MINUTES OF REGULAR MEETING OF BOARD OF COUNTY COMMISSIONERS

JULY 18, 1972

The Board of County Commissioners of Lake County, Florida, convened in regular session on Tuesday, July 18, 1972, in the Commissioners’ Room, Courthouse, Tavares, Florida, at 9:00 o’clock A.M. with the following members present:  Thomas J. Windram, Chairman; C. A. Deems; Kenneth VanAuken and J. M. Hoskinson.  Others present were: Christopher C. Ford, County Attorney; Frank E. Owens, Clerk of Circuit Court; and Norma H. Coven, Deputy Clerk.

The Chairman called the meeting to order and the invocation was given by Commr. Deems.  The Pledge of Allegiance was recited.

licenses and permits

Chairman Windram advised the Board members of meeting held on July 17, 1972, concerning the State takeover of the responsibilities for septic tank inspections and permits in the County.  He stated that the State did not budget the necessary funds and does not have sufficient personnel to handle the job.  At the present time, only one man is assigned to Lake County to issue the permits and handle the inspections.

The Chairman read letter from the Department of Transportation regarding speed zone restriction on SR 561 S.W. of Clermont.

appointments

On motion of Commr. VanAuken, seconded by Commr. Hoskinson and unanimously carried, the Board appointed Mrs. Elsie Izatt to replace Glenn C. Burhans on Planning and Zoning Commission.

budgets

At this time, the Board discussed and considered budget requests for 1972/1973 Fiscal Year.

It now being the time advertised for the Board to consider petition to close easements or rights of way for petitioner Campers Inn of America, Inc., and no one appearing to object to the closing, Commr. Hoskinson moved that a Resolution be adopted to close the easements or rights of way lying or being with the following described property:

The motion was seconded by Commr. Deems and unanimously carried.

It now being the time advertised for the Board to consider petition to close a portion of Highland Avenue and no one appearing to object to the closing, Commr. Hoskinson moved that a Resolution be adopted to close a portion of Highland Avenue, lying or being within the following described property:

 

That portion of Highland Avenue, East of Grand Highway to the lake shore of Jack’s Lake, lying in Section 20, Township 22 South, Range 26 East, Lake County, Florida.

 

The motion was seconded by Commr. Deems and unanimously carried.

A general discussion was held regarding unrecorded subdivision plats.  It was the decision of the Board that special rules should be established for old unrecorded plats.

planning & zoning

Mr. Frank Lawton, Assistant Planning Director, presented report of the Resource Survival Committee which outlines areas in Lake County that the Committee feels should be preserved as close as possible to their natural state.  On motion of Commr. VanAuken, seconded by Commr. Hoskinson and unanimously carried, the Board accepted and approved the report and authorized the expenditure for printing of said report to be distributed to Nature Conservancy members when they hold their convention in Lake County on August 11-13, 1972.

On motion of Commr. Hoskinson, seconded by Commr. VanAuken and unanimously carried, the Board adopted Resolution and Letter of Commendation to Mr. Lawton and members of the Resource Survival Committee for the scope of their report and work the Committee has accomplished.

On motion of Commr. Hoskinson, seconded by Commr. VanAuken and unanimously carried, the Board adopted Resolution declaring the week of August 7, 1972, as Nature Conservancy Week in Lake County, and authorized the staff to cooperate and help with the convention to be held on August 11-13, 1972.

The meeting recessed for lunch at 12:00 o’clock noon and reconvened at 1:30 o’clock P.M. to take up the remaining items of business.

Frank Lawton, Assistant Planning Director, appeared before the Board and recommended that the Board consider adoption of a countywide policy in regards to highway access controls along Lake County’s aerial highways and presented letter from the Department of Transportation with recommendations concerning such controls.

James C. Watkins, Planning Director, presented commercial zoning study along Highway #441 – Silver Lake Area.

It now being the time advertised to consider applications for changes to zoning classifications and on recommendation of the Planning and Zoning Commission, and on motion of Commr. Deems, seconded by Commr. LEGAL DESCRIPTION:  Sec. 15 & 22, Twp. 19S, Rge. 25E.  That part of Lot 4, Blk. 52, lying Southerly of Lot 1 and Lot 18, Country Club Gateway, LESS that part lying within 50 feet Northerly of survey line of S. R. 5000, including East side of Country Club Gateway Lots 1, 2, 3, 4, 5, 14 and 15.  As recorded in Plat Book 14, Page 71, Public Records of Lake County, Florida.

