MINUTES OF REGULAR MEETING OF BOARD OF COUNTY COMMISSIONERS

The Board of County Commissioners met in regular session in the County Commissioners’ Room in the Courthouse at Tavares on Tuesday, January 2, 1962, (Monday, January 1, being a Holiday, and all offices in the Courthouse being closed, the meeting was postponed to this date) with the following present:  Chairman Theus, Commissioners Cowart, Dykes, Simpson and Babb, Clerk Owens and Attorney Duncan, also present was County Engineer Givens.

The meeting was opened with prayer by Chairman Theus.

The Minutes of the meetings of November 13, 17, December 4, 11 and 15 were approved as read, on motion of Commr. Simpson seconded by Commr. Cowart and carried.

NOTARY PUBLIC BONDS APPROVED BY CLERK OWENS since the first meeting in December 1961 with PAN AMERICAN SURETY COMPANY – Ann S. Bowsky 12-20-61:  with AMERICAN FIRE AND CASUALTY COMPANY – Don R. Harvison 12-28-61.

Mrs. Arlie Wilder and J. A. Rutherford appeared before the Board Re:  Application of Mrs. Wilder which has been made to the Zoning Commission and the Zoning Commission recommended that the application be amended to grant variance for the placing of one mobile home on the property.  Commr. Dykes stated there has been a lot of opposition to this.  Mr. Wm. Wingler was present and protested this variance and presented a petition signed by several people asking that this variance not be granted.  Commr. Simpson suggested that the application go to the Appeal Board.

Motion by Commr. Simpson seconded by Commr. Dykes and carried, that the recommendation of the Zoning Commission for a variance on the property in the application of Mrs. Wilder be denied.

zoning in mount plymouth area:

William Daughtery of Mount Plymouth appeared before the Board and requested that the County Commissioners refer back to the Commission the blanket area zoning of R-1-A recommended and adopted for the Mount Plymouth area by the Zoning Commission at its public meeting held December 28, 1961.  A petition was signed by Lea B. Whitman and 34 others requesting that the County Commissioners refer back to the Zoning Commission the blanket area zoning was filed.

After discussion of the above matter, motion was made by Commr. Simpson seconded by Commr. Dykes and carried, that the zoning of the new territory zoned by Act of the last Legislature and also the re-zoning of the Mount Plymouth territory be referred back to the Zoning Commission for them to re-advertise and hold a separate hearing on each and report back to the Board of County Commissioners at a later date.

WHEREUPON, on motion of Commr. Cowart seconded by Commr. Babb and carried, the following Resolution was adopted:

WHEREAS, the State Road Department of Florida has authorized and requested LAKE COUNTY to furnish the necessary rights of way, borrow pits and easements for that portion of Section 11010, State Road 500, extending from a point in the Southeast 1/4 of Section 16, Township 19 South, Range 25 East, Easterly to Orange Avenue in Tavares, which has been surveyed and located by the State Road Department as shown by a map on file in the office of the Clerk of the Circuit Court of said County and in the office of the said Department at Tallahassee, and

WHEREAS, the said Department will not begin construction of said portion of said Section in said County until title to all land necessary for said portion of said Section has been conveyed to or vested in said State by said County and said lands are physically cleared of all occupants, tenants, fences, buildings and/or other structures and improvements upon or encroaching within the limits of the land required for said portion of said Section, and

WHEREAS, the said County is financially unable at this time to provide the necessary funds to acquire said rights of way, borrow pits and easements; now therefore, be it

RESOLVED, that the State Road Department of Florida be and it is hereby requested to pay for the rights of way, borrow pits and easements for said road, including the removal of buildings, fences and other structures and improvements thereon, and for other expenses of acquiring title to said rights of way, borrow pits and easements by purchase or condemnation, from such funds and under such conditions as are set out in the contract hereto attached; and be it further

RESOLVED, that said County, through its Board of County Commissioners, comply with the request of said Department and procure, convey or vest in said State the free, clear and unencumbered title to all lands necessary for said portion of said Section, and deliver to the State Road Department said lands physically clear of all occupants, tenants, fences, buildings and/or other structures and improvements situate upon or encroaching within the limits of the lands required for said portion of said Section, and that the Chairman and the Clerk of this Board be and they are hereby authorized and directed to execute and deliver on behalf of said County to said Department the Contract in the form hereto attached; and be it further

RESOLVED, that the attorney for this Board be, and he is hereby authorized and directed to proceed to take the necessary steps for the County to acquire in the name of said County by donation, purchase, or condemnation said rights of way, borrow pits and easements for said portion of said Section, and to prepare in the name of said County by its County Commissioners all condemnation papers, affidavits and pleadings, and prosecute all condemnation proceedings to judgment; and furnish to the Department the abstract search provided for in said Contract.

