A REGULAR MEETING OF THE PROPERTY APPRAISAL ADJUSTMENT BOARD

JANUARY 13, 1982

The Property Appraisal Adjustment Board met in Regular Session on Wednesday, January 13, 1982, at 9:00 A.M. in the Commissioner's Meeting Room, Lake County Courthouse, Tavares, Florida. Members present were: Commr . Glenn C. Burhans, Chairman; Commr. James R. Carson, Jr.; Commr. C. A. "Lex Deems"; Mr. Donald Berry; and Mr. R. Jerry Smith. Others present were: Mr. Ed Havill, Property Appraiser; Mr. Harold Williams, Chief Field Appraiser; Mr. Gaylord A. Wood, Property Appraiser's Attorney; Mr. Sanford Minkoff, Representing the County Attorney's Office; and Mary Grover, Secretary.

PROPERTY APPRAISER

PETITION 1981-l Pasco Fire Control District

Mr. Ted Schaffer, representing Pasco Fire District, was present to discuss this Petition with the Board. Mr. Ed Havill, Property Appraiser stated the Pasco Fire Control District did not file an exemption on the property. Mr. Havill stated the property did not have a building constructed on the site.

Mr. Sanford Minkoff, County Attorney's Office, stated Pasco Fire Control District is a governmental agency and is a part of County property. He felt the Fire District should be exempted.

On a motion by Commr. Carson, seconded by Mr. Berry and carried unanimously, the Board granted the tax exemption for Pasco Fire District.

PETITION 1981-2 John E. Gardner

Mr. John Gardner was present to discuss this Petition with the Board. Mr. Ed Havill, Property Appraiser, stated his office had the property assessed at $11,500.00. He stated if the land is on total hard pan the assessment could be $l,OOO.OO too high.

Mr. Gardner addressed the Board to state he had approximately four (4) acres of Agriculture. Mr. Havill informed Mr. Gardner there needs to be more than four acres of fruit to be considered a bona fide agriculture enterprise. He stated four acres was not considered economically feasible for a satsuma grove.

PETITION 1981-195 Picciola Volunteer Fire Dept., Inc.

No one present wished to discuss this Petition with the

Board.

On a motion by Mr. Berry, seconded by Commr. Carson and carried unanimously, the Board granted the Tax Exemption for Picciola Volunteer Fire Dept., Inc.

PETITION 1981-2 John E. Gardner

On a motion by Commr. Carson, seconded by Commr. Deems and carried unanimously, the Board approved the assessment of $10,500.00 as recommended by Mr. Havill, Property Appraiser.

On a motion by Mr. Berry, seconded by Commr. Deems and carried, the Board denied the request for agricultural classification. Commr . Burhans voted "NO".

PETITION 1981-197 Little Lake Harris Shores Civic Association, Inc

Mr. H. P. Horgan, past President of Little Lake Harris Shores Civic Association, Inc., was present to discuss the Petition with the Board. He stated the Association is a non- profit organization and is requesting relief for tangible tax.

Mr. Sanford Minkoff, County Attorney's Office, stated as the

Association is not open to the public, the Association should not

be entitled to the exemption.

On a motion by Commr. Carson, seconded by Commr. Deems and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied the request for Ad Valorem Tax Exemption.

PETITION 1981-200 Alfred R. Urciolo

Mr. Urciolo, Clermont, was present to discuss the Petition with the Board.

No action was taken at this time.

PETITION 1981-201 Mildred E. Holmes

Mr. Clarence E. Holmes, representing Mrs. Mildred Holmes, was present to discuss the Petition with the Board. Mr. Holmes presented the Board with a letter which stated Mr. Holmes' reasons why he estimated the value of the property to be $90,000.00.

PETITION 1981 202 Jack Roberts

No one present wished to discuss this Petition with the Board.

Mr. Havill, Property Appraiser, informed the Board he had a note which stated Mr. Roberts had withdrawn his petition. The Board directed Mr. Havill to check to see if the Petition has been corrected and report back to the Board later in the day.

