MINUTES OF regular MEETING OF BOARD OF COUNTY COMMISSIONERS

 TUESday – DECEMBER 10, 1962

The Board of County Commissioners met in regular session in the County Commissioners room in the Courthouse, in Tavares on Monday, December 10, 1962, at ten o’clock a.m., with the following present:  Chairman Simpson; Commr., Dykes, Theus, Cowart, and Commr. Babb; Attorney Duncan; and Clerk Owens.

The Board was called to order by Chairman Simpson

Mr. Theus gave the invocation.

On a motion by Commr. Theus, seconded by Commr. Dykes and carried:

DISTRICT 1 – that Mrs. Edith Hallmeyer be added to the list for $37 – address c/o Mrs. J. H. Barnes, Rt. 2, Box 358 J, Groveland

DISTRICT 2 – that no changes be made

DISTRICT 3 – that no changes be made

DISTRICT 4 – that William Daniel Powell c/o Richardson Nursing Home, Box 505, Wildwood, be granted $10 per month.

DISTRICT 5 – that no changes be made.

Myrtle Sudderth, County Welfare Worker, presented a statement for services rendered indigent patients in the Durham Young Hospital in the amount of $2,085; WHEREUPON, on a motion by Commr. Theus, seconded by Commr. Cowart and carried, the bill of Durham Young Hospital in the amount of $2,085 for services rendered indigent patients for the period October 1, 1961 to November 29, 1962 was approved for payment.

Mr. Hopson and a representative of the Florida Telephone Company appeared before the Board regarding this matter.  Mr. Hopson stated “would need fifty telephones to take care of all of the Departments and ten to twelve lines to take care of the night shift.  We need to determine what kind of central switchboard you are interested in.”  Mr. Hopson recommended the automatic system.  Mr. Theus thinks they should use the automatic system, and Commr. Dykes agreed.  WHEREUPON, on a motion by Commr. Dykes, seconded by Commr. Babb and carried, the automatic switchboard system was approved for the new courthouse in order that Mr. Hopson can go ahead and make arrangements for the work.

On a motion by Commr. Cowart, seconded by Commr. Babb and carried, the bids were referred to the County Engineer to study, tabulate, and make recommendations to the Board as to the low bidders.

Later during the day, Gordon Hays, County Engineer, advised the Board that E. A. Mariani Asphalt Company, Central Oil Company, and Supreme Oil Company, Inc. were the low bidders on RS-2 and SM-K at .1167 and .1307 respectively and that American Oil Company is the low bidder on AC-15, RC-1S, and RC-2 at .127, .1167, and .1167 respectively.  WHEREUPON, on a motion by Commr. Theus, seconded by Commr. Dykes and carried, the bids as recommended as being low by the County Engineer for asphalt were accepted.

Notice having been advertised for the purchase of crushed stone, the following bids were received: (per ton)

On a motion by Commr. Dykes, seconded by Commr. Babb and carried, the bids were referred to County Engineer Hays for study, tabulation, and recommendations to the Board.

Later during the day, the Engineer reported that Shands & Baker, Inc. and Florida Crushed Stone Company f.o.b their plants were the low bidders on stone SRD grades #18, #15, and #11 at the price of $2.45 per ton with a 5 cents per ton discount.  WHEREUPON, on a motion by Commr. Dykes, seconded by Commr. Babb and carried, the bids of Shands & Baker, Inc. and Florida Crushed Stone Company were accepted.

The County Engineer reported that Florida Crushed Stone Company was the low bidder on slag #15 and #18 at $3.00 per ton and #11 slag at $2.65 per ton with a discount of 5 cents per ton f.o.b plants.  WHEREUPON, on a motion by Commr. Theus, seconded by Commr. Cowart and carried, the bids on stone and slag as recommended by the County Engineer were accepted by the Board.

Notice having been advertised for the purchase of corrugated pipe, bids were received from the following companies and filed:

Babb and carried, the bid of Joe Creamons Chevrolet, Inc. to furnish Lake County a cab and chassis for the sum of $3,237.11 was accepted.

Cowart and carried, the bid of Jungle Auto Service to furnish Lake County two 1963 Internationals dump trucks for District No. 5 for the purchase price of $7,646.0 was accepted.

