MINUTES OF REGULAR MEETING OF BOARD OF COUNTY COMMISSIONERS

 MONDAY – January 10, 1966

The Board County Commissioners met in regular session in the Commissioners’ Room in the Courthouse at Tavares on Monday, January 10, 1966, at 10:00 o’clock A.M. with the following present:  Vice Chairman Cowart, Commrs. Dykes, Livingston and Babb; Clerk Owens, Attorney Christopher Ford representing C. E. Duncan, Engineer Hays and Zoning Director Webb.

The meeting was called to order by the Vice Chairman and the invocation was given by Mr. Hays.

Chairman Theus was present before the first transaction of business was completed.

bids

It now being the time advertised to receive bids for construction of addition to the Lake Memorial Nursing Home and dishwashing machine for the Home, the Chairman directed the Clerk to open the bids and the Architect to tabulate same; whereupon, the Architect reported receiving bids from the following:

Coven Construction Company

Fred Kuhlman, Inc.

Barnes Restaurant Supply Co., Inc.

Turner-Haack Company, Inc.

Schatz Kitchen Equipment of Florida, Inc.

 

On motion of Commr. Dykes seconded by Commr. Livingston and carried, the bids were referred to the Architect for study and recommendation to the Board.

Later in the day the Architect reported the bid of Barnes Restaurant Supply Company, Inc. covers the alternate equipment requested in Addenda No. 1 and recommended that bid of Schatz Kitchen Equipment of Florida, Inc. be accepted on the dishwashing machine and bid of Coven Construction Company on the addition.  Motion was made by Commr. Babb seconded by Commr. Dykes and carried that bids as recommended by the Architect be accepted.

It now being the time advertised to receive bids for the construction of a kitchen to the Juvenile Shelter, the Chairman directed the Clerk to open the bids and the Architect to tabulate same, whereupon, the Architect reported receiving bid from Fred Kuhlman, Inc. in the amount of $10,406.00.

On motion of Commr. Dykes seconded by Commr. Livingston and carried, action on the bid was deferred and the Clerk was instructed to determine the amount budgeted for this construction.

Later in the day Mr. Hopson and Dr. Klar appeared and recommended the bid be rejected and readvertise; whereupon, on motion of Commr. Dykes seconded by Commr. Babb and carried, the bid from Fred Kuhlman, Inc. was rejected and the Clerk was authorized to readvertise for bids to be received on February 14, 1966.

It now being the time advertised to receive bids on one 1966 truck, the Chairman directed the Clerk to open the bids and the Engineer to tabulate same, whereupon, the Engineer reported receiving bids from the following:

Joe Creamons Chevrolet, Inc.

Eustis Dodge, Inc.

Eustis Motor Company

Jungle Auto Service

 

On motion of Commr. Livingston seconded by Commr. Babb and carried, the bids were referred to the Engineer for study and recommendation to the Board.

Later in the day, on recommendation of the Engineer and on motion of Commr. Cowart seconded by Commr. Babb and carried, the low bid of Joe Creamons Chevrolet, Inc. in the amount of $2,282.70 was accepted.

On recommendation of the Engineer and on motion of Commr. Dykes seconded by Commr. Babb and carried, all bids on metal pipe received January 3, 1966 were rejected and the Clerk was authorized to readvertise for bids to be received February 7, 1966.

On recommendation of the Engineer and on motion of Commr. Dykes seconded by Commr. Babb and carried, bids as follows were awarded on furnishings and equipment for the Engineering & Zoning Building:

On motion of Commr. Cowart seconded by Commr. Dykes and carried, the Clerk was authorized to advertise for bids for one Caterpillar Front End Loader to be received February 7, 1966.

On motion by Commr. Cowart seconded by Commr. Babb and carried, the following changes were made to the present indigent list:

District No.  1-            No change

District No.  2 -           REDUCE Mrs. Annie Bell Morris from $37.00 to $10.00

roads – state

On recommendation of the Lake County Safety Council and on motion of Commr. Babb seconded by Commr. Dykes and carried, a Resolution was adopted requesting the State Road Department to make a survey of recommended changes on certain roads as safety measures, as follows:

1.      Additional signs needed at entrance to the Citrus Tower on State Road 25.

2.      Acceleration and deceleration lanes at entrances to the Lake-Sumter Community College.

3.      Cross-over on State Road 500 at entrance to Dora Canal Marina.

On recommendation of the Engineer and on motion of Commr. Babb seconded by Commr. Dykes and carried, a Resolution was adopted authorizing the return of the following described properties, acquired several years ago, to the owners in exchange for the necessary rights of way in order to establish correct road right of way:  SEE PAGE 436-437 FOR DESCRIPTIONS

Sheriff McCall appeared and reported the Sawgrass Road barricade has again been removed and requested the parties responsible be notified that legal action will be taken if the barricade is erected again.  On motion of Commr. Babb seconded by Commr. Dykes and carried, this matter was referred to the Attorney.