Babb seconded by Commr. Dykes and carried, Clerk Owens was authorized to return the bid unopened.

Motion by Commr. Cowart seconded by Commr. Babb and carried, that the bids of Crenshaw Equipment Inc. on the Spreader and Hot Mix Asphalt Plant be referred to the County Engineer for study and recommendation.

Letter from R. M. Wilkins Contracting Corp., P. O. Box 89, Sanford, giving facts on the expense of owning and maintaining an asphalt plant was read by Clerk Owens and filed.

Motion by Commr. Simpson seconded by Commr. Dykes and carried, that the above bids on filing cabinets be referred to the County Judge to see if they meet the specifications and if so that he accept the low bid of George Stuart, Inc.

Mr. Sawyer and Mr. Thompson appeared before the Board re:  Request for variance in Zoning on Mr. Thompson’s property southwest of Tavares adjoining Squibbs' Mobile Homes.  Mr. Sayer stated the Zoning Commission recommended that special use for Mobile Homes be permitted and requests that the County Commissioners concur in this recommendation.

Mr. Givens, Zoning Director, presented the following applications re:  ZONING -

George Z. Atz; Grand View Greenhouses, Inc.; Lela B. Whitman and Application of Grady and Mae Whitlock property now zoned agricultural and want it changed to conditional use for a junk yard.  Part of this land adjoins a junk yard.  They will put up a hedge to screen the junk yard from County road.  Mr. Duncan stated that Harry Gaylord, attorney, represents these people and he says this has been used for a junk yard for a long time.  It was suggested that the application be approved subject to construction of a fence within one year.

WHEREUPON, on motion of Commr. Dykes seconded by Commr. Babb and carried, the following Resolution was adopted on the five applications above referred to:

WHEREAS, the Lake County Zoning Commission did, on the 28th day of December A.D. 1961, after due notice of the hearing, review applications for changes and revisions of the Zoning of certain areas in Lake County and did approve certain changes as requested in the particular applications hereinafter set forth, subject to the approval by the Board of County Commissioners of Lake County; and the Board of County Commissioners of Lake County having reviewed said Applications and the recommendations of the Lake County Zoning Commission;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the Zoning Rules and Regulations of Lake County be altered and amended as they pertain to the following tracts of land, to the classification designated after each description:

            1.         All that part of the South 1/2 of the Southeast 1/4 of Sec. 31, Twp. 19 S., Rge. 27 E., Lake County, Florida, lying Easterly of the right of way of the Seaboard Air Line Railroad, less the following described tracts:  Begin at the Northeast corner of the Southeast 1/4 of the Southeast 1/4 of the said Section 31; run South 0°10’ West along the East line of the Southeast 1/4 of the Southeast 1/4 of the said Section a distance of 186.0 feet; thence run North 88°41’ West to the Easterly line of the right of way of the Seaboard Air Line Railroad; thence Northeasterly along the Easterly line of the right of way of said Railroad to the North line of the Southwest 1/4 of the Southeast 1/4 of said section; thence East to the point of beginning.  ALSO LESS:  Begin at a point of intersection of the easterly line of the right of way of the Seaboard Air Line Railroad with the South line of the Southwest 1/4 of the Southeast 1/4 of said Section 31, thence East along the South line of the Southwest 1/4 of the Southeast 1/4 of said Section 31, a distance of 60 feet; thence run due North a distance of 200 feet; thence due West to the Easterly line of the right of way of the Seaboard Air Line Railroad; thence run Southwesterly along the Easterly right of way line of the said Railroad to the point of beginning; and ALSO:  Government Lot 4 in Section 32, Twp. 29 S., Rge. 26 E., Lake County, Florida, less the North 186.0 feet thereof, now classified and zoned as A (Agriculture) be, and the same is hereby amended, changed and rezoned to Classification entitled “Mobile Home Subdivision establishing a variance to permit the sale of mobile home lots.

