MINUTES OF REGULAR MEETING OF BOARD OF COUNTY COMMISSIONERS

 MONDAY – OCTOBER 10, 1963

The Board of County Commissioners met in regular session in the Small Claims Office in the Courthouse at Tavares on Monday, October 14, at ten o’clock A.M. with the following present:   

Vice Chairman Babb, Commrs. Theus, Cowart, and Livingston Clerk Owens, Attorney Duncan, Engineer Hays, and Zoning Director Webb. Chairman Dykes is away on vacation.

The meeting was called to order by Vice Chairman Babb.

The invocation was given by Mr. Theus.

bids

It now being 10:00 A.M., the time advertised to receive bids on the concrete pipe, the Clerk was directed to open and tabulate the following bids:

Clerk Owens said before opening the bids, wish to report that Lakeland Cement called just before the meeting and advised that they had not submitted a written bid, the time slipped up on them, but did give me prices over the telephone. The Clerk was instructed to quote the bid of Lakeland Cement Company before opening the other bids which he did.

On a motion by Commr. Cowart, seconded by Commr. Theus, the bids were referred to the County Engineer for review and recommendation to the Board.

 

courthouse

Mr. Howell Hopson appeared with reference to two thousand changes to the original contract for remodeling the Courthouse. Said he and Mr. Theus and Mr. Owens had looked over the proposed changes and the approximant cost will be $4,000.00. Have instructed the contractor to give me a proposal of the entire cost, however, it was impossible for him to do this today but understand the Board meets again next Monday and I will have it then.

state agencies

Attorney Duncan filed letter from the Governor in answer to his inquiry regarding the construction of the highway patrol station in Lake County. Letter states the administration must wait for a revenue trend before allocating funds for non-emergency items.

railroads

Attorney Duncan said I have received an agreement from Seaboard Air Line Railroad Company for relocating the crossing at Dead River; WHEREUPON, on motion of Commr. Livingston, seconded by Commr. Theus, the following resolution was adopted:

WHEREAS, it has been brought to the attention of the Board of County Commissioners that the Seaboard Air Line Railroad crossing just east of the Dead River Bridge should be relocated, and

WHEREAS, it will be for the best interest of the public in the use thereof, that the crossing be relocated according to the following description:

A road or highway near Tavares, Lake County, Florida, which will cross,

at grade, the right of way and main track of Railroad, with center line

1,120 feet southeastwardly from Railroad’s Mile Post 781.

 

NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners that the Vice Chairman and Clerk of the Board of County Commissioners, be, and they are hereby authorized and empowered to execute contract between Seaboard Air Line Railroad Company and Lake County to relocate said crossing as described above.

right of way – Except Roads

Attorney Duncan filed letter from the Atlantic Coast Line Railroad Company starting that an offer from the County for the right of way north of Umatilla is in order. The attorney was instructed to write the State Road Department requesting confirmation from them of the County acquiring the right of way for use in the construction of SR 19 north of Umatilla.

accounts refused

 Letter from The Pure Oil Company was filed by Attorney Duncan relative to bills which according to the Florida Statutes cannot legally be paid by the Board. On a motion of Commr. Livingston, seconded by Commr. Theus, Attorney Duncan was instructed to contact the State Auditing Department regarding the legality of Pure’s claim that the bills are just and payable.

bids accepted

Engineer Hays advised that the bid received on October 7th from Polk Materials, Inc. on AC-15, RC-1, RC-5, and RS-2 Asphalt was low and recommended that the same be accepted; WHEREUPON, on motion of Commr. Theus, seconded by Commr. Cowart, the bid of Polk Materials, Inc. on AC-15, RC-1, RC-5, and RS-2 Asphalt was accepted.

Engineer Hays advised that identical bids on Cationic Asphalt was submitted by three companies and recommends that bids from all three companies be accepted; WHEREUPON, on motion of Commr. Cowart, seconded by Commr. Theus, bids from E. A. Mariana Asphalt Co., Central Oil Company, Inc., and Supreme Oil Company, Inc. for SMK Cationic Asphalt delivered price $0.1265 per gallon were accepted.

On recommendation of Engineer Hays, the bid of Curcie Bros, Inc., Hallandale, Florida, for single surface treating 62,304 square yards in District No. 4 at $.22 per square yard, total price $13,706.88, was accepted on motion by Commr. Livingston, seconded by Commr. Theus, and the Attorney was instructed to prepare contract.  

