A REGULAR MEETING OF THE BOARD OF COUNTY COMMISSIONERS

February 5, 1980

            The Lake County Board of County Commissioners convened in Regular Session on Tuesday, February 5, 1980, at 9:00 A.M. in the Board of County Commissioners' Meeting Room, Courthouse, Tavares, Florida. Commissioners present were: C. A. "Lex" Deems, Chairman; Glenn C. Burhans; James R. Carson, Jr.; Glenn Y. Middleton, Thomas J. Windram. Others present were: James C. Watkins, Clerk: Christopher C. Ford, County Attorney; and Pat Goetzen, Deputy Clerk.

            The Invocation was given by Mr. Watkins and the Pledge of Allegiance was led by Commr. Middleton.

            AUDITS/MEETINGS

            On a motion by Commr. Windram, seconded by Commr. Carson and carried unanimously, the Board approved to meet in Special Session on Monday, February 11, 1980, at 9:00 A.M., for the purpose of interviewing the three (3) C.P.A. firms selected by the Audit Selection Committee.

            The Board will select one (1) firm to perform the audits for Lake County, as required by Florida Law.

            COMMISSIONERS

            Commr. Deems informed the Board Ms. Dorrie Hostettler, had asked the Board to participate in a question and answer type program at the Golden Triangle Women's Club, on Monday, February 18, 1980, at 9:30 A.M.

            Commr . Carson, Commr. Middleton and Commr. Burhans stated they were planning to attend. Commr. Windram stated he would make every effort to be at the meeting.

            MINUTES

            On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board approved the Minutes of January 8, 1980, as amended and corrected.

            AGRICULTURE CENTER/COUNTY EMPLOYEES

            Mr. John Jackson, Acting Extension Director, appeared before the Board to present and recommend Mr. Russell Howard Swanson for the position of County Extension Agent in Urban Horticulture.

            On a motion by Commr. Burhans, seconded by Commr. Middleton and carried unanimously, the Board approved the employment of Mr. Russell Howard Swanson as County Extension Agent of Urban Horticulture, effective March 14, 1980, at a salary of $5,430.00 for the first six (6) months and $5,730.00 for the remainder of the fiscal year including budgeted travel of $1,000.00.

            MINUTES

            On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board approved the Minutes of January 15, 1980, as amended and corrected.

            COMMUNICATIONS

            Commr. Windram acknowledged Mr. Van Etten, Lake Joanna, who says he feels the County has taken property belonging to him and thereby violated his constitutional rights.

            Mr. Ford, County Attorney, stated he had spoken with Mr. Van Etten some time ago and advised him that the Engineer’s records show that he did not own the drive in question and the County had a right to be on the road. Mr. Ford advised Mr. Van Etten if he felt his constitutional rights had been violated he should obtain private counsel and pursue the matter through that means.

            MUNICIPALITIES

            Commr. Deems referred to a letter from the City of Leesburg requesting the County’s assistance in obtaining matching funds in the amount of $110,000.00 in order to receive a federal grant in the amount of $444,000.00 from the Federal Aviation Administration. The grant would be used for improvements to the Leesburg Municipal Airport.

            It was brought out that Department of Transportation wanted to participate in their share of the matching funds (10% of the total 20%), however, they would not be able to do so this year due to budget restrictions.

            The City is within a time frame to acquire their share of the matching funds and also acquire the Department of Transportation’s share which DOT would repay next year.

            On a motion by Commr. Windram, seconded by Commr. Burhans and carried unanimously, the Board authorized Commr. Deems, Mr. Watkins, and Mr. Ford, County Attorney, to check into the request to see if the County could possibly assist in funding the matching monies with DOT repaying their portion next year, providing the County has the available funds.

            ROADS-COUNTY, STATE

            Commr. Windram read a letter from the Department of Transportation indicating a study had been completed, as requested by the County, at the intersection of SR 19 and SR 42 East and C42 West in Altoona. The study indicated there was no need for a flashing beacon at C42 East but did recommend one to be installed at C42 West.

