A REGULAR MEETING OF THE PROPERTY APPRAISAL ADJUSTMENT BOARD

AUGUST 9, 1978

The Property Appraisal Adjustment Board met in Regular Session on August 9, 1978 at 9:00 a.m. in the Commissioners’ Meeting Room, Lake County Courthouse, Tavares, Florida.  Members present were:  Commr. James R. Carson, Jr., Chairman; Commr. C. A. “Lex” Deems; Commr. Glenn C. Burhans; and School Board Members Joan Brown and Donald Longworth.  Others present were Ed Havill, Property Appraiser; Christopher Ford, County Attorney; and Shirley Wilson, Deputy Clerk.

petition 1978-61 – mr. crawford w. allen

No one appeared before the Board regarding this Petition.

ACTION:  No action was taken on this Petition due to the Petitioner withdrawing his Petition by a letter dated July 30, 1978.

petition 1978-62 – alice mae allman

Mrs. Allman appeared before the Board regarding her Petition.

ACTION:  On a motion by Commr. Burhans, seconded by Mrs. Brown and carried by those present, the Board granted Ms. Allman Homestead based on her having title and equity through contract of purchase as of January 1, 1978.  Commr. Deems was out for the vote.

petition 1978-63 – gerald c. anderson

No one was present regarding this Petition.

ACTION:  Mr. Anderson withdrew his Petition.  No action was taken.

petition 1978-64 – paul h. andree, iii

No one appeared before the Board regarding this Petition.

ACTION:  Mr. Andree, III was granted Homestead based on proof of Contract to the Property Appraiser prior to the Meeting.  No action was taken.

petition 1978-65 – don e. bailey & assoc., inc.

No one appeared before the Board regarding this Petition.

ACTION:  Mr. Bailey withdrew his Petition on August 8, 1978, stating he had a business at this Homestead and knew he was not eligible for the Exemption.  No action was taken.

petition 1978-66 – william l. bailey

No one appeared before the Board regarding this Petition.

ACTION:  No action was taken based on a withdrawal letter stating he had sold the property.

petition 1978-67 – james r. beasley

No one appeared before the Board regarding this Petition.

ACTION:  On a motion by Commr. Burhans, seconded by Mrs. Brown and carried by those present, the Board upheld the recommendation of the Property Appraiser in that Mr. Beasley had moved from this Homestead on October 1977.  Commr. Deems was out for the vote.

petition 1978-68 – cecil blevins

No one appeared before the Board regarding this Petition.

ACTION:  On a motion by Mr. Longworth, seconded by Mrs. Brown and carried unanimously by those present, the Board upheld the Property Appraiser and denied Homestead Exemption to Mr. Blevins.

At this time Commr. Deems arrived.

petition 1978-79 & 1978-191 – roger w. conner

The Board had some time before the next hearing and saw that Mr. Roger W. Conner was present for his hearing at 9:50 a.m.  Mr. Conner was asked to be heard at this time regarding his Petition 1978-79.

ACTION:  On a motion by Commr. Burhans, seconded by Mrs. Brown and carried, the Board upheld the Property Appraiser and denied Mr. Conner Homestead Exemption based on untimely filing.

Mr. Conner also brought before the Board Petition 1978-191, which he failed to present before the Board on August 7, 1978.  On a motion by Commr. Burhans, seconded by Mr. Longworth and carried, the Board upheld the Property Appraiser on Mr. Conner’s tangible goods based on the untimely filing of his tangible forms.

petition 1978-69 – mr. charles m. bragg

No one was present regarding this Petition.

ACTION:  On a motion by Commr. Burhans, seconded by Mrs. Brown and carried, the Board upheld the recommendation of the Property Appraiser based on the homestead being rental property in 1978.

petition 1978-70 – vernon k. bradshaw

No one appeared before the Board regarding this Petition.

ACTION:  On a motion by Mr. Longworth, seconded by Mrs. Brown and carried, the Board upheld the recommendations of the Property Appraiser and denied Mr. Bradshaw Homestead based on a questionnaire mailed to him, which was not answered.  Commr. Burhans voted no.

petition 1978-71 – paul v. breier

No one appeared before the Board regarding this Petition.

