MINUTES OF THE regular MEETING OF THE BOARD OF COUNTY commissioners ON  monday, september 12, 1960

 

The Board of County Commissioners met in regular session in the County Commissioners’ room in the Courthouse at Tavares on Monday September 12, 1960, at ten o’clock A.M., with the following present:  Commissioners Theus, Cowart, Bishop, Simpson; and Chairman Cross, Attorney Duncan; and Clerk Owens.

The Board was called to order by Chairman Cross.

The minutes of the meetings of July 25, August 1 and 8, 1960, were adopted as read on motion of Commr. Theus seconded by Commr. Simpson and carried.

boat facilities and park at eustis

Don Porter again came before the Board re the Proposed Boat Basin and Park on Lake Shore Drive between Eustis and Tavares.  He said the City of Eustis is interested in the Wayside Park and would like for the County to put in the bridge.  He also stated the State Road Department said this is a secondary road bridge and the cost would be $300.00 per foot and estimated the bridge to be 60 feet long.  Eustis wants to develop this area for boat facilities and park.  Mr. Cross advised Mr. Porter that the State Road Department turned down the maintenance of this road under the secondary road program.

Motion by Commr. Simpson seconded by Commr. Theus and carried, that the County Engineer –C. P. Goodson – be authorized to arrange a meeting with the Board of County Commissioners, the City of Eustis, Mr. Hanna, Mr. Green and Mr. R. C. Bannerman of the State Road Department and the District Road Board Member, to discuss the matter.

Letter from Richey Green, District Engineer of the State Road Department enclosing a copy of the policy adopted by the Road Board on Nov 5, 1959 re:  Wayside Parks and Boat Ramps; also letter from Ernest P. Kidd, Eustis City Manager, stating City of Eustis will construct and maintain adequate toilet facilities within the Proposed Park, but not in a position at this time to offer to participate financially in the development of the Park, read and filed.

lady lake water problem

Mr. Ernest Zabor, Mayor of Lady Lake, again came before the Board complaining of the high water on his property which he stated is caused by improper drainage by the State Road Department.  Mr. Goodson stated that he, Dr. Hall, and Fred Tanner went up there and met with the State Road Department Engineer, and the Road Department still hangs onto the idea of drainage wells.  Commr. Theus thinks the Board should do something to help Mr. Zabor.  Although would not like to see drainage well, but if this is the only solution, think should do it.  Mr. Zabor is not the only one suffering.  It is a health hazard the way it is now.  Mr. Cross asked if there is any action this Board can take.  Mr. Simpson stated could ask the State Road Department to take the water off the road and he also suggested that the Board take this matter under advisement.  Mr. Goodson stated he will get the information.  Mr. Theus suggested that the Board make a special request that the State Road Dept. pump the water off of the Zabor property.  Mr. Cross suggested getting a hydraulic engineer to determine the cost.

Motion by Commr. Theus seconded by Commr. Bishop and carried that the bid of June Auto Service to furnish Lake County 2 1961 GMC trucks, Model V4001 with Marion Band Dump Bodies with 2 1957 GMC trucks trade-ins for the sum of $5,590.00 be accepted.

Karl Lehmann appeared before the Board and reported that a motorcade would form in Groveland and Mascotte at 8:30 on September 15 and people from Clermont would join in at Umatilla to attend the ribbon cutting on the bridge on SR 19 at 11:00 o’clock.  After this the barbecue chicken dinner will be served at Salt Springs.  The motorcade will be escorted by the State Patrol and the Sheriff’s Deputies.

Mr. Lehmann also gave a report of the splendid cooperation of everybody during the Storm Donna, whereupon, on motion of Commr. Simpson seconded by Commr. Cowart and carried, the following Resolution was adopted:

The people of Lake County have recently had a disastrous and harrowing experience caused by the passage of Hurricane “Donna” over the State of Florida and particularly over all of Lake County.

Hurricanes of such magnitude inevitably leave destruction, and even death, in their wakes and Donna was no exception.

However, lives and much property are saved by being properly forewarned of the course of hurricanes and by proper preparation and instruction before and during the passage of hurricanes.

The people of Lake County have much to be thankful for.  Our Civil Defense Forces and Red Cross Forces were prepared.  The Lake Amateur Radio Association, the Sheriff and his forces; the County Engineer and his forces; the County Road and Bridge maintenance crews rendered invaluable aid through their untiring efforts, shelters and provisions for immediate needs, were provided for those who did not have substantial shelter and who were fearful of the effects of Hurricanes.  Outstanding services to the people of Lake County were rendered by our Radio Stations and particularly WLBE, which remained on the air throughout the entire course of the hurricane. In the day preceding the arrival of the hurricane, bulletins and instructions were constantly given the people, and through the night when the terrific rains and winds of the hurricane were breaking down limbs and trees, and casting them over telephone and power lines and dwellings, with the resulting danger and destruction to lives and property, the cheerful and informative voice of the Announcer could be heard giving us last minute bulletins, and keeping us advised of the danger near us and generally relieving and easing the minds of us who waited.