            COMMUNICATIONS

            Mr. Gary Udouj, Greater Orlando Area Legal Services, Inc. (GOALS), appeared before the Board to request matching funds in the amount of $3,750.00 to be used as cash match to obtain Community Services Trust Fund monies in the amount of $15,000.00.

            The Board advised Mr. Udouj they would give every consideration to the request and get back with him as soon as possible.

            BONDS - MOBILE HOME, CANCELLATION

            On a motion by Commr. Burhans, seconded by Commr. Carson and carried unanimously, the Board cancelled the Mobile Home Bond and Agreement dated March 3, 1979, for Donald A. Simmons, in that the temporary structure had been removed and conditions met.

            BONDS - MOBILE HOME

            On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board approved the request of James J. McClusky, Bassville Park Area, District #1, to live in a travel trailer on the same piece of property on which his conventional dwelling is being built, subject to the proper bond being posted and with the understanding the travel trailer will be removed immediately upon the completion of the conventional dwelling or upon the request of the Board of County Commissioners.

            PLANNING DEPARTMENT

            On a motion by Commr. Burhans, seconded by Commr. Carson and carried unanimously, the Board approved the request for waiver of improvement requirements and plan requirements of the Subdivision Regulations - Section 62 for Steve Goddard (R.L.C. Investments, Inc.) Bassville Park Area - District #1 - Case #80-3.

            On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board denied the request for waiver of improvement requirements and plan requirements of the Subdivision Regulations - Section 62 for Helen Sumner - Okahumpka Area - District #2 - Case #80-8.

            On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board approved the request for waiver of improvement requirements and plan requirements of the Subdivision Regulations - Section 62 for Martha T. Konantz - Leesburg Area - District #2 - Case #80-9.

            On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Board denied the request for waiver of improvement requirements and plan requirements of the Subdivision Regulations - Section 62 for Edgar L. McNeil - Lady Lake Area - District #1 - Case #80-10.

            ORDINANCES

            On a motion by Commr. Windram, seconded by Commr. Burhans and carried unanimously, the Board approved to advertise an ordinance amending the Flood Plain Ordinance and set for Public Hearing.

            GRANTS/PLANNING DEPARTMENT

            On a motion by Commr. Carson, seconded by Commr. Middleton and carried unanimously, the Board approved the Chairman’s signature on a General Rehabilitation Contract for Drew & Lillian Dallas - Sorrento, in the amount of $4,000.00 (Community Development Block Grant).

            ORDINANCES

            At 10:00 A.M. the Chairman announced the advertised time had arrived for the Public Hearing regarding the consideration for adoption of an Ordinance amending the Zoning Regulations of Lake County, by changing the application filing date in Article VIII. It was noted that the proper proof of publication was on hand and had appeared in the January 18, and 25, 1980, editions of The Leesburg Commercial.

            On a motion by Commr. Carson, seconded by Commr. Windram and carried unanimously, the Ordinance was placed on the floor for its first and only reading by title only.

            At this time, Commr. Carson read the title of the Ordinance as follows:

AN ORDINANCE AMENDING THE ZONING REGULATIONS OF LAKE COUNTY, FLORIDA, ORDINANCE 1971-6, BY CHANGING THE APPLICATION FILING DATE IN ARTICLE VIII, SECTION 80. PROCEDURES, SUB-SECTION 80.103; PROVIDING FOR A SAVING CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.


            On a motion by Commr. Windram, seconded by Commr. Middleton and carried unanimously, the Board moved the adoption of said Ordinance, Number 1980-6, as read by title only, on its first and only reading.

            ORDINANCES

            At 10:15 A.M. the Chairman announced the advertised time had arrived for the Public Hearing regarding the consideration for adoption of an Ordinance amending the Zoning Regulations of Lake County, by adding a new section “ER” (Estate Residential). It was noted the proper proof of publication was on hand and had appeared in the January 18, and 25, 1980, editions of The Leesburg Commercial.

            On a motion by Commr. Carson, seconded by Commr. Burhans and carried unanimously, the Ordinance was placed on the floor for its first and only reading by title only.