ACTION:  On a motion by Commr. Burhans, seconded by Mr. Longworth and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the Homestead Exemption based on the Petitioner renting this property on January 1, 1978.

petition 1978-72 – g. m. burie

No one was present regarding this Petition.

ACTION:  On a motion by Commr. Burhans, seconded by Mrs. Brown and passed unanimously, the Board upheld the Property Appraiser’s denial due to the fact that the Petitioner is not a resident of Florida.

petition 1978-73 – wayne h. burton

No one was present regarding this Petition.

ACTION:  On a motion by Mrs. Brown, seconded by Commr. Burhans and carried unanimously, the Board denied Homestead due to a conversation between the Petitioner and the Property Appraiser on April 5, 1978, with the Petitioner stating the property was rental property as of January 1, 1978.

Mrs. Castle was present regarding this Petition.

ACTION:  On a motion by Mrs. Brown, seconded by Commr. Burhans and carried unanimously, Homestead was denied due to the Petitioner filing her Application after March 1, 1978.

petition 1978-75 – joe e. catlin

No one appeared before the Board regarding this Petition.

ACTION:  On a motion by Commr. Burhans, seconded by Mr. Longworth and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied Homestead Exemption due to the house being under construction and not being occupied on January 1, 1978.

ACTION:  Petitioner withdrew and no action was taken.

petition 1978-77 – ernest carpenter

No one appeared before the Board regarding this Petition.

ACTION:  No action was taken based on a letter from the Petitioner stating they were renting the house on January 1, 1978.  The Property Appraiser verified this statement.

ACTION:  Ms. Chandler voluntarily withdrew her Petition as she moved prior to January 1, 1978.  No action was taken.

ACTION:  The Property Appraiser advised the Board that Mr. Cooban had moved prior to January 1, 1978; based on this Commr. Burhans made the motion, seconded by Commr. Deems, and the Board voted unanimously to deny Homestead Exemption.

ACTION:  On a motion by Commr. Burhans, seconded by Mrs. Brown and carried unanimously, the Board requested Mr. DeWinter to bring Proof of Title in the afternoon in order to receive his Homestead Exemption.

ACTION:  On a motion by Commr. Burhans, seconded by Mrs. Brown and carried unanimously, the Board upheld the Property Appraiser in the denial of this Homestead Exemption due to the Petitioner not being a legal resident.

ACTION:  On a motion by Commr. Burhans, seconded by Mrs. Brown and carried unanimously, the Board denied Homestead due to Mr. Dykhuis renting the Homestead to another party as of January 1, 1978.

ACTION:  The Petition was withdrawn and no action was taken.

Mr. Gordon Savage, Attorney, appeared before the Board regarding this Petition – on behalf of Ms. Ferrell.

ACTION:  On a motion by Commr. Burhans, seconded by Mrs. Brown and carried unanimously, the Board granted Homestead Exemption based on Ms. Ferrell still being a legal resident of Lake County and away only temporarily.

ACTION:  On a motion by Commr. Burhans, seconded by Mr. Longworth and carried, the Board denied Homestead based on the title not being acquired by the Petitioner until January 18, 1978.

ACTION:  On a motion by Commr. Burhans, seconded by Mrs. Brown and carried unanimously, the Board denied Homestead due to the Petitioner owning the property in question but not owning the Mobile Home in which he resides.

ACTION:  On a motion by Commr. Burhans, seconded by Mrs. Brown and carried unanimously, the Board, per the recommendation of the Property Appraiser, granted Homestead Exemption due to the Petitioner having vested title as of January 1, 1978.

Mr. Stewart was present for the hearing of his petition.

ACTION:  On a motion by Commr. Deems, seconded by Commr. Burhans and passed, the Board overruled the Property Appraiser and reduced the assessment of Mr. Stewart’s office equipment from $1,860.00 to $1,600.00 with Mr. Longworth voting no.  The Board did uphold the Property Appraiser in the 20% penalty.

