MINUTES OF REGULAR MEETING OF BOARD OF COUNTY COMMISSIONERS

 MONDAY – april 5, 1965

The Board of County Commissioners met in regular session in the Commissioners’ Room in the Courthouse at Tavares on Monday, April 5, 1965, at 10 o’clock A.M. with the following present:  Chairman Livingston, Commrs. Theus, Cowart, Dykes and Babb; Clerk Owens, Engineer Hays and Zoning Director Webb.  Attorney Duncan was in Court.

The meeting was called to order by the Chairman.

Minutes

On motion of Commr. Dykes, seconded by Commr. Cowart and carried, the minutes of the regular meetings of March 1st and March 8th were approved as submitted.

On motion of Commr. Theus, seconded by Commr. Babb and carried, the minutes of the special meetings of March 15th and 19th were approved as submitted.

Bids

It now being the time advertised to receive bids on the addition to the Courthouse Annex, the Chairman directed the Clerk to open the bids and the Architect to tabulate same, whereupon, the Architect reported receiving bids from the following:

E. Cumming Construction Company

Fred Kuhlman, Contractor

A. W. Smith & Son

Thompson Brothers Construction Company

A. B. Williams, General Contractor

On motion of Commr. Dykes, seconded by Commr. Babb and carried, the bids were referred to the Architect for study and recommendation to the Board.

Later in the day the Architect appeared and recommended that the low bid of Fred Kuhlman in the amount of $69,190.00 be accepted.  At this time Mr. Kuhlman’s list of subcontractors was opened and recorded as follows:

Esko Collins, Frank Ramsey, Leesburg Glass & Mirror Corp., Mid Florida Heating & Airconditioning, and Lenhart Electric.

On motion of Commr. Dykes, seconded by Commr. Theus and carried, the low bid as submitted by Fred Kuhlman was accepted.

Bids

It now being the time advertised to receive bids on trucks, the Chairman directed the Clerk to open the bids and the Engineer to tabulate same, whereupon, the Engineer reported receiving bids from the following:

Motion was made by Commr. Theus, seconded by Commr. Cowart and carried, that the bids be referred to the Engineer for study and recommendation to the Board.

Plats

Col. Bill Foster appeared and presented plat of Pine Meadows Country Club Estates owned by Dr. Fred Nelson, said subdivision being located in the City of Eustis.  On motion of Commr. Babb, seconded by Commr. Dykes and carried, the plat was approved provided same is approved by the City of Eustis.

Road closings

On recommendation of the Attorney and on motion of Commr. Dykes, seconded by Commr. Babb and carried, a resolution was adopted amending a resolution adopted on March 1, 1965 closing McDonald Drive in McDonald Terrace to read as follows:

“the title thereto be vested in the adjoining property owners in accordance with law”, be stricken, and that the following be inserted in lieu thereof:  “the title shall revert to the owner or owners thereof as provided by law”.

Public health – right of way – roads

Mr. R. L. Gibson appeared representing the residents of Lake Gertrude Manor and requested permission to install 1,000 gallon water tank owned by the residents on a County right of way.  On motion of Commr. Dykes, seconded by Commr. Cowart and carried, the Board approved the installation of the water tank on the County right of way.

Road maintenance – subdivisions

Mr. R. M. Colteryahn and complained that the pavement of Myrtle Drive in Silver Lake Park is breaking off at the shoulders.  Commr. Babb stated this street was included and paved under the special assessment for Three Lakes Subdivision, however, it was not included in the streets taken over by the County for maintenance.  He further stated he is willing to grade the shoulders but will not resurface the street.

Mr. Funkhouser and a delegation from Milky Way Subdivision appeared objecting to the additional charges to the road surfacing costs on their petition under Special Act 63-1505, as they were not advised at the time the petition was presented to the Board there would be additional costs.  On motion of Commr. Theus, seconded by Commr. Dykes and carried, the Board agreed to omit the additional charges if bids are accepted and the work performed.

Mr. J. C. Schlauder appeared with reference to statement prepared by the Attorney, Tax Collector, Clerk and Engineer which shows reimbursement due him in the amount of $159.74.  Mr. Schlauder objected to this amount and on motion of Commr. Dykes, seconded by Commr. Babb and carried, a resolution was adopted authorizing one-half of $909.74, overage of receipts from paving assessments, be paid to Mr. Schlauder.