            At this time, Commr. Carson read the title of the Ordinance as follows:

AN ORDINANCE AMENDING THE ZONING REGULATIONS OF LAKE COUNTY, FLORIDA, ORDINANCE 1979-6, BY ADDING A NEW SECTION “ER,” ESTATE RESIDENTIAL, AN ADDITIONAL DISTRICT TO ENCOURAGE THE RETENTION AND DEVELOPMENT OF SUITABLE AREAS FOR SELECT TYPES OF RESIDENTIAL DEVELOPMENT AT LOW DENSITY; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.


            On a motion by Commr. Windram, seconded by Commr. Middleton and carried unanimously, the Board moved the adoption of said Ordinance, Number 1980-7, as read by title only, on its first and only reading.

            Discussion occurred regarding Section 62.310 of the above adopted Ordinance which refers to the required minimum living area of 2,100 square feet, of which 300 square feet of screened room, carport or storage area may be included.

            On a motion by Commr. Carson, seconded by Commr. Middleton and carried unanimously, the Board directed Mr. Willett, Director of Development and Public Works, to bring to the attention of the Planning and Zoning Commission, the possibility of requiring a smaller house size in Ordinance 1971-6, “ER” (Estate Residential), Section 62.310.

            RESOLUTIONS/PUBLIC WORKS

            Discussion occurred regarding Attorney General’s Opinion 79-104 which adversely affects the second gas tax which has been previously utilized by the State of Florida and now is being utilized by the counties of the State of Florida for maintenance purposes.

            Mr. Willett, Director of Development and Public Works, and Mr. Ford, County Attorney, stated they had been contacted by Marion County and asked to consider joining in a law suit concerning the above.

            On a motion by Commr. Windram, seconded by Commr. Carson and carried unanimously, the Board, acting upon the recommendation of Mr. Ford, County Attorney, approved a Resolution taking the same position as Marion County in opposition to the Attorney General’s Opinion (without joining in the law suit with Marion County).

            The Board directed a copy of the Resolution be sent to our Legislative Delegation, Senate and House Committees and the State Association of County Commissioners.

            TAX ROLLS/COMMUNICATIONS

            Mr. Ken Pass of The Leesburg Commercial appeared before the Board to discuss the publication of the 1979 delinquent taxes. Mr. Pass pointed out that The Leesburg Commercial qualifies to publish the tax rolls under the recent amendment to House Bill 16-C.

            Mr. Ford, County Attorney, advised The Leesburg Commercial and The Sentinel both qualified.

            Mr. Watkins, Clerk, stated he had been contacted by The Lake Region News who requested the decision of the Board, as to selecting a newspaper for publication, be held off until after the first week in April. It was their feeling the Legislature would make some changes in this Special Session.

            Mr. Watkins advised the Board a decision should be made no later than the middle of April, due to the fact the publication must run once a week for four (4) consecutive weeks, and considering the preparation of the tax roll and proofing done by the printer.

            PURCHASING/BIDS

            On a motion by Commr. Windram, seconded by Commr. Carson and carried unanimously, the Board approved the request of Norma Showley, Purchasing Agent, to rebid Asphalt (Southern Area), Limestone (Sumterville and Center Hill), Sign Blanks (all have expiration dates at the end of March).

            Ms. Showley advised she planned to ask for extensions at the current prices for six months but requested permission to rebid where extensions are not granted.

            The motion also included permission to rebid filled Rip Rap Bags, which has been extended several times and we have been advised prices are going up and would like to have a locked in price.

            COMMUNICATIONS

            Discussion occurred regarding the request of the Florida Highway Patrol to purchase gasoline from the County. Due to the rise in the cost of fuel, the State of Florida has had to allocate mileage driven by the Highway Patrol, cutting from 120 miles per day to 60 miles per day. If the Highway Patrol could purchase gasoline from County pumps it would eliminate having to drive to Leesburg (DOT) for fuel, using up their mileage allocation.

            Sgt. Duttenhaver, Troop D (Leesburg), advised the State is prepared to pay on a billing basis for the purchase of the fuel.

            Mr. Ford, County Attorney, recommended Commr. Deems check with Public Works Department and the Fuel Allocations Officer concerning the control which would be provided at the pumps if the request were approved and the availability of the fuel.

