MINUTES OF REGULAR MEETING OF BOARD OF COUNTY COMMISSIONERS

 AUGUST 15, 1972

The Board of County Commissioners of Lake County, Florida, convened in regular session on Tuesday, August 15, 1972, in the Commissioners’ Room, Courthouse, Tavares, Florida, at 9:00 o’clock a.m. with the following members present:  Thomas J. Windram, Chairman; James R. Carson, Jr.; J. M. Hoskinson; and Kenneth VanAuken.  Others present were: Christopher C. Ford, County Attorney; Frank E. Owens, Clerk of Circuit Court; and Norma H. Coven, Deputy Clerk.

The Chairman called the meeting to order and the invocation was given by Commr. Carson.  The Pledge of Allegiance to the Flag was recited.

public health

On motion of Commr. VanAuken, seconded by Commr. Carson and unanimously carried, the Board authorized Commr. Deems to advertise in any publication he deems necessary to fill the position of Lake County Health Director.

roads – state

The Chairman presented Notice of Beginning and Completion of Construction received from the State Department of Transportation re roads S-466A, S-44-A and S-470.

The Chairman presented letter from Department of Transportation which stated that they have received the Board’s request for a corridor location hearing for SR 46, from SR 500 to the Wekiva River.

The Chairman presented request from the District School Board requesting assistance of the Board in providing a topping of oil and gravel on the new street cut between Illinois Street and Highway 50 in Groveland which would provide an additional access to Groveland High School.  The Chairman instructed the Clerk to send a letter to the District School Board stating that the Board will contact the City of Groveland regarding joint operation in construction of this road and inform them that the Board would appreciate additional consideration from the School Board in considering the Board’s previous request to waive tuition fees at the Vocational-Technical Center for LPN and Nurses Aid Courses for employees or individuals who will agree to an employment contract to work at the Lake Memorial Nursing Home.

COUNTY BUILDINGS

Mrs. Verna Eastwood, County Welfare Director, appeared before the Board regarding space allocation in Welfare Building for Mental Health Center.  The Chairman instructed the Clerk to write Mr. Ubieta informing him that the Board needs the large reception room, the office occupied by Mrs. Eastwood and the office occupied by the receptionist; leaving two rooms for the Mental Health Unit, plus one restroom.

The Board instructed the Clerk to contact various consultant engineers informing them that the Lake County Board of County Commissioners is desirous of retaining a consultant to prepare a concept for Lake County administrative and judicial space requirements and that interviews will be held on Tuesday, September 19, 1972, regarding same.

The Chairman presented letter from the Tavares City Administrator asking the Board to assist in coordination of revised traffic flow patterns in the Courthouse area.  The letter was referred to the County Engineer.

On motion of Commr. Hoskinson, seconded by Commr. VanAuken and unanimously carried, the Board adopted a Resolution to remove the “no thru trucks” signs and establish 15 ton load limit on County Road 3-3168 and to erect appropriate signs.

James C. Watkins advised the Board that William E. Washburn, Jr. turned down the offer for employment as County Planning Director but he stated he has other applicants for the Board to interview for the position.

bids

On motion of Commr. Hoskinson, seconded by Commr. Deems and unanimously carried, the Board authorized the Clerk to advertise bids for three dump trucks and one rubber tired frontend loader for the Road and Bridge Department; bids to be opened on September 19, 1972, at 1:30 P.M.

county property

On motion of Commr. Deems, seconded by Commr. Carson and unanimously carried, the addressograph machine in the Tax Assessor’s Office was declared surplus and the Engineer was instructed to contact adjoining counties to determine if they may have a need for the machine before disposing of same.

outdoor recreational facilities

On motion of Commr. VanAuken, seconded by Commr. Carson and unanimously carried, the Board authorized the Engineer to notify Mr. James H. Powell that the County has no objection to the building of a dock in front of his marina, next to the public boat ramp, on the St. Johns River.

roads – county

The Engineer informed the Board of request from Mr. Lester Kalmanson who is proposing development of Sorrento Shores Subdivision located east of Lake Norris.  He stated that Mr. Kalmanson has offered to provide aid in the construction of County Road 5-7688, in amount of $50.00 per lot, to be paid at the time of lot sale, provided the County proceeds with the construction within a reasonable time.  The Board instructed the Engineer to inform Mr. Kalmanson that the County will require him to supply 2/3 of the cost for construction and surfacing County Road 5-7688 and the County will participate in the other 1/3; stipulating that it will be his responsibility to contact the owners adjacent to 5-7688 for donation of rights of way.

