MINUTES OF REGULAR MEETING OF BOARD OF COUNTY COMMISSIONERS
tuesday – september 5, 1967
The Lake County Board of County Commissioners of Lake County, Florida, met in regular session in the Commissioners’ Room in the Courthouse in Tavares on Tuesday, September 5, 1967 at 10:00 a.m. with the following members present: Chairman Dykes, Commrs. Theus, Cowart and Livingston. Others present were Clerk Owens, Attorney C. C. Ford of Duncan and Ford, County Engineer Gordon Hays, Zoning Director Robert S. Webb, and Deputy Clerk Norma Coven. Commr. Babb was on vacation.
The meeting was called to order by the Chairman and the invocation was given by Mr. Hays.
bids
It now being the time advertised to receive bids on the following items, the Chairman directed the Clerk to open the bids and the Engineer to tabulate same, whereupon, the following bids were received:

On motion of Commr. Theus, seconded by Commr. Livingston and carried, the bid was referred to the County Engineer for study and recommendation to the Board.
There being no interested parties present concerning the following bids, the Board waived the reading of the bids, and the Engineer announced the names of the vendors bidding:

On motion of Commr. Theus, seconded by Commr. Cowart and carried, the bids were referred to the County Engineer for study and recommendation to the Board.
Right of way – roads
Mr. Warren Peake of Eustis Heights appeared with reference to a previous request to have trees removed from the right of way of N. Palmetto Circle. The Clerk presented minutes of the May 1, 1967 meeting regarding the Board’s action. B. E. Dillard, Jr. was present and objected to the removal of the trees. Chairman Dykes directed the Engineer and Commr. Livingston to visit this location with Mr. Peake and Mr. Dillard and attempt to work out a solution for a 30’ right of way.
Right of way easements – except roads
Engineer Hays submitted a letter from Senator O’Grady relative to the Seaboard Coast Line Railroad dedicating the railroad right of way from Leesburg to Fort Mason to the public to be used as a bridle path. The Attorney was instructed to inquire of the railroad company if they will consider this request.
Safety council
W. H. Reedy appeared and presented summary of traffic laws passed by the Legislature. Mr. Reedy advised Major Carl Admas of the Florida Highway Patrol will appear before the Board, at the Board’s request, and review the new rules and regulations pertaining to traffic safety and semi-annual inspection of motor vehicles. He stated the Florida Development Commission will furnish the money for the examining stations or the county may handle this on a lease basis. He reminded the Board, the counties have until January 1, 1968 to decide how the inspection will be handled.
Building department
Clarence McCauslin, Building Administrator, appeared and submitted for the Board’s approval bond form that will be required for Certificates of Competency from contractors. Attorney Ford advised the form is satisfactory.
County employees
On motion of Commr. Cowart, seconded by Commr. Theus and carried, Mr. McCauslin was authorized to employ a building inspector effective September 15, 1967.
Clerk Owens presented resignation of Mr. and Mrs. Polhamus, Superintendent and Matron of the Juvenile Shelter effective August 31, 1967, and same was accepted by the Board.
On recommendation of Judge Milton and on motion of Commr. Cowart, seconded by Commr. Livingston and carried, Emmett Stephen Lane and Hilda Elaine Lane were approved for the position of Assistant Superintendent and Assistant Matron of the Juvenile Shelter, effective September 16, 1967 at the salary scale in the budget.
On recommendation of Judge Milton and on motion of Commr. Livingston, seconded by Commr. Cowart and carried, the Board authorized thee (3) days’ vacation pay and two weeks’ severance pay for Mr. and Mrs. Harwood, Assistant Superintendent and Assistant Matron of the Juvenile Shelter.
Recess and reassembly
The Board recessed for lunch at twelve o’clock noon and reconvened at 1:15 o’clock P.M. to take up the remaining items of business.
Roads – county
Engineer Hays advised property owners on Cashwell Road Extension, County Road 3-1038 and 3-1039 between Lake Minnehaha and Lake Shore West to intersect SR 561, will donate right of way and pay cost of resurfacing the road. He was instructed to add this construction to the present list of roads to be improved.
On motion of Commr. Cowart, seconded by Commr. Livingston and carried, the Engineer was instructed to add Rester Road, County #2-1313 and Edgewood boys Ranch Road, County #2-0822, to the present county road system.
The Engineer was instructed not to assign county road number to Gregory Road and Moody Road, and Vicker Smith Road from SR 466-A to Spring Lake.
The Engineer presented requests from the City of Eustis to resurface Lindale Avenue in a joint venture with the County’s share not to exceed $200.00 and that the County consider resurfacing the remaining portion of Seminole and Charlotte Avenues to Kurt Street. On motion of Commr. Theus, seconded by Commr. Livingston and carried, the Board agreed to resurface the portion of Lindale Avenue lying within the County, with the cost not to exceed $200.00, and that consideration will be given to Seminole and Charlotte Avenues when Kurt Street is completed.
Roads – state
The Clerk presented right of way map and request for title search from the State Road Department on Job 11210-2501, SR 530. Motion was made by Commr. Cowart, seconded by Commr. Livingston and carried that Lake Abstract & Guaranty Company prepare the search.
Railroads
The Engineer filed letter from the Seaboard Coast Line Railroad Company advising the County’s request for a public crossing at a point 303 feet West of Mile Post SR 811 near Okahumpka is being investigated.
State road department
On recommendation of the Engineer and on motion of Commr. Theus, seconded by Commr. Livingston and carried, the Board adopted a resolution relative to the county acquiring title to clay pits used during the construction of primary or secondary roads, and that when possible during acquisition of rights of way, the fee simple title be taken to the clay pits in the name of Lake County, subject to the acknowledged right of the State Road Department to use such sand clay pits or borrow pits during the construction of the roads being constructed.
County policy
On recommendation of the Engineer and on motion of Commr. Livingston, seconded by Commr. Theus and carried, section VII-B of County Road Policies was deleted and Sections VII-B1 and VII-B2 were added.