Babb, seconded by Commr. Theus and carried, the bid of Jungle Auto Service to furnish Lake County District No. 5 one 1963 GMC automatic shift pickup truck for the price of $1,392.00 was accepted.

crossover on sr 19 at trustone cement block plant

Mr. Jim Connelly appeared before the Board and requested the Commissioners to see if they can get the SRD to do something about the crossover to SR 19 from his place.  He explained how difficult it is for his trucks to get on the road at the crossover as planned.  He would like to have the SRD and the County Commissioners consider putting in an additional crossover or an alternate.  It is about impossible for us to get on 19 at the present crossover if we want to head west until we turn around.  Hugh Hannah of the State Road Department was present and stated it is our policy to establish entrances to roads already being used.  Probably if we stretched a point, we can put two crossovers between Lake Shore Drive and St. Clair Abrams Avenue.  After much discussion on the crossover problem, Mr. Theus suggested that the Board, Mr. Connelly, Mr. Hannah, and Mr. Bristol look over the situation at lunch time.

The meeting adjourned for lunch at 12:20 p.m. and reconvened at 2:00 p.m.

juvenile shelter

Mr. Hopson, architect, presented proposals on drapes for the Juvenile Shelter as follows:

Cotton Cottage, Inc.               $666.97

Lena’s Draperies                    $468.55

Mr. Hopson suggested that the proposals be presented to the Board of Visitors with samples and let them select what they think is the best buy.  Mr. Theus suggested getting the cheaper ones.  On a motion by Commr. Theus, seconded by Commr. Dykes and carried, Mr. Hopson was instructed to turn the quotations over to the Board of Visitors with recommendations to purchase something in the price range of the lower quotation, not to exceed $500.  It was also suggested that Mr. Hopson consult Mrs. Florence Gause, Tavares, about prices.

David D. Morris, Contractor’s Request No. 3 for payment of $6,941.70 was presented and approved by Howell Hopson, architect.  WHEREUPON, on a motion by Commr. Theus, seconded by Commr. Dykes and carried, the bill of David D. Morris, Contractor, in the amount of $6,941.70 for work on the construction of the Juvenile Shelter was approved for payment.

Judge Milton reported to the Board that two sides of the Juvenile Shelter are unfenced and will need probably 40 feet more fence.  Motion by Commr. Theus, seconded by Commr. Dykes and carried that the additional fence be purchased and put up by the Superintendent of the Shelter.

Judge Milton informed the Commissioners that Mrs. Louise Shay of Leesburg as of December 3, 1962 at a salary of $450 per month and travel expense of $104.16 per month has been employed as the assistance counselor of the Juvenile Court; WHEREUPON, on a motion by Commr. Dykes, seconded by Commr. Babb and carried, the appointment of Mrs. Louise Shay as assistance counselor of the Juvenile Court was approved.

atlantic coast line right of way from umatilla to altoona

Hugh Hannah of the State Road Department advised the Board that this right of way will be available to the SRD and/or Lake County.  The Atlantic Coast Line has received bids from individuals and companies, but are holding them until a decision is made by these boards.  If Lake County wishes to buy this right of way and wants to use secondary funds, the first thing is as to how we will go about doing this.  One of the first things to do is consult the State Road Department and get recommendations.  If it can legally be worked out, think we should buy everything they have.  The State Road Department has not determined the exact right of way.  WHEREUPON, on a motion by Commr. Babb, seconded by Commr. Theus and carried, this Board will request the State Road Department to negotiate with the Atlantic Coast Line Railroad Company and see what we can purchase the land for.  Mr. Duncan read a letter regarding this.

installation of telephone in chamber of commerce building

Karl Lehmann appeared before the Board and informed the Commissioners that he had a request for installation of a telephone in the Chamber of Commerce Building for the Industrial Center for Tourism, but he had no authority to let them put the telephone in.  Mr. Lehmann said he had forms from the Internal Revenue Service at the office for anyone desiring them, as well as a large package of civil defense material.  He was authorized to store these in the Pioneer Building.  It was suggested the Development and Tourism Commission be authorized to use a room in the Yates house for an office and have the telephone installed there.  Mr. Duncan was instructed to notify E. E. Huskey, President.

