MINUTES OF REGULAR MEETING OF BOARD OF COUNTY COMMISSIONERS on

 MONDAY – OCTOBER 12, 1964

The Board of County Commissioners met in regular session on Monday, October 12, 1964, in the Commissioners’ Room in the Courthouse at Tavares at 10:00 o’clock A.M. with the following present:

Chairman Babb, Commrs. Theus, Cowart, Dykes and Livingston; Clerk Owens, Attorney Duncan and Engineer Hays.

The meeting was called to order by the Chairman and the invocation was given by Mr. Theus.

minutes

On motion of Commr. Theus seconded by Commr. Cowart and carried, the minutes of the regular meetings of September 8th and 14th and special meetings of September 21st and 22nd were approved as submitted.

complaints

A delegation from the Lakes and Hills Republican Club appeared and voiced their protest of the Democratic nominee for Governor being asked to speak at the re-dedication ceremonies of the Courthouse.  The members of the Board concurring, the Chairman advised this is not a political meeting and arrangements have been made and it is impossible to change them at this late date.

bids

It now being the time advertised to receive bids on concrete pipe, the Chairman instructed the Clerk to open the bids and the Engineer to tabulate same, whereupon, the Engineer reported receiving bids from the following:

Pav-A-Way Corp.

Basic Asphalt Corp.

Orlando Paving Company

Macasphalt Corp.

 

Motion by Commr. Theus seconded by Commr. Livingston and carried, the low bid of Macasphalt Corp. on Type I Asphaltic Concrete $7.25 per ton and Type II Asphaltic Concrete $7.00 per ton was accepted and the low bid of Pav-A-Way Corp. on Cold Mix, Type A- Coarse - $8.00 per ton and type A – Fine - $7.75 per ton, was accepted.

It now being the time advertised to receive bids on rental of calibrated asphalt distributor with tachometer plus necessary operators, the Chairman directed the Clerk to open the bids and the Engineer to tabulate same, whereupon, the Engineer reported receiving bids from the following:

Macasphalt Corp. - $13.00 per hour – minimum of three hours

J. D. Manly Construction Co. - $10.00 per hour

Orlando Paving Company

Macasphalt Corp.

 

Motion by Commr. Dykes seconded by Commr. Theus and carried, the low bid from J. D. Manly Construction Company was accepted.

planning & zoning

Mr. Harry P. Adley of Adley Associates appeared and advised that Lake County is now eligible for federal assistance under the County’s planning program.  On motion of Commr. Dykes seconded by Commr. Theus and carried, the Board adopted a Resolution authorizing Mr. Adley to prepare application and other necessary papers for the purpose of securing financial assistance in planning the future development of Lake County.

bids

On recommendation of Mr. Adley and on motion of Commr. Dykes seconded by Commr. Cowart and carried, the Clerk was authorized to return unopened all bids on aerial photography which were advertised for 2:00 o’clock P.M. today.

Mr. Cecil Real of E. A. Mariani Asphalt Company appeared regarding bids opened at the last meeting on asphalt materials and advised that their bid price did not include any demurrage charges.  On recommendation of the Engineer and on motion of Commr. Cowart seconded by Commr. Dykes and carried, the low bids of Supreme Oil Company and E. A. Mariani Asphalt Company on emulsified asphalt (RS-2) and SMK Catonic were accepted.

Motion by Commr. Livingston seconded by Commr. Cowart and carried, the low bid of Central Oil Company, Inc. on AC 15, RC 1, RC 2, and RC 5 was accepted.

On motion of Commr. Livingston seconded by Commr. Dykes and carried, the following bids received October 5th were accepted:

Gulf Oil Corp. – Gasoline and Diesel Fuel

Armco Steel Corp. – Corrugated Metal Pipe

Florida Pipe & Mfg. Co. – Corrugated Aluminum Pipe – circular

Florida Culvert Mfg., Inc. – Corrugated Aluminum Pipe – arch

Shands & Baker, Inc. – Rock and limerock

Florida Crushed Stone Co. – Slag

 

indigents

There being no changes to the present indigent list, the current list was approved on motion of Commr. Theus seconded by Commr. Cowart and carried.

Commr. Livingston expressed his concern of our indigent hospitalization program and feels when the recipients are able they should be required to pay at least a share of their hospital expenses.  Clerk Owens advised that the County’s share of our current indigent hospitalization program is $31,200 and the State’s share is $10,061.

road closings

At the request of O. M. Simpson and on motion of Commr. Dykes seconded by Commr. Livingston and carried, the Board authorized advertising for a public hearing to be held on November 9, 1964 of the intention to vacate, abandon and close Palmer Street in Mountain View Subdivision as described below:

That part of Palmer Avenue, a dead-end street, running West from Lake Drive, bisecting Block A of Mountain View Subdivision in Section 19, Township 19 South, Range 27 East, as recorded in the public records of Lake County, Florida, filed for record October 4, 1926 and recorded in Plat Book 9, Page 49.

