MINUTES OF REGULAR MEETING OF BOARD OF COUNTY COMMISSIONERS

 TUESDAY – may 16, 1972

The Board of County Commissioners of Lake County, Florida, convened in regular session in the Commissioners’ Room, Courthouse, Tavares, Florida, on Tuesday, May 16, 1972, at 9:00 a.m. with the following members present:  Thomas J. Windram, Chairman; James R. Carson, Jr.; C. A. Deems; J. M. Hoskinson; and Kenneth VanAuken.  Others present were: Christopher C. Ford, County Attorney; Frank E. Owens, Clerk of Circuit Court; and Norma H. Coven, Deputy Clerk.

The meeting was called to order by the Chairman, the invocation was given by Commr. Deems, and the Pledge of Allegiance was recited.

minutes

On a motion by Commr. Hoskinson, seconded by Commr. VanAuken and unanimously carried, the Minutes of the Meeting of April 4, 1972 were approved as submitted.

tax assessments

The Chairman read a notice from the Department of Revenue which stated, “Effective April 24, 1972, Chapter 72-306, Laws of Florida, imposes a duty on any county levying an occupational license tax to file with the Department of Revenue the following by the 15th day of each month:  (A) A certified copy of the resolution or ordinance providing for an occupational license tax before such tax may become effective. (B) The collector of the tax shall report to the Department monthly on forms provided by the Department the amount of such tax received by class and amount of such tax apportioned between local governing authorities (incorporated municipalities) within the county.”  The Board instructed the Clerk to forward this information to the Tax Collector.

zoning

The Chairman read correspondence from the Lake County Conservation Council which advised the Board that the Council did not take a position on the recent zoning change request on property near Goose Prairie and said that they regret that the Lake County Conservation Council’s name was associated with the opposition to that zoning change in letters to the editor of several local newspapers.

communications

The Chairman read a letter from the Lake County Conservation Council concerning the Wekiva River Building moratorium.  Bill Burleigh appeared regarding a Seminole County resolution concerning a moratorium on building permits on the Wekiva River.  Mr. Ford, County Attorney, said he has legal reservations on this and reported that the scenic river act did not pass the legislature.

The Chairman read a letter of appreciation from Dr. Geoffrey H. Binneveld who commended the Board on the new pavement job on Picciola Road.

appointments

The Chairman announced that he contacted C. E. Duncan, Philip C. Gorman, and R. Dewey Burnsed; and they are willing to work on the Judiciary Advisory Board.  He has asked Mr. Howell Hopson for a copy of the courthouse plans.  On a motion by Commr. Deems, seconded by Commr. Hoskinson and unanimously carried, the action of the Chairman was approved.

oklawaha river basin improvement council

The Chairman read correspondence from the Executive Director, Southwest Florida Water Management District, regarding the Oklawaha River Basin Improvement Council and will take action at the next meeting on May 19, 1972, as to whether they will participate on the Council.

Copies of letters from the City of Clermont, Florida Citrus Mutual, and A. Duda & Sons, Inc. were filed regarding Improvement Council Representatives.

budgets

The Chairman received a letter from the President of the Board of Directors at the Sunrise Workshop requesting that the Workshop be included in the budget planning this next fiscal year.  The money is needed for rehabilitation of handicapped and economically deprived clients of Lake County.

roads – state

Commr. Deems reported the contractor for the four-laning of SR 25 through Leesburg has not received the road contract and recommended that the Board direct a strong telegram to Tallahassee on this.  Mr. Ford was requested to contact the Attorney for the Department of Transportation in regard to the contract.

resolutions

The Chairman read a letter of recommendation from the Game and Fresh Water Fish Commission concurring with the Putnam County resolution concerning commercial fishing in the St. Johns River and requesting that consideration be given to the legalizing of hoopnets and wire traps for the purpose of removing rough fish in the St. Johns River and its tributaries.

