MINUTES OF REGULAR MEETING OF BOARD OF COUNTY COMMISSIONERS

 TUESDAY – december 19, 1972

The Board of County Commissioners of Lake County, Florida, convened in regular session in the Commissioners’ Room, Courthouse, Tavares, Florida, on Tuesday, December 19, 1972, at 9:00 a.m. with the following members present:  Thomas J. Windram, Chairman; James R. Carson, Jr.; C. A. Deems; J. M. Hoskinson; and Glenn C. Burhans.  Also present were:  Joseph Flynn, Director of Planning; Christopher C. Ford, County Attorney; Fred Harpster, County Engineer; Frank E. Owens, Clerk of Circuit Court; and Norma H. Coven, Deputy Clerk.

The meeting was called to order by the Chairman and the invocation was given by Commr. Carson.  The Pledge of Allegiance was recited.

On motion of Commr. Hoskinson, seconded by Commr. Deems and unanimously carried, the Minutes of the meeting of October 3, 1972, were approved as submitted.

county agent

Mr. Jackson A. Haddox, County Extension Director, appeared before the Board and recommended Miss Doris Lynn Milligan for the position of Extension Home Economics Agent I, effective January 8, 1973, pending cooperative approval of the Board of Regents, at a salary of $9,820 per annum; the County contributing $4,420 and the State $5,400.  On motion of Commr. Hoskinson, seconded by Commr. Carson, and unanimously carried, the Board approved the employment of Miss Doris Lynn Milligan as Extension Home Economics Agent I, as recommended by Mr. Haddox.

Commr. Hoskinson read a letter from the U.S. Department of Agriculture, Forest Service, regarding proposed land exchange in Lake County between Tom Rucker and Company and the U.S. Forest Service.

utilities

Commr. Hoskinson stated that he checked with the telephone company regarding placing of controls on the Courthouse telephone to eliminate the unauthorized and unaccounted for toll calls being made.  The Board approved placing a toll restrictor on the Courthouse number; thereby, making it necessary for the one placing a toll call to go through the Courthouse operator.  Credit cards approved by the Board will be issued to only those authorized to place long distance calls.

ordinances

On motion of Commr. Carson, seconded by Commr. Burhans, and unanimously carried, the Ordinance relating to central sewage service and central water system was placed on third and final reading by title only; said title being as follows:

An ordinance requiring all package sewer plants and sewer plants and individual water users or sources located in Lake County, outside municipalities, to join and hook on to any central sewerage service, or central water system whether public, quasi-public, or private, that serves the public or substantial members of the public, whenever the central sewerage service comes within 1,000 feet of the existing package system or the central water system comes within 300 feet of the existing system; and to discontinue use of the package plant or water supply within twelve months from the time service by the central system is available; providing for extensions; providing an effective date; providing a severability clause.

The Chairman called for discussion from the public at this time.

Mr. C. F. Jeffery, owner of El Red Mobile Home Park, appeared before the Board regarding the operation of package sewer systems in mobile home parks, and requested that a clause be placed in the ordinance to allow the package plants that are now in operation to continue to operate so long as they meet the state and local standards.  On recommendation of the County Attorney, the Board amended Section 10 of the ordinance to read, “Notwithstanding…those central systems or package plants both sewer and water that are now in operation at the time when the central system is available may continue in operation, so long as it meets state and local regulations.”

On motion of Commr. Deems, seconded by Commr. Carson, and unanimously carried, the Ordinance was approved and adopted as amended on third and final reading by title only.

It now being the time advertised to open bids for one 1973 model sedan and one 1973 model pickup truck for the Planning Department, the Chairman directed the Clerk to open and tabulate the bids; whereupon the following bids were received:

On motion of Commr. Carson, seconded by Commr. Hoskinson, and unanimously carried, the bids for the sedan and pickup were referred to the Director of Planning to check specifications.  Commr. Carson stated that in view of the Attorney General’s opinion, he will refrain from voting on the purchase of the pickup truck, as he owns interest in a company bidding on the vehicle.