 

state agencies

The Engineer announced the Game & Fresh Water Fish Commission advises they are in a position to construct other boat ramps in the County provided locations are available.  The Chairman instructed the Engineer to notify the Game Commission that the location on Lake Yale will not be ready for another two months.

laws & legislature

On recommendation of the Attorney and on motion of Commr. Livingston seconded by Commr. Dykes and carried, the Attorney was instructed to ask for prices from the Municipal Code Corp. for indexing laws pertaining to Lake County.

county property

At the request of Commr. Livingston, Attorney Duncan was instructed to review the deed and plat of Belleaux Estates, aka Joanna Park to determine the advisability of the County selling this property.

plats

The Clerk submitted a letter from W. H. Simmons & Associates describing an error in the plat of River Forest, Unit Two.  On motion of Commr. Theus seconded by Commr. Dykes and carried, the letter was referred to the Attorney.

civil defense

Certificate appointing Surplus Property Agent for civil defense purposes was approved and signed by the Chairman.

recess and reassembly

The meeting recessed at 12:00 noon for lunch and reconvened at 1:30 P.M. to take up the remaining items of business.

insurance

Clerk Owens advised the Board that the insurance coverage on the Fleet Schedule, of highway equipment and liability on the Nursing Home expires November 1, 1964.  Mr. Hardin Powell and Mr. Axel Olivenbaum, members of the insurance committee, were present at the request of the Clerk to present their recommendation to the Board.  Mr. Powell stated the Insurance Commissioner’s office does not recommend that the political subdivision take bids on their insurance coverage.  Motion by Commr. Theus seconded by Commr. Dykes and carried, the Clerk was directed to renew the policies expiring on November 1, 1964.

indigents

Attorney Duncan reported one of the patients in the Nursing Home had passed away and has left a paper leaving all her worldly possessions to the County.  The Attorney was directed to investigate this and determine if the paper is legal.

zoning

On recommendation of the Zoning Commission and on motion of Commr. Theus seconded by Commr. Livingston and carried, the Board adopted resolutions amending the Zoning Rules and Regulations to the classifications designated after the following descriptions:

That part of the SW 1/4 of the NE 1/4 of Section 16, Township 18 South, Range 24 East, in Lake County, Florida, lying North of Pine Island Road, now classified and zoned as R-1-A, be, and the same is hereby amended, changed and rezoned to Classification R-1 (Residential), with Mobile Home Special Exceptions granted.

 

West 1/2 of Government Lot 1, in Section 7, Township 19 South, Range 27 East, now classified and zoned as R-2 (Residential), be, and the same is hereby amended, changed and rezoned to Classification A (Agriculture).

 

NE 1/4 of SE 1/4 of NW 1/4 of  Section 14, Township 18 South, Range 24 East, now classified and zoned as R-1-A (Residential), be, and the same Is hereby amended, changed and rezoned to Classification R-1 (Residential), with Mobile Home Special Exceptions granted.

On motion of Commr. Theus seconded by Commr. Dykes and carried, the bids were referred to the Engineer for study and recommendation to the Board.  (See bids on file in the Clerk’s Office.)

complaints

Mr. Jimmy Seng appeared and suggested to the Board since the County has so little forest lands left that the Forest Fire Service be converted to a rural fire service for homes.  The members of the Board concurring, the Chairman advised Mr. Seng the majority of the cost of the fire service is paid by the State and the County’s share amounts to approximately $12,000 annually and his suggestion would take a special act of the Legislature.

The Clerk presented proposal from Florida Nursery & Landscape Company to treat the large trees on the Courthouse grounds in the amount of $1,165.00.  On motion of Commr. Livingston seconded by Commr. Dykes and carried, the Clerk was instructed to authorize the Architect to prepare notice and specifications to receive bids on this work on November 9th.

county buildings

The Clerk submitted request from Mr. Holt, Child Welfare Director, for office space in the Pioneer Building.  On motion of Commr. Dykes seconded by Commr. Cowart, the Board allocated space on the second floor of the Pioneer Building to the Child Welfare Office.

accounts allowed

Motion by Commr. Dykes seconded by Commr. Livingston and carried, the Agricultural Agent was authorized to have teletype service with the Weather Bureau installed at a cost of $20.00 plus monthly charge of $42.25 for five months effective November 1, 1964.

On motion of Commr. Dykes seconded by Commr. Livingston, the Board approved bill from C. R. Lovell Auto Supply in the amount of $27.60, repairs to generator.

Request from the Tax Assessor for advance on commissions of the 1964 tax roll in the amount of $5,000 was approved on motion by Commr. Dykes seconded by Commr. Cowart and carried.

On motion of Commr. Cowart seconded by Commr. Livingston and carried, request from the Small Claims office for glass table top, cost $75.00, was approved.

On motion of Commr. Livingston seconded by Commr. Dykes, the Board approved statement from the City of Eustis for their proportionate share for paving Gottsche Avenue, Cost $1,230.90.

Motion by Commr. Cowart seconded by Commr. Theus and carried, the following vouchers were approved for payment by the Oklawaha Water Authority:

communications

Invitation for the County to participate in the Inaugural Parade for the Governor on Jan. 5, 1965 was read and filed.

reports

Report from the Juvenile Judge on costs and admissions to the Juvenile Shelter was read and filed.

Report for September from the Welfare Department was filed.

Reports from the Home Demonstration Agent and Assistants for September were filed.

Reports from the Agricultural Agent and Assistants for September were filed.

 

There being no further business to bring before the Board, the meeting adjourned at 2:30 o’clock P.M.