            ACCOUNTS ALLOWED/ELECTIONS/COUNTY PROPERTY

            On a motion by Commr. Windram, seconded by Commr. Middleton and carried unanimously, the Board approved the increase in rates for Leesburg Transfer and Storage, Inc., for delivery and pickup, and storage on voting machines as follows:

            1.         Delivery and pickup of machines will increase from $25.00 per machine to $32.50 per machine, with a minimum charge of $65.00.

            2.         Storage rates will increase from $2.10 per machine per month to $2.35 per machine per month. Your cost has been for 152 machines $319.20 per month or $3,830.40 per year. The new rate will be $357.20 per month or $4,286.40 per year. An annual increase of $456.00.


            TRAVEL/MVI STATIONS/ACCOUNTS ALLOWED

            On a motion by Commr. Carson, seconded by Commr. Windram, and carried unanimously, the Board approved travel for Frank Woodson, MVI, to attend a special meeting of Vehicle Safety Inspection Association of Florida, in Crystal River, February 14 through 16, 1980. Total anticipated cost of $165.00 ($45.00 of which is a registration fee).

            CHAMBER OF COMMERCE

            At this time, Mr. Ford, County Attorney, reported to the Board concerning the request of the Lake County Chamber of Commerce for funding. Mr. Ford stated his legal opinion was the Board could not give money or make an actual contribution to the Chamber for funding. However, the Board can contract with someone to perform advertising or public relations services, based upon the following:

            1.         The Board must conclude the advertising and public relations are in the best interest of the County and feel they are necessary in this County.

 

            2.         The advertising and public relations would have to be of substantial public interest under the latest Supreme Court Case to be warranted.

 

            3.         The funds must be strictly accounted for, no matter who receives the funds they would see the funds were being used for advertising and public relations which were contracted for.


            Mr. Ford mentioned there was one other special act which allowed for publicity. The act allows up to one mil but in Mr. Ford’s opinion, would require a referendum to put the special act into effect. More research would be required to give detailed information on the act.

            The Board would have to decide as to a policy decision if the advertising has a substantial public interest in Lake County and, if so, would the Board contract with someone else for the work or handle it in-house, or have a firm or the Chamber contract for the work.

            Commr. Windram referred to certain problems he felt the Board and other interested parties should be aware of in considering funding the Chamber. The following were mentioned:

            1.         Unauthorized purchased were made by the Chamber.

            2.         Records keeping procedures of the Chamber left much to be desired.

            3.         Failure to utilize the County Purchasing Agent.

            4.         Failure to remit rental funds to the County (from the Farmers Market).


            Mr. Don Smalt, Mr. Watkins, Ms. Puckett and Commr. Hoskinson met with the Chamber in 1978 to go over the records of the Chamber and found these and other problems to be evident. The County worked with the Chamber and improvements were made to some degree.

            However, this year the Board has received several complaints from clients who have used the Expo facilities for a number of years but were very dissatisfied this year due to the facility not being prepared in the proper manner for their particular use. The complaints were received from Golden Gen, Farm Bureau and Farm-City Week.

            Problems have also arisen from more than one event being scheduled on the same day.

            The Board had placed two (2) men at the fairgrounds for maintenance purposes, however, the grounds were not maintained, nor the buildings, fire codes and general repairs were not made.

            Commr. Windram also noted that the Lake County Fair Association, who has spent a considerable amount of money, which they earned from the fair, on the Expo facilities, such as building, etc., last year gave $5,000.00 to the Chamber for their services to the operation of the fair according to Dennis Horton, Chamber President. However, Commr. Windram stated he was informed just recently that the figure was actually $7,000.00, with the $5,000.00 to the Chamber for services and an additional $2,000.00 to the Chamber employees as bonuses.

            Ms. Lee Ravenhill, Secretary to the Chamber, addressed the Board and stated she was sure of the $5,000.00 for the 1979 Fair but she was not sure of the $2,000.00.