On recommendation of Engineer Hays, and on motion of Commr. Theus, seconded by Commr. Livingston, bids on the various sign materials were accepted as follows:

beverage law

Commr. Livingston reported that the truck which had been stored at the Eustis Body & Welding Works was moved to District 4 barn on October 8, 1963. On motion of Commr. Livingston, seconded by Commr. Cowart, the following resolution was adopted:

WHEREAS, it has come to the attention of the Board of County Commissioners, that costs have been incurred in the parking of motor vehicles seized under the State Beverage Law; and that because of the delay required for use of the same in evidence, the costs have become exorbitant, and

WHEREAS, the County has various parking areas where such vehicles may be parked without cost to the County;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the Sheriff’s Department of Lake County, and the Officers serving under the State Beverage Commission, be requested in the future, upon seizing motor vehicles under the State Beverage Law, to park the same in an area designated by the Board of County Commissioners, or the Clerk of said Board.

right of way

On recommendation of the Engineer and on motion of Commr. Theus, seconded by Commr. Livingston, and carried, easement from Earl T. Harris, and wife Margaret L. Harris, covering the following described property was accepted:

Seven and one-half feet (7-1/2) on each side of the following described

centerline (Aggregating 15 feet): Commencing at the Southwest corner

of Lot 30, according to the Plat of Tropical Shores Manor Subdivision,

located in Government Lot 1, Section 25, Township 19 South, Range 25

East, as appears in Plat Book 13, page 19, public records of Lake County,

Florida, and run thence East 125 feet for the entire length of the common

line between Lots 30 and 31 of said Tropical Shores Manor Subdivision.

 

Clerk Owens was instructed to record easement upon the public records of Lake County.

bids

On a motion of Commr. Theus, seconded by Commr. Cowart, and carried, the Clerk was authorized to advertise for bids for November 12th at 10 o’clock A.M. for surfacing 7,138 square yards Lane Park Extension Road.

On motion of Commr. Cowart, seconded by Commr. Livingston, and carried, the Clerk was authorized to advertise for bids for November 12th at 2 o’clock P.M. for one pickup truck and two (2) dump trucks for District 2.

roads

On motion by Commr. Livingston, seconded by Commr. Theus, and carried, the following resolution was adopted:

WHEREAS, it has been brought to the attention of the Board of County Commissioners, that, because of the narrow width of the Easterly portion of Washington Street, according to the Plat of Breezy Shores, in Lake County, Florida, and vehicular traffic on that portion of Washington Street which extends to the waters of Lake Joanna, is impossible, for the reason that in turning around, there is an encroachment upon adjoining properties, and

WHEREAS, there have been objections to the continued use of said portion of Washington Street because of such trespasses, and for other reasons, and it will be for the best interests of the public in the use thereof, that a portion of Washington Street be blocked to vehicular traffic;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that posts be inserted across Washington Street at a line approximately 100 feet West of the high water mark of Lake Joanna, for the purpose of prohibiting vehicular traffic on the said East 100 feet of Washington Street bordering Lot 7 of said Subdivision, but that said Street shall remain open for use by the public as an open pathway or walkway.

mosquito control

Mr. Fred Tanner appeared with reference to the work on this building, however, he said he has rather the engineer would bring the Board up to date on the construction. Mr. Hays advised he had given the contractor a list of things he should so to get the building in acceptable condition. One major problem is his price on additional work – it is extravagant. Clerk Owens said Chairman Dykes has inspected this building and he is opposed to paying the contractor any money until the work has been completed on a satisfactory manner and accepted by the engineer.

Motion was made by Commr. Livingston that no payments be made to the contractor until the work is completed satisfactorily and approved by the County Engineer. Motion was seconded by Commr. Cowart and passed.

water levels

Mr. T. C. Hanson appeared and stated he had attended the Southwest Florida Water Management District meeting last week and it was in reference to underground water. He recommends that Lake County have some control over Orange County pumping our water for their use. Attorney Duncan was instructed to check the law on this subject and advise the Board.

application

Application from Howard E. Barnes for the position of Civil Defense Director was read and files.

road & bridge department

Clerk owns said we have received request to clean out the drainage ditch north of Eustis at the colored section. Motion by Commr. Livingston, seconded by Commr. Cowart, that the ditch be cleared out and the time involved divided between Districts 4 and 5.

veterans service officers

Letter from the Veterans Service Officer requesting additional office space in the Pioneer Building when the building is vacated by the Board of Public Instruction was read and filed.

roads - county

On motion of Commr. Cowart, seconded by Commr. Theus, and carried, Typical Section on SR S-473 from SR 500 to SR 44, Bassville Park Road, was approved and the Clerk was authorized to execute same and return to the State Road Department.

Notice from the State Road Department with reference to Procedure for Requesting Traffic Signal Studies was read by Clerk. Clerk Owens was instructed to supply the attorney with several copies of this notice in order that municipalities requesting installation of traffic signals may be notified of State Road Department requirements.

recess and reassembly

The Board recessed for lunch at twelve o’clock noon and reassembled at 1:30 o’clock P.M. to take up the remaining items of business.

zoning

Mr. Melvin Huff appeared with reference to his property at Sorrento. Said he is not operating a junk yard but is restoring antique cars. Zoning Director Webb stated regardless of what type of business Mr. Huff is operating, it is in violation of the zoning regulations as the area is zoned residential and his office has no choice but to insist that he has no choice but to insist that he move the vehicles. Mr. Huff was advised to apply to the Zoning Commission.

