A REGULAR MEETING OF THE PROPERTY APPRAISAL ADJUSTMENT BOARD

AUGUST 7, 1978

The Property Appraisal Adjustment Board met in Regular Session on August 7, 1978 at 9:00 a.m. in the Commissioners’ Room, County Courthouse, Tavares, Florida.  Members present:  Commr. James R. Carson, Jr., Chairman; Commr. C.A. “Lex” Deems; Commr. Glenn C. Burhans; and School Board Members Donald Longworth and Joan Brown.  Others present were:  Ed Havill, Property Appraiser; Gaylord Wood, Attorney for Property Appraiser; Dan Roebuck, Representative from the County Attorney’s Office; and Shirley Wilson, Deputy Clerk.

Petition 1978-1 – Mrs. JEANNE f. harrison

No one appeared before the Board regarding this Petition.

ACTION:  On a motion by Commr. Burhans, seconded by Mrs. Joan Brown and carried unanimously, the Board upheld the recommendation of the Property Appraiser.

Petition 1978-3 – mr. alfred p. bosenquet

Mr. Jerry Lockett, Attorney, was present to represent Mr. Bosenquet regarding his Petition.

ACTION:  On a motion by Commr. Deems, seconded by Mrs. Joan Brown and carried unanimously, the Board requested Mr. Lockett to have Mr. Roger Hartsock inspect this piece of property and report back to the Board on Wednesday, August 9, 1978 and tell the Board whether this is a bonafide timber operation.  At that time, the Board will make its decision on the results.

petition 1978-5 – mr. ben w. christley, jr.

Mr. Christley was present to state his case regarding this Petition.

ACTION:  On a motion by Commr. Burhans, seconded by Mrs. Brown, the Board granted Mr. Christley an Agriculture exemption on his property.

petition 1978-6 – mr. edward g. watkins

No one was present regarding this petition.

ACTION:  No action was necessary.  Mr. Havill stated he had reached an agreement with Mr. Watkins and he was satisfied with the reassessed value of his property.

petition 1978-7 – maude humphrey

Mr. Humphrey appeared before the Board regarding this Petition.

ACTION:  Mr. Humphrey was advised that he had not filed by March 1, 1978; therefore the Board could not consider his Petition.  On a motion by Commr. Burhans, seconded by Mrs. Brown, the Board upheld the recommendation of the Property Appraiser.

petition 1978-8 – maude humphrey

Mr. Humphrey was present for the hearing of this Petition.

ACTION:  On a motion by Commr. Burhans, seconded by Mrs. Brown and carried unanimously, the Board upheld the recommendation of the Property Appraiser based on the untimely filing of the Petition.

Petition 1978-9 – mr. w. r. hancock, sr.

Mr. W. R. Hancock, Jr. was present to represent Mr. Hancock, Sr. regarding this Petition.

ACTION:  On a motion by Mrs. Brown, seconded by Commr. Burhans and passed, the Board upheld the recommendation of the Property Appraiser based on the Agriculture Application not being timely filed.

petition 1978-45 – mr. w. r. hancock, jr.

Mr. W. R. Hancock, Jr. was present regarding his Petition.

ACTION:  On a motion by Mrs. Brown, seconded by Commr. Burhans and carried unanimously, the Board upheld the recommendation of the Property Appraiser based on the Agriculture Application not being timely filed.

petition 1978-10 – mr. james l. meadows

No one appeared regarding this Petition.

ACTION:  On a motion by Commr. Burhans, seconded by Mr. Longworth and carried unanimously, the Board upheld the actions of the Property Appraiser, in that he had lowered the assessment from $287,680.00 to $226,490.00.  Mr. Meadows had withdrawn verbally based on this change.

petition 1978-11 – mr. larry r. ringle

Mr. Ringle was present for the hearing of his Petition.

ACTION:  On a motion by Commr. Deems, seconded by Mr. Longworth and carried unanimously, the Board upheld the Property Appraiser’s assessment of $81,540.00.

petition 1978-12 – mr. gerald fineis

Mr. Fineis was present for the hearing on his Petition.

ACTION:  On a motion by Commr. Commr. Burhans, seconded by Mr. Longworth and carried unanimously, this Petition was postponed until August 9, 1978, in order that the Property Appraiser may go out for an additional review of the property.

petition 1978-13 – mr. w. f. lasater

Mr. Lasater was present for the hearing of his Petition.

ACTION:  On a motion by Commr. Deems, seconded by Mrs. Brown and carried unanimously, the recommendation of the Property Appraiser was upheld.  Commr. Burhans voted no.

petition 1978-14 – mr. w. f. lasater

Mr. Lasater appeared before the Board regarding this Petition.