Mr. Theus introduced Mrs. Norma Hendricks, City Commissioner-elect of Leesburg.

The bids were referred to the County Engineer for tabulation and recommendation to the Board.  Later during the day, Gordon Hays, County Engineer, reported to the Board as follows:

American Oil Company is the low bidder on 460,000 gallons of regular gasoline at $0.1275.

Texaco, Inc. is the low bidder on 112,000 gallons of diesel fuel in tank wagon delivery at $0.1120.

Sinclair Refining Company is the low bidder on 98,000 gallons of diesel fuel by transport delivery at $0.0985.

All of the above bids are firm for one year.  Mr. Hayes stated that Cities Service Oil Company was the low bidder on regular gasoline at $0.1225, but they did not quote a firm bid.

Motion by Commr. Cowart, seconded by Commr. Theus and carried, that the bids as recommended as low bidders by the County Engineer on the diesel fuel and regular gasoline be accepted.

bid for insurance coverage on county employees

Notice having been advertised for insurance coverage on County employees, the following bid was received:

BUSINESS MEN’S ASSURANCE COMPANY OF AMERICA – The employee pays the full cost of this plan as outlined, and the employer is not required to pay any part of the premiums.

Clerk Owens advised the Board that the insurance companies have advised him that they are not interested in bidding on the insurance.  They said it would have to be based on the average age.

Motion by Commr. Babb, seconded by Commr. Dykes and carried that Business Men’s Assurance Company of America be permitted to sell this insurance to the employees of Lake County if they are interested.

Motion by Commr. Dykes, seconded by Commr. Babb and carried that the bill of C. E. Duncan for the following be approved and sent to the State Road Department for payment:

SECURING RIGHT OF WAY for Section 11682-2602, SR 44B; instituting condemnation proceedings and preparing for trial (Original appraisal $26,733) $1,500.00

SECURING RIGHT OF WAY for Section 11681-2602, SR S-565A; instituting condemnation proceedings and completing case without trial (Original appraisal $16,874.60) $1,000.00

Mr. Connelly again appeared before the Board after the Commissioners visited the property and stated he thinks it is unfair for him to pay for building the road at his property when the party across the road is not paying anything for his.  Will have to build 210 feet of road to get to the crossover.  The State Road Department said they would build 60 feet, but what good will that do?  Commr. Dykes said the State Road Department refused to make another interchange.  Mr. Connelly asked for the Board to pass a resolution requesting the State Road Department to establish the crossover as it originally stood.  The SRD engineer said if another interchange is made, it would be split and not benefit either entrance.

Harry Meilke appeared before the Board and requested that the Board take over for maintenance of the streets (or a thousand foot road) in Golden Heights Estates Subdivision.  However, he was advised that the Board would not accept the road unless it meets the specifications as adopted in 1961.  WHEREUPON, on a motion by Commr. Dykes, seconded by Commr. Babb and carried, the request was denied, with the full knowledge that any other request of similar nature be denied.

construction of a health clinic in clermont

Dr. Hall appeared before the Board and stated that two or three years ago this Board voted to have the State Board of Health return some ten thousand dollars which was sent to them for building funds, but did not go through with this as did not get the Hill-Burton money.  The Hill-Burton Fund has earmarked $10,500 to assist in planning, constructing and equipping the Auxiliary Health Unit in Clermont.  The City of Clermont has agreed to purchase a suitable lot for $5,000 to build on.  Dr. Hall stated the building will cost around $25,000.  Motion by Commr. Dykes, seconded by Commr. Babb and carried that the following resolution be adopted:

BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the State Board of Health of the State of Florida be requested to return from the funds heretofore deposited with the State Board of Health by Lake County, the sum of Ten Thousand Dollars ($10,000) to be used in the construction of an auxiliary health unit in the City of Clermont, Florida.  Said funds shall be used with $10,500 set aside by the Hill-Burton Funds to assist in the project of planning, constructing, and equipping a new Clermont Auxiliary Health Center.

SUBDIVISION IN NATIONAL FOREST

Dr. Hall reported to the Board that he would not approve for septic tanks the subdivision in the National Forest.

