A REGULAR MEETING OF THE PROPERTY APPRAISAL ADJUSTMENT BOARD
JANUARY 14, 1982
The Property Appraisal Adjustment Board met in Regular Session on Thursday, January 14, 1982, at 9:00 A.M. in the Commissioner's Meeting Room, Lake County Courthouse, Tavares, Florida. Members present were: Commr. Glenn C. Burhans, Chairman; Commr. James R. Carson, Jr.; Commr. C. A. "Lex" Deems, Mr. Donald Berry; and Mr. Jerry Smith. Others present were: Mr. Ed Havill, Property Appraiser, Mr. Harold Williams, Chief Field Appraiser; Mr. Sanford Minkoff, County Attorney's Office; and Mary Grover, Secretary.
PROPERTY APPRAISER/HOMESTEADS APPROVED
On a motion by Mr. Berry, seconded by Commr. Carson and carried unanimously, the Board approved the following Homesteads which were approved by Mr. Havill's Office prior to this meeting:

PETITION 1981-13 Jewel B. Hooks
Mrs. Jewel B. Hooks was present to discuss this Petition with the Board. Mrs. Hooks explained to the Board she was in the hospital in Fort Lauderdale for surgery. Mrs. Hooks further explained she went to Fort Lauderdale before Christmas, December, 1980, and returned to Leesburg on March 1 or 2, 1981.
On a motion by Mr. Berry, seconded by Mr. Smith and carried unanimously, the Board granted Homestead Exemption and Widow's Exemption as recommended by Mr. Minkoff, County Attorney's Office.

Mr. James Seymour was present to discuss this Petition with the Board. Mr. Seymour explained that he was forgetful due to the fact he had recently had a brain tumor removed and he also has epilepsy. He further stated his wife is also disabled.
On a motion by Commr. Deems, seconded by Mr. Berry and carried unanimously, the Board granted the Service Connected Total and Permanent Disability Exemption as recommended by Mr. Havill, Property Appraiser.

Mrs. Weltlich was present to discuss this Petition with the Board. Mrs. Weltlich presented Mr. Havill, Property Appraiser, with the two letters from doctors which was necessary to claim the Disability Exemption.
On a motion by Mr. Berry, seconded by Commr. Deems and carried unanimously, the Board granted the Disability Exemption to Mr. Weltlich as recommended by Mr. Havill, Property Appraiser.

Mr. Botner, Leesburg, was present to discuss this Petition with the Board. Mr. Botner presented Mr. Havill, Property Appraiser, with proof he is a permanent Lake County, Florida resident.
On a motion by Mr. Berry, seconded by Commr. Deems and carried unanimously, the Board granted Mr. Botner Homestead Exemption as recommended by Mr. Havill, Property Appraiser.

At this time, Commr. Deems informed the Board he had to leave for the remainder of the morning meeting and that Commr. Windram would be replacing him.

Mr. De Wilde was present to discuss this Petition with the Board. Mr. De Wilde presented Mr. Havill, Property Appraiser, with proof he is a permanent Lake County, Florida resident.

Mrs. Lee stated she felt the Corporation did not own the piece of property on which she has filed homestead. Mr. Minkoff, County Attorney's Office, stated if the Corporation was merely holding the legal title and the individuals actually owned the property, then the individuals would be eligible for Homestead. Mrs. Lee further stated the only other shareholders in the corporation were her sons and daughters.

Mr. Ed Havill, Property Appraiser, informed the Board Mr. Radel had vacated his property and had it for sale. During this time he had a residence at Eustis Villas (since July, 1981). Mr. Havill then explained he turned this case over to the State Attorney's Office. He further explained the Judge had heard the case without Mr. Havill being there to testify. and that the case had been thrown out. Mr. Radel then applied for the Homestead Exemption, at which time Mr. Havill informed Mr. Radel he would not approve the Homestead and that Mr. Radel would have to appear before the Property Appraisal Adjustment Board to hear the Petition. Mr. Havill informed the Board Mr. Radel died three weeks ago.

Mr. Havill explained to Mr. Hazy that only individuals can file for Homestead Exemption and under Florida Law a corporation is not an individual. Mr. Smith was present to discuss this Petition with the Board. Mr. Smith stated that he had put the property in his wife's name due to the fact he was trying to get his will in order, and that he had signed the homestead exemption card not thinking about it being in her name and not his.