ACTION:  On a motion by Mr. Longworth, seconded by Commr. Burhans and carried, the recommendation of the Property Appraiser was upheld.

petition 1978-15 – mr. c. j. lee

No one appeared before the Board regarding this Petition.

ACTION:  No action was taken due to a settlement between the Petitioner and Mr. Lee.

petition 1978-16 – mr. mcleod bleakley

Mr. Bleakley appeared before the Board regarding this Petition.

ACTION:  On a motion by Commr. Burhans, seconded by Mr. Longworth and carried unanimously, the recommendation of the Property Appraiser was overruled due to the Board lowering the assessed value from $15,000.00 to $12,500.00.

petition 1978-17 through 1978-22 – art hastings/southern fruit

No one appeared before the Board on these Petitions due to a settlement between the Property Appraiser and Petitioner prior to the Meeting.

petition 1978-23 – mr. john sargent

Mr. Sargent was present before the Board regarding this Petition.

ACTION:  On a motion by Commr. Burhans, seconded by Mrs. Brown and carried, the Board postponed the Hearing of this Petition until August 9, 1978 in order that the assessment could be reviewed by the Property Appraiser.

petition 1978-28 – mr. leonard h. baird, jr./city of clermont

Mr. Baird appeared before the Board regarding this Petition.

ACTION:  On a motion by Commr. Burhans, seconded by Mrs. Brown and carried, the Property Appraiser was overruled and the tax exemption granted.  Mr. Longworth and Commr Deems voted no.

petition 1978-29 – mr. john f. miller

Mr. Miller appeared before the Board regarding this Petition.

ACTION:  On a motion by Mrs. Brown, seconded by Mr. Longworth and carried, the Board upheld the decision of the Property Appraiser due to the fact he had reviewed the property after the Petitioner had filed and there had been no change.

petition 1978-30 – mr. arthur f. gilbert

Mr. Gilbert appeared before the Board regarding this Petition.

ACTION:  On a motion by Mr. Longworth, seconded by Commr. Deems and carried, the Board upheld the recommendation of the Property Appraiser.

petition 1978-32 & 33 – mr. peter h. neubauer/upson downs farms

ACTION:  On a motion by Commr. Burhans, seconded by Mrs. Brown and carried, the Board postponed the hearing until August 9, 1978.

petition 1978-31 – H. D. Dillingham/dilign, inc.

No one appeared before the Board regarding this Petition.

ACTION:  No action was taken due to a settlement between the Property Appraiser and Petitioner August 4, 1978.

petition 1978-34 – W. M. Gurley/Williams dist. Co.

Mr. P. B. Howell, Attorney, represented Mr. Gurley regarding this Petition.

ACTION:  On a motion by Commr. Deems, seconded by Commr. Burhans and carried unanimously, the Board found the Property Appraiser did assess the inventory on January 1, 1978 at its average value during the prior calendar year and used and considered the items and guidelines as required by Florida Statutes and Rules of the Department of Revenue, and therefore upheld the Property Appraiser.

petition 1978-36 – mrs. edith marie erickson

Mr. John E. Erickson represented Mrs. Erickson on this Petition.

ACTION:  On a motion by Mrs. Brown, seconded by Commr. Burhans and carried, the recommendation of the Property Appraiser was upheld based on the Agriculture classification application was untimely filed.

petition. 1978-37 – mt. dora lawn bowling assoc./roy christopher

Mr. Roy Christopher, Attorney, appeared before the Board regarding this Petition.

ACTION:  On a motion by Commr. Deems, seconded by Commr. Burhans and carried, the Board overruled the Property Appraiser, placing the possessory interest of the Mount Dora lawn Bowling on the property tax roll.  Mr. Longworth voted no.

petition 1978-38 – marvin m. smith

No one appeared before the Board regarding this Petition.

ACTION:  No action was taken due to an agreement between the Petitioner and Property Appraiser.

petition 1978-39 through 1978-44 – richard j. green/fl groves, inc.

Withdrew based on agreement with Property Appraiser.

petition 1978-47 – mr. evander byrd conoley/pelcon, inc.

No one appeared before the Board regarding this Petition.

ACTION:  No action was taken based on a memorandum from Mr. Conoley received August 7, 1978, withdrawing his Petition.

petition 1978-48 – robert l. carle/sun bank of leesburg

Mr. Chip Deems, Citrus Consultant, appeared before the Board regarding this Petition.

ACTION:  On a motion by Mrs. Brown, seconded by Mr. Longworth and carried, the Board upheld the Property Appraiser based on the new Lake County Citrus Schedule.

Commr. Carson and Commr. Deems were advised by the County Attorney to abstain from voting because of conflicting interest; therefore, Commr. Carson acted in a parliamentary position only, and Commr. Deems did not vote.

petition 1978-49 – mr. guy l. douglas/gulf realty

No one appeared before the Meeting regarding this Petition.