On motion of Commr. Theus, seconded by Commr. Livingston and carried, deeds conveying the following described rights of way to Lake County were accepted and ordered recorded upon the public records:

On motion of Commr. Cowart, seconded by Commr. Theus and carried, the bids were referred to the Engineer for study and recommendation to the Board.
Salaries and wages
On recommendation of the Engineer and on motion of Commr. Livingston, seconded by Commr. Theus and carried, the Road and Bridge Department personnel will be paid on a monthly basis effective October 1, 1967.
Insurance
Engineer Hays reported he has outlined a group life insurance program to the Road and Bridge employees and find that the majority are interested in hospitalization rather than life. He was instructed to pursue an insurance program embracing both hospitalization and life coverage.
Clerk Owens advised the Legislature passed a new law whereby the County must provide $10,000. occupational death or bodily injury coverage on law enforcement officers. The Attorney was directed to review the law and advise the Board regarding the new law.
The Clerk advised the fleet liability, hospital liability, and fire on county buildings, will expire on November 1, 1967, whereupon, on motion of Commr. Livingston, seconded by Commr. Cowart and carried, the Clerk was instructed to advertise bids for October 9, 1967.
Inventory
On motion of Commr. Livingston, seconded by Commr. Theus and carried, the Board declared the following county equipment to be surplus and obsolete and of no value:
County Property Nos. 265, 303, 399, 3992 and 242.
Clerk Owens submitted offer from Zeller-O’Neal, Inc. of $500.00 for used microfilm processing machine, Property No. 2577, that is no longer used by the Clerk’s office. Motion was made by Commr. Theus declaring the machine surplus property and instructing the Clerk to accept the best offer for the machine. The motion was seconded by Commr. Livingston and unanimously carried.
Municipal corporations
Engineer Hays reported the City of Eustis is requesting that the damage to Center Street caused by Grove Street being closed during the Fair be repaired. Commr. Livingston stated the street was in poor condition before the traffic was rerouted. No action by the Board.
Outdoor recreational facilities
Clerk Owens presented letter from ben S. Burton requesting an expression from the Board relative to the preservation and conservation of Emeralda Marsh. On motion of Commr. Livingston, seconded by Commr. Cowart and carried, a resolution was adopted urging that Emeralda Marsh be preserved in its natural state for public recreation and/or waterfowl refuge and water conservation.
Budget
Clerk Owens presented budget for the year ending September 30, 1968 which has been returned and approved as to form by the Comptroller, said budget being as follows:

County property
On motion of Commr. Theus, seconded by Commr. Cowart and carried, the Chairman and Clerk were authorized to execute deed conveying the following described property in Eustis (Old Fairgrounds) to Leslie R. Huffstetler, Sr. and Harry E. Gaylord, upon receipt of Escrow Agreement.