            The Chamber produced 7,000 copies of the 1979 Fair Program, in-house on its offset press for the Fair Association. The Chamber charged the Fair Association approximately $7,200.00 for the 7,000 copies. The Chamber also employed an outside firm to sell the ads for the program, at the cost of approximately $4,095.00. The firm sold approximately $8,928.00 in ads. The Fair Association lost approximately $2,400.00 on their Fair Program.

            This year the Fair Association likewise employed Don Smalt, to produce the Fair program. Mr. Smalt has contracted 7,000 copies to be printed by a professional printing firm at the cost of $3,500.00. One of the County’s secretaries has spent approximately one and a half weeks soliciting ads and has sold approximately $5,500.00 to $6,500.00 in ads so the Fair Association is assured of a profit in their Fair Program for this year (1980).

            Commr. Windram stated these were some of the reasons he could not approve paying the Chamber a management fee of $25,000.00 when the management received left a great deal to be desired. There was another approximate $15,000.00 allotted to the Chamber in expenditures for repairs, utilities, supplemental help, etc. plus the County sent employees from the Road and Bridge Department to assist in cleaning the facility after an event had taken place. Commr. Windram indicated he could not justify contracting with the Chamber again when the services received in the past were not satisfactory.

            Mrs. Lee Ravenhill, Secretary to the Chamber, addressed the Board and stated the funds were paid from the fair for all the bills accumulated for the fair program in 1979. Mrs. Ravenhill said there was never anything said at the Fair meetings about these expenditures. She asked why the Fair Board never came to Mr. Dunbar and indicated to him that the Fair Association did not want to expend that much money for programs or not hire professionals to sell ads for the programs. Mrs. Ravenhill stated the Fair Board approved whatever Mr. Dunbar said.

            Commr. Windram stated he could not speak for the Fair Association, however, in his opinion, it might be that the Chamber might not have been aware that these services could be performed for less expense.

            Mrs. Ravenhill stated the maintenance employees at the fairgrounds were not receiving direction from Mr. Dunbar and she instructed them at times. She said the maintenance people were not doing their jobs. Commr. Windram stated this was the point he was trying to make concerning poor management of the facility.

            Commr. Windram stated he wanted it understood he had not seen or did not make any indication that anyone took money or spent money on themselves. There is not question about anyone’s integrity.

            Mrs. Ravenhill stated the Chamber Board cared and had concern for Lake County and she felt they deserved the $25,000.00 funding from the County.

            Mr. Don Colborne, member of the Chamber of Commerce, expressed his feelings regarding the request for funding of the Chamber. He said he felt the Chamber was a vital aspect of Lake County and the County should support the Chamber.

            Mr. Dennis Horton, President, Lake County Chamber of Commerce, stated the problems brought out were things done incorrectly during the past couple of years. He feels the Chamber does need to find more ways to become self sufficient in the future but the Chamber cannot operate at this point without supplemental funding.

            RECESS AND REASSEMBLY

            The Board adjourned for lunch at 12:33 P.M. at the Silver Lake Country Club with the public and press invited on a Dutch treat basis. Discussion regarding the request for funding of the Chamber of Commerce will resume at 3:30 P.M.

            CODE VIOLATIONS

            PUBLIC HEARING ZV-79-156 - Roger C. Tworoger

            No one present wished to discuss this case with the Board.

            On a motion by Commr. Middleton, seconded by Commr. Carson and carried, the Board declared Mr. Tworoger in violation and granted him 60 days to come into compliance.

            Commr. Burhans voted “NO.”

            PUBLIC HEARING ZV 79-163 - Vernard Nealy

            No one present wished to discuss this case with the Board.

            On a motion by Commr. Burhans, seconded by Commr. Carson and carried unanimously, the Board declared Mr. Nealy in violation and granted him 30 days in which to come into compliance.

            PUBLIC HEARING ZV-80-1 - Gerald Whitman

            No one present wished to discuss this case with the Board.

            On a motion by Commr. Burhans, seconded by Commr. Carson and carried unanimously, the Board declared Mr. Whitman in violation and granted him 30 days in which to come into compliance.

            PUBLIC HEARING ZV-80-7 - Thomas W. Carter

            Mr. Carter was present and presented a letter from the Zoning Department stating he could keep hogs. Ms. Casburn, Code Enforcement, explained the letter was in error and a corrected letter was prepared and mailed to Mr. Carter.