            2.         Twenty-five (25) acres of land described as follows:  The South 977.56 feet of the North 1177.56 feet of that part of the North Half of the Southeast 1/4 of Sec. 3, Tp. 19 S., Rge. 25 E. in Lake County, Florida, lying South and East of State Road 44, less the East 346 feet thereof, now classified and zoned as A (Agriculture) be, and the same is hereby amended, changed and rezoned by granting a variance so that said property may be used as a garden type cemetery.

            3.         The Southeast 1/4 of the Southeast 1/4 of Sec. 7, Tp. 20 S., R. 25 E., less the West 66 feet thereof; ALSO, the Northeast 1/4 of the Northeast 1/4 of Sec. 18, Tp. 20 S., R. 25 E., less the West 71 feet thereof, now zoned and classified as A (Agriculture) be and the same is hereby amended, changed and rezoned to Classification R-1-A (Residential).

            4.         All of Block 16, Section A, according to the Plat of Mt. Plymouth, filed and recorded in the public records of Lake County, Florida, now classified and zoned as R-1 (Residential) be, and the same is hereby amended, changed and rezoned to Classification C-1 (Commercial).

            5.         The West 10 feet of the North 960 feet of the Northeast 1/4 of the Northeast 1/4, and the East 240 feet of the North 960 feet of the Northwest 1/4 of the Northeast 1/4 of Sec. 17, Tp. 18 S., R. 27 E. in Lake County, Florida, now zoned and classified as A (Agriculture) be changed, and that there be granted a variance permitting the use of said property for a junk yard, it appearing upon competent evidence submitted to the Board that said property has been used for a junk yard for a period of more than five years, and that the granting of a variance as above set forth will be granting a use of property for purposes for which it has been used prior to the adoption of the Zoning Act, said property having been used under the non-conforming rule for said period of time.  Provided, however, that the approval of a variance as above set forth is subject to the construction of a fence or the planting of a proper hedge, which will effectively hide from view said junk yard from the road right of way.  In the event this requirement is not complied with within said period of one year, this variance shall be null and void.

Mr. John Spears came before the Board to meet the Commissioners as he has made application for the job for custodian of the courthouse.  He was advised that this matter would not be taken up until this afternoon.

Tom Sawyer suggested that the County start using standard printing sheets for plats.  This would help in the Clerk’s Office where the Plats are filed.  Several of the counties have these printed forms.  Clerk Owens was instructed to write some of the counties using this form and find out the cost of same.

Clerk Owens read a copy of letter from Mr. Burrell, Chairman of Oklawaha Basin Authority, to Howard Young, stating the Authority will have a joint meeting with this Board at two p.m. today.

The Board adjourned for lunch and reconvened at 1:15 p.m.

Mr. French suggested that the maps be purchased and recommended that the Planning and Zoning Commission be authorized to use up to $2,000 from the Zoning Commission funds for this purpose, WHEREUPON, on motion of Commr. Dykes seconded by Commr. Babb and carried, Clerk Owens was authorized to transfer $2000.00 from the contingency item in the General Revenue Fund to Item 676-6 planning cost.

Motion by Commr. Babb seconded by Commr. Dykes and carried, that Clerk Owens be authorized to advertise for bids for the purchase of cloth for making the maps.

Mr. Cassady appeared before the Board and presented summons in the above case which has been served on him.  The Board members stated they have been served also.  Motion by Commr. Simpson seconded by Commr. Dykes and carried, that C. E. Duncan, attorney for the Board, be authorized to represent the defendants in the suit.