Later in the day, Mr. Flynn presented to the Board figures on past operational costs on cars now being utilized by the Planning Department.  It was the opinion of the County Attorney that the Board can reject a bid if the vehicle rejected has proven it has not given good performance in the past.  On the Attorney’s recommendation, the Board instructed the Attorney to draw up an added specification allowing the dealers to bid cars that are on the lot, which are closes to the specifications quoted, on the day of the bid opening.  The Board will determine whether the vehicle on the lot will meet the necessary requirements.

On motion of Commr. Carson, seconded by Commr. Hoskinson, and unanimously carried, the Board appointed Commr. C. A. Deems as Chairman of the Board of County Commissioners for 1973.

On motion of Commr. Deems, seconded by Commr. Burhans, and unanimously carried, the Board appointed Commr. James R. Carson, Jr. as Vice Chairman of the Board of County Commissioners for 1973.

Laws and legislature

The Board discussed a proposed bill that will be reintroduced in the legislature regarding the right to work law.  It was the feeling of the Board that they should encourage the delegation in Tallahassee to support this bill.

On motion of Commr. Carson, seconded by Commr. Hoskinson, and unanimously carried, the Board authorized the County Engineer to advertise for bids for a self-contained, self-propelled, highway marking machine for the Road and Bridge Department.

On motion of Commr. Hoskinson, seconded by Commr. Burhans, and unanimously carried, the Board authorized the County Engineer to advertise for bids for an electronic distance measuring device.

On motion of Commr. Hoskinson, seconded by Commr. Deems, and unanimously carried, the Board authorized the Engineer to advertise for bids for road striping paints to be used with the road marking machine.

roads – county

On motion of Commr. Hoskinson, seconded by Commr. Carson, and unanimously carried, the Board authorized the Chairman and Clerk to sign Disclaimer releasing road reservations for Leroy Bronson.

Maps and plats

The Board discussed the County’s responsibility regarding approval of subdivision plats located within the municipalities.  The County Engineer recommended that he give the plats a cursory approval to assure that the municipalities comply with State of Florida Plat Laws, Chapter 177.

The meeting recessed for lunch at 11:45 a.m. and reconvened at 1:30 p.m. to take up the remaining items of business.

county employee

On recommendation of the Planning Director, and on motion of Commr. Hoskinson, seconded by Commr. Carson, and unanimously carried, the Board authorized Robert Oatman, Building Administrator, to carry over four and a half days annual leave into 1973; said leave to be used by March 1973.

The County Planner advised the Board that Mr. Harry Nies, Jr., Graphic Technician, resigned effective December 31, 1972.

On motion of Commr. Deems, seconded by Commr. Hoskinson, and unanimously carried, the Board authorized Mr. Flynn, County Planner, to advertise for a planner for his department.

Included in the above motion was approval of Conditional Use Permit 390-5, 389-4 and 391-4 and denial of 213-72-1, 201-72-1, 108-72-4 and CUP 388-5.

On recommendation of the Planning and Zoning Commission, and on motion of Commr. Hoskinson, seconded by Commr. Carson and unanimously carried, Zoning Case 207-72-5 was postponed until 2:00 o’clock p.m. on January 18, 1973.

Zoning Case No. 211-72-4 was called for hearing and the Chairman called for interested parties to be heard.

L. E. Taylor, Attorney, appeared representing the applicant.

Bob Pearson, Mt. Dora City Councilman appeared opposing the rezoning.

 

On motion of Commr. Carson, seconded by Commr. Deems and unanimously carried, the Board upheld the decision of the Planning and Zoning Commission and denied the request for rezoning without prejudice.

Zoning Case No. 214-72-5 was called for hearing and the Chairman called for interested parties to be heard.

W. B. Hunter, Attorney, appeared representing adjacent property owners and opposed the rezoning.

Major D. Jones, applicant, appeared in interest of the rezoning request.

 

Commr. Deems moved that the request for rezoning be denied without prejudice.  The motion was seconded by Commr. Carson.  Commr. Hoskinson moved that the request for rezoning be tabled until the meeting on January 18, 1973.  The motion failed for lack of a second.  The Chairman then called for a vote on the motion previously made to deny the rezoning request without prejudice.  The motion was carried; Commr. Hoskinson voted “no.”

Zoning Case No. 190-72-5 was called for hearing and the Chairman called for interested parties to be heard.