PETITION 1981-218 T. B. Szubski

Mr . T.B. Szubski was present to discuss this Petition with the Board. Mr. Ed Havill, Property Appraiser, informed the Board the final assessment on Mr. Szubski's property was $59,306.00. He stated it was 28.65 acres ($2,O7O.OO per acre) and further stated he would purchase the land today if he could obtain the land for that price. Mr. Szubski stated he would sell Mr. Havill the land for that price. Mr. Havill told Mr. Szubski to make an appointment with his secretary and he would have the necessary contracts drawn up.

PETITION 1981-220 Dorothy Makowski

Mrs. Makowski was present to discuss this Petition with the Board. Mr. Ed Havill, Property Appraiser, informed the Board the final assessment for this property was $8,210.00. Mrs. Makowski stated she felt the property was worth $4,OOO.OO. She stated that the property was next to a fiberglass factory and that there was a terrible odor which came from the factory. The Board instructed the Pollution Control Department to check the situation at the factory (Mike's Spreader Works).

Mrs. Andrews was present to discuss this Petition with the Board. Mr. Williams, Chief Field Appraiser, stated the final assessment on Mrs. Andrews' property was $73,982.00.

On a motion by Commr. Carson, seconded by Mr. Berry and carried unanimously, the Board upheld the Property Appraiser's assessment of $44,357.00.

PETITION 1981-201 Mildred E. Holmes

On a motion by Commr. Carson, seconded by Commr. Deems and carried unanimously, the Board upheld the Property Appraiser's assessment of $99,234.00.

PETITION 1981-203 Bernard F. Wendt

On a motion by Commr. Carson, seconded by Mr. Berry and carried unanimously, the Board upheld the Property Appraiser's assessment of $77,054.00.

PETITION 1981-204 William & Grace Bushelle

On a motion by Commr. Carson, seconded by Mr. Berry and carried unanimously, the Board upheld the Property Appraiser's assessment of $6,728.00.

PETITION 1981-205 Manuelita Segars

On a motion by Commr. Deems, seconded by Mr. Berry and carried unanimously, the Board upheld the Property Appraiser's assessment of $25,875.00.

PETITION 1981-206 James H. Edwards, Jr.

On a motion by Commr. Carson, seconded by Commr. Deems and carried unanimously, the Board upheld the Property Appraiser's assessment of $57,934.00.

PETITION 1981-239 Lake Frances Estates, Inc.

Mr. Key, President of Lake Frances, Estates, Inc., was present to discuss this Petition with the Board. Mr. Harold Williams, Chief Field Appraiser, stated the final assessment on the property was $217,730.00. He further stated the Property Appraiser's Office had reduced the land value by $19,000.00. Mr. Key stated the final assessment on his tax bill was $245,686.00 but he still was not satisfied with the $217,730.00 as quoted by Mr. Williams.

PETITION 1981-240 Lake Frances Estates, Inc,

Mr. Key, President of Lake Frances, Estates, Inc., was present to discuss this Petition with the Board. Mr. Harold Williams, Chief Field Appraiser, stated the final assessment on the property had been $64,315.00, but the Property Appraiser's Office had reduced the assessment to $45,255.00.

On a motion by Commr. Deems, seconded by Commr. Carson and carried unanimously, the Board upheld the Property Appraiser's adjusted assessment of $45,255.00.

On a motion by Commr. Deems, seconded by Mr. Smith and carried unanimously, the Board upheld the Property Appraiser's assessment of $74,552.00.

PETITION 1981-212 Dorothy Calhoun

Mr. Harold Williams, Chief Field Appraiser, informed the Board the final assessment on this property was $11,500.00 but the Property Appraiser's Office was willing to reduce the assessment.to $lO,OOO.OO as the property lacks road access.

On a motion by Commr. Carson, seconded by Commr. Deems and carried, the Board upheld the Property Appraiser's adjusted assessment of $lO,OOO.OO.

Commr. Burhans voted "No".

