MINUTES OF REGULAR MEETING OF BOARD OF COUNTY COMMISSIONERS

 MONDAY – April 8, 1968

A regular meeting of the Board of County Commissioners of Lake County, Florida, was held in the Commissioners’ Room in the Courthouse, in Tavares, at 10:00 o’clock A.M. Monday, April 8, 1968, with the following members present: Commr. H. A. Babb, Chairman; Commrs. Theus, Cowart, Dykes and Windram.  Also present were, Clerk Owens, Engineer Hays, Planning & Zoning Director Webb and Deputy Clerk Norma Coven.

The meeting was called to order by the Chairman and the invocation was given by the Reverend James H. Goss, Pastor of Gloria Dei Lutheran Church, Leesburg, Florida.

Indigents

On motion of Commissioner Windram, seconded by Commissioner Dykes and carried, the following change was made to the present indigent list:

                        Dist. #4 – ADD Shepherd Chambers $7.72

Road maintenance

Leo J. Paul appeared and presented petition signed by 28 property owners requesting regular maintenance to the access road into River Road Acres, which is approximately 2.5 miles west of the junction of SR 42 and SR 44 near Crow’s Bluff.  The matter was referred to the Engineer.

Bill Clements was present and asked if the Fair Committee should continue to function in view of recent inspections by the Board members.  Chairman Babb stated the Architect has not been notified to make any changes in the proposed plans.

pollution

C. W. Sheffield, Chairman of the Governor’s technical for the Restoration of Lake Apopka was present and advised the Orange County Committee is now taking samples from all the lakes in the Oklawaha basin, and have applied for a federal grant to assist with the survey.  Attorney Duncan advised in view of the opinion from the Attorney general, Lake County will need itemized bills from the Committee before reimbursing Orange County for a share of expenses.  Also, Lake County will require copy of all information and data derived from the survey for future reference.  The Planning & Zoning Director requested that maps be made available showing where the samples are taken. 

On motion of Commissioner Dykes, seconded by Commissioner Cowart and carried, the Board adopted a resolution that Lake County will cooperate and negotiate with Orange County for the purpose of determining the best procedures for finding solutions to the water pollution problem and for the sharing of salaries, costs and fees required for such purpose.

Frank Bouis of the Lake County Farm bureau appeared and presented the names of William H. West and Guilford Sims as members of the Water Pollution Control board.  On motion of Commissioner Theus, seconded by Commissioner Dykes and carried, April 15, 1968 was established as the last day for the Board to receive applications from prospective members to serve on the Pollution Control Board. 

Development commission

George Daugherty, Al Rehbaum and Rick Kurfiss representing the Lake County Development Commission appeared and presented written report of the activities and accomplishments of the Commission.

On recommendation of the Engineer and on motion of Commissioner Dykes, seconded by Commissioner Theus and carried, deed and easements conveying the following described lands to Lake County were accepted and ordered recorded upon the public records:

Outdoor recreational facilities

On motion of Commissioner Cowart, seconded by Commissioner Theus and carried, a resolution was adopted prohibiting over-night camping on the parking area and rights of way at and near the boat ramp on Lake George.

County property

On recommendation of the Attorney and on motion of Commissioner Dykes, seconded by Commissioner Theus and carried, a resolution was adopted authorizing quit-claim deed to Green Thumb Garden Center, Inc. releasing any claims upon the following described property and to remove cloud upon the title because of foreclosure proceedings instituted by Lake County in the year 1945:

Lots 5 and 6, block B, according to the Plat of Alta vista, recorded in Plat Book 2, Page 14, public records of Lake County, Florida.

Elections – primary

Clerk Owens submitted copy of letter to the Supervisor of Elections together with list of candidates of the Democratic and Republican Parties who are without opposition in the Primary election of May 7, 1968.

BONds – misc.

Contractors’ bonds for certificates of competency numbered 312-332 and reinstatement of bond number 234 were approved on motion of Commissioner Dykes, seconded by Commissioner Theus and carried.

Bond for carrying firearms for C. H. Borneman was approved on motion of Commissioner Cowart, seconded by Commissioner Theus and carried.

Clerk Owens presented notice from the lake County Coast Guard Auxiliary that the Safe Boating Course has been postponed to being on April 22 through May 16, twice weekly, and asked for the use of the Commissioners Room.  Commissioner Dykes moved that the request be granted.  The motion was seconded by Commissioner Cowart and carried.

Road closings

It now being the time advertised to hold a public hearing to consider petition to close a portion of Canal Street in Stone Mountain Estates, and no one appearing to object to the closing, a motion was made by Commissioner Cowart, seconded by Commissioner Theus and carried, adopting a resolution to close the following described street:

Commence at the SE corner of the NE¼ of the NE¼ of Sec. 18, Tp. 20 S., range 25 E; thence run S 89°50’50” W 50 feet to the POB; thence run N 0°49’10” W 849.30 feet to the start of a curve to the left (concave to the SW) having a radius of 50 feet and an external angle of 90°34’30” thence run NW’ly along said curve, a distance of 78.04 feet; thence run S 89°45’20” W 10 feet to the start of a curve, concave to the SW, having a radius of 50 feet and an external angle of 90°34’30”; thence run SE’ly along said curve, a distance of 78.04 feet; thence run S 0°49’10” E 899.30 feet; thence run N 89°50’50” E 10 feet; thence run N 0°49’10” W 50 feet to the POB.

Courthouse

On motion of Commissioner Dykes, seconded by Commissioner Windram and carried, Bernie Sturtz was authorized to place a rack for the Florida Times Union Newspaper in the Courthouse Lobby.