Mr. Duncan presented in duplicate proposed agreement for execution, WHEREUPON, on motion of Commr. Babb seconded by Commr. Dykes and carried, the following Resolution was adopted:

At a regular meeting of the Board of County Commissioners of Lake County, Florida, held on the 2nd day of January 1962, the following was ordered and spread upon the minutes:

“It is hereby ordered by the Board of County Commissioners of Lake County, Florida, that the form of agreement between the said County and the Atlantic Coast Line Railroad Company dated December 5, 1961, by the provisions of which the said Railroad Company grants to the said County the right or license of improving and maintaining a public road or street crossing at grade across the right of way and track or tracks of the Atlantic Coast Line Railroad Company, at Lady Lake, Florida, at a point 1221 feet southwardly, measured along the center line of the Railroad Company’s main track from Mile Post S-796; as particularly described in said agreement and as more fully shown on the print attached to and made a part of said agreement, be and the same is hereby approved.

“Further that the Chairman and Clerk of said Board of County Commissioners are hereby authorized and directed to execute said agreement in the name and on behalf of said County.”

Appraisal in amount of $15,200.00 by L. W. Huey and H. B. Harrell, Jr., re:  PARCEL #2 – property of Cross-Country Truck Service, Inc., was filed with the Board, WHEREUPON, on motion of Commr. Simpson seconded by Commr. Cowart and carried, the appraisal was accepted, and the bill of the appraisers in amount of $50.00 each was approved for payment.

Motion by Commr. Cowart seconded by Commr. Babb and carried, that the following Resolution be adopted:

WHEREAS, the Board of County Commissioners entered into an Option to Purchase a tract of land located North of Lady Lake, in Lake County, Florida, for County purposes, which property is described as follows:

Begin at the intersection of the South line of Section 33, Township 18 South, Range 24 East, with the West boundary line of the right of way of U.S. Highway 441 (State Highway 500); run thence North along Westerly right of way of said road, 250 feet; thence run West 547 feet to the East line of the right of way of the Atlantic Coast Line Railroad; thence South along the right of way of said railroad to the South line of Section 33, thence East to the point of beginning,

WHEREAS, the Cross Country Trucking Company has offered to substitute in lieu of the property above described a tract of land of equal or greater value, located just North of the above described tract, which is more particularly described as follows:

From the point of intersection of the south line of Section 33, Township 18 South, Range 24 East, Lake County, Florida, with the West line of the right of way of the U. S. WHEREAS, the Board of County Commissioners has had the piece last above described appraised and find that the total value of the appraisal is in excess of the purchase price in said Option, and that the second piece of property will serve the purposes for which the property is required as good or better than the original tract;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the Chairman and Clerk of said Board be authorized to enter into an Amendment to the original Option, substituting the second tract above described for the first tract above described, and to extend the terms of the Option for a period not to exceed three months from the date hereof.

The hour of 2:00 p.m. having arrived, the Board of County Commissioners adjourned, and Mr. Burrell called the Special Meeting of the Board of Oklawaha Basin Recreation and Water Conservation and Control Authority to order.

At 3:30 p.m. the Board of County Commissioners reconvened and Chairman Theus called for a motion for adoption of a Resolution concurring in the Resolution as adoption by the Oklawaha Basin Board, WHEREUPON, on motion of Commr. Dykes seconded by Commr. Babb and carried, the following Resolution was adopted:

WHEREAS, the Oklawaha Basin Recreation and Water Conservation and Control Authority in Lake County has presented to the Board of County Commissioners a Resolution adopted by it in a Special Meeting called on the 2nd day of January, 1962, pertaining to the repair and reconstruction of the lock and spillway at Moss Bluff and the channels above and below the same, and

WHEREAS, the Board of County Commissioners of Lake County, being vitally interested in the conservation and control of waters in Lake County, wishes to join with the Oklawaha Basin Recreation and Water Conservation and Control Authority in Lake County in urging the repair and reconstruction of said spillway and lock and channels above and below the same;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that this Board adopt and approve the Resolution presented by Oklawaha Basin Recreation and Water Conservation and Control Authority in Lake County and affirmatively state that it will cooperate with said Authority in achieving the purposes of the Southwest Florida Water Management District in Florida as included in Chapter 61-691, enacted in the 1961 Session of the Legislature of Florida.

