MINUTES OF regular MEETING OF THE BOARD OF COUNTY commissioners
monday, april 2, 1956
The Board of County Commissioners met in regular session in the County Commissioners’ Room in the Courthouse at Tavares on Monday, April 2, with the following present: Chairman Singeltary; Commissioners Cowart, Lightfoot, Simpson, and Stokes; Attorney Duncan; and Clerk Owens.
On a motion by Commr. Stokes, seconded by Commr. Cowart and carried, the minutes of the meeting of March 5 were adopted as read.

On a motion by Commr. Stokes, seconded by Commr. Lightfoot and carried,
DISTRICT 1 – No changes were made in District 1.
DISTRICT 2 – W. D. Webb for $10 per month and George Williams for $15 per month were dropped from the list.
DISTRICT 3 – Mrs. Trusdale for care of Mrs. Essie Randall was increased to $40 per month and Mrs. W. M. Richardson for care of Ethel Lee was increased to $29.50 per month.
DISTRICT 4 – Mrs. Trusdale for care of M. Linton was increased from $20 to $40; Mrs. Trusdale was granted $40 per month for care of Mrs. Hattie Clapp. Mrs. Ray Cooper was granted $60 per month for the care of Mrs. Sallie Vest. Commr.. Simpson stated he has a request from Mr. Emerson for Mrs. Richardson to take Mrs. Emerson back, but she will not take her back for less than $100 per month. Mr. Emerson wants the County to subsidize $20 per month for this. Mr. Simpson stated that Mr. Emerson’s income is sufficient to pay for it, but he does not think the County should pay it.
DISTRICT 5 – No changes were made in District 5.

Notice having been advertised for sale of an old clay pit in Section 10-19-27, District #4, the following bid was received:
John M. Rayburn, Eustis – bid $200
WHEREUPON, on a motion by Commr. Simpson, seconded by Commr. Cowart and carried, the bid of John M. Rayburn to purchase land in Section 10-19-27 as advertised for the sum of $200 was accepted and the Attorney authorized to prepare the deed to John M. Rayburn and Josephine R. Rayburn, his wife, for the Chairman and Clerk to execute for the Board.

Notice having been advertised for bids for the sale of the Dream Boat located at the intersection of Road 19 from Eustis to Mount Dora and from Eustis to Tavares, the following bids was received: Helen E. Spears, P.O. Box 813, Deland, Florida.
“Confirming telephone conversation of Sixty Dollars for the old ship on the right of way. Will move to Lake County location.” Helen E. Spears.
WHEREUPON, on a motion by Commr. Lightfoot, seconded by Commr. Cowart and carried, the bid of Helen E. Spears to purchase the Dream Boat for the sum of $60 and move it to a Lake County location was accepted.
Attorney Duncan was instructed to notify Mrs. Spears her bid is accepted and ask for a cashier’s check in the amount of $60.
Clerk Owens read a letter from Neal D. Huebsch, Attorney for V. C. Gambrell, defendant in the condemnation proceedings, wherein he objected to the sale of the building by the County or the land herein involved. Attorney Duncan advised that the property on which the Dream Boat is situated has already been taken by the County on the basis of the resolution passed by the Road Board and Lake County, and when the County acquired title to the land, the building went with the land. Mr. Huebsch was present at the meeting and stated the declaration of taking was filed in 1953. Mr. Duncan advised that the County has the right to sell the property and the building.
Clerk Owens read a letter from Dr. J. Basil Hall, Director, Lake County Health Unit, stating the State Board of Health advised him to recommend to the Board that all bids received on March 5 on the trade-purchase arrangement for a half cubic yard dragline were to be thrown out; WHEREUPON, on a motion by Commr. Stokes, seconded by Commr. Lightfoot, the Board rejected all bids received March 5 on the trade-purchase arrangement for a half cubic yard dragline.
Sheriff McCall appeared before the Board and advised that a prisoner, Pleasant Leonard Avery, has escaped and been recaptured. The Sheriff requested the Board to grant him permission to take 15 days away from the prisoner for the escape; WHEREUPON, on a motion by Commr. Stokes seconded by Commr. Lightfoot and carried, the Sheriff was granted permission to take away 15 days from the prisoner, Pleasant Leonard Avery.
Clerk Owens advised the Board that H. O. Peters on March 10 presented to him Policy #964-072 on Live Oak Ridge Plat issued by Lawyers Title Insurance Company.