State road department

Clerk Owens submitted letter from the State Road department advising that funds are not available to surface the parking area at Lake Eustis Park.  They will, however, perform any necessary maintenance on the existing parking area.

Roads – state

On request of the State Road Department and on motion of Commissioner Cowart, seconded by Commissioner Dykes and carried, a resolution was adopted authorizing the relocation of a telephone cable on SR S-474, Section 11518-6601, and approving payment on an actual cost basis from secondary funds accrued to Lake County.

Licenses & Permits

            The following Use Permits were filed by the Engineer:

To Donald J. Barton to push an irrigation pipe and electrical conduit under County Rd. 3-4265 between Mount Dora and Tavares.

No. 116 to Florida Telephone Corporation for the construction and maintenance of buried cable along County Rd. 3-1244 between County Roads 3-1345 and 3-1245.

No. 117 to Florida Telephone Corporation along County Road 3-1345 between County Roads 3-1346 and 3-1245.

No. 118 to Florida Telephone Corporation along County Road 3-1344 between County Roads 3-1346 and 3-1345.

inventory

On motion of Commissioner Cowart, seconded by Commissioner Dykes and carried, push blade stores at the Mascotte Barn was declared obsolete and offer of $25.00 for same was accepted from Suburban Refuse Service.

Contracts & Agreements

Agreement was approved with Shoup Voting Machine Corporation for two (2) interlocks and sixty-six (66) strap assemblies at a total cost of $12,739.70 to be paid in two installments as follows: $6,244.95 on or before January 10, 1969 and $6,494.75 on or before January 10, 1970.

On motion of Commissioner Dykes, seconded by Commissioner Windram and carried, the Clerk was authorized to advertise bids on equipment for the Motor Vehicle Inspection Stations.  Bids to be received on April 29, 1968 at 9:00 o’clock A.M.

zoning

On recommendation of the Planning & Zoning Commission and on motion of Commissioner Dykes, seconded by Commissioner Windram and carried, a resolution was adopted amending the Zoning Rules and Regulations as they pertain to the following tracts of land, to the Classification designated after each description:

1.      Begin 140 feet North of Southwest corner of Northwest ¼ of Southwest ¼ in Sec. 20, Tp. 19 S.R. 24 E., run North 70 feet, East 210 feet, South 123 feet, Northwesterly to Point of Beginning;

now classified and zoned as R-2 (Residential), be, and the same is hereby amended, changed and rezoned to Classification A (Agriculture).

2.      Begin on lake shore at Southwest corner of Government Lot 1 in Sec. 17, Tp. 19 S.R. 25 E.; run East to Railroad right of way, Northeasterly along right of way 570 feet, North 66°30’ West to lake shore, Southwesterly along lake to Point of Beginning;

County employees

On motion of Commissioner Dykes, seconded by Commissioner Cowart and carried, resignation of Robert S. Webb effective May 24, 1968 was accepted.

Accounts allowed

Engineer Hays was instructed to secure price of an additional mercury lamp at the District One Barn.

Clerk Owens presented bill for resurfacing streets in Silver beach Heights in the amount of $8,358.42, one-half of which is to be paid by W. F. Austin & Sons.  Mr. Owens was directed to contract Mr. Austin and to withhold payment to the contractor until money is received from Mr. Austin.

Proposal of Dobbs Brothers Library Binding Co. in the sum of $958.50 for repairs and new covers to record books in the Clerk’s Office was approved on motion of Commissioner Cowart, seconded by Commissioner Windram and carried.

On motion of Commissioner Dykes, seconded by Commissioner Cowart and carried, a resolution was adopted that because of the emergency and the need for Allis Chalmers Loader, County No. 2501, repairs to same in the amount of $2,340.60 were approved.

Request of S. Robert Klar to travel to Fort Lauderdale April 25 & 26 to attend meeting of Florida Federation of Safety Councils was approved on motion of Commissioner Dykes, seconded by Commissioner Windram and carried.

On motion of Commissioner Dykes, seconded by Commissioner Cowart and carried, the Clerk, Doris Babb and Donna Jean Hayes were authorized to attend Spring Conference of the County Finance Officers Association in Tampa on April 24-27.

Travel expenses were approved for Floyd Hess and H. G. Drake to attend Florida Civil Defense Association Conference in Ocala on May 15-17 on motion of Commissioner Dykes, seconded by Commissioner Cowart and carried.

Bills from Seaboard Coast Line Railroad Company covering installation of public crossing near Mile Post TA-787 in Sorrento for $127.58 and crossing near Mile Post SF 811 in Okahumpka for $397.99 were approved on motion of Commissioner Dykes, seconded by Commissioner Cowart and carried.

Requisition from the tax Assessor for $20,000 advance on commissions on 1968 tax roll was approved.

Request from Lake County Development Commission for $1,250 was approved on motion of Commissioner Dykes, seconded by Commissioner Cowart and carried.

On motion of Commissioner Dykes, seconded by commissioner Windram and carried, a refund of $15.00 to L. R. Huffstetler, Inc. rezoning application fee was authorized, on recommendation of the Zoning Director.

On motion of commissioner Cowart, seconded by Commissioner Windram and carried, the board adopted the policy that no personal checks will be accepted at the Motor Vehicle Inspection Stations.

Reports

Monthly report form the Welfare Director was filed.

Minutes

On motion of Commissioner Dykes, seconded by Commissioner Cowart and carried, the minutes of the Regular Meetings of March 11th and March 4th and of the Special Meeting held March 14th were approved as submitted.

Commissioner Windram requested that copies of the minutes of the Board meetings be typed and submitted to the Board members.  Clerk Owens said he will take this under advisement and will try to have the minutes distributed to the members as of the June meetings.
