commr. Hoskinson seconded by Commr. VanAuken and carried.

Statement from the Clerk of Circuit Court for services rendered during the Spring Term of Court in the amount of $7,871.20 was approved on motion of Commr. Hoskinson seconded by Commr. Windram and carried.

On motion of Commr. Macdonell seconded by Commr. Hoskinson and carried, requisition from the County Judge in the amount of $16,941.85 was approved.

Repairs to the roof of the Juvenile Shelter not to exceed $100.00 were approved on motion of Commr. Hoskinson seconded by Commr. Windram and carried.  Commr. VanAuken to handle this with Esko Collins.

On recommendation of the County Attorney and on motion of Commr. Macdonell, seconded by Commr. Windram and carried, the Clerk was instructed to notify Pitney Bowes the statute of limitations has expired and payment of their invoice dated February 24, 1969 in the sum of $80.93 was refused.

Check from the Clerk of Circuit Court for $30.96 refund from advance for paying State Trial Witnesses, Spring Term Circuit Court, was accepted on motion of Commr. Windram seconded by Commr. VanAuken and carried.

Right of Way Deed conveying the following described property to Lake County was accepted on motion of Commr. Hoskinson seconded by Commr. Windram and carried, and same was ordered recorded upon the public records:

            GRANTOR:    Frances J. Lyon

            A strip of land 30 feet wide along the north   line of Tract 25 and 26, lying 30 feet from south of the centerline of the road shown on        the map of Clermont Farms as recorded in Plat Book 5, Page 59, Public Records of Lake County, Florida.

 

There being no further business to bring before the Board, the meeting adjourned at 4:50 o’clock P.M.
