MINUTES OF THE REGULAR MEETING OF BOARD OF COUNTY COMMISSIONERS

monday – DECEMBER 3, 1962

The Board of County Commissioners met in regular session in the County Commissioners’ Room in the Courthouse at Tavares on Monday, December 3, 1962, at ten o’clock a.m. with the following present:  Chairman Simpson; Commrs. Theus, Cowart, Dykes; and Babb; Mr. Owens, Mr. Duncan, Mr. Hayes and Mr. Livingston.

The Board was called to order by Chairman Simpson.

The invocation was given by Mr. Theus.

MINUTES

The Minutes of the meetings of October 1, 8, 15 and 22, and November 5, 1962 were approved as read on motion of Commr. Dykes seconded by Commr. Babb and carried.

NOTARY PUBLIC BONDS

The Board approved the Notary Public Bond of Mrs. Alice Ferguson Smart with Highway Insurance Company.

JUVENILE SHELTER

Commr. Dykes said that the beds at the Juvenile Shelter needed painting and he authorized this work done at a cost of $30.

COURTHOUSE REMODELING

Commr. Dykes advised the Committee has had two meetings recently.  Everybody is in accord that the work should be started.  Mr. Dykes made a motion that the plans be approved as now recommended by the Committee and that Howell Hopson, Architect, be given notice to go ahead and draw up the specifications in order that the contract may be let as soon as possible.  Motion seconded by Commr. Babb and carried.

The remodeling plans were presented later by Howell Hopson, Architect, and they call for the complete remodeling of the courthouse by using the space previously occupied by the old County Jail.  Plans on the first floor call for the offices of the Small Claims Court, Supervisor of Registration and Florida Highway Patrol.  County Clerk’s office will remain on the second floor, but will be expanded.  County Commissioners will have a meeting room on this floor.

Third floor facilities will be occupied by the County Judge’s office and Juvenile authorities.  County Judge courtroom will also be on this floor.

Fourth floor facilities will include a Judicial Library, Reading Room, Circuit Courtroom, Jury Room, Witness Room and Grand Jury Room.

Fifth floor will be occupied by the Circuit Court Judge’s Chambers, along with a visiting Judge’s office, three offices for Official Court Reporters and three offices for Probation Officers.

Mr. Hopson requested the Board to make a tour inspection of the Courthouse on December 10, 1962 at 1:15 P.M.  This was agreed to by the Board.

Commr. Babb filed check in amount of $60 from Ploeger Company, Inc. for fill dirt for road repairs.

CENTRAL TELEPHONE SWITCHBOARD

The proposal for a central telephone switchboard on the main floor has not yet been definitely decided on.  Mr. Hopson was instructed to find out from the telephone company more information about this and report to the Board next Monday.

Motion by Commr. Babb seconded by Commr. Theus and carried, that the bid of Simons Office Equipment, Leesburg, to furnish Lake County 4,000 case binders as specified in the quotations for the sum of $697.82 be accepted.

Quotations on 4 - #1877 Steelcase 2-drawer files were presented by Clerk Owens as follows:

Clerk Owens recommended that the low bid be accepted; WHEREUPON, on motion by Commr. Dykes seconded by Commr. Babb and carried, Clerk Owens was authorized to purchase 4 - #1877 steel case 2-drawer files from Leesburg Typewriter Service for the sum of $269.00.

zoning board hearing requested

Clerk Owens read a letter from Lake Yale Groves by Joe Eichelberger regarding Special Exception Mobile Home Village.  This letter requested that they be heard in opposition before any action is taken by the Board of County Commissioners.

Bob Webb, Zoning Director, was present when this letter was read and he stated this property is zoned Agricultural with Special Permission for Mobile Home Village.  We will call a special meeting for both parties and have a rehearing on this.  Mr. Eichelberger stated in his letter “Have head there might be objections from some of these trailer folks should dust or spray blow over their property. We want to be sure that we can take care of our groves in the customary manner we have for the past twenty years meaning cultivating, spraying, etc.  Therefore, we would like to have hearing with the Zoning Board to go over this matter to avoid any future trouble.”

Motion by Commr. Dykes seconded by Commr. Theus and carried, that the Planner of the Zoning Commission be requested to turn in a progress report to the Board of County Commissioners each month.