The Certificate of Lake Abstract & Guaranty Company regarding title insurance on Breezee Shores Policy #54234 was filed with the Board.
On a motion by Commr. Cowart, seconded by Commr. Stokes and carried, the Plat of Sittler’s Shores Subdivision was approved.
H. O. Peters appeared before the Board and presented the Plat of Potter’s Subdivision in the Town of Lady Lake, which was approved by the Board on a motion by Commr. Simpson, seconded by Commr. Stokes and carried, subject to the title insurance certificate being presented to the Board.
Attorney Duncan was instructed to talk with Mr. H. L. Pringle regarding the road adjoining Country Club View Subdivision as to whether said road is County maintained before the Plat is approved.
Kennie Pierce, Juvenile Counselor, appeared before the Board regarding a boy at Marianna on whom he wishes to retain jurisdiction after he is released, and if he can bring the boy back when he has to make a trip to Marianna, he would not have to make a special trip for him, but this may not be possible; therefore, Mr. Pierce requested that he be allowed to make a special trip to Marianna for the boy if necessary. Mr. Stokes suggested that Mr. Pierce be allowed to handle this matter in the best possible manner. The Board agreed to this.
On a motion by Commr. Stokes, seconded by Commr. Simpson and carried, the Clerk and Chairman were authorized to execute a deed to Barber and Starr to land purchased by bid at the last meeting and also to execute the deed to Glenn Y. Middleton to land purchased by bid at the last meeting at Bennett Heights.

Clerk Owens filed a Certificate of R. A. Gray, Secretary of State, certifying the persons who qualified as candidates of the Democratic Party and Republican Party in his office.
Clerk Owens filed the Certificate of Frank E. Owens, Clerk, certifying the persons who qualified in his office as candidates of the Democratic Party and Republican Party and stated he certified this list to Mrs. Baker, Supervisor of Registration.
Clerk Owens reported he received from the candidates as qualifying fees the sum of $3,689.26 and deposited same to the General Fund.
Clerk Owens reported to the Board that he and Attorney Duncan had gotten bids for printing the ballots; only two papers submitted bids. Eustis Lake Region News could not bid.
Bids as follows:
Leesburg Daily Commercial $37.80 per thousand on 70 weight paper
Mount Dora Topic $15.25 per thousand on 70 weight paper
$13.75 per thousand on 60 weight paper
Therefore, the Clerk and Attorney awarded the printing of the ballots to the Mount Dora Topic in the amount of $15.25 per thousand on 70 weight paper.
On a motion by Commr. Stokes, seconded by Commr. Lightfoot and carried, the action of the Clerk and Attorney in awarding the bid for printing the ballots to the Mount Dora Topic on March 28, 1956 in the amount of $15.25 per thousand on 70 weight paper was approved.
On a motion by Commr. Simpson, seconded by Commr. Simpson and carried, the Clerk was instructed to publish a copy of the ballot in the Mount Dora Topic at least 20 days before the Primary Election.
Motion by Commr. Lightfoot, seconded by Commr. Simpson and carried that the following named persons be designated as Clerks and Inspectors to serve in the First Primary Election to be held on May 8, 1956 and that the names be published in the Clerk Press:

The request of George L. Singeltary for two metal stop signs with metal stands for Sunnyside Drive, Leesburg, was approved by the Board.
Clerk Owens read a letter from C. E. Duncan enclosing an additional appraisal of the right of way on SR 25-500, Section 1104-2-4; WHEREUPON, on a motion by Commr. Simpson, seconded by Commr. Lightfoot and carried, the additional appraisal of Gibson, Hunt, and Smith was approved.
The executed right of way contract on SR S-565, Section 1160, was filed with the Board.
On a motion by Commr. Stokes, seconded by Commr. Lightfoot and carried, the State Road Department’s proposed typical section on St. Claire Abrams Avenue in Tavares, Job 1159-151-S-452, SR 500 to SR 19, .9 miles, type pavement limerock, budgeted amount $75,000, was approved and the Clerk authorized to sign same and mail to State Road Department.
A certified copy of the resolution passed at a special Tavares Council meeting on March 27, 1956 approving the use by the Florida State Road Department of that part of St. Clair Abrams Avenue lying north of US Highway 441 for the construction and maintenance of an access road to State Road 19 was filed with the Board.
Mr. Owens filed a copy of the final budget of the State Road Department covering the period from January 1, 1956 through June 30, 1956 and adopted January 31, 1956.