The Chairman adjourned the meeting for lunch at 11:45 o’clock A.M.  The meeting convened at 1:30 o’clock P.M. to take up the remaining items of business.

contracts and AGREEMENTS

On motion of Commr. Deems, seconded by Commr. Carson and unanimously carried, the Board approved contract agreement between Lake County and Macasphalt Corporation for rental of additional five acres and authorized the chairman and he Clerk to sign the Agreement.

Commr. VanAuken informed the Board that Mr. Reynolds, Veterans Service Officer, may have to resign because of his health.

contract & agreements

The Chairman said that he was contacted by Willard Ayers, County Attorney for Marion County, who indicated that Marion County is interested in coming into the Oklawaha Basin Improvement Council if some changes in the structure of the agreement are made.  Chairman Windram stated that he suggested to Mr. Ayers that he put Marion County’s objections in writing and send a copy to him and the County Attorney.

Tom Horton, representing Bassville Park residents, appeared regarding future planning for Bassville Park area.  Mr. Horton presented petition with 140 names opposing any future rezoning downgrade in the Bassville area and requesting that the zoning for this area remain R-1-7.  The Chairman said the information received will be considered by the Board when considering any future deliberations in this area.

The Chairman requested the Clerk to write the Governor requesting he appoint a member to the Zoning Board of Appeals to replace Mr. Payne who has resigned.

It now being the time advertised to consider applications for changes to zoning classifications and on recommendation of the Planning and Zoning Commission, and on motion of Commr. Carson, seconded by Commr. Deems and unanimously carried, a Resolution was adopted altering and amending the zoning rules and regulations as they pertain to the following described tracts of land to the classifications designed after each description:

On motion of Commr. Hoskinson, seconded by Commr. Deems and unanimously carried, Conditional Use Permit 377-3 was postponed until 2:00 o’clock P.M. October 17, 1972.

On motion of Commr. Hoskinson, seconded by Commr. VanAuken and unanimously carried, zoning case 72-72-4 was postponed until 2:00 o’clock P.M. September 19, 1972.

Zoning Case 145-72-2 (R-3 to RP) was called for hearing and the Chairman called for interested parties to be heard.  Commr. Hoskinson abstained from voting or discussing this case.  On motion of Commr. Carson, seconded by Commr. Deems and carried, the Board upheld the recommendation of the Planning and Zoning Commission and approved the rezoning request.

Zoning Case No. 144-72-3 (R-1-7 to C-1 & RP) was called for hearing and the Chairman called for interested parties to be heard.  A. Roberts, Attorney, appeared before the Board representing one of the property owners.  Richard Langley, representing a property owner, appeared in interest of the rezoning request.  On motion of Commr. Carson, seconded by Commr. Hoskinson and unanimously carried, the Board approved the rezoning and overturned the recommendation of the Planning and Zoning Commission.

Zoning Case No. 136-72-2 (R-3 to C-1) was called for hearing and the Chairman called for interested parties to be heard.  No-one objected to the rezoning and on motion of Commr. Hoskinson, seconded by Commr. VanAuken and unanimously carried, the Board upheld the recommendation of the Planning and Zoning Commission and approved the request for rezoning.

Zoning Case No. 130-72-4 (RP to RR) was called for hearing and the Chairman called for interested parties to be heard.  Willis Haynes II appeared in opposition to the rezoning.  On motion of Commr. Deems, seconded by Commr. VanAuken and unanimously carried, the Board upheld the recommendation of the Planning and Zoning Commission and approved the rezoning request.

Zoning Case No. 140-72-1 (R-1-7 to R-1-5) was called for hearing and the Chairman called for interested parties to be heard.  James Mabry, builder, appeared representing Mr. Lucas, the applicant, in support of the rezoning request.  He stated that Mr. Lucas wishes to build a home smaller than the minimum square footage set forth under R-1-7 zoning, but which would be allowed under R-1-5.  Dennis Church, adjoining property owner, appeared and objected to any rezoning which would downgrade this area.  Commr. Hoskinson moved that the action of the Planning and Zoning Commission be upheld and the request be denied.  The motion was seconded by Commr. Carson and unanimously carried.