On recommendation of the County Attorney, and on motion of Commr. Deems, seconded by Commr. Hoskinson and unanimously carried, the request was referred back to the Planning and Zoning Department for further recommendation and rescheduled for public hearing on January 18, 1973 at 2:00 p.m.

Conditional Use Permit 385-3 was called for hearing and the Chairman called for interested parties to be heard.

On motion of Commr. Carson, seconded by Commr. Deems, the Conditional Use Permit was approved and the recommendation of the Planning and Zoning Commission was upheld, with the condition that the permittee shall build the road from permittee’s property to State Road #50, and shall pay for the entire cost of such road including all building and material expenses.  The motion was carried; Commr. Hoskinson voted “no.”

#409 to Florida Telephone Corporation to construct and maintain aerial cable along Dist. Road 3-2854 in Lake County, Florida.

 

#408 to Florida Telephone Corporation to construct and maintain buried cable paralleling Dist. Road 2-4106 extending west approximately one mile from SR 44A in Lake County, Florida.

 

To Florida Gas Company to construct and maintain 2” steel gas main along dist. Road 4-5358.  Will jack & bore 2” steel gas main under dist. Road 4-5358.

 

To City of Eustis to construct and maintain a 12” cast iron water main crossing road 3-4861.

The County Attorney, Mr. Christopher C. Ford, advised the Board that the tax suit filed by Holt S. McKinney is scheduled for final argument on December 21, 1972 and the Robert L. Chapman, Jr. tax case is scheduled for hearing on January 10, 1973.

The County Attorney, Mr. Ford, advised the Board that Florida Statutes, Chapter 28-25, states that compensation for special services may be paid to the Clerk of the Circuit Court by the County Commissioners as Clerk of the Board of County Commissioners and for other services he shall be paid such charges as provided by law.  He also apprised the Board of Chapter 145.051 which states that the Clerk of the Circuit Court shall be compensated by the County for any additional duties he shall be required to perform with respect to the county court.  The Chairman stated that he will check into this further and come back to the Board with a recommendation regarding same.

Letter from Emmett S. Roberts, Department of Health and Rehabilitative Services, regarding space requirements in the proposed Community Services Complex was read and filed.

Letter from the Lieutenant Governor’s office requesting that Mr. Stroud serve on the Labor Market Advisory Council was read and filed.

The Clerk read the County Engineer’s recommendations regarding construction of Arlington Avenue.

Copy of a letter from Sheriff Meech to Lennon’s Ambulance Service regarding ambulance charge for transportation of a suicide victim to hospital was read and filed.

The Attorney read letter from Vince Fechtel, Jr., pledging his support to Lake County and stating that Jim Glisson will be the local delegation chairman.

The Attorney advised the Board of a letter from the Attorney General stating that a special act creating the Clerk of the County Court of Lake County can be repealed by General Law.

On motion of Commr. Deems, seconded by Commr. Carson and unanimously carried, the Board approved the purchase of a cash register for the probate department in amount of $2,995.00.

On motion of Commr. Carson, seconded by Commr. Deems and unanimously carried, the Board authorized Leesburg Armature to perform necessary repairs to air conditioning and heating system motor in the Courthouse.

On motion of Commr. Deems, seconded by Commr. Hoskinson and unanimously carried, the Board approved purchase of office equipment for the County Judge’s office from Simons Office Equipment in total amount of $1,597.60.

On motion of Commr. Deems, seconded by Commr. Carson and unanimously carried, the Board approved purchase of office equipment for State Attorney’s office from Simons Office Equipment in total amount of $994.45.

On motion of Commr. Deems, seconded by Commr. Hoskinson and unanimously carried, the Board approved purchase of Sony Dictaphone and Sony transcribing machine in amount of $435.00 each for the County Judge’s Office.

On motion of Commr. Carson, seconded by Commr. Hoskinson and unanimously carried, the Board approved purchase of Burroughs check disbursing machine for the Finance Office n amount of $720.00.

On motion of Commr. Carson, seconded by Commr. Hoskinson and unanimously carried, the Board approved the purchase of 17” Remington Rand typewriter for State Attorney’s office in amount of $464.40.
