LAKE COUNTY VALUE ADJUSTMENT BOARD MEETING

NOVEMBER 28, 1995

This meeting is a continuance of the Lake County Value Adjustment Board for 1995. The Board met in regular session on Tuesday, November 28, 1995, at 9:00 a.m., in the Board of County Commissioner's Meeting Room, Lake County Administration Building, Tavares, Florida. Commissioners present at the meeting were: G. Richard Swartz, Jr., Chairman, Value Adjustment Board; Rhonda H. Gerber; and William "Bill" H. Good. School Board members present were: Kyleen Fischer. School Board member Claudia Ramsey was not present, due to another commitment. Others present were Sanford "Sandy" Minkoff, County Attorney; Ed Havill, Property Appraiser; Jordan Stewart, Attorney, representing Property Appraiser's Office; Frank Royce, Chief Deputy, Property Appraiser's Office; and Sandra Carter, Deputy Clerk.

The Chairman opened the meeting and noted that the only cases scheduled for this date were Petition No. 1995-322, Harbor Hills Development, L.P., and 1995-323, Harbor Hills Country Club, L.P.

It was noted that said cases involved value assessments.

No one was present representing said cases.

Ms. Jordan Stewart, Attorney, representing the Property Appraiser's Office, informed the Board that they could make a decision, either way, if sufficient evidence was present on the documents that were submitted by the petitioner, prior to this meeting.

It was noted that the Board did not have any documents from the petitioner to consider, therefore, did not have any findings of fact, or evidence, that would be sufficient to reduce the Property Appraiser's assessment of said properties.

Mr. Ed Havill, Property Appraiser, recommended that the Board uphold his assessments for these cases.

On a motion by Ms. Fischer, seconded by Commr. Gerber and carried unanimously, by a 4-0 vote, the Board upheld the Property Appraiser's assessment of $14,080,542.00 for Petition No. 1995-322 and $8,003,108.00 for Petition No. 1995-323, due to the fact that no one was present to discuss the cases and/or present evidence to reduce the assessments of said properties.

Ms. Ramsey was not present at this meeting.

MISCELLANEOUS

On a motion by Ms. Fischer, seconded by Commr. Good and carried unanimously, by a 4-0 vote, the Board upheld the recommendation of denial, by the Property Appraiser, for the following petitions, due to the fact that no one appeared before the Board to discuss the cases and/or present evidence to overturn the recommendation of denial:

Petition No. 1995-365L Mark and Dana Miller Late Filing

Petition No. 1995-367L Bud K. Neff Late Filing

Petition No. 1995-371L Louise R. Owens Late Filing

Petition No. 1995-372L David H. Halberg Late Filing

Petition No. 1995-373L Janey G. DeBaugh Late Filing

Petition No. 1995-374L Janey G. DeBaugh Late Filing



Ms. Ramsey was not present at this meeting.

Ms. Stewart, Attorney, representing the Property Appraiser's Office, informed the Board that, under this set of circumstances, the Notice of Decisions that are mailed out to each of the petitioners becomes important, because the date on the notices is the date that the petitioner's right to bring an action in Circuit Court begins to run. She stated that the second certification of the roll does not start any time running for them, so, if the notices go out as timely as possible, the Board might want to ascertain that all the decisions this Board made are the final decisions and that the Notice of Decisions that go out be dated this date, or as soon as possible.

It was noted that, if there was any other action that would need to be taken, as a result of the dual certification, it would be done at the time that the Minutes of the meetings are approved.

Ms. Stewart suggested that the Board not adjourn the meeting, but recess it, so that should anything come up during the year, before next year's Value Adjustment Board is formed, this Board could reconvene, if need be.

Mr. Minkoff, County Attorney, concurred.

Commr. Swartz thanked the Property Appraiser, Mr. Havill; his staff; and his legal counsel, Ms. Stewart, stating that they were very helpful through the whole Value Adjustment Board process, noting that he felt this Board had heard some of the most difficult cases to come before a Value Adjustment Board, during the times that he had served on said Board. He thanked the County Attorney, Mr. Minkoff, for his help, and Ms. Fischer and Ms. Ramsey, School Board members, and his fellow Commissioners, Commrs. Gerber and Good, for serving on said Board.

There being no further business to be brought to the attention of the Board, the meeting was recessed at 9:10 a.m., until further notice.