On recommendation of the Right of Way Agent and on motion of Commr. Babb seconded by Commr. Dykes and carried, the Board agreed to rebuild or erect fence on land donated for road right of way provided the fence was already in existence or necessary.

Commr. Livingston advised the City of Eustis has agreed to pay one-half or up to $2300.00 for resurfacing the streets adjacent to the Fair Grounds in Eustis.  The Engineer was instructed to secure this commitment in writing.  Bids for the resurfacing will be received on February 14.

CONDEMNATION proceedings

A discussion was held regarding the County filing condemnation proceedings for rights of way when there are only one or two property owners who refuse to donate the right of way, whereupon, on motion of Commr. Livingston, seconded by Commr. Babb and carried, this matter was referred to the Attorney for his recommendations.

bonds – misc.

On motion of Commr. Livingston seconded by Commr. Dykes and carried, Emery Dillard, Right of Way Agent, was authorized to apply for Notary Public Bond and the Board will pay costs of same.

county employees

Dr. Klar appeared and advised effective January 1, 1966 Mr. and Mrs. Albert Alton are the Assistant Superintendent and Assistant Matron at the Juvenile Shelter.

Dr. Klar discussed additional relief for the Superintendent and Matron of the Juvenile Shelter and requested that the Assistant Superintendent and Matron be allowed to work an extra one-half day per week in order to allow Mr. and Mrs. Polhamus additional time off.  On motion of Commr. Dykes seconded by Commr. Babb and carried, the Board agreed to allow the Superintendent and Matron the additional time off and pay Mr. and Mrs. Alton an extra one-half day per week based on the rate of $12.50 per day, effective today.

Dr. Klar further advised when the kitchen for the Juvenile Shelter is completed and equipped, the Assistant Superintendent and Matron will be the chefs.

civil defense

The Civil Defense Director appeared with reference to the Board considering making Medical Self-Help Training available and mandatory to County employees.  Mr. Hess advised his office is set up to give the necessary training, can hold staggered classes to be held during the working hours.  The eleven lessons can be reduced to seven sessions of two hours each.  Action was deferred for consideration.  Communication regarding this from the Department of Health, Education and Welfare was filed.

On motion of Commr. Dykes seconded by Commr. Livingston and carried, the application of Terry Arndera Martin was approved to the Florida School for the Deaf and Blind at St. Augustine.

recess and reassembly

The Board recessed for lunch at twelve o’clock noon and reconvened at 1:30 o’clock P.M. to take up the remaining items of business.

roads – state

Dr. Louis R. Bowen and seven interested parties appeared with reference to the road survey being made by the State Road Department as requested in Resolution adopted by the Board on November 8, 1965, east of Umatilla.  Dr. Bowen said if the proposed route is followed there will be extensive damage to his pasture land.

On motion of Commr. Babb seconded by Commr. Dykes and carried, the Clerk was directed to contact the State Road Department in Deland and request that work cease on this road survey until further notified.  Commr. Babb and interested parties to go to Deland and consult with the State Road Department engineers regarding another route for the road.

zoning

On recommendation of the Planning and Zoning Commission and on motion of Commr. Cowart seconded by Commr. Dykes and carried, a Resolution was adopted amending the Zoning Rules and Regulations as they pertain to the following described properties, to the classifications designated after each description:

1.      The NE ¼ of the SW ¼; and the W ½ of the NW ¼ of the SE ¼ in Section 14, Township 18 South of Range 24 East, in Lake County, Florida. 

Now classified and zoned as R-1-A (Residential), be, and the same is hereby amended, changed and re-zoned to Classification A (Agriculture).

2.      Begin 135 feet West of the Northeast corner of the NW ¼ of the NE ¼ of Section 28, Township 19 South of Range 24 East, in Lake County, Florida, run thence West 721 feet, thence South to the North line of the right of way of public highway, thence easterly along the North boundary of said highway 721 feet more or less, to a point directly South of the point of beginning, thence North to the point of beginning, LESS any right of way for public highway along the North side. 

Now classified and zoned as R-1 (Residential), be, and the same is hereby amended, changed and re-zoned to Classification C-1 (Commercial).

3.      Begin 200 feet North on the West line of the W ¼ corner of Section 23, Township 19 South of Range 25 East, run East 100 feet, South 200 feet, East 393 feet, North 6°29’ East to South right of way of State Road 500, Northwesterly along Southerly right of way of State Road 500 to West line of said section, South to point of beginning. 