Mr. Burrell thanked the Commissioners for the splendid cooperation they have given the Water Authority.  Mr. Burrell stated the Trustone Company has given the Authority during the past about twelve thousand blocks and loaded them on the trucks for us.  They also gave us another thousand blocks today.  Mr. Burrell asked that Mr. Owens write a letter of appreciation to Mr. James E. Connolly, Eustis, Manager of Trustone Company.

Clerk Owens read proposal of Bruce Thompson to do this work, which had been requested by the County Engineer.   “I propose to furnish all equipment and perform all labor to pump with a suction dredge, a sand fill in the amount of 600 cu. yds. in place.  Fill to be graded to grade stakes approved by the County Engineer – for the total sum of $250.00.  This is a minimum price, including set-up and moving on and off the location.  Any additional fill desired will be pumped at a unit price of 30¢ per cu. yd.”

County Engineer Givens stated that Pete Brown does not want this filled in, HOWEVER, motion was made by Commr. Babb seconded by Commr. Dykes and carried, that the County Engineer be instructed to contact Bruce Thompson re this matter.

Request of R. G. Cassady, Tax Assessor for advance on 1962 Tax Roll in amount of $10,000 was approved on motion of Commr. Simpson seconded by Commr. Cowart, and carried.

Certificates of Correction of Errors on the 1961 County Tax Roll, numbered 243 through 264, were approved on motion of Commr. Dykes seconded by Commr. Simpson and carried.

WARRANTS

Warrants as follow authorized canceled on motion of Commr. Cowart seconded by Commr. Simpson and carried:

Fine & Forfeiture #53 dated December 11, 1961 in amount of $35 made payable to Dr. Thomas E. Langley, Eustis, for expert witness fee re:  State of Florida vs. William H. Robinson, as this was paid on November 3, 1961.

 

General Revenue Fund warrant #268 dated December 11, 1961 in amount of $3.00 made payable to Tom Adams, Secretary of State, in payment of Invoice #1677, as this was paid on October 3, 1961.

 

Motion by Commr. Dykes, seconded by Commr. Babb and carried, that Clerk Owens be authorized to issue warrant to Motor Vehicle Commission for 1962 X-tags and new title certificates.

Letter from State Road Department stating “This bridge was returned to the County for maintenance in compliance with the County’s Resolution dated February 8, 1960.  Any necessary work on the structure will, therefore, be the responsibility of Lake County”  was read.  Also, letter from Gee & Jenson, Consulting Engineers, re this matter was read and copy ordered sent to City of Tavares.

Motion by Commr. Dykes seconded by Commr. Simpson and carried, that the bill of H. B. Harrell, Jr., in amount of $50.00 for services rendered in the Suit – State of Florida vs. Oklawaha Nurseries, Road 448 -  be approved for payment.

Mr. Owens advised the Board that Vaughn Sperry made an offer of $4.00 each for two of the large size ballot boxes.  Motion by Commr. Dykes seconded by Commr. Babb and carried, that the Board sell to Vaughn Sperry two of the large ballot boxes for the price of $4.00 each.

PSYCHIATRIC ward for indigent patients in waterman memorial hospital, eustis

 

Copy from C. E. Duncan to Edwin Mead re the above was read:  Said letter stated that Mr. Duncan and two of the Commissioners have been to Tallahassee and discussed the problem with the Legal Department of the Auditing Department.  However, did not get a commitment from the Department because we could not explain in detail the type of persons who are to be treated in the Ward.  We were requested to secure from the Hospital Assn. and from the doctors the types of patients who would be treated in such a Department within a year.

Letter from Karl Lehmann requesting that the Board of County Commissioners authorize U.S.D.A. Forest Service to build and maintain a gate at the entrance to the picnic area at Alexander Springs was read, WHEREUPON, on motion of Commr. Babb seconded by Commr. Simpson and carried, the following Resolution was adopted:

WHEREAS, it has been brought to the attention of the Board of County Commissioners that subsequent to the development of Alexander Springs and the picnic and parking area on the Southerly side of the Springs, that the use thereof has been abused during the hours of darkness and that measures should be taken to protect said area against such abuse; and

WHEREAS, the Forest Service of the United States Department of Agriculture has agreed to build and maintain a gate at the entrance to said grounds south of the Springs, which will be closed at appropriate times by the Alexander Springs Corporation and the Board of County Commissioners is convinced that the construction of a gate will be for the protection of said property and an assurance to the legal users thereof against vandalism and abuse;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the Forest Service of the United States Department of Agriculture be, and it is hereby authorized to construct a gate and entrance to the picnic area at Alexander Springs in Lake County (just off the Alexander Springs Highway) and that the Alexander Springs Corporation and the Forest Service of the United States Department of Agriculture be granted the right to determine the hours during which said gate shall be closed.

