A SPECIAL MEETING OF THE VALUE ADJUSTMENT BOARD

The Lake County Value Adjustment Board met in special session on Monday, November 29, 2010, at 10:00 a.m., in the Board of County Commissioners’ Meeting Room, Lake County Administration Building, Tavares, Florida.  Present at the meeting were:  Commr. Conner, Chairman, Debbie Stivender representing the Lake County School Board, and Will Walker as a citizen member.  Others present were:  Alison Yurko, Counsel for the Value Adjustment Board; Barbara Lehman, Chief Deputy Clerk, County Finance; Brenda Press and Courtney Thompson, Deputy Clerks.

approval of minutes

The Chairman asked for approval of the Minutes of September 8, 2010, and October 7, 2010.

On a motion by Ms. Stivender, seconded by Mr. Walker and carried unanimously by a vote of 3-0, the VAB approved the Minutes of the meetings held on September 8, 2010, and October 7, 2010.

approval of alternate special magistrate contract

Ms. AlisonYurko, VAB Counsel, stated that it was her recommendation that the Board approve the one-page document authorizing Ms. Joy P. Ewertz to be the alternative Special Magistrate.  She noted that a conflict arose on one of the cases involving Special Magistrate Denise Lyn.  She explained that they made inquiries to Orange County of any VAB Special Magistrates they had used and received several names recommendations.  She remarked that of those recommendations, Ms. Ewertz was highly recommended.  She commented that Ms. Ewertz was formerly of the Winderweedle, Haines, Ward & Woodman, P.A. law firm.  She remarked that the terms of this Contract were the same as the Special Magistrates presently serving Lake County.

Commr. Conner remarked that the County Attorney also concurred with this recommendation.

On a motion by Mr. Walker, seconded by Ms. Stivender and carried unanimously by a vote of 3-0, the VAB approved the Contract of Ms. Joy P. Ewertz as alternative Special Magistrate.

approval of invoices

Ms. Barbara Lehman stated that when the Value Adjustment Board began they stated they would pay the invoices of the Special Magistrates after they had been reviewed for reasonableness, pay same, and then present them to the Board for approval.  She explained that due to the fact the VAB meets sporadically throughout the year this method would provide timely payment of the invoices.  She commented that they are presenting the paid invoices today and recommends approval of same.

On a motion by Ms. Stivender, seconded by Mr. Walker and carried unanimously by a vote of 3-0, the VAB approved the invoices presented by Ms. Lehman.

ADJOURNMENT

There being no further business to be brought to the attention of the VAB, the meeting was adjourned at 10:05 a.m.