County buildings
Clerk Owens presented letter from the Veterans Service Officer for office space in the Health Department Building when new building is constructed. Clerk Owens requested the Board to consider using the building for storage of old tax rolls and records. Action was deferred on the requests pending completion of land acquisition and building plans.
Clerk Owens submitted letter from the Department of the Army, Office of Civil Defense, with reference to design techniques to incorporate fallout protection in the construction of future county buildings. The letter was referred to the Architect on the Health department Building.
Road closings
Petition to close portions of platted streets in Craig’s Addition to Sorrento signed by E. C. Aulls, Jr. for Jos. E. Johnston was referred to the County Engineer.
Public health
The Clerk submitted request from Dr. Hall that the Board implement the law by resolution to establish fees for the issuance of health certificates, and same was referred to the Attorney.
Use permits
Use Permits to Florida Gas Company for the construction and maintenance of gas main along County Roads 4-5154 and 4-5156 between Eustis and Tavares were filed.
Equalization board
Letters from E. C. Wrenn requesting reconsideration of assessment were read and filed.
Complaints
Letter from Nichols J. Morohovich relative to zoning restrictions in the Ocala National Forest was referred to the Zoning Director.
Correspondence between Mrs. Kate Furr and the County Engineer relative to a road in Hubbard Subdivision was read and filed. The Engineer also advised since writing to Mrs. Furr she has been in the office and has been personally advised that the road is not a county maintained road and further advising her that the road can be repaired under Chapter 63-1505.
Bonds – misc.

Opinions – legal
Clerk Owens presented opinion from the Attorney General relative to additional compensation for Public Defender defending juveniles and same was referred to the Attorney.
The Clerk advised the elected County Prosecutor resigned and the County Judge issued an order appointment L. R. Huffstetler, Jr. temporary prosecuting attorney. Opinion of the County Attorney that the County Judge is authorized to appoint a temporary prosecuting attorney was read and filed.
Suits affecting county
Motion in suit filed in U.S. District Court was referred to the Attorney.
Hospitals
Notices from the State Tuberculosis Hospitals were filed as follows:
Margaret Borgard discharged with medical advice on August 23, 1967
Viola Cordia Stephens discharged with medical advice on August 31, 1967
Accounts allowed
On motion of Commr. Theus, seconded by Commr. Cowart and carried, Emery Dillard, Right of Way Agent, was authorized to attend American Right of Way Assn. meeting in Jacksonville on September 13-15.
Expenses of J. C. Bryant were approved to attend meeting in St. Petersburg on September 8, on motion of Commr. Theus, seconded by Commr. Cowart and carried.
On motion of Commr. Theus, seconded by Commr. Livingston and carried, the Clerk was authorized to pay the interest and principal on certificates of indebtedness.
On motion of Commr. Livingston, seconded by Commr. Theus and carried, the action of the Clerk was approved in having Whitford Appliances install air conditioner in the Highway Patrol Office in the Pioneer Building at a cost of $274.00 plus installation of approximately $35.00.
Request from R. S. Webb for car expense to attend Technical Committee on Lake Apopka in Jacksonville on August 24, 1967 was approved on motion of Commr. Cowart, seconded by Commr. Theus and carried.
Request from Earl Kelly, Agricultural Agent, to attend National Assn. of County Agricultural Agents meeting in Omaha, Nebraska on September 14-21, was approved on motion of Commr. Livingston, seconded by Commr. Theus and carried.
On motion of Commr. Theus, seconded by Commr. Livingston and carried, payrolls for the month of August were approved.
communications
Questionnaire from Florida Mobile Homes Assn. regarding the Board requiring mobile homes and travel trailers to be tied down was not considered.
Reports
Annual report of Lake-Seminole County Forestry Project as prepared by the Farm Forester Terrell Davis was filed and copy distributed to each Board member.
Report of Financing of Florida Highways and Traffic Related Activities for 1965 prepared by the State Road department and bureau of Public Roads was referred to the Engineer.
