MINUTES OF REGULAR MEETING OF the BOARD OF COUNTY COMMISSIONERS

 monday – MARCH 8, 1971

A regular meeting of the Board of County Commissioners of Lake County, Florida, was held in the Commissioners’ Room in the Courthouse, Tavares, Florida, at 9:00 o’clock A.M. on Monday, March 8, 1971, with the following members present:  J. M. Hoskinson, Chairman; James R. Carson, Jr., Thomas J. Windram, C. A. Deems and Kenneth VanAuken.  Also present were County Attorney Christopher C. Ford, Clerk of the Circuit Court; Frank E. Owens, and Deputy Clerk Norma H. Coven.

The meeting was called to order by the Chairman, and the invocation was delivered by Mr. Carson, after which the Pledge of Allegiance to the Flag was given.

appraisals

On recommendation of the Mosquito Control Director that the Board consider the purchase of two locations to be used as sump sites and on motion of Commr. Carson seconded by Commr. Deems and carried, appraisals were authorized on the following parcels of land, and that same be surveyed for any evidence of existing clay:

The West ½ of the SE ¼ of the SW ¼ of Section 17, Township 19 South, Range 28 East, East of SR 437 and Northeast of Sorrento, 20 acres.

 

The East ½ of the SE ¼ of the SW ¼ of Section 17, Township 19 South, Range 28 East, located approximately ¾ miles East of SR 437, 10 acres.

 

road and bridge department

Mr. J. F. Goldthorpe appeared and presented written recommendation of Robert H. Norton for the design of a control structure on property near the Wolfe Branch Road.  Proposal for concrete structure with risers was rejected on recommendation from Mr. Norton and the County Attorney that the risers would be for the benefit of the property owner and not the County.  Opinion of Mr. Norton that the installation of two anti-seep collars would strengthen the embankment was approved on motion of Commr. Windram, with the cost of same to be borne by Lake County.  The motion was seconded by Commr. Carson and carried.

indigents

On motion of Commr. Deems, seconded by Commr. Carson and carried, the following change was approved to the present indigent list:

            District No. 2 – ADD Nannie Mae Price - $40.00

appointments

On motion of Commr. Carson, seconded by Commr. Deems and carried, A. H. Bourlay was appointed to serve on the Planning and Zoning Commission from District No. 1.

bids

On motion of Commr. Carson, seconded by Commr. Windram and carried, the Clerk was authorized to advertise for bids on a new 1971 model sedan for the Pollution Control Officer, to be received April 12, 1971.  The Pollution Control Officer was authorized to use the County Engineer’s vehicle until his car is purchased or a new engineer employed.

On recommendation of the Planning Director that the secretary to the Civil Defense Coordinator occupy an office in the Pioneer Building, the transfer of the Civil Defense Office to the Pioneer Building was approved.

county property

Commr. Windram presented request from property owners on Lake Joanna to consider the sale of County property designated as “Belleaux Park,” and on advice of the Clerk of prior action of the Board regarding this property, same was referred to the Attorney.

municipal corporations

R. A. Young, Tavares Councilman, appeared and requested the Board’s assistance to improve the intersection of Clara Avenue and SR 19A.  The Board informed Mr. Young this will be considered and possibly corrected by the Road and Bridge Department.

recess and reassembly

The Board recessed to the Clerk’s Office at 11:00 A.M. to review the financial records of the Clerk’s Office and reconvened after lunch at 1:30 o’clock P.M.

Commr. Deems announced for the record that the Board members had visited the Clerk’s Office and examined those certain records presented to them by Frank E. Owens, Clerk of the Circuit Court, and copies of same were filed with the Board, including the following:

Copy of Report of Receipts, Expenses and Net Income for the year ending December 31, 1970, which was filed with the Board January 25, 1971.

Report reflecting salary ranges within the Clerk’s Office

 

With further reference to information regarding financial records of the various county offices, the Attorney remarked he has received replies from County Judge W. A. Milton, Jr., County Judge L. R. Huffstatler, Jr., Supervisor of Elections Katherine L. Baker, and Judge of the Small Claims Court E. C. Aulls, Jr., that the information requested will be forthcoming.

Chairman Hoskinson filed for the record copy of report of the operations of the Small Claims Court.

Sheriff McCall appeared and presented a breakdown of salaries in his department, commenting that in his opinion it will be a mistake to publish these figures – that it will cost the County money rather than save money.

