MINUTES OF regular MEETING OF BOARD OF COUNTY COMMISSIONERS

 monday – november 13, 1961

The Board of County Commissioners met in regular session in the County Commissioners room in the Courthouse at Tavares on Monday, November 13, 1961 at ten o’clock a.m., with the following present:  Chairman Theus; Commissioners Cowart, Babb, Dykes, and Simpson; Attorney Duncan; and Clerk Owens.  Senator Boyd was a visitor.

The meeting was called to order with prayer by Chairman Theus.

On a motion by Commr. Simpson, seconded by Commr. Cowart and carried:

D-1 - Mrs. Cora White for $10 was canceled

D-2, D-3, and D-4 – No changes were made in these three Districts.

D-5 – Mrs. Shirley Deal, Umatilla, for $25 was canceled; Lake Memorial Nursing home was paid $70 for the care of Ted Parker; and Flora Patrick, Umatilla, was allowed $$25 per month, P.O. Box 574.

On a motion by Commr. Dykes, seconded by Commr. Babb and carried, the bill of Howard E. Kurfiss Funeral Home in the amount of $150 for the funeral account of Mrs. Nellie Patterson was approved.

On a motion by Commr. Dykes, seconded by Commr. Cowart and carried, the bill of Hewitt’s Drug Company for Mrs. Mae Green, welfare patient, in the amount of $56.25 for medicine was approved.

A letter from Gov. Bryant to C. E. Duncan dated October 24, 1961 stated this date the following have been appointed to membership on the Lake County Jury Commission was read:  Norris L. Hutchinson, Clermont; L. L. Polk, Eustis; Harold McCowan, Umatilla; Leslie D. Burdine, Leesburg; and Lacey Thomas, Groveland.  Clerk Owens was instructed to ask that the name McCowan be on the commission as Harold McCown, which is the correct spelling.

County Forester C. W. Chellman and C. W. Moody, Assistant District Forester, appeared before the Board regarding their annual report which was filed last Monday, and they discussed the report.

The Board adjourned for lunch at 12:30 p.m. and reconvened at 2:00 p.m.

sale of abandoned clay pit east of altoona

Commr. Babb said this clay pit is non-essential to Lake County, and a party has spoken to him about buying it; WHEREUPON, on a motion by Commr. Babb, seconded by Commr. Simpson and carried, Attorney Duncan was authorized to advertise for sale the abandoned clay pit near Altoona belonging to Lake County.  Commr. Babb is to furnish him the description.  SEE BOTTOM OF PAGE 520 for resolution declaring the land non-essential, as follows:

On a motion by Commr. Babb, seconded by Commr. Dykes and carried, the following resolution was adopted:

WHEREAS, it has been brought to the attention of the Board of County Commissioners that Lake County owns the following described tract of land in Lake County, Florida:

From the Northeast corner of the SE ¼ of SE ¼ of Sec. 6, Tp. 18, S. R. 27 E, angle South 88̊ 30’ West 747 feet, thence South 1̊  15’ East 16 feet to a point in fence line, being point of beginning, thence South 1̊ 15’ East 300 feet to a point, thence South 88̊ 30’ West 400 feet to a point, thence North 1̊ 15’ West 300 feet to a point in fence line, thence North 88̊ 30’ East 400 feet to place of beginning; and

WHEREAS, it appears that said tract of land was used for excavating clay and that this clay has been removed from said tract; that said tract of land has no further useful purpose for Lake County, and

WHEREAS, the adjoining property owner has requested the purchase of said property in such manner as is provided by the laws of Florida.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the above-described tract of land be designated as not essential to Lake County and that the same be advertised for sale by sealed bids to be received in such manner as shall be designated by such notice.

easement over property in astor

It was brought to the attention of the Board that the Florida Game & Fresh Water Fish Commission wants to acquire an easement about 400 feet long on some property in Astor for boat ramps; WHEREUPON, on a motion by Commr. Babb, seconded by Commr. Dykes and carried, Attorney Duncan was authorized to prepare the easement. (Copy to be sent to the Commission.)

Hugh Hanna of the State Road Department and C. W. Moody of the Florida Forest Service appeared before the Board and discussed the possibility of the County obtaining matching funds that are available for Forest Highways.  Have about $600,000 in the fund.  Mr. Moody stated if they do not get bids on these roads, we would like for the Board of County Commissioners to take advantage of this on other roads.  After June 30, 1962, part of this money will be lost as far as the County is concerned.  Commr. Babb stated he would like to use some of the “matching funds” on a road south of Astor into Alexander Springs.  Start at Spring Creek bridge, run east a few miles, then north to Astor – thinks would cost about 120 to 125 thousand dollars.  No action was taken on this.

Mr. Hanna inquired as to the height of the bridge that is to be constructed on Eustis Lake Shore Drive.  He was advised that the height is 12 feet with a minimum 25 feet horizontal clearance.