On a motion by Commr. Hoskinson, seconded by Commr. Carson and unanimously carried, the resolution was adopted.

County buildings and grounds

Chairman Windram read a letter from the County Engineer recommending that the courthouse grounds sprinkler heads be lowered so that they are flush with the ground surface and thereby eliminating the safety hazard caused by the present steel riser type system.  On a motion by Commr. Deems, seconded by Commr. Carson and unanimously carried, the Engineer’s request was approved.

east central florida planning council

Jack Glatting from the Council appeared and introduced Roger Neiswinder and Ken Kloos, who discussed proposals for a central sewerage and water system, advising they have visited all the municipalities in the County and did not meet with much enthusiasm.

Frances Gay representing Lakco Citrus appeared relative to the development at the intersection of SR 25 and 19 and proposed a central system at this location.  Mr. Glatting recommended the Board consider a building permit moratorium in this area until the problem is resolved.  Chairman Windram advised the Commissioners that the Council and interested parties and agencies will meet to discuss central water and sewerage franchises on Tuesday at 1:30 p.m. at the Agricultural Center, and a public hearing on same will be advertised for June 13, 1972.

roads – county

On a motion by Commr. VanAuken, seconded by Commr. Hoskinson and unanimously carried, a memo of agreement with Macasphalt Corporation for site rental and sand purchase in conjunction with the County road resurfacing project was approved.

public health

Commr. VanAuken will discuss with the Volusia County Commission the problem of Volusia residents dumping trash and garbage in Astor.

bonds – misc.

On a motion by Commr. Deems, seconded by Commr. Carson and unanimously carried, a bond for carrying firearms was approved for Frank Cipris, Jr.

Contractor Bonds for a Certificate of Competency were approved on a motion by Commr. Carson, seconded by Commr. VanAuken and unanimously carried for the following:

roads – state

A maintenance agreement and resolution pertaining to the installation of a traffic signal at the intersection of SR 25 and SR S-466A in Leesburg was approved on a motion by Commr. Hoskinson, seconded by Commr. Deems and unanimously carried.

roads – county

On the recommendation of the County Engineer and a motion by Commr. Carson, seconded by Commr. Hoskinson and unanimously carried, a resolution was adopted to establish a 35 mph speed limit on County Roads 1-7407 and 1-7611 in Carlton Village.

bids

It now being the time advertised to receive bids for the sale of surplus county property, the Chairman directed the Clerk to open and tabulate bids, whereupon the following bid was received:

E. Irving Burleigh       $125.00

On a motion by Commr. Deems, seconded by Commr. Carson and unanimously carried, the bid was accepted and the Attorney was instructed to prepare a deed conveying the following described property to Mr. Burleigh:

Commence at the NW corner of Lot V in Block 8, in City of Tavares as shown by sheet #10 of the supplemental plat of Section 29 and 32 Official Plats of the survey of said Section in Township 19S, Range 26E, of the Tallahassee Meridian and run thence South approximately 13 feet to the Old Meander line as set forth on said Plat, thence run N of E to intersect the N line of said Lot V at approximately the NE corner of said Lot V, thence run W. to the NW corner of Lot V.

It now being the time advertised to receive bids for the sale and removal of a one-story frame dwelling, located in Umatilla, Florida, the Chairman directed the Clerk to open and tabulate bids, whereupon the following bid was received:

J. W. Parrish   $911.00

On a motion by Commr. Hoskinson, seconded by Commr. VanAuken and unanimously carried, the bid was accepted and the following described property will be sold to Mr. Parrish:

One story frame house with four rooms and bath and a small screened front porch, containing approximately 1600 sq. ft. floor space, situated on Lots 14 and 15, Block D.  Collins Subdivision (E. Mary Street), adjacent to the Lake County Barn, Umatilla, Florida.

