MINUTES OF REGULAR MEETING OF the BOARD OF COUNTY COMMISSIONERS

 MONDAY – FEBRUARY 16, 1970

The Board of County Commissioners of Lake County, Florida, met in regular session in the Commissioners’ Room in the Courthouse, Tavares, Florida, on Monday, February 16, 1970, at 9:00 o’clock A.M. with the following members present:  Commissioners James R. Carson, Jr., Chairman, Alex J. Macdonell, J. M. Hoskinson, Thomas J. Windram and Kenneth VanAuken.  Other present were County Attorney C. E. Duncan, County Engineer Gordon Hays, Jr., Clerk of the Circuit Court Frank E. Owens and Deputy Clerk Norma H. Coven.

The meeting was called to order by the Chairman and the invocation was given by Mr. Hays, after which the Pledge of Allegiance to the Flag was given.

minutes

On motion of Commr. Macdonell seconded by Commr. Hoskinson and carried, the minutes of the regular meeting of February 2, 1970 were approved as submitted.

roads – county

Upon evidence submitted in the form of affidavits signed by three (3) residents of Lake County, and on motion of Commr. Macdonell seconded by Commr. VanAuken and carried, a Resolution was adopted declaring the following described road a public road by prescription and subject to use by the public:

Begin at a point where the South line of the North half of Section 4, Township 23 South, Range 24 East, intersects the Easterly right of way line of SR 565; thence run East to the East line of Section 4, Township 23 South, Range 24 East.

 

Upon evidence submitted in the form of affidavits signed by three (3) residents of Lake County and on motion of Commr. Macdonell seconded by Commr. Hoskinson and carried, a Resolution was adopted declaring the following described road a public road by prescription and subject to use by the public:

Commence at the West quarter corner of Section 11, Township 22 South, Range 24 East; thence run East 200 feet more or less to the centerline of SR 33; thence run Southeasterly along said centerline 360 feet more or less to the start of a clay road running East, said point being the Point of Beginning of this centerline; thence run East 1130 feet more or less to the end of this centerline.

 

Upon evidence submitted in the form of affidavits signed by three (3) residents of Lake County and on motion of Commr. Macdonell seconded by Commr. Windram and carried, a Resolution was adopted declaring the following described road:

Commence at the Northeast corner of the SE ¼ of the NE ¼ of Section 35, Township 22 South, Range 24 East, said point being at the intersection of County Roads 2-1312 and 2-1214; thence run South, along existing County Road 2-1214; thence run South, along existing County Road 2-1214, 680 feet to the Point of Beginning of this extension; thence run in a southerly direction 1.94 miles more or less to the end of this centerline, said point being 630 feet more or less North of and 1,100 feet more or less West of the Southeast corner of Section 2, Township 23 South, Range 24 East.

 

On motion of Commr. Hoskinson seconded by Commr. VanAuken and carried, a Resolution was adopted establishing maximum speed limits on County Road #3-1040 as follows:

From the intersection of Hooks Street and Minnehaha Lakeshore Drive to a point 1,430 feet South – 25 miles per hour;

From a point 1,430 feet South of said intersection to a point 4,350 feet South – 35 miles per hour;

From a point 4,350 feet South of said intersection to a point 11,030 feet South to the center of the Lake Susan Bridge – 45 miles per hour.

 

road closings

It now being the time advertised to hold a public hearing to consider petition to close a portion of Deerwood Drive in Orlando Hills and no one appearing to object to the closing, a motion was made by Commr. Hoskinson seconded by Commr. Windram and carried, that a Resolution be adopted closing the following described street:

That portion of Deerwood Drive in Orlando Hills Subdivision as will appear by reference to plat thereof filed and recorded in the public records of Lake County, Florida in Plat Book 18, page 20 and located in the Southwest quarter of the Northwest quarter of Section 26, Township 18 South, Range 27 East, more particularly described as follows:  Beginning at the S.W. quarter of Lot 90 of said Orlando Hills Subdivision, said point being the true point of beginning, thence run along the Southerly lines of Lots 90 and 91 N. 88°53’28” E. a distance of 853.24 feet to the SE corner of said Lot 91; thence on the Southerly prolongation of the Westerly line of said Lot 91 South 50.01 feet to the Southerly line of said Orlando Hills Subdivision; thence run S. 88°53’28” W. 852.26 feet to the Easterly line of said State Road 439; thence along the Easterly line of State Road 439 N. 01°07’27” W. 50.00 ft. to the true point of beginning.