Dr. Hall was authorized to pick up these forms or return them if they are not needed.

zoning resolution

Bob Webb, Zoning Director, appeared before the Board and presented a resolution from the Planning & Zoning Commission requesting that the minutes of a previous meeting regarding Mobile Homes be corrected, as we thought that R-1 included Mobile Homes, and this should be corrected to reflect what the Commissioners intended to do; WHEREUPON, on a motion by Commr. Dykes, seconded by Commr. Cowart and carried, the following resolution was adopted:

WHEREAS, it has been brought to the attention of the Lake County Zoning Commission that the application of George W. Daugherty, for the owners of a certain tract of land in Government Lot 2 and 7, Section 25, Township 19 South, Range 25 East, and Section 30, Township 19S, Range 26E of Lake County, Florida, more particularly set forth and described in a Resolution adopted by the Board of County Commissioners on the 5th day of June, 1961, under paragraph numbered “1” for a change and variance in zoning regulations to permit the location of mobile homes on said tract of land was considered and unanimously approved, and

WHEREAS, the Resolution as adopted by the Board of County Commissioners provided only for a change from R-1-A (Residential) to R-1 (Residential), which does not permit the permanent location of mobile homes on said property, and

WHEREAS, it was the intention of the Zoning Board to grant a variance so as to permit the location of mobile homes on said property;

NOW, THEREFORE, BE IT RESOLVED by the Lake County Zoning Commission that the Board of County Commissioners be requested to correct paragraph numbered “1,” corrected and more particularly described:

Mr. Duncan said this would have to be published and could be heard at the second meeting in January, on January 14, 1963. WHEREUPON, on a motion by Commr. Dykes, seconded by Commr. Theus and carried, Clerk Owens was authorized to publish the Notice of Hearing for 2 o’clock p.m. January 14, 1963.

Bob Webb, Zoning Director, filed the application of A. B. Dean, et al for a change in zoning; WHEREUPON, on a motion by Commr. Babb, seconded by Commr. Dykes and carried, the following resolution was adopted:

WHEREAS, the Lake County Zoning Commission did, on the 29th day of November, 1962, after due notice of the hearing, review applications for changes and revisions of the zoning of certain areas in Lake County and did approve certain changes as requested in the particular application hereinafter set forth, subject to approval of the Board of County Commissioners of Lake County Florida, and the Board of County Commissioners having reviewed said application and the recommendations of the Lake County Zoning Commission;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County Florida, that the Zoning Rules and Regulations of Lake County be altered and amended as they pertain to the following tract of land to the classification designated after the description:

1.     That part of the North half of the Southwest Quarter of Section 2, Township 19 South, Range 26 East, lying between Old State Road #2 and State Road #44 and North of Trout Run, now classified and zoned as R-2 (Residential), be, and the same is hereby reclassified and rezoned to C-1 (Commercial).

discussion on extending regulations to include the whole county

No action was taken on this.  It would have to be an act of the Legislature.

On a motion by Commr. Cowart, seconded by Commr. Dykes and carried, the action of the Chairman and Clerk in approving the application of Jeff Davis Cooper for entrance to the T.B. Hospital was approved.

On a motion by Commr Dykes, seconded by Commr. Babb and carried, the application of Margaret Baxter Gilson for admission to the T.B. Hospital was approved by the Board.

Commr. Babb stated he wants to have a survey run on the road at Grand Island from SR 42 at Peurifoy Corner to Lake Yale and west up the hill, then south back to SR 452.  The Board said for him to go ahead and have the survey made.

A request from Farm Bureau to be allowed to put in a meter on the County water line and get water for the Farm Bureau building was read.  They are to buy the meter, read same, and reimburse the County for the water.  WHEREUPON, on a motion by Commr. Dykes, seconded by Commr. Babb and carried, the Farm Bureau was to be allowed to do this.  Commissioner Dykes said he will notify them this request was granted.  SEE PAGE 245 FOR RESOLUTION ON THIS.