            On a motion by Commr. Windram, seconded by Commr. Burhans and carried unanimously, the Board postponed this case until March 4, 1980, at 2:00 P.M. or as soon thereafter as possible to allow code enforcement to see if Mr. Carter’s property is grandfathered in.

            PUBLIC HEARING ZV-80-10 - Ken Walburn

            No one present wished to discuss this case with the Board.

            On a motion by Commr. Carson, seconded by Commr. Middleton and carried unanimously, the Board declared Mr. Walburn in violation and granted him 30 days to come into compliance.

            On a motion by Commr. Middleton, seconded by Commr. Carson and carried unanimously, the Board acknowledged receipt of the Financial Statement for Lake Community Action Agency, Inc. ending September 30, 1979.

            On a motion by Commr. Middleton, seconded by Commr. Carson and carried unanimously, the Board acknowledged receipt of the Monthly Board Packet from Lake Community Action Agency, Inc.

            BUDGET/LANDFILLS

            On a motion by Commr. Burhans, seconded by Commr. Middleton and carried unanimously, the Board authorized the Chairman to sign the Arthropod Control Budget for the Lake County Landfill beginning October 1, 1979 and ending September 30, 1980.

            ASSESSMENTS

            On a motion by Commr. Burhans, seconded by Commr. Middleton and carried unanimously, the Board authorized the Chairman and the Clerk to sign the Satisfaction of Assessment Lien for L. W. Humphrey and Ramona Humphrey.

            EMERGENCY MEDICAL SERVICES/RESOLUTIONS

            On a motion by Commr. Burhans, seconded by Commr. Middleton and carried unanimously, the Board authorized the Chairman to sign a resolution supporting the EMS Council and endorsing the Grant Application for funds under Section 1204 (1) of EMS Systems Act, intended to provide for advanced life support.

            FAIRGROUNDS/ACCOUNTS ALLOWED

            On a motion by Commr. Windram, seconded by Commr. Burhans and carried unanimously, the Board approved the request of Don Smalt, Acting Fairgounds Manager, to purchase the following Fire Safety Equipment:

            8 pressurized water extinguishers

            8 ABC dry chemical extinguishers

            16 cabinets to hold same


            This equipment is required in order to comply with the Fire Marshall’s Safety Regulation and must be purchased and installed before March 1, 1980, at which time another fire safety inspection will be conducted.

            COMMUNICATIONS/MUNICIPALITIES

            Mr. Watkins, Clerk, presented a letter from the City of Mt. Dora regarding their concerns of:

            1.         Revenue and costs aspects associated with the pending 201 Project.

            2.         Sewage treatment and treated wastewater disposal issues during the next several years, until the pending 201 Project is installed and operating.


            Mike Willett, Director of Development and Public Works, and Ted Wicks, Acting Pollution Director, are to be obtaining the necessary information to reply to the letter.

            Mr. Watkins directed a letter be written to the city advising of Mr. Willett’s and Mr. Wick’s efforts to reply as soon as possible.

            PUBLIC HEALTH/RESOLUTIONS

            On a motion by Commr. Windram, seconded by Commr. Middleton and carried unanimously, the Board approved a resolution as requested by the Lake County Health Department, granting the Lake County Health Department permission to charge for the following services:

            1.         Septic Tank Site Evaluation

            2.         Septic Tank Permit

            3.         Certify Existing Septic Tank System

            4.         Child Day Care (Annual License)

            5.         Public Drinking Water Supply Samples

            6.         Public Swimming Pool Samples

            7.         County Employee Physicals


            The Department has been charging for six of the above services since May 1978. The County physicals began November 7, 1979, and the auditor has requested a resolution for authorization.

            Mr. Ford, County Attorney, was directed to draw up the resolution.

            ORDINANCES

            On a motion by Commr. Windram, seconded by Commr. Burhans and carried unanimously, the Board authorized the secretaries in the Board Office (under the direction of Mr. Watkins, Clerk) to set dates for Public Hearings without presenting to the Board.