PETITION 1981-213 George W. Farner, Sr.

On a motion by Commr. Carson, seconded by Commr. Deems and carried unanimously, the Board upheld the Property Appraiser's assessment of $43,217.00.

PETITION 1981-214 John T. & Marjorie M. Rose

On a motion by Commr. Carson, seconded by Mr. Berry and carried unanimously, the Board upheld the Property Appraiser's assessment of $21,429.00 (lot with mobile home) and $6,587.00 (adjoining lot).

PETITION 1981-215 Mark V. Davis

On a motion by Commr. Carson, seconded by Mr. Berry and carried unanimously, the Board upheld the Property Appraiser's adjusted assessment of $94,300.00.

PETITION 1981-97 Jackson T. Morgan

On a motion by Commr. Carson, seconded by Mr. Berry and carried unanimously, the Board upheld the recommendation of the Property Appraiser and denied Homestead Exemption due to the Petitioner not filing before March 1, 1981, (filed March 10, 1981).

PETITION 1981-217 Fred Riemer

On a motion by Mr. Berry, seconded by Mr. Smith and carried unanimously, the Board upheld the Property Appraiser's assessment of $13,612.00.

PETITION 1981-218 T. B. Szubski

On a motion by Commr. Carson, seconded by Mr. Berry and carried unanimously, the Board upheld the Property Appraiser's assessment of $59,306.00.

PETITION 1981-219 John H. Abrahams, Jr.

On a motion by Commr. Carson, seconded by Mr. Berry and carried unanimously, the Board upheld the Property Appraiser's assessment of $5,750.00.

PETITION 1981-173 Donald Tobin

Mrs. Donald Tobin was present to discuss this Petition with the Board. Mrs. Tobin presented Mr. Williams, Chief Field Appraiser, with an unrecorded deed. Mr. Wood, Property Appraiser's Attorney, stated if Mrs. Tobin would give a copy of the deed to the Property Appraiser's Office, then the Property Appraiser would grant Homestead.

On a motion by Commr. Carson, seconded by Mr. Berry and carried unanimously, the Board instructed Mrs. Tobin to go to the Property Appraiser's Office and give them a copy of her deed and recommended she have her deed recorded in the Recording Department of the Clerk's Office.

On a motion by Mr. Smith, seconded by Commr. Deems and carried unanimously, the Board upheld the Property Appraiser's assessment of $8,210.00.

On a motion by Mr. Smith, seconded by Commr. Deems and carried unanimously, the Board upheld the Property Appraiser's assessment of $73,982.00.

Mr. Cooksey was present to discuss this Petition with the Board. Mr. Harold Williams, Chief Field Appraiser, stated Mr. Cooksey had failed to sign the Homestead Exemption card, the card was send back to Mr. Cooksey, but the card was not sent back to the Property Appraiser's Office.

Mr. and Mrs. Parker were present to discuss this Petition with the Board. Mr. Harold Williams, Chief Field Appraiser, stated the assessment on this property was $80,328.00 but he recommended the Board reduce the assessment to $75,073.00.

Mr. Huff was present to discuss this Petition with the Board. Mr. Huff explained to the Board his wife handles the book work and she had had a mental breakdown. Mr. Huff further stated his wife claimed she sent in the form, but the Property Appraiser's Office did not have a record of receiving the card.

PETITION 1981-288 R. William Rae

On a motion by Commr. Carson, seconded by Commr. Deems and carried unanimously, the Board upheld the Property Appraiser's assessment of $98,282.00.

PETITION 1981-289 Vernie W. Parker

Commr. Carson made the motion, which was seconded by Mr. Smith to uphold the Property Appraiser's adjusted assessment of $75,073.00. Commrs. Burhans and Deems voted "No". The motion failed.

On a motion by Commr. Deems, seconded by Mr. Smith and carried unanimously, the Board overturned the Property Appraiser's adjusted assessment of $75,073.00 and approved an assessment of $70,073.00.

PETITION 1981-290 Robert E. Huff