Mr. Owens read a letter from the State Road Department regarding Job 1114-105, SR 40 (Marion County line to Astor) in which the right of way map on the job was turned over to Lake Abstract & Guaranty Company on March 19 for a title search to be made.
On a motion by Commr. Stokes, seconded by Commr. Simpson, the following resolution was adopted:
WHEREAS, Lorene Mulloy, Louise O. Mulloy, Frank S. Wright, Isabelle S. Wright, Walter L. Hitt, and Lelah A. Hitt, the owners of the land abutting the following described platted street, have presented to the Board of County Commissioners of Lake County, Florida, a Petition to close a certain platted street in the subdivision bearing the title “Replat of Minnehaha Terrace,” which Plat is filed and recorded in Plat Book 8, Page 93, public records of Lake County, Florida. Said street is more particularly described as follows:
All that portion of an unnamed street lying between Lots 3 and 8 and between Lots 4 and 9, according to the said re-plat of Minnehaha Terrace; and said Petition is in proper form and order, and
WHEREAS, said Petitioners published a Notice of Intention to Vacate said platted Street, proof of which has been filed with the Board of County Commissioners of Lake County, Florida, and
WHEREAS, the said Board of County Commissioners has on the 2nd day of April, 1956, at its regular meeting at 10:00 in the forenoon in the office of said Board in the Courthouse at Tavares, Florida, considered the advisability of renouncing and disclaiming any right of Lake County and the public in and to said platted street and the advisability of vacating, abandoning, discontinuing, and closing the same, and
WHEREAS, the said Board has considered said Petition and no objection having been made to the closing of said street, and it appearing to the Board that the continued dedication of said platted street can serve no useful purpose to the public and the adjoining property owners;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the platted street hereinbefore more particularly described be henceforth closed, abandoned, discontinued, and vacated; and that the Board of County Commissioners, acting for Lake County and the public, does hereby renounce and disclaim any right, title, interest, or easement in and to said platted street and that the title to said platted street be vested in the adjoining property owners as above named, in accordance with law.
Mr. Simpson filed with the Board a check in the amount of $89.80 from Igou & Milton for sale of pipe; ordered deposited into Road & Bridge Fund, credit District 4.
Mr. Owens reported he had received from Clermont Auto Sales, Inc. a check in the amount of $30 for junk trucks which were advertised for sale (no bids received). The check was ordered deposited to the Road & Bridge Fund, District 3.
Mr. Owens reported that Joe Bassett wants to buy the old boat used for spraying hyacinths and has offered $150 for the boat. The Clerk was instructed to find out from Dr. Hall if he needs this boat, and if not, the Clerk was instructed to advertise same for sale.
Mr. Owens reported he had received from Maurice H. Connell & Associates, Inc., Consulting Engineers, forms for advertising for bids for construction of a timber bridge on the Astatula Road over the Apopka-Beauclair Canal in Lake County; WHEREUPON, on a motion by Commr. Stokes, seconded by Commr. Simpson and carried, the Clerk was authorized to advertise in the Clermont Press for bids to construct said bridge. Mr. Stokes suggested that the Board ask for alternate bids with iron I beams.
Mr. Owens read a copy of a letter from Dr. Hall, Director of the Lake County Health Unit, to Mrs. Lillie M. Hill notifying Mrs. Hill if she comes back to Lake County, she will have to be arrested and sent back to the T. B. Hospital, as she left without consent of the doctors.
On a motion by Commr. Stokes, seconded by Commr. Simpson and carried, the action of the Chairman and Clerk in approving the application of John C. Cox and Edward Robinson for admission to the T. B. Hospital was approved.
A letter from the Central Florida T. B. Hospital stating that Mrs. Anna O’Brian of Mascotte was discharged from the Hospital on March 28, 1956, condition pulmonary Tuberculosis, moderately advanced, inactive.
Motion by Commr. Simpson, seconded by Commr. Stokes and carried that the Clerk be instructed to run an advertisement in the Eustis Lake Region News for the purchase of a dragline for District 4.
Clerk Owens read a letter from Lucile C. Tally regarding the Hartford Steam Boiler Inspection & Insurance Company – Policy #194-17489 issued 4-14-56 to 4-14-59, which is a renewal of Policy #94-11619 stating the company has available now a roader form coverage which will enable the Board to fully recover the expense or repair to the property covered; the additional premium cost be would $74.50. WHEREUPON, on a motion by Commr. Stokes, seconded by Commr. Simpson and carried, the Clerk was instructed to notify Mrs. Tally to add this additional coverage at an additional cost of $74.50.
