MINUTES OF regular MEETING OF THE BOARD OF COUNTY commissioners

monday – january 12, 1959

 

The Board of County Commissioners met in regular session in the County Commissioners’ room in the Courthouse at Tavares on Monday January 12, 1959, at ten o’clock A.M. with the following present:  Chairman Simpson; Commissioners Theus, Cowart, Hooten and Cross; Attorney Duncan and Clerk Owens.

The Board was called to order by Chairman Simpson.

D-1      That Nora O. White and David Bass be dropped from the list

D-2      That Fred Cook be reduced from $40.00 to $18.00 and that the Bill for $37.13 for transportation of Luther Ballentine, wife and one child to South Carolina be paid

D-3      That John W. Swaffar, Astatula be granted $20.00 per month

D-4      That John Johnson, 803 Jackson Street, Mt. Dora, be granted $20.00 per month

D-5      That County aid for Mrs. Ray Gatch for Mr. Cone Fleming, 403 N. Center Street, Eustis, be decreased to $10.00 per month.

Commr. Hooten stated the County owns an old scraper that the Town of Astatula would like to purchase, WHEREUPON, on motion of Commr. Cowart seconded by Commr. Theus and carried, the Board was authorized to sell to the Town of Astatula for one dollar an old scraper located in District No. Three.

Dr. Hall appeared before the Board and requested that the Board advertise for Dental Equipment at a cost of about $8,000.00, WHEREUPON, on motion of Commr. Theus seconded by Commr. Cowart and carried, the Clerk was instructed to advertise for Dental Equipment for the Health Department.

Motion by Commr. Theus seconded by Commr. Cross and carried, that all bids on Trailers be held up for Mr. Goodson to inspect the equipment.

Later during the day, Mr. Goodson reported he looked at the Priest trailer and the Florida Equipment Trailer at Plymouth and now recommended that the Board accept the low bid of Joe Priest, Inc. on the second hand trailer, WHEREUPON, on motion of Commr. Hooten seconded by Commr. Cowart and carried, the Board accepted the low bid of Joe Priest, Inc., to furnish Lake County 1-1954 30-T heavy equipped trailer manufactured by Hardee for the sum of $2,000.00 to be paid for County wide.

Motion by Commr. Cross seconded by Commr. Hooten and carried that all of the above bids on Cut-back and semi-solid asphalt materials be accepted, and that the Board purchase from any of the above companies.

There being no bids received pursuant to advertisement on Dump-trucks, Clerk Owens was authorized to re-advertise for bids for the purchase of 2 dump trucks in D-3 and one in D-4.

A member of the Eustis Junior Chamber of Commerce and a member of the Rough Riders Association appeared before the Board re:  Installing a rodeo arena in the Lake County Fairgrounds.    They presented a letter from Senior Chamber of Commerce endorsing this request.  Mr. Hess stated they have plans and specifications drawn for the arena and asked that the County furnish some clay for fill and prison laborers.  After discussion of this matter, the Board agreed to furnish the clay and prisoners to do the work.

Commr. Cross read a letter from the County Attorney of Marion County re:  The proposed joint Lake-Marion County Road.  Said letter stated the County Commissioners of Marion County approved the Resolution re construction of the road adopted by Lake County Bd.  The letter was ordered filed.

Commr. Hooten filed check from the Town of Minneola in the amount of $489.94 for oil on a road.  Ordered deposited to Road & Bridge Fund credit of District Three.

R. G. Cassady, Tax Assessor, appeared before the Board and presented a letter from Chairman of the Board of County Commissioners in Lee County stating this County is doing away with addressograph system and would like to sell the equipment.  Mr. Cassady said he would like to have the cabinets as they are as good as new, and Mrs. Baker thinks she wants one of the cabinets.  There are five cabinets and they cost about $300.00 each new.  If we take all of them, would have to store some of them until needed and would have to go down there to get them.  Mr. Theus said if he can get the right price would be a good deal.  Mr. Cassady stated bids would be received on the cabinets on January 21st.  Whereupon, motion of Commr. Theus seconded by Commr. Hooten and carried, R. G. Cassady Tax Assessor was authorized to make a bid of $101.00 each on the five cabinets and to write the Lee County Board of Commissioners.

Motion by Commr. Theus seconded by Commr. Hooten and carried, that C. E. Duncan, County Attorney, be authorized to join in an appeal in the case of Consolidated Naval Stores Company versus R. G. Cassady, Tax Assessor of Lake County, Florida, et al., and advise the Comptroller of this action.