On motion of Commr. Windram, seconded by Commr. VanAuken and carried, the Attorney was instructed to request from the Tax Assessor and Tax Collector a financial breakdown of their office records, including a job description breakdown.

At three o’clock P.M. the Board recessed to the County Judges’ Office to review the financial records and upon reconvening in the Commissioners’ Room, Commr. Deems reported for the record that certain records were submitted to the Board members in report form, as follows:

roads – county

Clerk Owens submitted information from the Department of Transportation relative to an inventory and evaluation of County roads, as required by the Comptroller.  The letter further explains that the Department has an inventory of County roads for each county, and that the information has been transferred to a printed map, indicating the road type.  The Clerk was instructed to ask the Department if the maps are available to the counties for use in the County offices and the cost of same.

road closing

The Clerk presented proof of publication for hearing on petition to close a dedicated right of way in Section 6, Township 19 S., Range 28 E., as having been advertised for hearing on March 1, 1971 and proof not being received on that date same was not considered by the Board.  Also, submitted was map showing the road is located ½ mile south of SR 44-A and ½ mile East of SR 437 and same was referred to Commr. Windram.

contracts and agreements

Memorandum of Agreement between the Department of Transportation, the Department of Natural Resources and Lake County concerning the construction and maintenance of a fishing catwalk at Little Lake Harris Bridge on State Road 19, was approved on motion of Commr. Windram, seconded by Commr. Carson and carried and the Chairman and Clerk were authorized to execute the same.

Bonds for carrying firearms on the following were approved on motion of Commr. Windram seconded by Commr. VanAuken and carried:

accounts allowed

On motion of Commr. Carson, seconded by Commr. Windram and carried, the Board approved the purchase of one hand truck for the surplus Commodity Warehouse, at an appropriate cost of $20.00.

On recommendation of the Chairman and on motion of Commr. Carson, seconded by Commr. Deems and carried, an expenditure of $330.00 was approved for aluminum and glass doors with closures and security locks, to be installed on the outside doors at the Juvenile Court Complex Building.

Request from Harvey Spears General Contractor, Inc. for payment of $11,169.00 for work performed on the Livestock Show Building, was approved on motion of Commr. VanAuken, seconded by Commr. Carson and carried.

Request from the Clerk for four (4) Civil Action Docket Books from Florida Forms & Systems of Jacksonville in the amount of $398.00, was approved on motion of Commr. Carson seconded by Commr. Windram and carried.

Request from the Clerk of Circuit Court for $500.00 advance to pay State Trial Witnesses was approved on motion of Commr. Windram, seconded by Commr. VanAuken and carried.

Request from the Extension Agent to purchase seven (7) folding banquet tables, was deferred pending receipt of another quotation.

Payment to the East Central Florida Planning Council in the amount of $1,373.21 for January expenses was approved on motion of Commr. VanAuken, seconded by Commr. Carson and carried.

Payment to the Lake County Chamber of Commerce for February expenses in the amount of $2,083.33 was approved on motion of Commr. Carson, seconded by Commr. Deems and carried.

Requisition from Waterman Memorial Hospital for $121,000.00 was approved on motion of Commr. Windram, seconded by Commr. Carson and carried.

Statement in the sum of $170.44 from Duncan and Ford covering one-half of basic telephone bill, plus toll charges, and copying charges, was approved on motion of Commr. Windram seconded by Commr. VanAuken and carried.

Travel expenses for the Superintendent and Matron of the Juvenile Shelter to attend Florida Group Child Care Assn. Workshop in Deland, June 13 – 18, were approved on motion of Commr. Carson seconded by Commr. Deems and carried.

On motion of Commr. Carson, seconded by Commr. Windram and carried, the following vouchers were approved for payment:

funds – transfer

Transfer from the Contingency Item in the General Revenue Fund $1,500.00 to Account #68585 to cover payments to the Law Library, was approved on motion of Commr. Carson, seconded by Commr. VanAuken and carried.

roads – county and state

At this time the Board discussed primary and secondary roads to be considered in the five-year construction program to be submitted to the Department of Transportation on March 29, 1971, and the Chairman called a special meeting for Wednesday, March 17, 1971 at ten o’clock in the forenoon to designate the road projects.

There being no further business to bring before the Board, the meeting was adjourned at 5:00 o’clock p.m.