Clerk Owens presented a list of Confederate pensioners of Lake County as follows: Mrs. Lenorah Haire, Umatilla; Mrs. Nonnie Gray, Mascotte; and Mrs. Lydia C. Sligh, Eustis, which was approved by the Board.
The bill of F. A. Nelson for drilling a well on the right of way Road 25-500 in the amount of $563.50 was referred to Attorney Duncan for investigation.
Clerk Owens read a letter from the Department of Veterans Affairs regarding the Fifth Annual Statewide Service Officers’ School and Conference to be held at the Daytona Plaza Hotel, Daytona Beach, on May 1, 2, 3, 4, and 5, 1956; WHEREUPON, on a motion by Commr. Simpson, seconded by Commr. Stokes and carried, Mr. J. C. Hunter, County Service Officer, was authorized to attend the Annual Statewide Service Officers’ School in Daytona Beach, with expenses paid by the Board of County Commissioners.
Clerk Owens read a letter from Mrs. Edith Y. Barrus, District Home Demonstration Agent, regarding the resignation of the Assistant Home Demonstration Agent, Miss Joan Mills, effective May 31, 1956 and plan for a replacement. WHEREUPON, on a motion by Commr. Stokes, seconded by Commr. Simpson and carried, the resignation of Miss Joan Mills, Asst. Home Demonstration Agent, effective May 31, 1956, was approved by the Board, and the Clerk was authorized to confirm the selection of personnel for her replacement.
Clerk Owens presented to the Board recommendations of the Fact Finding Committee signed by Dr. E. E. Lewis on the need of a Home for the Aged of Lake County; WHEREUPON, on a motion by Commr. Simpson, seconded by Commr. Lightfoot and carried, the Clerk was instructed to notify the Fact Finding Committee and Dr. Hall, Director, Lake County Health Unit, that a meeting would be held on Wednesday, April 18, at 2:30 p.m. in the County Commissioners room for discussion of the recommendations.
The request of Karl Lehmann for money available for publicity was approved by the Board on a motion by Commr. Stokes, seconded by Commr. Simpson and carried.
Mr. Owens brought to the attention of the Board the Public Notice regarding the application for the Department of Army permit by Sumter Electric Cooperative, Inc., Sumterville, for a permit to construct an aerial electric power transmission line across Haines Creek. Attorney Duncan reported that this was taken up at the Oklawaha Authority meeting, and they agreed that the height was sufficient for boats to pass under.
Mr. Lane Blanton appeared before the Board regarding getting authority for an easement across the County land along the Dora Canal. Mr. Duncan stated he sees no objection to granting this easement but suggested that Mr. Blanton also present this matter to the Oklawaha Authority by talking to Mr. E. J. Burrell. Mr. Duncan stated that subject to the approval of the Oklawaha Authority, the Board of County Commissioners could grant Mr. Blanton the access to the canal after he talked to Mr. Burrell; WHEREUPON, on a motion by Commr. Stokes, seconded by Commr. Simpson, the following resolution was adopted.
BE IT RESOLVED BY the Board of County Commissioners of Lake County, Florida, that an easement for a drainage ditch is hereby granted to Lane Blanton and his heirs and assigns across property of Lake County and more particularly described as follows:
A strip of land 50 feet wide running in a westerly direction and located in the north half of the south half (N ½ of S ½ ) of Government Lot 1 in Section 30, Township 19 South, Range 26 East and extending from the Dora Canal, also known as “Little Oklawaha,” through property of Lake County located west of the said Dora Canal.
That the said Lane Blanton shall have the right to excavate along said strip of land for drainage purposes, a ditch, the bottom of which shall be at the same level as the lowest bottom of the said Dora Canal. All spoilage from the excavation shall be distributed in such a manner as not to create mounds, and all work shall be completed in a neat manner.
Lake County retains the right concurrently to beautify and keep in a neat and attractive appearance the banks of said ditch.
In excavating for said ditch, the said Lane Blanton and his agents shall not disturb any large cypress trees and shall not disturb any other growth than shall be absolutely necessary in making such excavation.
Any violations of the above provisions shall be grounds for the rescission of the easement hereby granted.
Mr. Jack Morgan, teacher at Tavares High School, and his freshman civics class visited the Board and were addressed by Attorney Duncan and Commr. Simpson.
On a motion by Commr. Stokes, seconded by Commr. Simpson and carried, the following vouchers were approved for payment:
