MINUTES OF REGULAR MEETING OF BOARD OF COUNTY COMMISSIONERS

 MONDAY – NOVEMBER 4, 1963

The Board of County Commissioners met in regular session in the Small Claims Office in the Courthouse at Tavares on Monday, November 4, at ten o’clock A.M. with the following present: 

Chairman Dykes, Commrs. Cowart, Livingston and Babb; Clerk Owens, Attorney Duncan, Engineer Hays, and Zoning Director Webb.

The meeting was called to order by Chairman Dykes.

The invocation was given by Mr. Livingston.

Clerk Owens reported to the Board the reason Mr. Theus is not present this morning is due to the death of his mother; WHEREUPON,  on motion of Commr. Livingston, seconded by Commr. Babb, the following resolution was adopted:

In his Divine Wisdom, our Lord has determined that the time has arrived for the return of May A. Theus, to her Maker, and to her Heavenly Home, to enter into the joys of eternal life, and there join her loved ones and await those who will follow her, but despite our Faith in the knowledge of her happy Homecoming, the leaving of her loved ones is a great shock and a great sorrow, and

WHEREAS, in going to her Eternal Home, she has left her Son, the Honorable Cecil C. Theus, a Member of the Board of County Commissioners, and her leaving has been a great sorrow to him and other Members of her Family;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners  of Lake County, Florida, that the individual Members of this Board, by this action, express to our Co-member, Cecil C. Theus, our deep sorrow and regret upon the passing of his Mother, May A. Theus; and that we extend to him our sympathy and sorrow with the realization, however, that she was a woman of great Faith, and in spite of sorrow and sadness, she smiles back upon her Son, with the realization that they will meet again.

BE IT FURTHER RESOLVED that this Resolution be spread upon the Minutes of the Board of County Commissioners; and that a copy be forwarded to the Honorable Cecil C. Theus.

Clerk Owens also reported to the Board that next Monday, the 11th is Veterans’ Day; WHEREUPON, on motion of Commr. Livingston, seconded by Commr. Babb, and the Board concurring, it was agreed that Monday, November 11, 1963, would be declared a holiday and the next regular Board meeting be held on Tuesday, November 12, 1963.

On motion from Commr. Babb, seconded by Commr. Livingston, the bids were referred to the County Engineer for study and recommendation to the Board.

complaints

Mr. Wm. Rumley of Fruitland Park appeared before the Board requesting the removal of a tree which fell across his property during Hurricane Donna blocking his driveway. Members of the Board concurring, the Chairman referred this matter to the County Engineer.

Mr. T. C. Hanson representing the Lake County Property Owners League appeared complaining about the assessment to grove property and wanted to know if the Board expected to take any action to adjust the values placed on groves which border on roads and lakes. Attorney Duncan said after the tax roll has been approved and sent to the Comptroller, we have lost jurisdiction of it.

Mr. Hanson also complained with reference to the brochure distributed by the Industrial and Tourism Commission and criticized the Commission for supporting this group.

Letter from Maynard D. Church with reference to street signs at the intersection of Overlook Drive and Old Eustis Road was referred to Commr. Livingston.

Letter from J. Alan Cross with reference to Haines Creek Development was referred to Attorney Duncan.

road maintenance - Subdivisions

Mr. Earl Funkhouser representing several property owners in the Milky Way Subdivision appeared with reference to the property owners resurfacing streets in the subdivision and the county taking over the maintenance of same after they are resurfaced. Attorney Duncan advised Mr. Funkhouser the proper procedure to follow in this matter and said he would draw the petition for the owners if Mr. Funkhouser will give him the necessary information.

The Engineer was instructed to make an investigation of these roads as to present base and estimated cost for resurfacing, and advise the Board.

ROADS - County

Letter from the City of Clermont requesting improvements to road known as the Farm to Market Road was read and filed. Chairman Dykes said he would discuss this with Mayor BonJorn.

Attorney Roy Christopher of mount Dora appeared and submitted petition signed by owners and lessee of Adams Management and Investment Company, requesting a hearing on resolution adopted by the Board on September 9th whereby barrier across a certain road described in the petition, and known as the Bear Pen Road, was ordered removed. Petition requests that action of the Board be rescinded. Hearing was set for November 12th at three o’clock P.M. and the Clerk was instructed to notify the parties interested.

Mr. Howell Hopson appeared with reference to temporary heat while the remodeling is going on. Mr. Hopson recommended that oil burning heaters be used and said Mr. Elliott of Val Rich Construction would have a sample heater here today or tomorrow. On Mr. Howell’s recommendation he and Mr. Owens were authorized to inspect the heater for performance and safety purposes and arrive at a decision on heating the building temporarily.

permits

Mr. Joe Andrews appeared and requesting dredging permit on Lake Harris for Dr. Walter H. Ebert. Mr. Andrews submitted approval of the Game and Fresh Water Fish Commission; WHEREUPON, on motion of Commr. Babb, seconded by Commr. Livingston, the permit was approved.

Mr. Duncan said Mr. Ernest Carr has approval of the Game and Fresh Water Fish Commission for dredging in Lake Harris but the Board needs to approve this also, WHEREUPON, on motion of Commr. Babb, seconded by Commr. Cowart, the permit was granted provided same is approved by the Game and Fresh Water Fish Commission.

Request from Irwin Cauthen for dredging permit in Lake Griffin was read. Clerk Owens was instructed to advise Mr. Cauthen that the Board will need approval of the Game and Fresh Water Fish Commission before permit can be granted.

RIGHT OF WAY EASEMENTS – Except Roads

Attorney Duncan submitted easement between Lake County and Game and Fresh Water Fish Commission for boat launching facilities on the Palatlakaha River; WHEREUPON, on motion by Commr. Babb, seconded by Commr. Livingston, the Chairman and Clerk were authorized to execute the easement conveying the following described property to the State of Florida for use by the Game and Fresh Water Fish Commission:

Commerce at the Southwest corner of Government Lot 3, Section 7, Township 23 South, Range 26 East, same being a concrete monument; thence run North 297.27 feet; thence run north 80°36’50” E, 885.20 feet to P.O.B.; thence run South 38°54’30” East, 60.00 feet; thence run North 51°05’30” East, 150.00 feet; thence run North 38°54’30” West, 290.40 feet; thence run South 51°05’30” West 150 feet, thence run South 38°54’30” East, 230.40 feet to P.O.B., containing one acre and being located in that part of Government Lot 3, Section 7, T.23 S., R.26 E, West of the Palatlakaha River, Lake County, Florida.

 

Together with a right of way or road suitable for vehicular travel described as follows:

Commence at the NW corner of Government Lot 3, Section 7, T.23 S., R. 26 E., thence run South 51.40 feet, to the centerline of “Hull Road” (County No. 3-0942); thence run South 53°54’25” East along said centerline, 371.70 feet; thence run South 47°24’40” East along said centerline, 264.85 feet; thence run South 39°26’05” East along said centerline, 344.02 feet; thence run North 51°05’30” East, 19.58 feet to the Northwest corner of a one acre tract, hereby granted as an easement to the Florida State Game and Fresh Water Fish Commission.

Copy of letter from Orange County Service Officer to Mrs. Julia Hoverstock, Assistant County Service Officer, regarding Thomas Warren Carroll was filed. Clerk Owens was instructed to furnish Mr. Carroll copy of this letter.

Motion was made by Commr. Babb, seconded by Commr. Cowart, that W. D. Thomas be allowed to teach an adult education clad at night, provided it does not interfere with his duties as County Service Officer.

railroads

Letter from Seaboard Air Line Railroad to Mr. Duncan with reference to railroad crossing at Dead River was read and filed.

interest

Clerk Owens presented breakdown by funds of interest earned from monies not required for current expenditures amounting to $33,190.77 from 10/1/62 to 9/30/63. The Clerk was commended by the Board in his management of the County funds.

industrial & tourism commission

On recommendation of Commr. Livingston, the following were reappointed to serve as members of the Industrial & Tourism Commission for the current year:

Elections - Specials

On motion of Commr. Cowart, seconded by Commr. Babb, the Clerk was authorized to pay rental for voting place in Precinct 29, Mrs. Edgar Ward, Casteen’s Grocery, $10.00; and $15.00 to Smith’s Furniture for voting place Precinct 27.

Chairman Dykes said we need a volunteer on the canvassing board for Wednesday morning. Commr. Babb volunteered and he was directed to meet the canvassing board in the Supervisor of Registration’s office Wednesday at nine o’clock A.M.

report of accident

Clerk Owens said several weeks ago I reported to you an accident involving Mrs. Grace Turley of Tavares. She was in my office this morning and I advised her that the county has no liability in accidents of this nature. Commr. Livingston moved that the County Welfare Director be instructed to investigate this case and report to the Board regarding same.

recess and reassembly

The Board recessed for lunch at 12:00 noon and reconvened at 1:30 P.M. to take up the remaining items of business.

mosquito control

Letter from Lake County Health Department advising that the area around the new building is ready to be clayed and requested that this work be done. Also, that the parking area at the Leesburg Health Unit needs reworking. On motion by Commr. Livingston, seconded by Commr. Cowart, the Engineer was instructed to work with the Health Department on this.

appraisals

Mr. Harry Johnson appeared before the Board with reference to offer made to him on Lots K and L, Block 6, Tavares. Members of the Board concurring, the Chairman referred this matter to the County Attorney with the request that he and Mr. Johnson try to arrive at an agreeable conclusion.

county property

The Clerk submitted the request of John Alden Murray to re-advertise the property in Mount Dora located at 352 E. Third Avenue; WHEREUPON, on motion of Commr. Livingston, seconded by Commr. Babb, and carried, the Clerk was authorized to advertise this property for December 9th at 10 o’clock A.M.

parks closing

Letter from Howard L. Rutherford was submitted by the Clerk objecting to the petition for closing parks on Lake Joanna. The Clerk was instructed to present this letter at the hearing on December 2nd.

road closing

The Clerk submitted petition from property owners in Mount Plymouth Subdivision to close 14 ft. alleyway. Inasmuch as the petition was incomplete, the Clerk was instructed to notify the owners the proper procedure for handling this.

Attorney Harry P. Johnson submitted petition to close street in Edgewater Beach Subdivision. Hearing on same was set for December 9th at 10 o’clock A.M.

Civil defense

Letter of application from Elizabeth P. McCraw for Civil Defense Director was read and filed.

Letter from Karl Lehmann, Director Lake County Defense Council, regarding a State Civil Defense office was submitted by Clerk Owens and referred to the Chairman for handling.

ROADS - County

Letter from the Florida State Turnpike Authority advising that the overpass and approaches to County Road where this road crosses the Turnpike Extension has been completed and same is being returned to the County for maintenance.

Letter from the Florida State Turnpike Authority advising that the overpass and approaches on Persimmon Trail where this road crosses the Turnpike Extension has been completed and Persimmon Trail is being returned to the County for maintenance.

PERMITS - Use

Engineer Hays filed Use Permits with the Florida Telephone Corp. as follows:

Permit L.C. #5  -

To construct and maintain buried cable between SR S-466A and a private road.

Permit L.C. #6  -

To construct and maintain buried cable between SR 19 and a private road.

Permit L.C. #7  -

To construct and maintain poles, aerial, and buried cable between SR S-452 and Yale Retreat Mobile Home Subdivision.

Also, Use Permit with the Florida Power Corp. to construct and maintain pole line between Minneola and Howey.

 

Mr. Hays said in approving these permits, we run into the problem of streets in subdivisions that are not maintained by the County and have no way of knowing which streets they are and would like to have reduced set of prints on all subdivisions’ maps filed in the County. Clerk Owens was instructed to check into this and arrange to have the prints furnished to the Engineer.

railroads

Mr. Bill Boyd of Clermont appeared with reference to railroad right of way between Minneola and Clermont. Mr. Duncan said he has written the railroad but has heard nothing concrete on this.

county engineer

Mr. Hays requested larger office space for his department when same is available.

county engineer

Mr. Hays presented correspondence he has had with the State Road Department regarding right of way maps of Lake County. Said he had asked for prices of the maps and instead the State Road Department had mailed him a roll of 103 maps. Does not know what the cost will be and should he keep them or return them? Mr. Hays was authorized to keep the maps.

machinery & equipment

Engineer Hays said he has spent considerable time trying to get the asphalt plant operating. Has had a price of $70.00 for parts needed and Crenshaw Equipment Company of Orlando has agreed to pay anything over this if needed. Motion was made by Commr. Babb, seconded by Commr. Cowart, and carried, that the Engineer be authorized to spend $70.00 on parts to get the asphalt plant in operation.

The Engineer reported he has been advised by the gasoline dealers that the tanks and pumps in the Districts are owned by the gas companies and suggested we might get better prices from the companies if the County owned this equipment. He was instructed to check into this and determine who owns the equipment.

zoning

On request of Mr. T. C. Hanson, the County Engineer reported that he and his survey men are working on a survey for road adjacent to Mr. Register’s property at Lady Lake but it is not complete at this time.

Zoning Director Webb reported that the problem at Sorrento with Mr. Melvin Huff has not been solved. Mr. Huff is making no attempt to clean up the junk and feels further action is necessary to enforce zoning law. The Board concurring, the Chairman referred this matter to the County Attorney to confer with the Prosecuting Attorney and enforce the zoning law.

Mr. Webb presented request from the Planning and Zoning Commission that L. E. Brown be employed effective October 1, 1963 as attorney for the Planning and Zoning Commission at a monthly retainer fee of $100.00; WHEREUPON, motion was made by Commr. Babb, seconded by Commr. Cowart, that Mr. Brown be employed effective October 1, 1963 inasmuch as he did attend the October meeting in an advisory capacity.

Letter from Agricultural Experiment Station with questionnaire regarding study of County wide zoning in Florida was referred to the County Planner.

On recommendation of the Clerk, motion was made by Commr. Babb, seconded by Commr. Livingston, and carried, the following resolution was adopted:

WHEREAS, Mrs. Marian B. Valentine, the Lake County Home Demonstration Agent, has, among other awards, received a National Fellowship Award, recognizing her unusual ability and talents for the work to which she has devoted her life, and

WHEREAS, the past achievements of Marian B Valentine speak for themselves; that having completed Graduate work in her chosen field, at the University of North Carolina, the University of Florida and Florida State University, she has held the following Offices and distinguished Appointments:

District Chairman, North Carolina Home Demonstration Agents Association

Third Vice President of North Carolina Home Demonstration Agents Association

Extension Section Chairman of Florida Home Economics Association

Secretary of Florida Home Demonstration Agents Association

President Florida Home Demonstration Agents Association

Counselor Southern Region of National Home Demonstration Agents Association;

 

that she received the Distinguished Service Award from National Home Demonstration Agents Association in 1961; she was a Panel Member on the Extension Section of American Home Economics Association in 1962; that she received the Progressive Farmer Award for County Community Programs, and has this year received the Grace E. Frysinger Fellowship Award of the National Home Demonstration Agents Association, and

WHEREAS, Marian B. Valentine came to Lake County as its Home Demonstration Agent om 1954, and has rendered to Lake County, and particularly to the young people of Lake County, outstanding service, training, and education in Home Demonstration Projects;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Lake County, Florida, that this Board express to Marian B. Valentine, its deep appreciation for her service to Lake County, the people of Lake County, and particularly the young people of Lake County; that it commend her for the awards that she has received, and particularly express to her the thanks of the individual Members of this Board for the training she is giving our Young People, the future of our County.

BE IT FURTHER RESOLVED that this Resolution be spread upon the Minutes of the Board of County Commissioners, and that a Copy be forwarded to Mrs. Marian B. Valentine.

Motion by Commr. Livingston, seconded by Commr. Babb, and carried, that the County Service Officer be authorized to attend mid-winter conference in St. Petersburg on November 21st and 22nd, expenses not to exceed $35.00.

Motion by Commr. Cowart, seconded by Commr. Livingston, and carried, that R. E. Norris, County Agent, be authorized to attend Florida State Horticultural Society Meeting in Miami Beach on November 5, 6, and 7, expenses to be reimbursed by the Board.

Motion by Commr. Cowart, seconded by Commr. Babb, and carried, that the Supervisor of Registration and office personnel be authorized to attend election workshop in Tallahassee on December 6th.

On motion by Commr. Babb, seconded by Commr. Livingston, the Clerk was authorized to execute service agreement with National Cash Register Company on the new book-keeping machine.

Mr. Duncan read letter from the State Auditing Department with reference to Pure Oil Company bills that have previously been refused. Mr. Duncan to pursue this subject further.

Chairman Dykes presented check for $519.32 from the Metropolitan Life Insurance Company for Mrs. Charles Keable, deceased. Motion by Commr. Livingston, seconded by Commr. Babb, and carried, that the check be accepted and the Clerk instructed to deposit same to the General Revenue Fund, and authorized to issue warrant to Steverson Funeral Home in the amount of $519.32.

Check from University Hospital in the amount of $70.00 refund on Cornelia T. Jackson, was accepted on motion by Commr. Babb, seconded by Commr. Cowart, and the Clerk was instructed to deposit same to the General Revenue Fund.

On motion of Commr. Livingston, seconded by Commr. Babb, check from the State of Florida in the amount of $3,000.00 to be used for the construction of an auxiliary health center in Clermont was accepted and the Clerk authorized to deposit same to Special Building Fund, Lake County Health Clinic.