 

Attorney Duncan presented Petition to Close Dedicated Right of Way signed by LeRoy H. Brown, H. W. Mullinax, W. S. Yancey and A. G. Lowrie, owners adjacent to said right of way, whereupon, on motion of Commr. VanAuken seconded by Commr. Windram and carried, a Resolution was adopted accepting the petition and authorizing a public hearing to consider the right of the County to disclaim the following described dedicated right of way:

That portion of a dedicated right of way commonly referred to as “Saw Grass Road” more particularly described as follows:

Commencing at the S.W. corner of Section 2 according to the Plat of Manhattan recorded in Plat Book 2, Page 2, Public Records of Lake County, Florida, run thence South 89° 29’34” East along the South boundary of said Section 2, a distance of 5,280.30 feet to the S.E. corner of said Section 2; thence continuing East 5,397.06 feet, thence run North 3,956.58 feet, thence run East 450 feet to the Point of Beginning.  Thence run North 115 feet, thence run East 50 feet, thence run South 280 feet, thence run West 50 feet, thence run North 165 feet to the Point of Beginning.

 

Bids

It now being the time advertised to receive bids to air condition the Lake Memorial Nursing Home, the Architect appeared and announced only one bid has been received and recommended that the bid be refused and readvertise.  Commr. Macdonell moved that the bid be rejected and returned to the bidder unopened and that the Clerk be authorized to readvertise the bids for March 9th.  The motion was seconded by Commr. Windram and carried.

complaints

Mr. J. B. Prevatt appeared and complained of water problem on his property at Sorrento.  He said he has spent in excess of $2500.00 in an attempt to correct the problem and asked the County’s assistance.  Attorney Duncan advised since there are four owners involved, this becomes a public problem.  The Engineer was instructed to make a study of the problem and give his recommendations for correcting same to Mr. Prevatt.

Mr. Boyer appeared relative to a drainage problem that exists between Mobile Home Estates and Thompson Estates.  He was advised this is a private problem and the Board has no authority in this matter.

Letter from Henry M. Saulsbury complaining of the condition of Bay Street in Haines Creek was referred to Mr. VanAuken.

ordinance

It now being the time advertised to consider the final passage of an Ordinance providing necessary regulations for the accumulation, storage, collection and disposal of certain waste and garbage in all areas in Lake County, the reading of the Ordinance in full was waived and same was read by title only.  On motion of Commr. Macdonell seconded by Commr. Hoskinson and carried, the Ordinance was placed on final passage and enacted.  (See Ordinance Record No. 1, Page 8.)

planning and zoning

Letter from Elliott Seabrook resigning as a member of the Planning and Zoning Commission was read and on motion of Commr. VanAuken seconded by Commr. Windram and carried, a Resolution was adopted commending him for his services while a member of the Commission.

road maintenance – subdivisions

John C. Wanamaker, Sr. and Sidney Rawls appeared relative to the County maintaining the streets in Shady Dell Subdivision.  Engineer Hayus advised he knows of no agreement to maintain the streets.  Chairman Carson informed them the streets are dedicated streets but not County roads, however, the Board members will view the roads on the next road inspection trip.

On motion of Commr. Windram seconded by Commr. Macdonell and carried, the Board approved repairs to Washington Street in Sylvan Shores.