Now classified and zoned as R-1-A (Residential), be, and the same is hereby amended, changed and re-zoned to Classification C-2 (Commercial).

4.      The North 367.5 feet of East 210 feet of W ½ of NE ¼ of NW ¼ of NW ¼ in Section 21, Township 19 South of Range 24 East, in Lake County, Florida.

Now classified and zoned as R-2 (Residential), be, and the same is hereby amended, changed and re-zoned to Classification C-2 (Commercial).

5.      Begin on the East line of Government Lot 7 and the South line of the ACL Railroad right of way, in Section 26, Township 19 South of Range 26 East, run South 250 feet, thence West 450 feet, thence North to the South right of way line of the ACL Railroad, thence Easterly along the Railroad right of way to the point of beginning. 

Now classified and zoned as R-1-A and C-3 (Residential and Commercial), be, and the same is hereby amended, changed and re-zoned to Classification C-3 (Commercial).

On motion of Commr. Cowart seconded by Commr. Babb and carried, action of the Chairman and Clerk was approved in approving applications to the Southwest Florida Tuberculosis Hospital for the following:

The Board authorized the Nursing Home Director to gather information on a hoist for ambulatory patients and report to the Board.

contracts and agreements

On motion of Commr. Dykes seconded by Commr. Babb and carried, the Chairman and clerk were authorized to execute contract with a five year option for storing and transporting voting machines.

roads – state

Clerk Owens submitted letter from the State Road Department regarding speed zone study on State Road 19A, Section 11050, South of Eustis, advising they do not recommend a change in the existing speed limit.

The Clerk presented letter from the State Road Department advising that bids will be received in Tallahassee on January 27, 1966 on Job Nos. 11650-3604 and 11650-3602, State Rod S-468 and State Road 44 South and East to State Road 25 in Leesburg (South Street).

licenses & permits – use

The Right of Way Agent filed the following Use Permits:

No. 51 to Florida Telephone Corp. for the construction and maintenance of buried cable paralleling and crossing a portion of County Road 3-2954.

No. 52 to Florida Telephone Corp. for the construction and maintenance of buried cable paralleling County Road 3-2854.

county property

The Clerk presented letter from the Division of Plant Industry advising that the burrowing nematode was not found in samples collected from the Lone Pine Clay Pit.

reports – official

Report of Receipts, Expenses and Net Income for the year ending December 31, 1965 by the Clerk of Circuit Court was filed and check in the amount of $6,531.01 was attached thereto and ordered deposited.

minutes

On motion of Commr. Dykes seconded by Commr. Livingston and carried, the minutes of the regular meetings held on December 6 and December 13, 1965 were approved as submitted.

accounts allowed

Change Order No. 1 to the contract on the Engineering and Zoning Building in the amount of $286.00 covering changes to electrical work and moving exterior wall in equipment room was approved on motion by Commr. Dykes seconded by Commr. Cowart and carried.

On motion of Commr. Dykes seconded by Commr. Cowart and carried, the Board authorized reimbursement to the Clerk of Circuit Court for salary of indexing clerk in the amount of $300.00 from General Revenue Fund.

On motion of Commr. Dykes, seconded by Commr. Livingston and carried, expenses of Doris Babb to attend County Finance Officers and Directors meeting in Daytona Beach on January 28 and 29 were approved.

Expenses of Clerk Owens and Deputy Clerk Norma Coven to attend Election Workshop in Tallahassee January 18 – 20 were approved on motion of Commr. Cowart seconded by Commr. Livingston and carried.

Request of Fred Kuhlman, Contractor, on the Engineering and Zoning Building in the amount of $17,028.00 was approved on motion of Commr. Livingston seconded by Commr. Babb and carried.

Supervision fee in the amount of $300.00 from Jack Jones, Architect, for professional services on the Engineering and Zoning Building was approved on motion of Commr. Babb seconded by Commr. Dykes and carried.

Request of the Tax Assessor for $15,000 advance on commissions on 1965 tax roll was approved on motion of Commr. Dykes seconded by Commr. Babb and carried.

On motion of Commr. Cowart seconded by Commr. Livingston and carried, request of the Tax Collector for commission on remittances of 1965 tax roll in the amount of $35,239.35 was approved.

On recommendation of the Architect and on motion of Commr. Dykes seconded by Commr. Livingston and carried, the Engineer was authorized to secure prices on a reverse cycle air conditioner for the Sign Shop.

Letter from the State Board of Health regarding sanitary sewers to serve the Northwest portion of Leesburg was read and filed.  Copy furnished the Zoning Director.

Notice was filed from the Director of Revenue, State of Florida, regarding advantages and disadvantages to Florida by the Interstate Taxation Act.