At this time, the Chairman called for the opening and tabulation of the bids for dragline and bucket.  The following bids were received:

On a motion by Commr. Hoskinson, seconded by Commr. Deems and unanimously carried, the bids on the purchase of dragline and bucket were referred to the County Engineer for his recommendation.

budget

Mr. Noel Griffin appeared representing the Lake Soil and Water Conservation District requesting increases in the budget for the next fiscal year, increasing the annual salary for part-time secretarial help from $1,800 to $2,000 and $200 with which to pay dues to the National Association of Soil and Water Conservation Districts.

insurance

Mr. Reaves and Mr. Donahue, representing Colonial Life and Accident Insurance Company, appeared and presented a group salary supplement plan for on the job and off the job accidents.  He asked for permission to discuss the plan with the County employees.  Commr. Hoskinson recommended that the Board appoint an insurance consultant committee to meet to review the various plans offered to the employees.  Chairman Windram stated he would check with the Finance Office and the department heads and notify Mr. Donahue.

recess and reassembly

The meeting was recessed for lunch at 12:30 p.m. and reconvened at 1:30 p.m. to take up the remaining items of business.

bids

The County Engineer requested permission to advertise for bids for July 11, 1972 for the installation of  a corrugated pipe arch culvert in the Montevista Canal under Bronson Road.  On a motion by Commr. Carson, seconded by Commr. Deems and unanimously carried, the request to advertise was approved.

road maintenance – subdivisions

The County Engineer reported that he is in receipt of a proposal from a developer in Carlton Village requesting permission to resurface Magnolia Street.  The Board feels that the County cannot take on this work and instructed the Engineer to notify the developer that he can resurface the street, specifying that this street cannot be taken into the County maintenance system unless the street is built to County specifications.

county employees

On a motion by Commr. Deems, seconded by Commr. Carson and carried, the Engineer was authorized to employ out of county residents when all efforts have been exhausted in finding qualified residents of Lake County.

bids and proposals

The County Engineer requested permission to buy two half-ton pickup trucks “off the lot.”  The Board instructed the Engineer to price the trucks and present this proposal back to the Board.

oeo bus system

Mr. Harpster, County Engineer, presented a request from the OEO Bus System regarding servicing of buses and recommends that this servicing be done at the Umatilla Barn.

county planner

On the recommendation of Mr. Watkins, County Planner, and on a motion by Commr. Hoskinson, seconded by Commr. Carson and unanimously carried, Mr. Sam Mazzotta was promoted to Zoning Administrator and Mr. Frank Lawton to Assistant Planning Director.

salaries and wages

On a motion by Commr. Carson, seconded by Commr. Deems and unanimously carried, Mr. Frank Lawton will receive an increase in salary as Assistant Planning Director from $8,500 to $10,000 annually, effective immediately.  His salary will be paid under the EEA Program.

reports

On a motion by Commr. VanAuken, seconded by Commr. Carson and unanimously carried, the report of the distribution of revenue sharing funds to the Department of Revenue was approved.

hospitals

On a motion by Commr. Deems, seconded by Commr. VanAuken and unanimously carried, the action of the Chairman and Clerk in approving the application to the W. T. Edwards Tuberculosis Hospital for Rosanna Dezoria Stokes was approved.

licenses and permits

Use Permits filed by the County Engineer were approved on a motion by Commr. Carson, seconded by Commr. Deems and unanimously carried, for the following:

To Florida Power Corporation to construct and maintain a 72,000 volt aerial electric transmission line crossing County Road 3-1362 at junction with State Road 50 as shown on Drawing T-6665-A-1, providing a minimum 45-foot clearance.

To Florida Power Corporation to construct and maintain a 72,000 volt aerial electric transmission line crossing County Road 3-1370 at junction with State Road 50 as shown on Drawing T-6665-A-2, providing a minimum 38-foot clearance.