Mr. Hughes of Lady Lake appeared with reference to zoning in his area. Zoning Director Webb said he has recommendation before the Planning and Zoning Commission that will solve Mr. Hughes’ problem and recommend that Mr. Hughes apply to the Zoning Commission.

Mr. T. C. Hanson appeared on behalf of Mr. Register of Lady Lake and requested that action be taken against the Barber Pallet Company which is operating a sawmill next to Mr. Register’s property and is in violation of the zoning law. Zoning Director Webb said the owner has applied for rezoning at the request of the Planning and Zoning Commission and consequently his hands are tied as far as enforcing the zoning regulations. Mr. Duncan said Mr. Register had been to see him regarding the smoke nuisance. The question of whether or not the smoke is creating a health hazard was brought up and Dr. Hall was requested to appear and give the Board his views on this. 

On appearing Dr. Hall stated that the matter had been investigated by his department for a possible health hazard, and Mr. Barber has agreed to stop burning the sawdust. Mr. Hanson was instructed to advise Mr. Register to apply to the Zoning Commission.

Roads - County

Commr. Theus requested that the road north of Fruitland Park and east of U.S. 27 be surveyed by the Engineer to furnish better access to existing road. (This road adjoins Mr. Register’s property.)

zoning

On recommendation of the Zoning Director and on motion of Commr. Theus, seconded by Commr. Livingston, and carried, the Board authorized a public hearing for November 12th on amendments to the zoning regulations.

juvenile judge

Judge Milton appeared regarding the position of Assistant Juvenile Counselor. Harold Underwood pf Leesburg has been selected to fill this position. He is a former policeman with     2-1/2 years’ experience. Commr. Theus recommended that this individual be hired at a starting salary of $4,800.00, the Board concurred in this recommendation. WHEREUPON, on motion of Commr. Theus, seconded by Commr. Livingston, Judge Milton was authorized top employ Harold Underwood as Assistant Juvenile Counselor effective November 1, 1963 at an annual salary of $4,800.00.

Clerk Owens submitted request from the Board of Visitors, Lake County Juvenile Shelter, for one oil fired furnace and one power lawn; WHEREUPON, motion was made by Commr. Cowart, seconded by Commr. Theus, the Engineer was instructed to prepare bids on these two items for November 12th and the Clerk was authorized to advertise same.

municipal corporations

Mr. John Rapalje pf the City of Tavares appeared with reference to low places on St. Clair Abrams Avenue in the City where water stands. Motion by Commr. Theus, seconded by Commr. Cowart, and carried, the following resolution was adopted:

WHEREAS, recently the State Road Department paved in part, and resurfaced in part, St. Clair Abrams Avenue in the City of Tavares, from Alfred Street (Old 441) North to intersect State Road No. 19, now State Road 500 (U.S. 441), as an access road from said State Road 19, and

WHEREAS, since the construction of said road, certain portions of the same have settled and have created drainage problems so that rain water does not flow off of the street in the proper manner, but creates pools of water without proper means of disposing of the same,

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that the State Road Department investigate the drainage problems which are occurring along the above described road; and that such steps be taken to provide proper drainage for said street for the protection of the road, and the travelling public, and adjoining property owners.

appraisals

Appraisal of C. B. Treadway and Edwin R. Waite was submitted by Clerk Owens on Lots K and L, Block 6, Town of Tavares, in the amount of $6,500.00 for the land, including improvements the appraisal is $7,000.00. Motion by Commr. Theus, seconded by Commr. Livingston, that Mr. Johnson be notified that the Board will purchase the lots for $6,500.00, subject to conditions in his letter of October 1st, as this is the appraised value placed on the land.

Appraisal fee of C. B. Treadway in the amount of $25.00 and Edwin R. Waite in the amount of $30.00 was approved for payment on motion of Commr. Livingston, seconded by Commr. Cowart.

Affidavits of R. G. Cassady, Tax Assessor, certifying the intangible personal property assessment roll and real and tangible personal property were approved and signed by the Board on motion of Commr. Theus, seconded by Commr. Cowart, and the Clerk was instructed to record the warrant to the Tax Collector in the minutes of this meeting as follows:

You are hereby commanded to collect out of the real estate and personal property, and from each of the persons and corporations named in the annexed roll, the taxes set down in each roll opposite each name, corporation or parcel of land therein described, and in case taxes so imposed are not paid at the time prescribed by law, you are to collect the same by levy and sale of the goods and chattels, lands and tenements assessed, or of the person or corporation so taxed; and you are to pay to the legally qualified Depository all sums collected for County taxes, district school taxes and other special taxes; and you are further required to make all collections on or before the first Monday in April; and on or before the first Monday in July you will make a final report to and settlement with the Comptroller and County Commissioners.

On motion by Commr. Cowart, seconded by Commr. Livingston, the Vice Chairman and Clerk were authorized to execute county deed to Roy Smith for the sale of the following described lands acquired by the County for delinquent taxes.
