MINUTES OF SPECIAL MEETING OF BOARD OF COUNTY COMMISSIONERS

on monday – august 21, 1961

The Board of County Commissioners met in special session in the County Commissioners’ room in the Courthouse at Tavares on Monday, August 21, 1961 at 9:30 o’clock a.m. for the purpose of considering the proposition concerning the maintenance of streets in qualified subdivisions and such other matters as may be brought before the Board, with the following present:  Chairman Theus, Commissioners Cowart, Dykes, Simpson and Babb, also Attorney Duncan; and Clerk Owens.  Also present was a delegation of 13 persons, owners of subdivisions or representatives of owners.

The Board was called to order by Chairman Theus who announced that this special meeting was called to consider the proposition that was presented to us at the last meeting concerning the maintenance of streets in qualified subdivisions in order that they might be approved by F.H.A. as they require our approval before they will approve.  We asked our attorney, Mr. C. E. Duncan, to make a study as to what we might do for anyone who has a subdivision at present and anyone who might have them in the future.  We want to do the right thing.  It is our intention this morning to come to some satisfactory arrangement whereby it will be acceptable to all parties concerned.  I would like for our attorney, if he has any facts to bring to our attention, to do so now.

Mr. Duncan stated that he contacted Orange County, and was informed that they adopted a special Act in the Legislature to make special assessment against certain property where streets are to be paved or maintained later on.  He also stated that he contacted two of the Legislators, was unable to contact Mr. Reedy and they agreed that they will, in their respective Houses, introduce and get through a certain Bill for Lake County at the next Session.  Mr. Theus suggested they should have a firm letter from the three Legislators that they will do this.  Mr. Duncan stated “See no reason why we cannot go ahead now and accept streets in certain subdivisions.”  Mr. Duncan read a maintenance surety bond of Marvin Boykin Construction Company obligating them up to $4,000.00 to maintain streets for one year, in Spring Lake Manor, with renewal clause.  Mr. Duncan also stated that Orange County adopted on September 23, 1952, a Resolution re streets.  He was directed to get a copy of this Resolution.  Mr. Theus stated that F.H.A. will not accept streets until curb and gutters are installed.  Mr. Duncan stated he will go to Orlando this afternoon and get further information and Mr. Sawyer said he would go to Volusia County and find out what they do in regard to maintenance of streets in subdivisions.

Mr. Dykes reported that he has had quite a number of complaints about excessive speed in the canals in North Lakewood Park.

Motion by Commr. Dykes seconded by Commr. Simpson and carried, the following Resolution was adopted:

WHEREAS, it has been brought to the attention of the Board of County Commissioners that the waterways and canals opened up within Lakewood Park Addition in the City of Tavares, Florida, which are connected directly with Lake Eustis, are located in a strictly residential section and excessive speed from motor boats within the said canals and waterways are dangerous to other boat traffic therein and also is destructive in that waves created from speeding boats wash down the banks of said waterways;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County Florida, that under authority of Section 125.46, Laws of Florida 1959, the Commissioners do hereby fix as a maximum speed, and it shall be unlawful for any person to exceed the maximum speed, of five miles per hour on any of the waterways and canals located within Lakewood Park Addition in the City of Tavares, Florida.

BE IT FURTHER RESOLVED that anyone violating the provisions of this Resolution shall be guilty of a misdemeanor and shall be punished in accordance with the Laws of Florida for the commission of a misdemeanor.

Mr. Larabee was present at this meeting and said signs should be placed in Haines Creek to limit the speed of boats.  Motion by Commr. Simpson seconded by Commr. Dykes and carried, that the Clerk be instructed to refer this request to Oklawaha Basin Authority.

Mr. Tori appeared before the Board and presented this Plat with letter from Lake County Health Department and letter from Henry K. Martin, Engineer, re septic tanks.  Also letter from Lake County Health Department and letter from Henry K. Martin, Engineer, re septic tanks.  Also letter from C. P. Goodson, County Engineer, stating the subdivision complies with all requirements of the Lake County Plat Law and that the Subdivision is outside the jurisdiction of the Lake County Zoning Department.  Mr. Tori stated that Lots 35 to 67 are not included in this Plat.  Mr. Duncan stated that Unit No. One did have an access road.  This Subdivision meets requirements so far as road is concerned.  Fern Hill Drive continues from No. One to No. Two Subdivision.  Mr. Tori pretend opinion of title issued by Lawyers Title & Guaranty Fund written by Levy & Levy, attorneys of Palm Beach, showing that R. F. Land and Guaranty Corp. are the owners of the property described in the opinion, subject to a mortgage to Royal Park Estates, Inc. in amount of $95,600.00.  Release of streets to be recorded today.  Mr. Duncan stated, therefore, the streets are cleared from the mortgage.  A letter from Burton Harrison, Attorney of Miami, refers to Title Policy OG 119637.  Mr. Duncan stated therefore it now appears that this Plat is acceptable for record, WHEREUPON, on motion of Commr. Babb seconded by Commr. Dykes and carried, the Plat of River Forest Unit No. Two was accepted and approved.

Clerk Owens read a letter from Sheriff McCall in part as follows:

“August 16, 1961 – I have, this date, removed the gate from the entrance of the Saw Grass Road leading from Cassia to Paisley, as per your request.  Someone has plowed a fire line around the north side of this pasture and plowed the road up to where an ordinary car would get stuck. If you request it, we will try to find the parties responsible for this and have them smooth it over.”

It was reported that signs have been placed along the Saw Grass road indicating it is a private road.  Motion by Commr. Babb seconded by Commr. Cowart and carried, that Clerk Owens be instructed to notify Sheriff McCall to find the people who plowed up the road and have them smooth it over and that he remove the signs indicating it is a private road.

Commr. Babb filed check in amount of $100.00 from Reed Hollinger for road material.

Letter from Mrs. L. Peterson, Star Route, Eustis re:  Bad condition of the road into her place; also letter from Mrs. Fred A. Vincenti requesting repairs to road, where referred to Mr. Simpson.

Letter from Walter J. Watson, Sr., 208 E. North Street, Tampa, requesting Commissioner to clay road to their properties either from Highway 27 or Road from 545 referred to Mr. Dykes.

A meeting was set up tentatively for Friday a.m. at 9:30, but if for any reason cannot meet then, the delegation will be notified.
