A SPECIAL MEETING OF BOARD OF COUNTY COMMISSIONERS

january 3, 1973

The Board of County Commissioners of Lake County, Florida, convened in special session in the Clerk’s Office at the Courthouse, Tavares, Florida at 2:30 p.m. on January 3, 1973 to determine whether a Conditional Use Permit is required for an oil company to drill an exploratory well in Lake County.

The Chairman called the meeting to order with the following members present:  C. A. Deems, Chairman; James R. Carson, Jr., J. M. Hoskinson and Glenn C. Burhans.  Thomas J. Windram has a previous appointment and was not present.  Others present were:  Christopher Ford, County Attorney; Frank Lawton, Planning Department; James C. Watkins, Clerk of Circuit Court; and Bethany A. Ragland, Deputy Clerk.

Commr. Hoskinson informed the Board that an oil company which has a permit from the Florida Department of Natural Resources plans to drill an exploratory well in Lake County.  The Planning Department, Building Division, issued the company an electrical permit for temporary service of a water pump only.  The Code Enforcement Officer tagged the property stating that under para 60.16 para 1. (Agriculture District) of the Lake County Zoning Ordinance, a Conditional Use Permit is required if the company intends to drill for oil.

It was the opinion of the Board that a Conditional Use Permit is not required to drill an exploratory well when natural resources are not being extracted and no permanent structures are erected on the property.

The County Attorney stated that at a future meeting the Board should consider adopting an ordinance or amend the present ordinance to cover the drilling of exploratory wells.

On recommendation of the Attorney and on motion of Commr. Hoskinson, seconded by Commr. Carson, and unanimously carried, the Board instructed the Planning Department to remove the “red tag” and grant temporary electrical services as needed and instruct the parties involved that prior to construction of any permanent structure on the site, the company must obtain a Conditional Use Permit.

There being no further business to bring before the Board, the meeting adjourned at 3:00 p.m.