Suits affecting county

Mr. J. T. Huff on Cassia appeared and presented letters from Wilson Cypress Company and John B. Fowler with reference to Bear Pen Road and recommending that the road be kept open to the public.  Chairman Livingston reported he had made a personal inspection of this with Commr. Dykes, Engineer Hays, Noel Griffin, and Mr. Huff, and it was the general opinion of everyone on the inspection tour that the road should be kept open until better access is available, whereupon, the Attorney was instructed to defend the County in the suit regarding this matter.

Complaints

Clerk Owens submitted a letter from H. Saunders of Eustis complaining of disposition of County Court case and returning Warrant #444 drawn on the Fine & Forfeiture Fund in the amount of $3.60; whereupon, the Clerk was authorized to cancel said warrant.

Chamber of commerce

On motion of Commr. Theus, seconded by Commr. Dykes and carried, the Clerk was instructed to request financial statement from the Lake County Fair and Flower Show.

Interest

Clerk Owens reported interest earned for the past fiscal year from the Capital Outlay Reserve Fund was $42,423.58 and from the Bond Interest & Sinking Fund $11,254.55.

Zoning

Zoning director Webb filed report from his department for the month of March showing revenue collected $2,272.80.

Mr. Webb reported zoning violator Ross is continuing to increase the junk cars on his property and that Mr. Richardson has stopped building.  The Clerk was instructed to request the Attorney to report at the next meeting on the status of action taken against these offenders.

Mr. Webb advised there will be a meeting in his office on April 14th at 9:30 A.M. with a representative from the Florida Development Commission regarding planning assistance under the 701 Plan.  Chairman Livingston said he will try to attend this meeting and would like any of the other members to be present if possible.

Mr. Webb advised he has received the trainee grant to attend the two weeks health course at the University of Florida from April 19th to the 30th.

Laws & Legislature

The Zoning Director presenting proposed legislation regarding County wide zoning as recommended by the Planning and Zoning Commission.  The attorney was authorized to advertise same, on motion of Commr. Babb, seconded by Commr. Dykes and carried.

On motion of Commr. Dykes, seconded by Commr. Babb and carried, the Board agreed to sponsor a bill regulating child care requirements and the attorney was authorized to advertise same.

Proposed civil defense legislation was submitted and filed.

Recess and reassembly

The Board recessed for lunch at 12 o’clock noon and reconvened at 1:30 o’clock P.M. to take up the remaining items of business.

Attorney Duncan was present until 2:30 P.M.

Soil survey

The Chairman submitted a memorandum from the Soil Conservationist advising a total of 5,685 acres of land were mapped during the month March.

State agencies

Attorney Duncan presented easement between the County and the State for the construction of a boat ramp on Lake George, whereupon, on motion of Commr. Babb, seconded by Commr. Cowart and carried, the Chairman and Clerk were authorized to execute said easement.

On motion of Commr. Dykes, seconded by Commr. Babb and carried, a resolution was adopted requesting the Game & Fresh Water Fish Commission to use Lake Griffin as a pilot lake for the seining of rough fish for experimental purposes.

Attorney Duncan was instructed to write the Department of Public Safety if they are interested in selling the West 200 feet of the property the County deeded to them for the benefit of the Highway Patrol System.

Commr. Theus advised the dedication ceremonies for the Highway Patrol Station north of Fruitland Park will be held April 17th at 2 o’clock P.M.

Roads – state

On motion of Commr. Dykes, seconded by Commr. Babb and carried, a resolution was adopted pledging $50,000 from secondary funds for the widening and resurfacing of SR S-455 from S-561 to SR 50.  This request to replace Secondary Road Request No. 10.

On motion of Commr. Theus, seconded by Commr. Dykes and carried, the Engineer was instructed to inspect the fill being pumped by the road contractor on SR 25 and if adequate that same be diverted to Singletary Park.

Clerk Owens submitted letter from the State Road Department advising that the crossovers on SR 25, Jobs 11040-3502 and 11200-3504, will remain as planned on the construction plans.

The Clerk submitted a letter from the State Road Department regarding the construction of South Street in Leesburg.

Letters from the State Road Department were read and filed advising that bids on the following road projects were received on March 30th:

SR 19-A, Diesem’s Corner; SR S-438 (Old SR 50); SR S-561 Minnehaha Lakeshore Drive; Streets and parking area at Lake-Sumter Junior College; SR S-466 Lady Lake Road.

Inventory

On motion of Commr. Dykes, seconded by Commr. Theus and carried, Autocar Tractor/Truck, County No. 1030, stored at the Minneola Barn was declared junk and Commr. Dykes was authorized to sell same.

On request of the Chairman, Clerk Owens advised we will be in a position to sell the surplus equipment when the inventory clerk completes the inventory.