Zoning Case No. 74-72-4 (RR to C-1) was called for hearing and the Chairman called for interested parties to be heard.  Royal R. Taylor appeared in support of the rezoning request.  Alfred W. Bond, adjoining property owner, appeared in opposition to the request.  Bob Pearson of the Mt. Dora City Council appeared and read letter from the Mayor of Mount Dora opposing rezoning of land bordering US 441 east of the Eustis Shopping Plaza to the Orange County Line.  Commr. Hoskinson stated that this rezoning would only deepen the commercial zoning already present along the highway in this area.  Commr. Carson moved that the rezoning request be approved and the recommendation of the Planning and Zoning Commission be upheld.  The motion was seconded by Commr. Deems.  Commr. Windram and Commr. VanAuken opposed the motion.  The Chairman declared the motion carried.

Zoning Case No. 134-72-4 (RR to R-3) was called for public hearing and the Chairman called for interested parties to be heard.  Glenn Wallace appeared and opposed the rezoning and presented a petition with 70 signatures from residents in the area.  Gus Anderson appeared in opposition to the rezoning.  The Clerk presented three letters in opposition which his office received.  Elmo Hauffman, Attorney representing the applicants, appeared in support of the rezoning request.  On motion of Commr. VanAuken, seconded by Commr. Deems and unanimously carried, the Board overturned the recommendation of the Planning and Zoning Commission and denied the request.

Zoning Case No. 133-72-4 (A to RR) was called for public hearing and the Chairman called for interested parties to be heard.  Commr. VanAuken asked for more explanation regarding this rezoning request.  Receiving no objections from the public, Commr. Hoskinson moved that the recommendation of the Planning and Zoning Commission be upheld and the request for rezoning was approved.  The motion was seconded by Commr. Carson and unanimously carried.

Conditional Use Permit 378-4 was called for hearing and the Chairman called for interested parties to be heard.  No-one appearing to object to the permit, Commr. Deems moved that the recommendation of the Planning and Zoning Commission be upheld and the Conditional Use Permit was approved.  The motion was seconded by Commr. VanAuken and unanimously carried.

Zoning Case No. 129-72-4 & 5 (RR to R-3) was called for public hearing and the Chairman called for interested parties to be heard.  Donald F. Hunt, applicant, appeared in interest of the rezoning request.

Dewey Burnsed, Attorney, appeared representing property owners opposed to the rezoning.  On motion of Commr. Deems, seconded by Commr. Hoskinson and unanimously carried, the recommendation of the Planning and Zoning Commission was upheld and the request for rezoning was denied.

On motion of Commr. Hoskinson, seconded by Commr. Deems and unanimously carried, Conditional Use Permit 368-4 was postponed until September 19, 1972, at 2:00 o’clock P.M.

Commr. Hoskinson moved that the Board adopt Resolution declaring a moratorium on issuing any building permits within 200 feet of the Wekiva River and instruct the Attorney to prepare the necessary Ordinance drawing setback requirements to be included in the zoning regulations.  The motion was seconded by Commr. VanAuken.  The Attorney recommended that the Engineer and Planning Director present the Board reasons why the 200’ setback should be imposed from a public health standpoint at the time the Ordinance is discussed and include this in the minutes of that meeting.  After discussion regarding the advisability of a moratorium, Commr. VanAuken withdrew his second to the motion.  The Chairman then declared the motion died for lack of a second.  The Chairman referred the matter to the Pollution Control Officer, Planning Director, and Attorney to review and make recommendations to the Board.