            PERSONNEL/POLLUTION/PLANNING/MOSQUITO CONTROL/

            COUNTY EMPLOYEES


            On a motion by Commr. Burhans, seconded by Commr. Middleton and carried unanimously, the Board approved the following employees’ salary increases and promotions as presented by Sherry Puckett, Acting Personnel Director:

            1.         Linda Baggett be promoted from Secretary II to Executive Secretary at a salary of $8,400 effective January 26, 1980. The Executive Secretary position is budgeted at $9,600.00. The Secretary II position will not be filled at this time. Request made by Mr. Wicks, Acting Pollution Director.

 

            2.         Jerry Greif, Planning Department, to receive a merit increase effective January 26, 1980, from $12,000.00 to $12,900.00 per year. Request made by Mr. Willett, Development and Public Works Director.

 

            3.         Andrew Duncan, Mosquito Inspector, to receive a merit increase from $7,800.00 to $8,100.00, effective February 4, 1980. Request made by Phil Yoder, Director of Mosquito Control.

 

            4.         Franklin Fritzinger, Mechanic, Mosquito Control, to receive a merit increase from $8,502.00 to $9,500.00, effective February 4, 1980, and probationary period to be terminated. Request made by Mr. Yoder, Director of Mosquito Control.


            Commr. Windram suggested all salary increases requested that are larger than the budgeted salary be brought to the attention of the liaison Commissioner before being presented to the Board by Personnel.

            CHAMBER OF COMMERCE

            Discussion resumed regarding the request for funding of the Lake County Chamber of Commerce.

            Mrs. Ravenhill addressed the Board and stated Commr. Windram was correct concerning the $7,000 paid to the Chamber by the Fair Association for the 1979 Fair.

            On a motion by Commr. Windram, seconded by Commr. Middleton and carried unanimously, the Board denied the request of the Chamber for funding. The Board felt they could not justify entering into a contract with the Chamber at this time.

            COMMUNICATIONS

            Mr. Ford, County Attorney, advised the Board to check into the request of the Greater Orlando Area Legal Service (GOALS) for matching monies to assist them in obtaining Community Trust Funds.

            Commr. Deems, Chairman, appointed Commr. Carson as liaison Commissioner for GOALS. Mr. Ford, Mr. Watkins and Commr. Carson are to check into the request further.

            PLANNING/APPOINTMENTS

            On a motion by Commr. Middleton, seconded by Commr. Windram and carried unanimously, the Board appointed C.L. Merritt of Ferndale to the Planning and Zoning Commission for District #3, to replace Marvin Mincey whose term expires February 28, 1980.

            FIRE DISTRICTS/APPOINTMENTS

            On a motion by Commr. Burhans, seconded by Commr. Windram, the Board appointed W.A. Long as Fire Commissioner for the Paisley Fire District to replace Sue Parker who resigned.

            CHAMBER OF COMMERCE

            Commr. Windram advised the Board he had received a letter from the Chamber advising that their next Board meeting would be held on March 11, 1980, and, at that meeting, their Board would discuss the billing from the County for unpaid rentals from the Farmers Market.

            SUITS AFFECTING THE COUNTY

            Commr. Carson recommended congratulations to Mr. Ford, County Attorney, for a job well done regarding the results of the road suit (condemnation suits). The results were extremely favorable to the County and to the State.

            EMERGENCY SERVICES

            Commr. Carson referred to a letter from Bob Lewis, Director of Emergency Services, regarding identification cards for Emergency Medical Services and estimates for same.

            Commr. Carson will present to the Board next week.

            NURSING HOME/CONTRACTS, LEASES & AGREEMENTS

            On a motion by Commr. Burhans, seconded by Commr. Middleton and carried unanimously, the Board approved a contract between Lake Memorial Nursing Home and Dorothy Monroe as a Dietary Consultant at $75.00 per month.

            MUNICIPALITIES/ROADS - COUNTY & STATE

            Commr. Burhans brought up a bill in the amount of $15,247.28, to the City of Umatilla, dated November 15, 1979, for the paving of Grove Street in Umatilla. The bill has not been paid and the Board directed Mr. Ford, County Attorney, to pursue the matter for collection.