For their unselfish and humanitarian services to the people of Lake County, those who participated in the preparation of shelters and furnishing of supplies to those in need; the telephone and power lineman who worked tirelessly through the hurricane, keeping us in contact with each other and supplying us with light and power at the actual risk of their lives; the County Engineer the Road and Bridge Maintenance Crews and the radio station technicians and announcers who kept us constantly and cheerfully informed, the people of Lake County are ever grateful and wish to express their great appreciation for such services under such trying conditions.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that, speaking for the people of Lake County, this Board expresses to all who furnished services and materials during the fearful and disastrous hurricane, the deep gratitude and thanks of the people of Lake County, and recognizing that previous knowledge of disasters prevents loss of life and more serious destruction of property and resulting in the relieving of tension and relieving the minds of unknown fear that results from lack of knowledge.

BE IT FURTHER RESOLVED that a copy of this Resolution be furnished to each of the Newspapers of Lake County.

 

Mr. Owens reported that Mount Plymouth wants to buy surplus equipment for Civil Defense.

Mr. Simpson reported that W. T. Bland needed some culvert pipe and he had sufficient second hand pipe on the yard that would serve the purpose and asked for authority to let Mr. Bland have the pipe.

Motion by Commr. Simpson seconded by Commr. Cowart and carried, that Commr. Simpson be authorized to sell Mr. Bland the second hand pipe he needs.

discussion on requesting state road department to complete the repairing and resurfacing of road 19 north of the bridge over the OKLAWAHA river to connect with u.s. highway 17

 

Motion by Commr. Simpson seconded by Commr. Bishop and carried, that that the following Resolution be adopted:

WHEREAS, the State Road Department has completed the construction of a bridge across the Oklawaha River connecting Putnam and Marion Counties, creating a new link between Palatka and Lake County and Central Florida, which will result in increased travel through Central Florida and will greatly increase the values of properties in the vicinity of State Road 19.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the State Road Department of the State of Florida be commended for its foresight in the construction of the bridge over the Oklawaha River and in constructing the connecting road links with said bridge, and that the said Road Department be urged to complete the repairing and resurfacing of the road North of said bridge to connect with U.S. Highway 17.

BE IT FURTHER RESOLVED by the Board of County Commissioners that the State Road Department be urged to consider at an early date the extension of State Road 19 South of Groveland in Lake County and continuing in a Southerly direction to connect with U.S. 301 in the proximity of --- Zephyrhills, the construction of which would shorten the distance to Tampa and open and improve a large area in Central Florida.

Judge Hall came before the Board and stated the carpenters have fixed the shelves in the library and also said someone told him if the shelves were painted instead of being varnished a poison to repel roaches and silver bugs could be mixed in the paint.  He asked who should do the painting.  Mr. Cross said this is a minor item and Judge Hall and Mr. Goodson could work this out.

Resume of work completed by Hunnicut & Associates, Inc. to August 8, 1960, in connection with the Lake County Revaluation Program was filed with the Board.

Motion by Commr. Theus seconded by Commr. Bishop and carried, that the bill of Hunnicutt and Associates in the amount of $18,284.60 for work completed June 27 thru July 30, 1960 be approved for payment.

bond issue

Bond Issue ($1,250,000.00) for repairs to courthouse and construction of jail.  Mr. W. J. Meredith of W. J. Meredith & Company, Orlando, and Mr. B. J. Van Ingen of the B. J. Van Ingen & Company, Inc., Miami, appeared before the Board in response to invitation to submit proposal on bond issue.  Clerk Owens read a letter from Leedy, Wheeler & Alleman, Bond Company, Orlando, stating they would present a proposal next week.  Also letter from Barcus, Kindred & Company of Miami re bonds.

Motion by Commr. Theus seconded by Commr. Bishop and carried, that Clerk Owens be authorized to notify the bonding companies that the Board will receive proposals on Tuesday, September 20, at 9:00 o’clock A.M.

MEETING ADJOURNED FOR LUNCH – RECONVENED AT 1:30 P.M.