Mr. French and Mr. Goodson appeared before the Board re:  Zoning.  Mr. Goodson stated we have set up a set of regulations in brief and it has been suggested that we take the regulations to Auburndale and review them with Mr. Bair.  We would like to have the consent of the Board on this.  This Mr. Bair’s fee would be $75.00, plus expenses, WHEREUPON, on motion of Commr. Theus seconded by Commr. Hooten and carried, Mr. Goodson and Mr. French were authorized to contact Mr. Bair and state with the Zoning procedure and present the bill for this service to the Board.

Mr. Goodson stated that one or two of the members of the Zoning Commission went to go to the Zoning Conference Short Course in Tallahassee.  The maximum fee for 2-1/2 days for the course is $15.00 plus 3 days’ hotel bill.  Expense would be approximately $25.00 per day plus $16.00 for the Course.  WHEREUPON, on motion of Commr. Theus seconded by Commr. Cross and carried, that the Board authorized as many as three members of the Zoning Commission, in addition to Mr. Goodson to attend the Short Course on Zoning in Tallahassee on February 18-19-20-1959, at County expense.

Mr. French sated the office for the Zoning Commission needs future.  No action taken on this matter.

C. H. Hopson, Architect, appeared before the Board upon request of the Board re:  Inspection of the Villa Dora Hotel in Mount Dora.  Clerk Owens stated that since Mr. Hopson was asked to come to the meeting, we have received a request to look at the Clermont Hotel on Lake Minneola for a Home for the Aged.  Clerk Owens stated that since Mr. Hopson as asked to come to the meeting, we have received a request to look at the Clermont Hotel on Lake Minneola for a Home for the Aged.  Clerk Owens read a note from “an old lady” objecting to the Villa Dora Hotel being used for a Home for the Aged.

Motion by Commr. Cross seconded by Commr. Hooten, and carried, that Mr. Hopson, with Dr. Hall be authorized to look at the Villa Dora Hotel and the Clermont Hotel to determine the suitability of them being used for a Home for the Aged.

Mr. Duncan presented SRD No. 3 Section 11650-2150 SR S-468 deed from County to State Road Department and State Road Department No. 96, Subordination of Encumbrance to property Rights to State of Florida, together with Resolution on said road, WHEREUPON, on motion of Commr. Theus seconded by Commr. Cross and carried, the following Resolution was adopted:

WHEREAS, The State Road Department has located and proposed to construct and/or improve a portion of State Road S-468, Section 11650; and

WHEREAS, in order for the State Road Department to further and complete said project, it is necessary that certain lands now owned by Lake County to execute and deliver to the State Road Department a deed in favor of the State of Florida conveying all right, title and interest that Lake County has in and to said lands required for said road right of way and said request having been duly considered;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the Chairman and Clerk of said Board be, and they are hereby authorized and directed to make, execute and deliver to the State Road Department a deed in favor of the State of Florida conveying all right, title and interest of Lake County in and to the following described lands in Lake County, Florida, to-wit:

That part of:

The North 330 feet of the East 605 feet of the SW ¼ of SW ¼ of Section 9, Township 19 South, Range 24 East, lying West of and within 33 feet of the survey line of State Road S-468, Section 11650, said survey line being described as follows: 

 

Begin on the South line of Section 9, Township 19 South, Range 24 East, at a point 1334.89 feet East of the Southwest corner of said Section 9, and run thence North 00°39’04” East, 1326.07 feet to the North line of the SW ¼ of SW ¼ of said Section 9, at a point 605 feet East of the Northwest corner of the NW ¼ of SW ¼ of said Section 9.

 

BE IT FURTHER RESOLVED that a certified copy of this Resolution be forwarded forthwith to the State Road Department at Tallahassee, Florida.

Mr. Simpson stated he needs appraisers on the road East of Lake Joanna Road S-44-B Orange Avenue Extension to Mount Dora, WHEREUPON, on motion of Commr. Cross seconded by Commr. Theus and carried, the Board appointed Emery Dillard, Eustis, Robert Eichelberger, Eustis and John Murray, Mount Dora, appraisers to appraise the property to be taken on Road S-44-B, Orange Avenue Extension to Mount Dora.

Fred Owles, Architect, appeared before the Board and stated he is waiting for a go ahead on bids for the Old Folks Home at Astatula.  Mr. Theus suggested that this matter be held up until the Board gets a report from Mr. Hopson on the two hotels.  The Board agreed to this.  Mr. Hopson was requested to have his report in by the first meeting in February.

Clerk Owens read a letter from Mrs. Dorothy Alexander, Juvenile Counselor for girls re some Lake Countians taking care of expense of Nancy Hood.

Mr. Starr and Mr. May appeared before the Board and presented for approval Plat of Lake Shepard Shores, with Policies Nos. FE 3403 and FE 7563 of Lake Abstract & Guaranty Co., with letter from Lake County Health Department.  Mr. Starr stated he is willing to give the County an additional 7 feet for right of way to the present 66 foot right of way if the State Road Department requires same.  Motion by Commr. Hooten seconded by Commr. Cowart and carried that the Plat of Lake Sheppard Shores be approved.