CHANGE IN ZONING CLASSIFICATION:  The Zoning Classification is hereby changed from C-1 (Rural or Tourist Commercial District) and RP (Residential Professional District) to C-2 (Community Commercial District).

 

Included in the foregoing motion was approval of Conditional Use Permits 376-1 and 277-3A; denial without prejudice of cases 127-72-5 and 111-72-5 with approval for site plan approval under A; denial of cases 33-72-1, 61-72-1, 104-72-1 and 116-72-4.

Zoning Cases 60-72-3 and 125-72-3 were withdrawn by applicant.

On motion of Commr. Hoskinson, seconded by Commr. Deems and unanimously carried, the Board postponed zoning cases 72-72-4 and 74-72-4 and Conditional Use Permit 377-3 until hearing on August 15, 1972, at 2:00 o’clock P.M.

On motion of Commr. Hoskinson, seconded by Commr. VanAuken, and unanimously carried, zoning cases 75-72-4 and 73-72-4 were postponed until September 19, 1972, at 2:00 o’clock P.M.

Zoning Case 103-72-4 was called for hearing and the Chairman called for interested parties to be heard.

C. E. Duncan, Attorney for Mr. Joranson, adjacent property owner, appeared and objected to the rezoning request stating that the proposed mobile home subdivision would be too close to the poultry farm operated on Mr. Joranson’s property and requested the Board consider establishing a 500 ft. buffer zone.  Tage Joranson appeared and stated that the subdivision would be a detriment to the operation of the poultry farm.  J. C. Watkins, Planning Director, reported that they contacted Mr. Kalmonson by phone and he objected to the 500 ft. set back suggested and requested that the Board take action on his application.  On motion of Commr. VanAuken, seconded by Commr. Hoskinson and unanimously carried, the request for rezoning was denied and decision of the Zoning Commission was overturned.

Zoning Case 27-72-1 was called for hearing and the Chairman called for interested parties to be heard.

Robert Toller, H. L. Pringle, and Mrs. Frank Manley, residents in Silver Lake area, appeared and opposed the rezoning request.

L. E. Taylor, Attorney for the applicant, Mr. Bob Birdsong, appeared in support of the rezoning for extension of automotive sales and service operation.

On motion of Commr. Hoskinson, seconded by Commr. VanAuken and unanimously carried, the Board upheld the decision of the Planning and Zoning Commission and approved the rezoning request.

Zoning Case 126-72-5 was called for hearing and the Chairman called for interested parties to be heard.

E. W. Martin of Coastal Engineering appeared and explained the plans for development of the area.  Richard Tracy, representing Lake County Conservation Council, appeared asking for the preservation of wildlife in the area.  Mr. Martin said his organization will make every effort to cooperate with the Conservation Council.

On motion of Commr. VanAuken, seconded by Commr. Deems, and unanimously carried, the Board upheld the decision of the Planning and Zoning Commission and approved the request for rezoning.

Zoning Case 117-72-1 (R-1-7 to R-1-5) was called for hearing and the Chairman called for interested parties to be heard.

James V. Coursey, applicant, appeared in support of the rezoning request.

George Myers appeared in opposition to the request.

On motion of Commr. Deems, seconded by Commr. VanAuken and unanimously carried, the Board approved the rezoning to R-1-5 and overturned the decision of the Planning and Zoning Commission.

Conditional Use Permit 375-3 (For rest home in A) was called for hearing and the Chairman called for interested parties to be heard.

Don Geddes, Attorney representing Independent Order of the Foresters, appeared and requested that the applicant be required to comply with Article 9 of the Zoning Ordinances requiring construction of roadway to County standards as was required in the CUP granted to the Independent Order of Foresters.  On motion of Commr. VanAuken, seconded by Commr. Deems and unanimously carried, the Board postponed the hearing until September 19, 1972, a 2:00 o’clock.

Zoning Case 113-72-1 (RR to R-1-5) was called for hearing and the Chairman called for interested parties to be heard.

Norman Cummins, Attorney representing the applicant, Mr. William Ernst, appeared in support of the rezoning request.