ROAD CROSSOVERS

T. C. Hanson, Lake County Property Owners League, appeared before the Board regarding crossovers on U.S. 441 North of Leesburg.  He said there is a need for crossovers at Picciola Road.  It is the policy of the State Road Department to put crossovers every 800 feet, but these crossovers are 1100 feet apart.  He asked that the Board have the Engineer look into this.  Mr. Theus stated we have had repeated requests for this.  Think we should have speed limit signs erected.  There is a need for other crossovers on this road.  Mr. Simpson suggested that all requests be put in one Resolution; WHEREUPON, on motion of Commr. Babb seconded by Commr. Dykes and carried, the following Resolution was adopted:

WHEREAS, it has been brought to the attention of the Board of County Commissioners that the intersection of State Road 25 with State Road 48, located just East of the Town of Okahumpka, is a very dangerous intersection and crossing, due in part to the hill to the south of said intersection over which State Road 25 passes, thereby obstructing view for any distance to the South, and, as a result thereof there have been serious accidents at said intersection;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, to provide for the location of a caution light at said intersection, requiring motor vehicle operators to approach said intersection with caution and care.

BE IT FURTHER RESOLVED by the Board of County Commissioners that the State Road Department be requested to locate a sign at the North city limits of Lady Lake, at the juncture of State Road 25, U.S. 27 and 441, with the road continuing North to Weirsdale, to read:  ‘WEIRSDALE NEXT LEFT,” and that said sign be placed between 400 and 500 feet south of the intersection, to give motor vehicle operators ample notice of the turnoff to the left for entry upon the road to Weirsdale.

BE IT FURTHER RESOLVED by the Board of County Commissioners of Lake County, Florida, that the State Road Department be requested to construct crossovers within the existing islands or medians on State Road 25, U.S. 27-441, included in (Project 1104-204, 205), at the following Stations:

Mr. Hopson announced that no one bid on Group 5 – Hot Plate.  He recommended that the low bids be accepted, WHEREUPON, on motion of Commr. Dykes seconded by Commr. Babb and carried, the bid of Simons Office Equipment, Leesburg, to furnish Lake County Juvenile Shelter Group 1 – furniture for the sum of $1,292.18 and the bid of Barnes Restaurant Supply Co., Inc. to furnish Lake County Juvenile Shelter Group 2 – flatware for the sum of $13.60; Group 3 – plastic dinnerware for the sum of $50.60 and Group 4 – Hot Chocolate Dispenser for the sum of $110.45 were accepted.

vandalism of county equipment

Mr. Simpson reported to the Board that a dragline located in Lake County clay pit in Orange County was shot up during the holidays the week of Thanksgiving.  Think it was done by some boys.  Unless we do something about this, it can happen again to other equipment.  Think it would be well to have Lake County offer an award for the apprehension of the guilty parties.  Suggest that the Sheriff be requested to try to apprehend the parties, WHEREUPON, on motion by Commr. Cowart, seconded by Commr. Dykes and carried, Lake County was authorized to offer a hundred dollar reward for the report and conviction of anyone guilty of vandalism of Lake County property, said reward to be paid upon the conviction of the party apprehended by the person claiming the reward.  The Board agreed that in the future rewards would be offered for any vandalism occurring to County equipment.

road closing procedure

Mr. Duncan read a letter he received from Elmer C. Jost regarding procedure of closing roads.  The opinion of the Lake County Board of Realtors in regard to notification to those owning property immediately adjoining the road or property in the vicinity that might be affected by its closing, be advised by registered mail and given adequate time to protest, rather than notification by publication in a newspaper.  Board of Realtors is taking the necessary steps to introduce legislation to this effect.

acquisition of railroad bed for right of way

Mr. Duncan read a letter from J. L. Kennedy, Superintendent, Atlantic Coast Line Railroad regarding this.  The letter stated in part as follows:  Coast Line is willing to negotiate sale of this right-of-way north of Umatilla from which we have authority from the Interstate Commerce Commission to remove the branch line track and, to that end, handling has been initiated to develop information which will enable us to name a price on this right of way.  I will advise you further regarding this matter as quickly as possible.

Mr. Duncan also read a letter from him to the State Road Department regarding this matter.  Mr. Duncan was instructed to call Mr. Richey Green of the State Road Department and offer the Board’s cooperation in this matter.

Errors Certificates numbered 1 to 180, inclusive, were filed.  Motion by Commr. Theus seconded by Commr. Dykes and carried, that the Certificates of Errors on the 1962 Lake County Tax Roll numbered from 1 to 180, inclusive, be approved and the letter of transmittal be signed in duplicate and the two copies returned to R. G. Cassady, Tax Assessor.