Rev. Ralph W. Hatch, pastor of the Church of God at Haines Creek, appeared before the Board and stated that he understands that the building across the street from the church is to be sold and the purchasers expect to have beer for sale there.  Mr. Duncan said that no establishment shall sell alcoholic beverages, such as whiskey, within 2500 feet of a church outside of a municipality, and within the city limits the distance is 500 feet.  Mr. Hatch asked if the County Commissioners could not protect the churches in some way.  Mr. Duncan said he would search the law on this.

A letter from Pine Meadows Golf Estates, Inc., requesting the same privilege to dispense alcoholic beverages on Sunday as seems to be allowed Silver Lake Golf Club and Mt. Plymouth Country Club.  Sheriff McCall was called into the meeting and the Board requested him to notify Silver Lake Golf Club and Mt. Plymouth Country Club to discontinue selling alcoholic beverages on Sunday.  Mr. Owens and Mr. Duncan were instructed to answer the letter from Pine Meadows Golf Estates, Inc.

closing of platted alley in city of tavares

Motion by Commr. Bishop seconded by Commr. Cowart and carried, that the Resolution of the City of Tavares to close a platted alley in the City of Tavares and within Block 5, and more particularly described as follows:  “That certain alley commencing at the North boundary of Ruby Street, according to the Plat of the City of Tavares, at the approximate center of the South line of said Block 5 and extending North to the South boundary of Lot G in said Block 5.”

Motion by Commr. Simpson seconded by Commr. Cowart and carried, that the List of All Errors, Double Assessments, Discounts and Insolvencies on the Tax Roll for the year 1959 as submitted by Hon. Paul H. Reed, Tax Collector, be approved.

Request of Marion B. Valentine, Home Demo Agent, for a 16 mm sound projector with prices for same was presented to the Board.

Motion by Commr. Theus seconded by Commr. Simpson and carried, that Mrs. Valentine be authorized to purchase the RCA Sound Projector for the price of $436.00, if there is sufficient money in her budget to pay for same.

Clerk Owens read a letter from Sue B. Young, Secy. Home Demo. Agents’ Assn. of Florida stating that Marian Valentine, Home Demo Agent of Lake County, has been chosen to represent the Florida Home Demonstration Agents’ Association at the National Convention to be held in Chicago early in November and asking that the County make it possible for the trip by helping Mrs. Valentine arrange for the time and finances for the trip.  Clerk Owens was instructed to request Mrs. Valentine to advise the Board approximately what the amount of the trip will be.

Letter requesting confirmation of date of completion of the pipeline so that this bond may be cancelled was read.  Mr. Duncan was instructed to answer that the “final completion was approximately July 1, 1960.”

DISCUSSION ON PEOPLE SWIMMING IN THE DORA CANAL

Mr. Duncan stated under a police power, the Board has authority to stop swimming in the entire length of the Dora Canal, Whereupon, on motion of Commr. Simpson seconded by Commr. Theus and carried, the following Resolution was adopted:

WHEREAS, it has been brought to the attention of the Board of County Commissioners of Lake County, Florida, that, because of the hazard of boats passing through the Doral Canal, swimming therein has become dangerous; that the swimmers are subject to being seriously injured or to actual loss of life;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that under authority of Section 125.46 of Florida Statutes, 1959, from and after the adoption of this Resolution it shall be unlawful for persons to swim in the Dora Canal at any point between the mouth of the Dora Canal in Lake Dora and the outlet of the Dora Canal in Lake Eustis.

Mr. Goodson was instructed to put up signs in the Doral Canal – “No Swimming allowed.”

Clerk Owens read a letter from SW Florida T. B. Hospital stating “Levi Chavis a County charge from your County left this institution on 8-14-60 of his own accord and against the advice of his physician.”  Whereupon, on motion of Commr. Simpson seconded by Commr. Theus and carried, the Board ordered that Levi Chavis be located and returned to the Hospital.

East Lake Company’s bill in amount of $7,826.25 for work completed on Emeralda Road from SR 452 to a point 2 miles westerly was authorized paid on motion of Commr. Theus, seconded by Commr. Bishop and carried.

Bill of R. G. Cassady, Tax Assessor, was authorized paid on motion of Commr. Theus seconded by Commr. Simpson and carried.  Said Bill being as follows:

wawrzycki house

Mr. Duncan stated he has discussed the moving of the Wawrzycki house with the State Road Department, but they want too much money to move it.  Mr. Goodson was instructed to contact a Mr. Smith in Haines City and see if he is interested in moving the house and the price for same.