James Brazell of Eustis Club Casino again appeared before the Board regarding the time of closing the Club.  He requested that the Board allow the Club to stay open until one o’clock a.m. on weekdays.  After discussion on this matter, Commr. Cowart moved that the time be left as is and that the request for extension of time be denied.  The motion was seconded by Commr. Dykes and unanimously carried.

lake memorial nursing home – leesburg

At the request of the Board of County Commissioners, Mrs. Martha Schaller (Root) appeared before the Board regarding her contract for managing the Home.  Commr. Theus stated the time for the expiration of your contract is about here, and we thought at this meeting we would first discuss with you your problems.  Mrs. Schaller stated that most of the patients are better than when she took over, and most of them can now come into the dining room to eat.  She extended an invitation to the Board to visit the Home at any time.  She would like an expression from the Board as to what is your idea on this Home.  Commr. Theus inquired about the economical part of the operation.  Mrs. Schaller stated the receipts for the 5 ½ months through the first of November have been $20,399.51.  Expenditures:  payroll $15,270, not counting herself.  She stated she owes some food bills now.  Also took out liability insurance that cost $184.  We have 18 County patients and 10 private ones.  Mrs. Schaller stated she does not feel like she wants to put any more money into it.  If you have anyone who can do any better, that will be alright. Commr. Theus called on Dr. Hall for his opinion, but he had no comment.  Mrs. Schaller said she has lost money during the six-month period.  Commr. Theus stated looks like the Board will have to devise some other arrangement to operate the Home.  Discussion on time of payment for patients.  Mrs. Schaller said the bills paid on the second Monday of the month would be for the previous month.  Mrs. Schaller thought that the 28 patients were not enough to carry the Home, as the same help could take care of more patients.  Commr. Theus thanked her for coming over and said the Board will advise its decision.  Commr. Theus thinks they can get this worked out by Thursday morning, at which time they will call a meeting for nine o’clock a.m.  Mr. Owens advised the Board the budget would have to be amended showing additional revenue coming in if the Board takes over the Home.

Clerk Owens stated they will have to advertise for bids; WHEREUPON, a motion was made by Commr. Dykes, seconded by Commr. Simpson and carried that the County Engineer be instructed to prepare plans and specifications for an addition to the Home for an administrative office and that Clerk Owens be authorized to advertise for bids for the construction of the addition.

On a motion by Commr. Cowart, seconded by Commr. Babb and carried, the bill of C. E. Duncan, attorney, in the amount of $1,000 for services rendered in acquiring rights of way by negotiation and purchase and by condemnation proceedings on SR S 565 were approved for payment by the State Road Department.

Commr. Dykes reported that he has contacted the Child Welfare Unit about moving into the building west of the Chamber of Commerce building; they looked at the building and agreed that it would be adequate for their needs; and they are willing to move in the first of the year when Mrs. Holmes moves out.  Commr. Dykes stated the building will need a little painting inside.

Commr. Dykes also reported on some work he had done in the County Engineer’s office, and he was instructed to continue with the work as suggested.  He stated he has contacted three painters, and they will submit prices on the painting.

moving mosquito control equipment

Commr. Dykes suggested that the Commissioners help the Mosquito Control to move to the land purchased for them on the Dora Canal.  On a motion by Commr. Dykes, seconded by Commr. Babb and carried, the Commissioners are to help the Mosquito Control move to this location and that the Board go ahead and pave the existing location at the time we do the leveling of the Pioneer Parking Lot.  This is to be worked out by the Commissioners.

maximum salaries

Dr. Hall, Director of the Lake County Health Department, appeared before the Board and discussed with them his letter to Mr. Duncan dated October 13, 1961 relative to the maximum salaries that could be allowed for the employees in Lake County and suggested that the Board adopt a resolution asking that the State Board of Health change Lake County to a higher rate, namely from No. 4 to No. 5, asking that the County supplement until classified as a 5; WHEREUPON, on a motion by Commr. Simpson, seconded by Commr. Dykes and carried, the following resolution was adopted:

WHEREAS, the Board of County Commissioners of Lake County is advised that the classification of County Health Officer for Lake County is at present Class IV, and

WHEREAS, the compensation for such class is not commensurate with the demands of Lake County for the Health Officer and the duties and services required of him;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the State Health Commission be requested to designate for service in Lake County, County Health Officer Class V.

On a motion by Commr. Babb, seconded by Commr. Cowart and carried, Clerk Owens was authorized to transfer $600 from contingency item in the General Revenue Fund to Item #681-21, Lights Agricultural Building.

On a motion by Commr. Simpson, seconded by Commr. Babb and carried, Clerk Owens was authorized to transfer $175 from contingency item in the Bond Interest & Sinking Fund (County Buildings) to Item 763, Commissions & Expenses.

On a motion by Commr. Dykes, seconded by Commr. Babb and carried, Clerk Owens was authorized to transfer $2,100 from Planning and Cost item in the General Revenue Fund 676-6 to Item #676-7 for salary secretary Zoning Commission.  $200 per month.

Mr. Duncan was instructed to send the Florida Highway Patrol a map showing the location of the land under option for purchase.

On a motion by Commr. Simpson, seconded by Commr. Cowart and carried, the bill of Bankers Trust Company of New York for services as agent regarding the Certificates of Indebtedness in the amount of $112.50 were approved for payment.

On a motion by Commr. Dykes, seconded by Commr. Simpson and carried, the request of R. G. Cassady, Tax Assessor, in the amount of $40,052.41 were approved for payment.

On a motion by Commr. Cowart, seconded by Commr. Babb and carried, Cecil Theus was reimbursed in the amount of $40 advanced for transportation and food for Mr. and Mrs. Jake Hannah and two children from Leesburg to Knoxville, Tennessee.

The School Board resolution regarding the primary election date was filed without action.

Mr. Duncan advised the Board that there is no dedicated road in the Plat of Monroe Park.  Commr. Theus stated he will try to talk to the Monroes about this road.

The completed executed copy of the Agreement with Seaboard Air Line Company dated July 20, 1961 covering establishment of the highway crossing 4095 feet SE of Mile Post 781 was filed with the Board.

Gourd neck park on lake apopka

Commr. Dykes said there is a group of people interested in making a public park at Gourd Neck on Lake Apopka, but they did not appear before the Board today as anticipated.