On recommendation of the Engineer and on motion of Commr. Windram seconded by Commr. Hoskinson and carried, the Attorney was instructed to notify Stin Haselton he has the Board’s permission to use the right of way on proposed SR 452 East of Eustis for pasture, until such time as the State or County requires the right of way, and that no permanent structures are to be erected.

roads – county

Engineer Hays advised there is an abandoned truck parked on the right of way on County Road #5-5942, and have been asked to have the truck removed.  Attorney Duncan said should locate the owner and ask him to remove the truck.

county PROPERTY

Terrell Davis, County Forester, appeared at the request of the Board relative to planting trees around the landfill sites.  Paul Milton was also present and he was instructed to work with Mr. Davis.

county employees

Chairman Carson read letter of recommendation from the Attorney concerning the Board’s future policy on employees receiving workmen’s compensation benefits.  On motion of Commr. Hoskinson seconded by Commr. Windram and carried, the Board adopted the policy to determine the amount of compensation the employee will receive and salary check will be issued for the difference.

water levels

Attorney Duncan presented a letter from Gee & Jenson Consulting Engineers relative to the high water levels on Lake Joanna.  Letter advises that E. T. Hall prepared a survey showing the elevations of Lake Joanna and the lakes which lead to Lake Eustis, and a major problem exists due to the rather large hydraulic differential of more than 82 feet.  A less expensive solution was suggested that a gated pipe culvert could be installed in the present weir section to control the discharge from Lake Joanna.  This matter was tabled pending further recommendations from Gee & Jenson.

The meeting recessed for lunch at twelve o’clock noon and reconvened at 1:15 o’clock P.M. to take up the remaining items of business.

roads – county

Commr. VanAuken advised Otis Lee wants to close the right of way along Julia Street from SR 40 North to the North boundary of Astor as platted.  He will check into this further.

tax assessments

Certificates of Error and Corrections on the 1969 Tax Roll numbered 136 through 148 were approved on motion of Commr. Windram seconded by Commr. Hoskinson and carried.

tax delinquent

On motion of Commr. VanAuken seconded by Commr. Hoskinson and carried, the Clerk was authorized to redeem 1968 Tax Certificate No. 474 in the amount of $19.00 and No. 475 in the amount of $12.49 covering delinquent taxes on County property located in Sunny Dell Park and Sunny Dell Park First Addition.

On motion of Commr. Macdonell seconded by Commr. Hoskinson and carried, the following inventory items were declared surplus and of no value:

salaries and wages

On recommendation of the Veterans Service Officer and on motion of Commr. Macdonell seconded by Commr. VanAuken and carried, salary for Lorrine Retey was increased to $400.00 per month effective February 1, 1970; and the employment of Sherry Bartholomew was approved effective today.

Request from J. W. Bryant for increase in salary was taken under consideration by the Board.

fair grounds

Jack Pae appeared at the request of the Board relative to the County leasing the Fairground facilities on a percentage basis.  Attorney Duncan advised the Board cannot indiscriminately lease County property.  Mr. Pae was requested to investigate this matter further.

checks received

On motion of Commr. VanAuken seconded by Commr. Hoskinson and carried, check from Leesburg Cablevision, Inc. in the amount of $71.42 was accepted and ordered deposited to the General Revenue Fund.

cancellation of warrants

Fine and Forfeiture Fund Warrant No. 287 payable to Daniel A. Boone in the amount of $10.20, Juror County Judge’s Court, was authorized cancelled.

accounts allowed

On motion of Commr. Hoskinson seconded by Commr. Windram and carried, travel expenses were approved for Royce C. Williams to attend Annual Pest Control Conference at the University of Florida, Gainesville, February 24 and 25.

On motion of Commr. Hoskinson seconded by Commr. Windram and carried, the Clerk was authorized to record in the public records Resolutions declaring public roads to be prescriptive in nature, based upon evidence submitted.

communications

Chairman Carson submitted telegram from Representative Chappell’s office advising that funds for the Oklawaha Channel will be available for contract letting April 15th.

reports

Report for the month of January from the County Welfare Director was filed.

Report from the Beverage Department showing the cigarette tax collections and distributions for the month of January was filed.