Motion by Commr. Dykes seconded by Commr. Babb and carried, that the Small Claims Court be authorized to purchase the two dockets from General Office Equipment & Printing Company for the price of $144.00.

County Engineer Hays read three letters from the State Road Department regarding Sinclair Avenue in Tavares; Bridge on SR 452 Marina at Eustis; Silver Lake Forks SR 500 to Dora Canal.

Clerk Owens read a letter from the State Road Department acknowledging receipt of Resolution regarding light at Eustis Interchange.

purchase of electric saw

Clerk Owens was instructed to purchase a power electric saw from Paul Rogers for a cost of $239.95.

READMISSION TO T. B. HOSPITAL

Motion by Commr. Dykes seconded by Commr. Babb and carried, that the action of the Chairman and Clerk in approving the application of Walter Henry Noling for readmission to the T. B. Hospital be approved.

1962-1963 BUDGET

Clerk Owens gave each member of the Board a copy of the 1962-1963 Budget.

cooperative forest management project

Copy of the Annual Report to the County Commissioners Orange, Lake and Seminole Cooperative Forest Management Project was given to each Commissioner with copy of Florida’s Timber Changes in Supply and Use and copy filed with the Board.

LAKE county fair association

Copy of letter from Karl Lehmann, Secretary-Manager of the Lake County Fair Association regarding painting some of the Fair buildings (each Board member had a copy of this letter) was read and Clerk Owens reported that Mr. Lehmann stated to him that the work has been done and the Fair Association paid for same.

MEETING ADJOURNED FOR LUNCH – RECONVENED AT 1:30 P.M.

CHAIN-O-LAKES SUBDIVISION

Clerk Owens read a Petition signed by Paul W. Borek and 60 others of this subdivision requesting County assistance on maintenance of the roads in this subdivision.  Commr. Dykes stated he has done some work on the roads; he also stated that he had discussed the problem of these streets with Mr. Elmer Jost last year and that Mr. Jost had stated to him he would prefer that the County not have anything to do with the streets; that he would take care of the streets and requested the Commissioner and his Superintendent of Roads to stay away from the subdivision.  However, Commr. Dykes stated since the Petition is signed by most of the property owners or resident in the subdivision, he will review the streets’ condition and will, in the near future, repair the streets so that they will be more passable.

LAKE MINNEHAHA ESTATES ASSOCIATION

A letter from the President of Lake Minnehaha Estates Association, Rev. Dean E. Burton, was also presented to the Board on November 5, 1962 in regard to this matter.  Mr. Duncan was instructed to answer this letter and the petition.

kiwanis luncheon

Judge Hall appeared before the Board and announced that Thursday, December 13th, is the regular Kiwanis luncheon day in Tavares.  On this day we will have our guest speaker Chief Justice of the Supreme Court – Honorable G. K. Roberts – who is Chairman of the Judicial Council of Florida.  He will speak on “Getting legislature through the next session relative to providing defense counsel for indigents, other than as it is now for capital punishment only.”  Judge Hall stated he hopes all of you can attend.

BILL FOR SERVICES ON SECTION 11010-2501 SR 500

Emery Dillard presented his bill for services on Section 11010-2501 SR 500 and several other roads in amount of $4,311.00.  He was instructed to have the bill itemized and then present for payment.  Motion by Commissioner Dykes seconded by Commissioner Babb and carried, that the bill of Emery Dillard be approved subject to having same itemized.

This is a replat of McDonald Terrace in Section 25-19-26.  Letter from Roy Christopher, Attorney, states, “Owner is Josephine McDonald and the records denote that all taxes are paid thereon and there are no encumbrances on said property, and that the title thereof is completely insurable.”  Letter from Lake County Health Department with copy of letter from Orange State Engineers, Inc. to Dr. J. B. Hall regarding septic tanks filed.

Motion by Commr. Theus seconded by Commr. Dykes and carried, that the Plat of Billingsley’s Acres be approved.

Letter from G. G. Ware, Secretary Lake County Courthouse Bond Trustee, enclosing bill for Trustees for the period October 1, 1961 – September 30, 1962.  Due George J. White $23.74, due G. G. Ware $123.73, was approved for payment by the Secretary.  On motion of Commr. Dykes seconded by Commr. Theus and carried, and the report for the same period by the Bond Trustees was filed.

Gordon Hays, County Engineer, reported that he has checked the right-of-way of this road.  The County has only a 30 foot R/W.  Should have ten feet additional on each side.  No action taken on this.  Still pending.