Bids

On motion of Commr. Cowart, seconded by Commr. Dykes and carried, the Clerk was authorized to advertise for two-way radio communication equipment to be used by road foremen, survey party, engineer and chairman.  Bids to be received May 10th.

On motion of Commr. Babb, seconded by Commr. Dykes and carried, the Clerk was authorized to advertise for two sets of aerial prints to be used by the Engineering Department and Tax Assessor.  Bids to be received May 10th.

On motion of Comm. Theus, seconded by Commr. Babb and carried, the Clerk was authorized to advertise for bids for resurfacing certain roads in districts 4 and 5.  Bids to be received May 3rd.

On recommendation of the Engineer and Dr. Hall and on motion of Commr. Babb, seconded by Commr. Dykes and carried, bids totaling $1,391.92 for office furnishings for the Clermont Health Center and $632.10 for surgical equipment, grand total $2,024.02, were accepted.

deeds

On recommendation of the Engineer and on motion of Commr. Dykes, seconded by Commr. Cowart and carried, deed conveying the following described property to Lake County was accepted and ordered recorded upon the public records:

GRANTOR:   CITY OF EUSTIS

THE EAST 25 FEET OF:  The West ½ of the Northwest ¼ of the Southwest ¼ of Section 14, Township 19 South, Range 26 East;

AND

THE EAST 25 FEET OF:  The North ½ of the Northwest ¼ of the Southwest ¼ of the Southwest ¼ of Section 14, Township 19 South, Range 26 East.

Roads – state

The Chairman instructed the Engineer and Commr. Dykes to discuss with the State Road Department the procedure necessary to obtain survey on future roads in order that the County might acquire the right of way.

Public health

Clerk Owens submitted notice from the Florida Development Commission that final inspection of the Health Center in Clermont will be April 6th at 9:30 A.M.

The Engineer was instructed to clay the parking lot at the Clermont Health Center for the present time.

Road maintenance – subdivisions

On recommendation of the Engineer and on motion of Commr. Dykes, seconded by Commr. Theus and carried, a resolution was adopted accepting Cactus Lane in Golden Heights – 2nd Addition – for maintenance.

Zoning

The Clerk read a letter from the Orange County Commission with reference to a proposed mutual agreement between the two counties regarding developments near county boundaries.  The Clerk was instructed to advise the Orange County Board we are willing to cooperate and would be interested in such an agreement.

Tax assessor

On motion of Commr. Theus, seconded by Commr. Cowart and carried, Certificates of Correction of Errors numbered 160 through 174 as submitted by the Tax Assessor were approved.

Hospitals

On motion of Commr. Theus, seconded by Commr. Dykes and carried, the action of the Chairman and Clerk in approving petitions for admittance to Southwest Florida Tuberculosis Hospital for the following was approved:

Notices from the Tuberculosis Hospital regarding the following were filed:

Florence Louise Washington was discharged with medical advice on March 1, 1965

Charlie Ezephro Walker was discharged with medical advice on March 11, 1965

John Westley Allen was discharged with medical advice on March 16, 1965

Letter was read from E. C. Haynes expressing gratitude for the care given his mother while she was a patient at the Lake Memorial Nursing Home before her death.

Letter from Mary Hamner, Director of the Lake Memorial Nursing Home, was read expressing appreciation of the residents of the Home for the color television set.

State road department

On motion of Commr. Babb, seconded by Commr. Dykes and carried, a resolution was adopted requesting the State Road Department to pay from bond funds bills amounting to $3,062.10 for expenses incurred by the City of Umatilla in obtaining right of way from Atlantic Coast Line Railroad for State Road 19.

Bonds – miscellaneous

Deputy Sheriff bond for Enith M. Turner was approved on motion of Commr. Cowart, seconded by Commr. Theus and carried.

Schools – miscellaneous

Admission to the Deaf and Dumb School at St. Augustine for Timmy Lee Rakes was approved on motion of Commr. Theus, seconded by Commr. Cowart and carried.

Permits – use

The following use permits were filed by the Engineer:

To Sumter Electric Coop., Inc. for construction and maintenance of distribution line on County Road 2-1317 between Road 2-1213 and SR 33.

To Fla. Telephone Corp. for construction and maintenance of buried cable along County Road 2-3131 south of Yalaha.  L.C. Permit #35.

To Fla. Telephone Corp. for construction and maintenance of buried cable along County Road 4-4581.  L.C. Permit #34.

Courthouse

The Clerk was instructed to notify the Architect to get quotation for handrails to be installed between the 3rd and 4th floors of the Courthouse and between the 4th and 5th.