L. E. Taylor, Attorney representing adjoining property owner, appeared and stated that this request  has been turned down previously by the Planning Commission and objected to the rezoning to allow mobile homes in this area and requested that the Board uphold the recommendation of the Planning and Zoning Commission for denial.

Otto Kirby appeared in opposition to the request for rezoning.

On motion of Commr. Deems, seconded by Commr. VanAuken and unanimously carried, the Board upheld the recommendation of the Planning and Zoning Commission and denied the request.

Zoning Case 123-72-4 was called for hearing and the Chairman called for interested parties to be heard.

Frank McMillan, Attorney representing prospective purchaser of the property to be rezoned, appeared and informed the Board that the improvements on the property have for years been used as a concrete products manufacturing plant, although not in operation when owner re-acquired the title to the property through foreclosure proceedings.  He stated that the owner of the property now desires to have a permit to continue operation of the plant and will withdraw the application for rezoning to M-1 if said property is deemed to be a pre-existing nonconforming use and the owner be entitled to all licenses necessary to carry on such business provided the application for licenses is made within six months.

A. V. Lent, Becky Calkins and F. E. Owens, adjoining property owners, appeared and objected  to the operation of the plant in this residential zone.

Frank McMillan, Attorney, withdrew the request for M-1 rezoning and requested from the Board a declaration of nonconforming use.

Mr. Ford, County Attorney, stated that the applicant should take this up with the Board of Zoning Appeals.

On motion of Commr. VanAuken, seconded by Commr. Hoskinson and unanimously carried, the Board denied the rezoning without prejudice.

On recommendation of the County Attorney, and on motion of Commr. Hoskinson, seconded by Commr. VanAuken and unanimously carried, the Board instructed the Planning & Zoning Department to recognize the lots owned by Willard and Klaber in Villa Shores Subdivision as lots of record in view of court order recognizing those lots and making petition distribution by those lots.

Zoning Violation Case #71-68 was called for public hearing.  Mr. & Mrs. Ernest Foster, alleged violators, were not present.  On motion of Commr. Deems, seconded by Commr. VanAuken and unanimously carried, declared a public nuisance and in violation of County Ordinance 1971-6 and given 30 days to clean up the area.

Zoning Violation Case #72-24 was called for hearing by the Chairman.  S. R. Lingo, alleged violator, was not present.  On motion of Commr. Deems, seconded by Commr. VanAuken, declared a public nuisance and in violation of County Ordinances 1970-1 and 1971-6 and given 30 days to clean up the area.

On motion of Commr. VanAuken, seconded by Commr. Deems and unanimously carried, the Board approved the action of the Chairman and the Clerk in granting petition to the W. T. Edwards Tuberculosis Hospital for Irene Evelyn Page on July 12, 1972.

public health

The Clerk presented request for commercial garbage franchise received from John Vegter, Jr.  The Engineer advised the Board that the application form is obsolete and he forwarded a new franchise application and copy of the garbage disposal ordinance to Mr. Vegter.

Mr. Owens, Clerk, presented letter from the District School Board appointing Mr. Paul W. Bryan and Mrs. K. Barbara Wyckoff to serve on the Tax Adjustment Board.

Letter from the County Engineer regarding repairs to the hot water tank at the County Jail was read and filed.

Notice from the Corps of Engineers that Moss Bluff Locks will be closed to navigation from August 7 – September 11, 1972, was read and filed.

On motion of Commr. VanAuken, seconded by Commr. Deems and unanimously carried, the Board approved travel expenses for Fred Harpster, County Engineer, to attend meeting of Division of Florida Land Sales Advisory Council in Tampa, August 4, 1972.

On motion of Commr. Deems, seconded by Commr. Hoskinson and unanimously carried, the Board approved employment of Berry L. and Bernatha J. Taylor as Asst. Matron and Superintendent at Juvenile Shelter at annual salary of $7,100.00, effective June 26, 1972.

On motion of Commr. Deems, seconded by Commr. Hoskinson and unanimously carried, the Board approved purchase of two U.L.V. Conversion Units for Mosquito Control at $1,075.00 each from State I funds.

On motion of Commr. VanAuken, seconded by Commr. Deems and unanimously carried, the Board approved travel expense for Mr. Hoskinson to attend SACC Directors’ Meeting in Crystal River, July 29, 1972.