PLAT OF GREENWOOD CEMETERY

Plat of Greenwood Cemetery was presented by Neal Huebsch, who stated the purpose of this Plat is to redesign the lots in this cemetery.  The Plat consists of 7 sheets.  Mr. Duncan said the low part only affects the part outside of the City of Eustis.  Motion by Commr. Simpson seconded by Commr. Theus and carried, that the Plat of Greenwood Cemetery consisting of 7 sheets be approved.

Plat of Howey in the Hills – partial replat of Palm Gardens was presented by Mr. Duncan.  Motion by Commr. Cowart seconded by Commr. Bishop and carried, that the Plat of Howey in the Hills – Partial Replat of Palm Gardens be approved.

Letter from City of Tavares requesting that the County Commissioners complete the restrooms that were built some time ago in the County Park on Dora Canal, by having the septic tank installed and connected to the toilets in the restrooms was read and Mr. Goodson was instructed to finish this work.  This to be charged to Park Board.

agricultural center

Robert Ford, Architect, appeared before the Board and discussed the proposals on the Lake County Agricultural Center and asked whether to restrict the construction to Lake County Contractors.  Mr. Duncan stated cannot do this.  Mr. Ford estimated the cost at $80,000.00.  It was agreed that the bids should be taken on October 17th.  Discussion on advertising for bids for the well and pump; also paving access road to the building and parking area.

Motion by Commr. Theus seconded by Commr. Simpson and carried, that Clerk Owens be authorized to advertise in all of the County papers three (3) issues weekly for bids for the construction of the Agricultural Center to be taken on October 17th; and advertise in the Eustis Lake Region News two (2) weekly issues for drilling one six-inch water well on the site of the proposed Agricultural Center near Tavares, Florida, to be taken on October 3, 1960.

Mr. Ford filed report of Wolpert, Tilden, Denson & Associates, Consulting Engineers, regarding soil and subsoil exploration and report covering proposed site of new Lake County Jail to be located at SE corner of existing Lake County Courthouse.

Bill of John H. Bledsoe in the amount of $1850.00 for demolition of houses on SR 500, with letter from H. L. Edwards re this matter were read by Mr. Duncan.  Motion by Commr. Bishop seconded by Commr. Simpson and carried, that the bill as above stated be approved for payment by the State Road Department.

Mr. Duncan read a letter from the State Road Department stating this bridge has been turned back to the City of Howey.  Mr. Duncan was instructed to reply to the letter.

Letter from J. Kenneth Ballinger offering to provide Lake County with a quick service of complete summaries of some 60 population acts now affecting Lake County by the 1950 census and more than 80 population acts into which Lake County will grow by its 1960 population.  Some of these affect salaries, courts, taxes.  Whereupon, on motion of Commr. Simpson seconded by Commr. Theus and carried, Mr. C. E. Duncan, County Attorney, was authorized to negotiate with Mr. Ballinger re the above matter.

Motion by Commr. Theus seconded by Commr. Cowart and carried, that Clerk Owens be authorized to accept the quotation of Bowen Supply Company for One #18 Record of Land Sold for Taxes for $124.50, with index tab sheets at $2.25 each.

Motion by Commr. Bishop seconded by Commr. Theus and carried that the bill of the City of Leesburg in the amount of $15.88 for electricity used during the construction of the Home for the Aged be approved and paid out of construction fund – Home for the Aged.

Dockets re various hearings were referred to Mr. Duncan and he is to inform any member of the Board if they should attend a hearing.

Motion by Commr. Theus seconded by Commr. Simpson and carried, that the Clerk, Chairman and Attorney for the Board be authorized to have the ballots for the General Election to be held on November 8, 1960 prepared and printed.

Motion by Commr. Cowart seconded by Commr. Bishop and carried, that the Certificates of Correction of Errors on the 1959 Lake County Tax Roll, numbered 245 through 272, (this is final on the 1959 Tax Roll) be approved as submitted by R. G. Cassady, Tax Assessor.

Motion by Commr. Cowart seconded by Commr. Bishop and carried, that the following numbered Vouchers be approved for payment:

Motion by Commr. Simpson seconded by Commr. Cowart and carried that the motion duly made, seconded and carried at the meeting of September 6, 1960, as follows:  “That the Clerk be authorized to have stop payment placed on Fine & Forfeiture warrant #635 dated September 14, 1969 in amount of $16.10 to Harry E. Barcus for juror County Judge’s Court” be rescinded, as the warrant has been located by Mr. Barcus and he has been notified to present same to the Bank for payment.

Mr. Goodson, Zoning Director, presented to the Board applications requesting changes in Zoning Regulations for certain property; WHEREUPON, the following Resolutions were adopted on motion made by Commr. Simpson seconded by Commr. Theus and unanimously carried.