Clerk Owens and Chairman Simpson executed the deed to William Elliott for a clay pit he bought from Lake County near Clermont in October or November.

Clerk Owens filed typical section on Job No. 11590-3601-2-42, SR 19, location Lake Dora Canal Bridge & Approaches, in Tavares, budgeted amount $40,000.00.

Clerk Owens read a letter from R. E. Norris, County Agent, expressing thanks for referring to him letter from Felix Bullard regarding cooperation with Jaycees in selecting the Outstanding Young Farmer of Lake County.

Motion by Commr. Theus seconded by Commr. Hooten and carried that the Clerk be instructed to write a letter to R. E. Norris, County Agent, commending him for the honors he has received.

Motion by Commr. Cross seconded by Commr. Cowart and carried that warrant in the amount of $1200.00 be issued to Florida Georgia-Tractor Company in payment of one month’s rental on the bulldozer as soon as received from the Lake County Health Department one month’s rental.

Clerk Owens reported that he anticipated the Typical Section on Job No. 1100-3501-02, SR 19 from North City Limits of Umatilla to Altoona would be received before the first meeting in February, WHEREUPON, on motion of Commr. Cross seconded by Commr. Cowart and carried, Clerk Owens was authorized to execute said Typical Section if same was received before the first meeting in February and mail same to State Road Department.

A representative of the Houston Texas Gas and Oil Corporation appeared before the Board and Mr. Duncan stated this Company wants to run pipe lines along and across County roads in Lake County.  Our County Engineer has made a study of this and will give a report on same, WHEREUPON, Mr. Goodson, Co. Eng., gave a report on this matter.  He stated the County should be protected everywhere it can be.  Certain things should be set forth in the permit.  The representative stated  “If need additional working space, would get additional rights-of-way from the owners.  Would like to use the County right of way where possible.  If you ever widen the road where our pipeline is, we would move the pipe line at our expense.

Motion by Commr. Cross seconded by Commr. Theus and carried, that warrant be issued to Florida Board of Forestry in the amount of $932.97 for Farm Forestry Project in Lake County 1958-1959.

Motion by Commr. Cowart seconded by Commr. Hooten and carried, that warrant be issued to Florida Board of Forestry in the amount of $12,033.00 for Fire Control Assessment for 1958-1959.

Clerk Owens read a Court Order from Judge Futch re additional fees for attorneys defending Sam Wiley Odom, WHEREUPON, on motion of Commr. Cowart seconded by Commr. Cross and carried, Clerk Owens was authorized to issue warrant in the amount of $100.00 to W. M. Kennedy and W. B. Hunter, attorneys, re appeal in above case.

Motion by Commr. Theus seconded by Commr. Cowart and carried, that warrant in the amount of $77.50 be issued to Motor Vehicle Commission on the Road and Bridge Fund and warrant for $9.00 on General Fund, for x-tags for trucks and trailers.

Motion by Commr. Theus seconded by Commr. Cowart and carried, that warrant in the amount of $200.00 be issued to Lake County Chamber of Commerce for Civil Defense.

Motion by Commr. Theus seconded by Commr. Cowart and carried, that warrant in the amount of $7,000.00 be issued to R. G. Cassady, Tax Assessor, for advance.

Civil Defense data on Fallout Protection was ordered brought back to the first meeting in February.

Letter from U. S. Fidelity & Guaranty Company, Jacksonville, and re:  installing mirrors in two jail cell areas, ordered referred to Sheriff’s Office.

Motion by Commr. Theus seconded by Commr. Cowart and carried, that Clerk Owens be authorized to re-advertise for Dump trucks for Districts 3 and 4, as the other advertisement was cancelled.

Motion by Commr. Cross seconded by Commr. Theus and carried that Clerk Owens be authorized to advertise for sale the following described land (Old Clay Pit):

Lot 1-A Block 20 according to the Plat of Silver Lake Estates, containing 5 acres, more or less.

 

Motion by Commr. Cross seconded by Commr. Theus and carried, that Clerk Owens be authorized to advertise for concrete pipe.

Emery Dillard appeared before the Board re:  Club Casino being allowed to stay open until 2:00 AM on Sundays for the sale of alcoholic beverages, WHEREUPON, on motion of Commr. Cross seconded by Commr. Hooten and carried, the following Resolution was adopted:

BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the sale of alcoholic beverages in Lake County shall, in addition to the statutory hours for the sale of such beverages, be permitted to be sold between the hours of 12:00 o’clock midnight on Saturday till  2:00 o’clock AM on Sundays.