To Florida Power Corporation for construction and maintenance of a 72,000 volt aerial electric transmission line crossing County Road 3-1255 at junction with State Road 50 as shown on Drawing T-6665-A-3, providing a minimum 53-foot clearance.

communications

The Deputy Clerk read the application from the Mid-Florida Sightseeing Service, Inc. to the Florida Public Service Commission regarding temporary authority to use state roads, US highways, Interstate 4, and Interstate 75 for a sightseeing service.

county buildings and grounds

Mr. Ford, County Attorney, was contacted by Mr. Stebbins regarding a request received from the Jehovah Witness Church to use the Fair Building Convention Center for a church convention on September 29, 30, and October 1, 1972.  The Attorney read Item 20 from the Fair Building Convention Center Rental Policies which states, “The Convention Center shall not be used by any religious group for church services.  This does not preclude rental to church-connected groups for occasional one-time usage.”  On the recommendation of the Attorney and on the motion by Commr. Carson, seconded by Commr. VanAuken and unanimously carried, the Board requested the Attorney to notify the Chamber of Commerce that the Board approved the Jehovah Witness Church request to use the fairgrounds for a convention site, provided they enter into the usual rental contract.

ordinances

Mr. Ford, County Attorney, brought before the Board the Ordinance regarding Occupational License Classification and Rates.  On a motion by Commr. Deems, seconded by Commr. Hoskinson and unanimously carried, this ordinance was declared an emergency.  On a motion by Commr. Hoskinson, seconded by Commr. VanAuken and unanimously carried, the Board requested that the ordinance be advertised for Public Hearing on June 6, 1972.

Chairman Windram announced it is time to consider an Ordinance providing for liens in favor of operators of hospitals supported or aided by local tax revenue.  On a motion by Commr. Hoskinson, seconded by Commr. VanAuken and unanimously carried, the Ordinance was placed on third and final reading by title only, said title being:

An Ordinance providing for liens in favor of operators of hospitals supported or aided by local tax revenue in Lake County upon causes or action, suits, claims, counterclaims, and demands accruing to patients, therein, or their legal representatives, and upon judgments, settlements and settlement agreements, on account of injuries of such patients, for all reasonable charges for hospital care, treatment and maintenance necessitated by such injuries; providing for method of perfecting and enforcing such liens, and for the recovery costs, and reasonable attorney’s fees in any action enforcing such liens; requiring claims for lien to be recorded and fees for recording; providing that no release or satisfaction shall be valid as against lien unless lienholder joins therein or executes release; providing that acceptance of release or satisfaction of any cause of action, suit, claim, counterclaim, demand or judgment and any settlement in absence of release or satisfaction of lien shall prima facie constitute impairment of such lien, and giving lienholder right of action at law for damages on account of such impairment, and providing for recovery from one accepting release or satisfaction or making settlement; exempting from provision of this act matters within purview of workman’s compensation act of this state.

The Chairman called for discussion by the members of the public.

On a motion by Commr. Deems, seconded by Commr. VanAuken and unanimously carried, the Ordinance was adopted on the third and final reading by title only.

commissioners

The Attorney reported that he received an opinion from the Attorney General stating that County Commissioners who are serving on boards as ex officio members do not need to resign to seek election.  However, Attorney Ford recommends that they do resign to eliminate all possible conflicts which might arise.

planning and zoning

It now being the time advertised to hold a public hearing on zoning reclassifications and on the recommendation of the Planning and Zoning Commission, and on the motion of Commr. Carson, seconded by Commr. Deems and unanimously carried, a resolution was adopted altering and amending the zoning rules and regulations as they pertain to the following described tracts of land:

WHEREAS, the Lake County Planning and Zoning Commission did, on the 27th day of April, 1972, review certain applications for changes and revisions of the zoning of certain areas in Lake County, Florida, and after giving Notice of Hearing on applications for changes of zoning classifications (including a Notice that said applications would be presented to the Board of  County Commissioners of Lake County, Florida on the 16th day of May, 1972), and WHEREAS, the Lake County Planning and Zoning Commission did make recommendations as to the changes as requested in the particular applications hereinafter set forth subject to the approval of the Board of County Commissioners of Lake County, Florida, and WHEREAS, THE Board of County Commissioners reviewed said applications, the recommendations of the Lake County Planning and Zoning Commission and any comments, favorable or unfavorable from the public surrounding property owners, at a public hearing duly advertised.