Tom C. Hanson of Lady Lake, Secretary of Property Owners League of Lake County, appeared before the Board and stated the purpose of this organization is not to fight but to help, and will work with the Commissioners for better government.

Chas. N. Givens, County Engineer, submitted recommendation from Lake County Planning and Zoning Commission for the establishment of new electrical and plumbing fees to be charged by the Lake County Zoning Department and to consider certain changes as recommended, subject to the approval of the Board of County Commissioners of Lake County, Florida, and said Board of County Commissioners having reviewed said recommendations of the Lake County Zoning Commission for the establishment of new Electrical and Plumbing Fees to be charged by the Lake County Zoning Department, and certain changes to the Lake County Fire  Safety and Electrical Code;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the Electrical and Plumbing Fees to be charged by Lake County Zoning Department, effective February 1, 1962, shall be as follows:

BE IT FURTHER RESOLVED that the Lake County Fire Safety and Electrical Code be amended by adding the following:

“ADDENDUM #3 TO LAKE COUNTY FIRE SAFETY AND ELECTRICAL CODE SECTION 23 – WIRING METHODS

16.       a.         Electric Range Circuit shall not be less than two #6 and one #8 wires.

            b.         In cases of individual oven and surface units (built in ranges) it will be permissible to install a minimum of three #20 conductors to each of the units, provided that each rim is separately circuited with proper over-current protection for the size of conductors and equipment used.  The actual name plate wattage SHALL determine the size conductor and over-current protection.

            c.         Where multiple range units are fed from a common cable and common breakers, the wire size shall not be reduced at any point.

27.       a.         Every kitchen shall have a minimum of two appliance outlets, each on a separate circuit; no other outlet shall be on these circuits.

            b.         Dishwashers, garbage disposers and all water pump systems shall be on separate circuits.  Disposers shall have an indicating switch within sight and reach.

            c.         The utility room, garage, or laundry shall also have an appliance outlet on a separate 20 amp. circuit.

            d.         Kitchen, bathroom, laundry, utility room, garage and any other plumbing fixtures shall be controlled by a wall switch.

            e.         A convenience outlet shall be installed at a height of not over 48 inches from the floor in all bathrooms.

28.       a.         Nonmetallic sheather cable (Romex) shall not be run on top of ceiling joist unless within 18 inches of the junction of the joists with the roof rafters.

            b.         Bottom chords of roof trusses SHALL NOT be drilled under any circumstances.  The outside panel of roof trusses, except kingpost trusses, shall be considered as meeting the requirements under “a” above.

37.       a.         Requirements in multiple dwellings:

                        On new buildings and REWIRED BUILDINGS no branch circuit shall be connected to serve more than one apartment.

 

            c.         IN RESIDENCES, PANELS SHALL NOT BE LOCATED IN BEDROOMS, BATHROOMS, CLOTHES CLOSETS, OR IN ANY LOCATION IN WHICH MAINTENANCE WOULD BE PERFORMED FROM A DAMP OR WET AREA, and therefore no distribution of branch panel shall be approved if placed there.

 

BE IT FURTHER RESOLVED that after February 1, 1962, the ISSUING PROCEDURE FOR BUILDING PERMITS shall be as follows:

“One permit covering all phases of construction will be issued just as in the past.  The Permit will be divided into three sections:  Building, Electrical and Plumbing.  All three, if involved, must be taken out when the Permit is issued.  The building permit will be issued on the same basis as in the past, based on the valuation of the completed work using the same fee schedule.  The electrical and plumbing section of permit will be completed according to the attached schedules.

“It shall remain the general contractor’s or owner’s responsibility to make application and obtain the permit.  Complete plumbing and wiring diagrams will be required in order to satisfactorily complete these sections.”