ACTION:  No action was taken on this Petition based on a withdrawal in person by the Petitioner prior to the Meeting.

petition 1978-50 – a. s. johnson/martin anderson trust

Mr. Johnson appeared before the Board regarding this Petition.

ACTION:  On a motion by Mr. Longworth, seconded by Mrs. Brown and carried, the Board upheld the recommendation of the Property Appraiser.  Commr. Burhans voted no.

petition 1978-53 – mr. glenn rogers

No one appeared before the Board regarding this Petition.

ACTION:  No action was taken on this Petition based on the Petitioner withdrawing before the Meeting and stating he and the Property Appraiser had come to an agreement regarding his Petition.

petition 1978-54 – dewey burnsed, attorney/b.g. ray et al.

No one appeared before the Board regarding this Petition.

ACTION:  This Petition was withdrawn prior to the Meeting based on a settlement between the Petitioner and the Property Appraiser.

petition. 1978-55 – dewey burnsed/citizens national bank

No one appeared before the Board regarding this Petition.

ACTION:  This Petition was withdrawn prior to the Meeting based on a settlement between the Petitioner and the Property Appraiser.

petition 1978-56 – dennis l. horton/edward r. vrablik

Mr. Horton, Attorney, appeared before the Board regarding this Petition.

ACTION:  On a motion by Mrs. Brown, seconded by Commr. Burhans and passed unanimously, the recommendation of the Property Appraiser was upheld based on the Property Appraiser lowering the assessment from $15,100 to $13,700.

petition 1978-57 – charles sendelback

No one appeared before the Board regarding this Petition.

ACTION:  On a motion by Commr. Burhans, seconded by Commr. Deems and carried unanimously, the recommendation of the Property Appraiser was upheld.

petition 1978-58 – mary k. blackburn

No one appeared before the Board regarding this Petition.

ACTION:  No action was taken on this Petition due to the Petitioner and Property Appraiser coming to an agreement before the scheduled time of the hearing.

petition 1978-59 – anthony v. pace, jr.

No one appeared before the Board regarding this Petition.

ACTION:  On a motion by Mrs. Brown, seconded by Commr. Deems and carried unanimously, the recommendation of the Property Appraiser was upheld.

petition 1978-60 – emmett peter, jr.

No one appeared before the Board regarding this Petition.

ACTION:  No action was taken on this Petition based on a withdrawal by the Petitioner in a letter dated August 3, 1978 stating he was now satisfied with the appraisal on his property.

petition 1978-51 – lou talley/mt. dora golf association, inc.

Mr. Lou Talley, Attorney, appeared before the Board regarding this Petition.

ACTION:  Lengthy discussion was held between Mr. Lou Talley; Mr. E. M. Talley, Jr.; Mr. Gaylord A. Wood, Attorney; and Mr. Dan Roebuck, County Attorney, regarding the possessor interest of the Mt. Dora Golf Association, inc., Appraisal of Physical Improvements, and the Land Valuation, comparing this with other local golf courses.  Mr. John Becham, President of the Association, was also present for the discussion.

On a motion by Commr. Burhans, seconded by Commr. Deems and carried, the Board overruled the Property Appraiser’s recommendation, and the Petitioner was granted the tax exemption.  Mr. Longworth voted no.

petition 1978-52 – lou talley/bay street players, inc.

Mr. Lou Talley appeared before the Board on behalf of the Bay Street Players.

ACTION:  After a brief discussion, on a motion by Commr. Deems, seconded by Mr. Longworth and passed unanimously, the Board upheld the recommendation of the property Appraiser.

petition 1978-191 – roger conners/conners of tavares

No one appeared before the Board regarding this Petition.

ACTION:  On a motion by Commr. Burhans, seconded by Mrs. Brown and passed, the Board upheld the recommendations of the Property Appraiser’s assessment of late penalty for the non-filing of tangible goods for 1978.  Commr. Deems was out for the vote.

At this time, the Board recessed to reconvene at 4:40 p.m.

petition 1978-192 – d. arthur yergey

No one appeared before the Board regarding this Petition.

ACTION:  On a motion by Commr. Burhans, seconded by Mr. Longworth and carried unanimously, the Board postponed this Petition to be heard on Wednesday, August 9, 1978 at 1:00 p.m. or as soon thereafter as possible.

petition 1978-194 – mrs. joan w. tepper

No one appeared before the Board regarding this Petition.

ACTION:  An affidavit was presented to the Board regarding the 39 acres belonging to Mrs. Tepper requesting an agriculture exemption.  On a motion by Commr. Burhans, seconded by Mrs. Brown and carried unanimously, the Board upheld the Property Appraiser and denied the exemption based on the renewal card not being received.

ADJOURNMENT

There being no further business to be brought to the attention of the Board, the meeting was adjourned at 5:45 p.m.