CHANGE IN ZONING CLASSIFICATION:  The Zoning Classification was RP (Residential Professional District) and is hereby changed to R-1-7 (Urban Residential District).

Zoning Case No. 65-72-5 was called for hearing, and the Chairman called for interested parties to be heard.

Mr. J. A. Patterson appeared opposing the rezoning, stating that he owned a portion of this land.  The minutes of the Planning and Zoning Commission were read into the record concerning this case.

Mr. Jim Hearn appeared and opposed the rezoning.

On a motion by Commr. Hoskinson, seconded by Commr. Carson and unanimously carried, the recommendation of the Planning and Zoning Commission was upheld and the request was approved.

Conditional Use Permit 366-5 was called for public hearing, and the Chairman stated that this CUP should be clarified.  The original intent of this permit is to allow, in addition to the existing home already on the property, one mobile home and two additional conventional homes.  On a motion by Commr. Carson, seconded by Commr. VanAuken and unanimously carried, the recommendation of the Planning and Zoning Commission was upheld and the request was approved.

Zoning Case No. 70-72-1 and 59-72-1 were called for hearing, and the Chairman called for interested parties to be heard.

Larry Taylor, Attorney, appeared representing adjoining property owner, Mr. Fred Greene, opposing the rezoning north of Lot #28.

On a motion by Commr. Hoskinson, seconded by Commr. Carson and unanimously carried, the recommendation of the Planning and Zoning Commission was upheld, and the request was approved to rezone Lots 26 and 28 only.

Conditional Use Permit 368-4 was called for hearing, and the Chairman called for interested parties to be heard.

Mr. C. E. Middlebrooks, the applicant, appeared in interest of the permit.

The Chairman suggested a 30-day postponement to enable the Board members an opportunity to view the area in question.  On a motion by Commr. Hoskinson, seconded by Commr. VanAuken and unanimously carried, the case was postponed until June 20, 1972 at 2:00 p.m.

salaries and wages

The Chairman said he has located a secretary to the Board who will assist in the Finance Office, and on a motion by Commr. Deems, seconded by Commr. Carson and unanimously carried, the Board approved employment of Agatha McKnight at a monthly salary of $460.

accounts allowed

On a motion by Commr. Carson, seconded by Commr. Hoskinson and unanimously carried, travel was approved for Frank Lawton to attend a meeting in Crystal River regarding the Resource Survival Committee on May 19 and 20, 1972.

Request of the Clerk to purchase two (2) Acme Visible Microfilm cabinets for the Clerk’s Office was approved on a motion by Commr. Deems, seconded by Commr. Carson and unanimously carried, in the amount of $424.95.

On a motion by Commr. VanAuken, seconded by Commr. Hoskinson and unanimously carried, travel was approved for J. C. Watkins to attend the Planning and Zoning Association Director’s Meeting in Tampa, April 28 and 29, 1972 and for Robert S. Stroud to attend the Governor’s Council on Criminal Justice in Tallahassee on March 13-15, 1972.

On a motion by Commr. VanAuken, seconded by Commr. Carson and unanimously carried, building permit #18982 in the amount of $35.50 was refunded to Robert Mills, due to the fact that he will not be moving to Lake County.

warrant cancelled

On a motion by Commr. Carson, seconded by Commr. VanAuken and unanimously carried, the Board canceled the following warrant, which was a duplicate payment:

Warrant #59, $9.99 payable to Orlando Frame & Art Supply, Inc., Orlando, dated May 9, 1972 – Youth Services Fund.