NOTICE FOR PURCHASE OF ONE RECORDAK was read by Clerk Owens. He reported he had only one quotation on this, and it is from RECORDAK CORP. at a price of $1,095.00 for model MPC-1.  Motion by Commr. Dykes, seconded by Commr. Babb and carried that Clerk Owens be authorized to purchase one Recordak from Recordak Corp. for the sum of $1,095.00.

Mr. Owens also presented a price on Reader-Filler, Model 600, movable carriage, Product #7686 for $995.  Motion by Commr. Dykes, seconded by Commr. Cowart and carried that Clerk Owens be authorized to purchase from Recordak Corp. the Reader-Filler for the price of $995.

Clerk Owens read a quotation from Remington Rand on a butt-weld splicer, Cat. No. F80.2, Hercules Model at $607.10 FOB factory.  Motion by Commr. Cowart, seconded by Commr. Dykes and carried, that Clerk Owens be authorized to purchase from Remington Rand the Hercules Splicer for the sum of $607.10 FOB factory.

Motion by Commr. Dykes, seconded by Commr. Babb and carried that Clerk Owens be authorized to sign the Recordak equipment service agreement.

Judge Milton presented two quotations on an electric hot plate for the Juvenile Shelter: Glenn Electric Co. $17.46.  Payne Electric Co. $16.95.

WHEREUPON, on a motion by Commr. Babb, seconded by Commr. Dykes and carried, the County Judge was instructed to purchase the hot plate from Payne Electric Company for the sum of $16.95.

The request for authority to purchase a Gray Audograph dictating and Transcribing Machine for the sum of $795 was granted on a motion by Commr. Dykes, seconded by Commr. Babb and carried.

advertise for mosquito control tractor crawler

On a motion by Commr. Babb, seconded by Commr. Cowart and carried, Clerk Owens was authorized to advertise for the purchase of a tractor crawler for mosquito control.  Bids to be taken on January 14, 1963.

WHEREUPON, on a motion by Commr. Dykes, seconded by Commr. Babb, and carried, the following resolution was adopted:

WHEREAS, the Atlantic Coast Line Railroad Company has abandoned that portion of the railroad system extending from North Umatilla to Altoona, its present terminus, and

WHEREAS, the Board of County Commissioners feels that the acquisition of the abandoned portion of said right of way and use thereof for repairing State Road 19 will resolve and eliminate a greater portion of such hazardous conditions, and

WHEREAS, the terrain in that area does not permit the removal of State Road 19 to another location without great expense and without extending the length of the road;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the State Road Department of Florida be requested by Resolution to determine that portion of the right of way of the Atlantic Coast Line Railroad Company extending from North Umatilla to Altoona, the present terminus of the railroad to be necessary for public interests in the realignment and construction of State Road 19 and particularly for the purpose of removing hazardous conditions in the use of said road in its present condition.

WHEREAS, The Lake County Farm Bureau, whose main offices are located on the west side of State Road 19 and North of the Lake County Agricultural Center, southwest of Tavares, has requested permission to tap the water lines extending from the City of Tavares to the Lake County Agricultural Center with the understanding that a meter be placed at the point of the tap to measure the amount of water used by the Lake County Farm Bureau, and

WHEREAS, the Board of County Commissioners has agreed to the tapping of its line for the above purpose, provided the Lake County Farm Bureau pay its proportionate share of the flat charge and charge for use of water to be determined by the meter installed at the tap;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the Lake County Farm Bureau be, and it is hereby authorized and empowered through its agents to tap the water line extending from the water mains of the City of Tavares to the Lake County Agricultural Center, provided that a meter be installed at the tap and that the Lake County Farm Bureau pay its proportionate share of the flat charge and water used monthly.

Doug Igou appeared before the Board again in regard to this matter.  Mr. Igou said he reserved 35 feet when he sold the property to Sewell so Atkinson would have access to his property.  When Moorhead made the survey he said Igou did not own what he reserved.  The County Engineer at this time presented some maps which were studied by the Board.  Mr. Duncan suggested requesting the State Road Department to verify their survey made by Mr. Peters; WHEREUPON, on a motion by Commr. Dykes, seconded by Commr. Babb and carried, Mr. Duncan was instructed to request the State Road Department for a verification of the survey made by Mr. Peters.