On motion of Commr. Theus, seconded by Commr. Babb and carried, the Clerk was instructed to contact Dr. Paul Williams regarding student at the Junior College acting as a watchman in the Courthouse after six o’clock P.M. in order to allow the Attorneys to have access to the Law Library.

On motion of Commr. Dykes, seconded by Commr. Babb and carried, the quotations were referred to the Architect for study and recommendation to the Board.

Salaries & wages

On recommendation of the County Agent and on motion of Commr. Cowart, seconded by Commr. Dykes and carried, the Board approved the employment of Nancy Cabe Folsom as Assistant Home Demonstration Agent effective August 1, 1965 at an annual salary of $2640 and annual expenses of $900.

On motion of Commr. Babb, seconded by Commr. Cowart and carried, the Engineer was authorized to employ a Clerk-Typist at a salary of $250.00 per month.

On recommendation of Dr. Hall and on motion of Commr. Dykes, seconded by Commr. Babb and carried, the Board approved an increase in salary of $20.00 per month effective March 1, 1965 for James Paul Milton, Director Mosquito Control.

Funds – transfers

On motion of Commr. Babb, seconded by Commr. Theus and carried, the Clerk was authorized to transfer $1,500 from Item 676-10 Planning Expense in General Fund to Item #411-1 – Clerk Engineering Department.

On motion of Commr. Cowart, seconded by Commr. Dykes and carried, the Clerk was authorized to transfer $2,500 from Reserve for Contingency in General Fund to Item #262-2 Legal Expense.

Accounts allowed

On motion of Commr. Dykes, seconded by Commr. Babb and carried, a resolution was adopted to pay Attorney Neal Huebsch $1,250.00 per month to assist the legislative delegation during the 1965 session.

On motion of Commr. Dykes, seconded by Commr. Babb and carried, the Board approved $29.96 expenses for 4-H Boys and Girls to attend District Events Day in Gainesville on April 9th and 10th.

Request of Engineer for expenses for attending meeting in Tampa on March 19th was approved on motion of Commr. Dykes, seconded by Commr. Babb, and carried.

On motion of Commr. Cowart, seconded by Commr. Dykes and carried, the Engineer was authorized to apply for gasoline credit cards from other oil companies.

Request of the Small Claims Court to purchase 5-drawer file cabinet from Leesburg Typewriter Service in the amount of $133.88 was approved on motion of Commr. Theus, seconded by Commr. Cowart and carried.

Request for advance on commissions from the Tax Assessor in the amount of $15,000 was approved on motion of Commr. Cowart, seconded by Commr. Theus and carried.

Expenses of W. T. Mills and Louise R. Shay were approved on motion of Commr. Babb, seconded by Commr. Dykes, to attend Juvenile Counselors Workshop in Wakulla Springs on April 21st – 23rd.

Request from Assistant Service Officer to attend Annual Conference in Winter Park on May 3 through 8th was approved on motion on Commr. Dykes, seconded by Commr. Babb and carried.

On motion of Commr. Cowart, seconded by Commr. Theus and carried, the Clerk was authorized to issue warrant in the amount of $2,000 to Connecticut Mutual Life Insurance Company for the purchase of approximately four acres of land from Phillip Berkovitz to be used as a clay pit for District #2; also, warrant for $50.00 to W. T. Cox for securing partial release of mortgage on said property.

On motion of Commr. Dykes, seconded by Commr. Babb and carried, the payrolls for the month of March were approved.

Checks received

Check in the amount of $1,000 from the City of Eustis reimbursement for road materials for paving Kurt Avenue was accepted on motion of Commr. Babb, seconded by Commr. Cowart, and the Clerk was authorized to deposit same to the Road and Bridge Fund.

Check in the amount of $40.53 from Mrs. Ruth Tanner reimbursement for pipe was accepted on motion of Commr. Babb, seconded by Commr. Dykes, and the Clerk was authorized to deposit same to the Road and Bridge Fund.

Communications

Letter from Karl Lehman regarding Lake County Fair and Flower Show was filed.

Letter from Central Florida Fair regarding Lake County’s outstanding exhibit was read and filed.

Letter from Mount Dora Chamber of Commerce expressing thanks for the action taken with reference to preserving the scenic beauty of Dora Canal was read and filed.

Letter from Gordon W. Folke, Florida State Board of Health, to C. A. Peterson, Inc. regarding Springs Bath & Yacht Club was read and filed.

Letter from Florida State Board of Health to A. E. O’Neall Associates, Inc. regarding City of Umatilla sewage collection system extension was filed.

Minutes of meeting of E. Central Florida Regional Planning Council held on February 10th were filed and copy distributed to each member.