Ordinances

It now being the time advertised to consider an Ordinance relating to amendments to Lake County Ordinance 1971-6, Commr. Hoskinson moved that the Ordinance be placed on first reading by title only.  The motion was seconded by Commr. VanAuken and unanimously carried.  The title being as follows:

AN ORDINANCE AMENDING 1971-6 BY AMENDING SECTION 70.31, PERTAINING TO THE SITE PLAN APPROVAL PROCESS BY STRIKING ANY REFERENCE OF SITE PLAN APPROVAL BEING APPROVED BY THE DIRECTOR OF PLANNING AND PROVIDING FOR APPROVAL BY THE SUBDIVISION ADVISORY COMMITTEE; AND AMENDING ARTICLE VII, SUBSECTION 70.31 AND SECTION 70.311 PERTAINING TO SITE PLAN APPROVAL FEE BY REQUIRING A MINIMUM FEE DEPOSIT IN THE AMOUNT OF $25.00 WITH ADDITIONAL FEES DEPENDING ON ACTUAL COST, AND OTHER MISCELLANEOUS PROVISIONS PERTAINING TO FEES; AND AMENDING SECTION 68 PROVIDING FOR INCLUSION OF SITE PLAN APPROVAL FOR “C-1” RURAL OR TOURIST COMMERCIAL DISTRICT BY THE SUBDIVISION ADVISORY COMMITTEE; AND PROVIDING AN EFFECTIVE DATE.

 

On motion of Commr. VanAuken, seconded by Commr. Deems and unanimously carried, the Board approved the Ordinance on first reading, by title only, as amended.

Zoning Violation Case 71-63MQ (S.K. Davis) was called for hearing.  On motion of Commr. Carson, seconded by Commr. Hoskinson and unanimously carried, declared public nuisance and violator given 30 days to clean up the area.

Zoning Violation Case 71-167 (Walter Lesky II) was called for hearing.  On motion of Commr. Deems, seconded by Commr. VanAuken and unanimously carried, declared public nuisance and violator given 30 days to clean up the area.

Zoning Violation Case 72-25 (Vernon L. I. Day) was called for hearing.  On motion of Commr. VanAuken, seconded by Commr. Deems and unanimously carried.

Zoning Violation Case 72-26 (Annie and/or Emory Pierce) was called for hearing.  On motion of Commr. Hoskinson, seconded by Commr. Carson and unanimously carried, declared public nuisance and violator given 30 days to clean up the area.

The Engineer informed the Board that A. G. Lowrie wishes to construct a hyacinth control fence and gate across the canal in St. Johns Waterfront Estates and requests that the Board notify the Corps of Engineers that Lake County has no objections to the construction.  On motion of Commr. VanAuken, seconded by Commr. Deems, and unanimously carried the Board instructed the Engineer to notify the Corps of Engineers that the Board has no objection if the gate is left unlocked and maintained by Mr. Lowrie.

The County Engineer and Board members discussed the feasibility of requiring the platting of five acre tracts.  The Chairman asked the Engineer and Planner to draw up recommendations regarding same for the Board’s approval.

The Attorney presented the Commissioners copies of the Final Judgment in the Robert L. Chapman, Jr., tax suit, and informed the Board that Judge Mills denied the rehearing.

The Attorney advised the Board that Robert L. Chapman, Jr., is planning to bring two suits against the County this year.  On motion of Commr. Carson, seconded by Commr. Hoskinson and unanimously carried, the Board authorized the Attorney to accept service of process.

On motion of Commr. Carson, seconded by Commr. Hoskinson and unanimously carried, the Board approved supplemental agreement with Florida Department of Commerce, relating to an Emergency Employment Program, which extends the term of the original agreement from September 6, 1972 to September 15, 1972 and authorized the Chairman to sign same.

On motion of Commr. Carson, seconded by Commr. VanAuken and unanimously carried, the Board authorized the purchase of one Gravely Bahia Mower, at approximate cost of $850.00 for the Road & Bridge Department.

On motion of Commr. Deems, seconded by Commr. Carson and unanimously carried, the Board approved payment of $75.00 traffic citation for Hubert McMurphy, Road and Bridge employee who was cited by the Patrol for allowing sand to blow off dump truck.

On motion of Commr. Hoskinson, seconded by Commr. Deems and unanimously carried, the Board authorized the Clerk to rent computer typewriter at rate of $181.45 per month.  If, within 2 years, the Board should decide to purchase the typewriter, 50% of the rental paid will be credited to the price of the machine.

On motion of Commr. Deems, seconded by Commr. VanAuken and unanimously carried, the Board approved purchase of 1,000 criminal case binder for the Clerk’s Office from Florida Forms & Systems, at cost of $267.10.