WHEREAS, the Lake County Zoning Commission did, on the 19th day of July 1950, after due notice of hearing called for that purpose, review applications for changes and revisions of the zoning of certain areas in Lake County, and did approve such changes as requested in the particular applications hereinafter set forth; and the Board of County Commissioners of Lake County having reviewed said applications and the recommendations of the Lake County Zoning Commission;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the Zoning Rules and Regulations of Lake County be altered and amended as they pertain to the following tracts of land to the classification following each description.

1.     That part of the Southwest Quarter of Southwest Quarter of Section 33, Township 18 South, Range 24 East, bounded and described as follows:  Begin at a point on the South line of said Section 33, 426.8 feet West of the Southeast corner of said Southwest Quarter of Southwest Quarter, thence run North 1320 feet to the North line of Southwest Quarter of Southwest Quarter; thence West to the Northwest corner of said Southwest Quarter of Southwest Quarter, thence South 664 feet, thence East 554.5 feet, thence South 10°30’ West 666.8 feet to the South line of said Section 33, thence East along the South line of said Section to the point of beginning, now zoned and classified as “A” (Agricultural) be reclassified, amended, changed and rezoned to Classification R-1-A (Residential).

2.     The Northwest Quarter of the Southwest Quarter of Section 33, Township 18 South, Range 24 East, less the East 396 feet thereof.  The Southeast Quarter of Section 32, Township 18 South, Range 24 East, less the South Half of the Southeast Quarter of the Southeast Quarter, and also less that part of the West 600 feet of the North ¾ of the Southeast Quarter lying South of the County Road (located Northwest of Fruitland Park on Spring Lake), now zoned and classified as “A” (Agricultural), be reclassified, amended, changed and rezoned to Classification R-1-A (Residential).

RESOLUTION NO. 2:

WHEREAS, the Lake County Zoning Commission did, on the 25th day of July 1960, after due notice of hearing called for that purpose, review applications for changes and revisions of the zoning of certain areas in Lake County, and did approve such changes as requested in the particular applications hereinafter set forth; and the Board of County Commissioners of Lake County having reviewed said applications and the recommendation of the Lake County Zoning commission;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the Zoning Rules and Regulations of Lake County be altered and amended as they pertain to the following tracts of land to the classification following each description:

1.     That part of Govt. Lot 6, in Section 26, Township 19 South, Range 26 East, in Lake County, Florida, bounded and described as follows:  Begin at the most Southerly corner of said Govt. Lot 6, thence run in a Northerly direction along the Easterly line of said Govt. Lot 6, a distance of 65 feet; thence run in a Westerly direction and parallel with the Southwesterly line of Govt. Lot 3 in said Sec. 26 if extended Westerly, to the waters of Lake Saunders.  Begin again at the point of beginning and run thence in a Northerly direction along the waters of Lake Saunders to interesect the line last described above.  ALSO:

Lot 2, run North 89°58’30” West along the South line of said Govt. Lot 2 a distance of 1261.29 feet for a point of beginning.  From said point of beginning run North 0°19’ West 339.72 feet; thence run North 89° 58’30” West and parallel with the South line of said Govt. Lot 2 to a point of intersection with the Easterly line of Govt. Lot 6 in said Section 26, the said point being hereby designated as Point “A;” begin again at the point of beginning and run thence South 0°19’ East 910.28 feet to a point on the Southwesterly line of said Govt. Lot 3; thence run North 59°53’ West along the Southwesterly line of said Govt. Lot 3 a distance of 884.33 feet to a point of intersection with the Easterly line of said Govt. Lot 6; thence run North 39°53’30” East along the Easterly line of said Govt. Lot 6 to the designated Point “A” above mentioned.  LESS right of way for public road.

Now zoned and classified as R-1 (Residential), be reclassified, amended, changed and rezoned to classification C-1 (Commercial).

RESOLUTION NO. 3

WHEREAS, the Lake County Zoning Commission did, on the 4th day of August, A.D. 1960, after due notice of hearing called for that purpose review applications for changes and revisions of the zoning of certain areas of Lake County and did approve such changes as requested in the particular application hereinafter set forth; and the Board of County Commissioners of Lake County having reviewed said application and recommendation of Lake County Zoning Commission;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the Zoning Rules and Regulations of Lake County be altered and amended as they pertain to the following tracts of land to the classification following the description thereof:

1.     Southeast Quarter of Northwest Quarter; East Half of Southwest Quarter of Northeast Quarter of Section 9, Township 18 South, Range 24 East, now zoned and classified as R-1-A (Residential), be reclassified, amended, changed and rezoned to classification R-1 (Residential).