ACTION:  On a motion by Mrs. Brown, seconded by Mr. Longworth and carried, the Board upheld the recommendation of the Property Appraiser on the #34,000.00 assessment on his gasoline pumps, plus a 20% penalty.  Commr. Burhans voted no.

ACTION:  On a motion by Commr. Burhans, seconded by Mrs. Brown and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied Homestead Exemption due to the fact that the re-application was mailed on March 17, 1978.

 ACTION:  On a motion by Commr. Burhans, seconded by Mr. Longworth and carried unanimously, the Board upheld the Property Appraiser based on the Petitioner no longer being a resident of Florida.

ACTION:  On a motion by Commr. Burhans, seconded by Mr. Longworth and passed unanimously, the Board upheld the recommendation of the Property Appraiser due to late filing by the Petitioner.

Mrs. Millett appeared before the Board regarding this Petition.

ACTION:  No action was taken due to a settlement before the hearing.

petition 1978-3 – jerry t. lockett, atty./MR. alfred p. bosanquet

Mr. Lockett appeared before the Board on behalf of Mr. Bosanquet.

ACTION:  Mr. Lockett presented a written opinion before the Board from a Mr. Roger Hartsock, as was requested by the Board on August 7, 1978.  Mr. Jim Loflin, Representative from the Property Appraiser’s Office, presented his findings on Mr. Bosanquet’s property.   Commr. Burhans made the motion to grant the Agriculture Exemption, but the motion died for lack of a second.  On a motion by Mr. Longworth, seconded by Mrs. Brown and carried, the Board denied the Agriculture Exemption.  Commr. Burhans voted no.

ACTION:  On a motion by Commr. Burhans, seconded by Mrs. Brown and carried unanimously, the Board denied Homestead Exemption due to the Petitioner being deceased.

No one was present regarding this Petition.

ACTION:  On a motion by Mr. Longworth, seconded by Mrs. Brown and carried unanimously, the Board upheld the Property Appraiser based on there being no title to this property on January 1, 1978.

ACTION:  On a motion by Mrs. Brown, seconded by Commr. Deems and carried unanimously, the Board denied the Homestead Exemption due to untimely filing by the Petitioner.

ACTION:  On a motion by Commr. Burhans, seconded by Mr. Longworth and carried, Mr. Poulos was granted Homestead Exemption, in that he stated he had signed a Declaration of Domicile stating he was a legal resident of Lake County and a homesteader on said Homestead.  Commr. Deems and Mrs. Brown voted no.

ACTION:  No action was taken due to Mr. Yergey withdrawing his Petition on August 8, 1978, based on an agreement between Mr. Yergey and the Property Appraiser prior to the hearing.

ACTION:  On a motion by Commr. Burhans, seconded by Mr. Longworth and carried unanimously, the Board upheld the Property Appraiser’s penalty on the late filing of the 1978 tangible return.

At this time, the Property Appraiser asked the Board Members if they would be in favor of hearing all of the organizations which were involved in the possessory interest cases due to the decision of the Board on August 7, 1978 regarding the Mount Dora Golf Association, Mount Dora Lawn Bowling, City of Mt. Dora and Clermont Chamber of Commerce.  The Board advised Mr. Havill they did not feel the organizations should be treated differently from other untimely filing petitions.  The Property Appraiser stated he would like to write letters advising them to file in order that they might have the same opportunity as the above-mentioned organizations.  The Chairman brought to the Property Appraiser’s attention that he had the authority to remove them from the tax roll, if he so desired.  Mr. Havill stated that he was not in agreement to do this, and that his intentions were not to take from the tax roll but to put the ones back on which had previously been removed.

The Chairman then stated the Property Appraisal Adjustment Board would meet on Friday, August 25, 1978, at 9:00 a.m. to approve the August 7th and 9th Minutes.

There being no further business to be brought to the attention of the Board, the meeting was adjourned at 5:55 p.m.