Motion by Commr. Dykes seconded by Commr. Babb and carried, that Leesburg Typewriter Service be notified to continue servicing the County-owned typewriters and adding machines for the year 1963 on a quarterly basis under the present contract as follows:

stored cars seized for beverage violations

Motion by Commr. Dykes seconded by Commr. Theus and carried, that Attorney for the Board be instructed to write the parties who have these cars stored that the vehicles will be forfeited for storage charges.

Zoning Director Webb reported to the Board that last Thursday at the Zoning meeting they got a “slap” in the face for not enforcing zoning regulations – for issuing a permit in violation of the zoning regulations.  The Zoning Department issued a temporary permit to Pav A Way Corp. to locate its plant near Lisbon to do some state road department work.  Some of the citizens in that vicinity have taken their complaints to the State Board of Health and have appeared before the Zoning hearing and complained, also wrote Pav A Way.  We understand now that Pav A Way is anticipating to a new location near Okahumpka.  The Board of County Commissioners took no official action on this complaint.

naming lake norris road bridge

Mr. Simpson asked that the name of this bridge be put on record as the Dr. S. C. Colley Bridge if it meets with the approval of the Board; WHEREUPON, on motion of Commr. Dykes seconded by Commr. Babb and unanimously carried, the Lake Norris Road Bridge was named the Dr. S. C. Colley Bridge and the County Engineer was instructed to get two bronze plaques to be placed on the bridge and contact Mrs. Theus before purchasing.

Mr. Dykes said he would like to have the bridge which has been completed in the south end of the county named, but no action taken on this.

Mr. Simpson filed copy of Civil Defense Operational Survival Plan of Sorrento – Mt. Plymouth, Florida.  Paul McDonald, Sr. is the Director.

Motion by Commr. Theus seconded by Commr. Cowart and carried that the payroll for the month of November be approved.

jefferis subdivision

Harry Meilke appeared before the Board regarding a street in Jefferis Subdivision being taken over for maintenance by Lake County.  The County Engineer, Mr. Hays, reported that he has checked this street and it has ample base and is stabilized and is okay for acceptance by the County.  WHEREUPON, on motion by Commr. Dykes seconded by Commr. Babb and carried, the following Resolution was adopted:

WHEREAS, the Board of County Commissioners of Lake County, Florida, has been advised by the County Engineer that the street located within Jefferis Subdivision, located near but without the boundaries of the City Limits of the City of Eustis, has been paved in accordance with the specifications required by the County and meet the specifications of the State Road Department for secondary road construction; that the dedicators of said street have compiled with all of the requirements of Lake County as set forth in its Resolution providing for taking over care of streets after certain requirements and specifications have been met;

NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Lake County, Florida, that maintenance by Lake County be resumed upon the following street in Jefferis Subdivision:

JEFFERIS COURT, according to the Plat of Jefferis Subdivision filed in Plat Book 15, page 25, public records of Lake County, Florida.

 

Upon depositing with the Clerk of the Board of County Commissioners the guaranties required as provided in and by the Resolution setting forth the requirements and specifications before accepting maintenance of streets in subdivisions.

Mr. Meilke also requested that the County take over for maintenance the streets in this subdivision.   The County Engineer reported that these streets are not stabilized under the base and do not meet the specifications. He has sufficient base and right of way but does not have them stabilized.  The streets are 18 feet wide and approximately one thousand feet long and do not have any curves.  These streets were paved prior to the new specifications.  Mr. Hays does not recommend acceptance of these streets.  However, Commr. Dykes stated, “due to the fact this was done in accordance with instructions given by County Engineer Givens, I move that the following Resolution be adopted;” WHEREUPON, a motion was seconded by Commr. Babb and carried:

WHEREAS, Harry Mielke, the owner of a subdivision known as “Rolling Acres Estates,” has made application to the County Engineer for requirements in the construction of streets in said subdivision; and

WHEREAS, the County Engineer at the time of said request gave the said Harry Mielke certain specifications and he did thereupon pave the streets in said subdivision in accordance with the specifications then approved by the County Engineer; and

WHEREAS, said Harry Mielke has requested the County to adopt a Resolution accepting the maintenance of the streets in said subdivision since they had been constructed in accordance with the specifications of the then County Engineer;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the following named streets in Rolling Acres Estates:

            Sharp Court

            Highland Drive

be, and the same are hereby accepted by Lake County for maintenance.
